Bob McManus, Beacon Aviation Insurance Services9–10 a.m.Understanding Workers Compensation in Aviation Compared to many of the risks that confront aviation insurance professionals, workers’ compensation is fairly unique in a number of ways. First, obligations placed on employers to compensate employees who are injured at work are rooted in common, federal and individual state laws. Second, workers’ compensation insurance is tightly regulated by both state and federal law. Finally, by its very nature, United States based aviation employers frequently have operations that extend beyond the borders of the United States. Such employers must also concern themselves with protecting their American employees abroad and workers’ compensation laws of foreign countries. This presentation will focus primarily on workers’ compensation laws and insurance in the United States.

& Johnson2–4 p.m.Insuring Unmanned Aerial Systems The potential applications for Unmanned Aerial Systems are widespread and pose unique challenges to the Aviation Insurance Industry. This emerging technology has required the aviation insurance industry to innovate in order to keep pace with new aircraft systems and liability exposures. There are dozens of realized and unrealized uses for this emerging technology which include border patrol, filming, news gathering, crop dusting, search & rescue, power line patrol and land surveying. For Unmanned Aerial Systems to gain wider usage, current regulations and the insurance industry need to adapt along with the technology. The Federal Aviation Administration (FAA) has made integration of Unmanned Aerial Systems into U.S. airspace a top priority. The changing regulatory landscape is the single most important factor that will influence how this technology is ultimately used by the civilian population and the eventual size of the industry. The FAA has estimated that by 2020 around 30,000 small unmanned aircraft will be used for all types of business purposes.

The FAA has made ‘NextGen’, and all that is encompassed by that term, a priority in order to carry out its mission of maintaining a safe and commercially effective national airspace system. The fulfillment of Next Gen requires implementation of many new technologies for operators of aircraft both manned and unmanned, for airports and for other stakeholders. We will review the potential for losses, claims and liability exposure of the different constituencies in the aviation industry as this new technology becomes more commonly employed.

Don Andersen, Taylor English Duma LLP8–9 a.m. Aviation UpdateJoin us for a review of significant aviation legal developments over the past year.

Jeff Ellis, Clyde & Co, US LLP9–10 a.m.The Case for Preemption of Aviation Product Design and Manufacture ClaimsThe nature of aviation safety and the manner in which it has been regulated makes it clear that civil aviation authorities (such as the FAA) have been vested with exclusive regulatory authority over all aspects of aviation safety, including product design and manufacture. The Supreme Court of the United States has held that this approach is the best way to preserve the delicate balance between safety and efficiency. When these fundamental principles are understood, it follows that courts or juries addressing common law or strict product liability claims should not be allowed to overrule civil aviation authority safety determinations. If that was not the case, these regulatory authorities would be divested of their exclusive regulatory authority and the balance between safety and efficiency impossible to

maintain. This issue has been the focus of recent litigation in the United States and will continue to be an important issue to consider in aviation products liability cases going forward.

Richard Morris, Fowler White Burnett10:30–11: 30 a.m.InflightLossofControlPreventioninCommercial and General AviationFAA Advisory Circular 120-111 (April 14, 2015) requires that Part 121 carriers implement upset prevention and recovery training (UPRT) by 2019, but not for Part 91 operators, even though the historical death tolls for Part 91 operations due to inflight loss of control are more than four times that of Part 121 operations. Inflight loss of control caused more than 40% of fixed wing GA fatal accidents between 2001 and 2011 and the integration of UAVs in to the airspace is one of several new challenges pilots face.
