(A) That through the instant writ petition, the petitioner
made the following prayers:-
i) Allow the above wri t petition of the petitioner.
ii) Issue an appropriate writ, direction or order directing the respondent officers of the Reserve Bank of India or such other responsible persons t o immediately take steps as permitted under Chapter V of the RBI Act.
iii) Issue an appropriate writ, direction or order directing the Reserve Bank of India t o set up a committee to fix and fasten responsibility upon those officers of the RBI who failed in detecting, diagnosing and acting in t ime to prevent this siphoning of f of crores of rupees of the company and its shareholders.
- iv) Any other appropriate order or directions
which are deemed just and proper by this Hon'ble Court may also be passed in favour of the humble petitioner and in the interest of justice.
v) Cost of the wri t petition be allowed in favour of the humble petitioner"
As per the contents of the wri t petition, it is
apparent that the petitioner prays for initiating
proceedings in terms of Chapter-V of the Reserve Bank
of India Act, 1934 (hereafter referred as "the RBI Act")
on the basis of proceedings already initiated by the
respondent Bank against First Leasing Company of
India Limited (hereinafter referred as "the Company").
