RECREATION GROUNDS RULES

made under section 2

* 13/1954 .

1. These Rules may be cited as the Recreation Grounds Rules.

2. (I) Each recreation ground specified in the First Schedulemay, in the discretion and with the written permission of theCouncil of the appropriate County which, for the purposes of theseRules, includes Tobago specified in that Schedule, be used byschoo ls, clubs, societies, other organisations and members of thep uhlir- for pl :lyi ng cr-icket o r :m y othe r 1:l\v fI11 8:lm f':, o r for the

holding of sports meetings , cycle races, rallies, parades , agriculturalor hort icultural shows, or for any charitable or philanthropic orpublic purpose but not for political mee tings .

(2) A community, village or district council of the ward,town or village and its env irons , specified in the First Schedule inparenthesis in relation to the said ground may be nominated by theCouncil of the appropriate County specified in that Schedule forthe purpose of advising them on all matters affecting the publicintere st in the use of the gro und.

(3) The Council for the County in which any recreationgro und mentioned in the First Schedule is situated , may-

(a) charge a fee for the use of the recreation ground;

(h ) allotthe recreation ground or any part thereof onany day or part thereof for the use of any particularperson , school, club , society or other organisation;

(c) close or authorise the closure of such recreationgrounds or part thereof to the public on such days(not exceeding fifty-two days in any year norseven consecutive days on anyone occasion nortwo Sundays a month) and on such terms andconditions as the Council thinks fit, for use by

any person, school, club, society or otherorganisation for any purpose author ised bysubrule (I);

(d) charge an admission fee to any recreation groundor part thereof closed to the public; and

(e) permit any person, school, club, society ororganisation to charge an admission fee to anyrecreation ground or part thereof closed to the

public, if the proceeds or the admission fee are tobe given to some charitable or sportingorganisation approved by the Council.

(4) Applications for permission to use a recreation groundshall be made in writing to the Council for the County in whichthe recreation ground is situated.

(5) A Council desiring to close the recreation ground orpart thereof otherwise than in accordance with subrule (3)(c) shallobtain prior approval from the Minister to whom responsibilityfor local government has been assigned.

3. (I) Each recreation ground for children specified in theSecond Schedule shall be under the control of the Council of theCounty in which the recreation ground for children is situated.

(2) No person shall play cricket, football, rounders, orother games dangerous to young children, in any recreation groundspecified in the Second Schedule.

4. The Minister may by Notification vary the First or theSecond Schedule by adding thereto any other recreation ground orremoving therefrom any recreation ground included therein O!"

added thereto.

5. Any person who, within the limits of the ground or of anychildren's recreation ground-

(a) affixes any notice or advertisement to anybuilding, wall, fence, post or tree ;

(h) sits upon or damages any fence, gate or turnstile;

(c) commits any nuisance by depositing any offensivematter or rubbish;

(d) throws, deposits, or leaves any bottles or glass ,broken or otherwise, any tins or other containers ,or any earthenware or old iron;

(e) wilfully damages any seat, walk, footpath, orspecially prepared part thereof;

(f) cuts, trims, uproots, damages, or destroys any tree,shrub or plant;

(g) digs any earth , cuts any grass , or removes anyturf , manure or grass, without the permission ofthe Council for the County in which the recreationground is situated;

(h) discharges any firearm, or throws, casts, sets fireto, or lets off any fireworks, without the authorityof the Council for the Cou nty in wh ich therecreation ground is situated ;

(i) wilfully neglects or refuses to obey the lawfulorders of any person authorised by the Councilfor the County in which the recreation ground issituated or any member of the Police Service;

(j) rides any animal, or leads any animal , except adog, or drives or pushes any vehicle, except aperambulator or other hand-carriage for youngchildren or such other vehicle as may be permittedby the Counci l for the Co unty in which therecreation ground is situated;

(k) sets or lights any fire;(I) mo les ts or ob structs or annoys any person

engaged in , or who has made preparatio n toengage in, or who is a spectator at, any permittedgame, sport or pastime;

(m) creates any obstruction on any walk or drive ;(11) uses obscene language, throws any stone or other

missile, or otherwise conducts himself in a

disorderly manner to the annoyance of the publicor young children respectively;

(0) tethers or allows to trespass any animal;(p ) wilfully interferes with or obstructs the authorised

user thereof;

(q) erects or places thereon any booth, tent, shed,stand, screen, post, rail, fence, swing chair or seator other erection or obstruction of any kindwhatsoever without the authority of the Councilfor the County in which the recreation ground issituated;

(r) does, aids in, or abets any act or thing which maynot in these Rules be specifically mentioned andwhich ma y tend to the inj ury, disfig urementthereof or to interference with the use thereof bythe public or by young children respect ively forthe purposes of exercise and recreation ,

is liable on summary conviction to a fine of two hundred dollars.

6. Any person who uses the recreation ground as a short cutfor the passage of wheeled or bridle traffic is liable on summaryconviction to a fine of two hundred dollars .

7. Tobago shall for all purposes of these Rules be deemed tobe a County.
