SECTION I – IKIT OVERVIEW

A. PURPOSE OF THIS IKIT?

This iKit is for a conditional permanent resident (CPR), who obtained such status through

marriage to a US Citizen (USC) or is a child dependent of a CPR, to petition to U.S.

Citizenship and Immigration Services (USCIS) to remove the conditions on his/her

residence.

B. WHO SHOULD USE THIS IKIT?

You may petition to remove the conditions on Form I-751 if you received CPR status

through marriage to your USC spouse. As long as you are still married, the petition must

be filed jointly by you, the CPR spouse, and your USC spouse through whom you

obtained CPR status.

If you have a dependent child and s/he acquired CPR status concurrently with you on the

same date or within 90 days thereafter, you may include him/her with your petition.

However, if any child is unable to file concurrently, the CPR parent is deceased, or for

other reasons, the child may nonetheless file a separate I-751 petition to remove the

conditions on permanent residence.

C. WHEN SHOULD YOU FILE?

1. FILING JOINTLY

If you are filing your petition jointly with your USC spouse, you must file within the

90 days preceding the second anniversary as a CPR. Remember to not confuse this

date with your second marriage anniversary or wedding date. Neither has any

relevance to the expiration date that is printed on your conditional permanent resident

card. However, if you and your USC spouse reside outside the US pursuant to

military or Government orders when the petition must be filed, you may file your

petition within 90 days of your return to the United States.

Locate the “Expiration” date on your conditional permanent resident card and

subtract 90 days. This date is the earliest you may file to remove the conditions on

your residence. Do not make the common mistake of subtracting 3 months instead of

90 days. Consider using an online “date calendar calculator” to eliminate any chance

of error.

Example: The “Expiration” Date that is printed on your conditional permanent

resident card is December 1, 2011. After subtracting 90 days the earliest filing date is

September 2, 2011. If you made the common mistake of subtracting 3 months, the

filing date would have been September 1, 2011. Filing too early will result in your

application being rejected and returned to you.

SECTION II – BONA FIDES OF YOUR MARRIAGE

A. TYPES OF PROOF

Although the USCIS instructions for Form I-751 states that evidence should cover the

entire period from your marriage up to the present date, it is not necessary to repeat

evidence that you already submitted prior to your first marriage interview. However, be

prepared to answer any questions prior to your marriage. Anything is fair game with

USCIS. It is additionally just as important to focus on gathering evidence of your

marriage that has developed since USCIS last interviewed you.

You should submit any applicable documents that may evidence the bona fides (“good

faith”) of your marriage. Only send copies of the bona fides with your petition.

However, the originals must be available for presentation to USCIS at the time of your

interview (if not waived). The more evidence you and your spouse have of your

marriage, the better your chances of having your interview waived or having a successful

interview.

Remember: USCIS presumes all marriages to be fraudulent. Thus, you have the

burden of proving that your marriage was valid and bona fide at its inception and

was not entered into in order to circumvent US Immigration laws.

Below is a detailed list of documents you can present to establish the bona fides of your

marriage. The following documents may be presented to evidence that your marriage

was entered into and remains in good faith, and not solely for the purpose of

circumventing the immigration laws of the United States. You should bring originals and

photocopies of the following:

1. DOCUMENTATION OF CHILDREN RESULTING FROM THE RELATIONSHIP

a. Birth certificates (issued by appropriate civil authority) of any children born to the

US Citizen and alien spouse during the marriage showing: (1) Timely registration;

(2) Date and place of birth; and (3) Parents’ names;

b. Adoption decrees of children adopted by US Citizen and/or alien spouse;

c. Documentation showing legal guardianship of stepchildren;

d. School records listing stepparent as a contact or guardian; and/or

e. Medical records listing the stepparent as a contact or guardian.

2. COMMUNICATION DOCUMENTS

a. E-mail records;

b. Love letters with envelopes;

c. Letters and cards to and from friends and relatives evidencing the

relationship;

d. Photographs of husband and wife together, with children, in-laws, etc.;
