Reference above, this is to intimate to you that the rates of Oxygen & Nitrogen gas quoted by you in your offer dtd. 08.11.2012 (copy enclosed) were inclusive of VAT & other incidental charges. The individual basic prices of the gases and the rate of VAT were not specified in your offer. Also vide FAX received on date 28.12.2012 (copy enclosed), you had agreed to FIRM pricing of the tendered items. After opening of the price bid, any change of amount by any way or other, breaks the sanctity of the tendering procedure and is also unlawful.

Furthermore, it may please be noted that if you had quoted the basic price of the materials along with the rate of VAT explicitly in your offer, the benefit of change of percentage of VAT (if any) would have been passed on to you by DVC. However, since your rates are inclusive of all taxes & duties and on FIRM basis throughout the Contract Period, it is implicit that any change of taxes & duties (i.e. either increment or decrement) shall be borne by you and DVC can in no way be implicated or be made liable for any extra payment.
