WHAT YOU NEED TO KNOW…THE BUYING PROCESS

Your real estate sales representative helps you prepare an Offer to Purchase. This offer

should include all the details of the sale. (This is a legally binding document)

Your real estate sales representative will then present the offer to the vendor, who will accept, reject, or make a counteroffer.

You sign the offer back to the vendor with a higher price than

your original offer, but lower than the vendor’s counteroffer.

The vendor accepts the offer and the deal concludes.

Vendor

The vendor accepts this counteroffer and the deal concludes.

You reject the counter offer of a higher price and decide not to make a subsequent counteroffer.

The vendor makes a counteroffer asking for a higher price. If a counter offer is

returned to you at a higher price, ensure that you know exactly how much you

can afford before you start negotiating. You don’t want to get caught up in the

heat of the moment with costs you cannot afford.

The sale doesn’t go through and your deposit is returned.

Why should I use an agent to purchase a home?

The advantage of have The Tom Joseph Team help you purchase a home is that we can provide you with valuable insight into the market. With our expertise in negotiating, contracts and closings, we can find you the perfect home quickly.

Builders have a professional real estate representatives watching for their interests and you need and deserve the same expert representative watching out for you.

It is very important that you interests be professionally represented when you are entering into a contract. These transactions are complex and the contract details must be exact in order to protect you and ensure that you get exactly what you want.

Is there any advantage to not using an agent to purchase a home?

No. When buying from a builder, builders have a “single price” policy meaning you will be charged the same price whether your interests are represented by an agent or not. When buying resale, the Seller pays the agents fees.

• Your rights as a Buyer and our agency responsibility as your realtor.

• Explain and sign an exclusive Buyer’s agent contract.

• You will be given copies of each listing and encouraged to make notes that will help you to remember what you saw and “feel” about the property.

• The next and subsequent trips out to view properties are a more focused search, both in types of properties and area.

The Offer: We will prepare the contract of purchase and guide you through the negotiation process.

Legal Issues. You will receive disclosure of issues that affect the property. We will oversee the compilation of

documents as required by the strata property act.

You will be professionally represented on all offers and negotiations to ensure the best price and terms for you

and the enforceability of the contract.

A donation will be made to Children’s Miracle Network and Pacific Assistance Dogs Society on your behalf.

The foregoing action plan is contingent on the Buyer’s availability and disclosure of financing and budget

particulars.

CLOSING COSTS

Here is a list of the expenses typically incurred by a buyer of residential property:

1. Legal Fees: Lawyers’ fees vary. It is an issue for each buyer to raise at the time he/she engages the lawyer to close the deal.

2. Land Transfer Tax: This is a sales tax charged by the provincial government. The formula used to assess the tax is as follows:

Provincial Land Transfer Tax (Applies to all Ontario properties, including Toronto)

0.5% on the first $55,000plus 1.0% of the amount from $55,001 to $250,000

plus 1.5% of the amount in excess of $250,001 to $400,000plus 2.0% of the amount in excess of $400,000

Toronto Land Transfer Tax(Applies to Toronto properties only)

0.5% on the first $55,000plus 1.0% of the amount from $55,001 to $400,000

plus 2.0% of the amount in excess of $400,000

(Provincial land transfer tax only)

Purchase Price Calculation of LTT

0 - 55,000 .005 x Amount

55,001 - 250,000 (.01 x Amount) minus 275

250,001 - 400,000 (.015 x Amount) minus 1,525

400,000 + (.02 x Amount) minus 3,525

If the purchase price falls within this range, then apply formula to purchase price

(e.g. on a $175,000 home (.01 X 175,000) minus 275=LTT)

CLOSING COSTS CONTINUED

FIRST-TIME BUYERS of BOTH re-sale, and newly constructed homes, will be eligible for a rebate of the provincial land transfer tax of up to $2,000.Land transfer tax in Toronto area (416 telephone # area code) are double if you are not the first time buyer. 3. Survey: You may want a new survey, or your mortgage company may require one in order to advance the mortgage funds. Surveys start at about $900.00. The price goes up depending upon the size and configuration of the property.

4. Title Insurance: Most mortgage lenders are prepared to accept title insurance instead of a survey. A Title Insurance policy costs about $250.00 - $300.00 for most residential properties. The fee will vary to some extent with the value of the property.

5. Disbursements: When your lawyer closes the purchase, he/she will have to pay a variety of expenses for you. He/she will add these costs to the bill he/she sends you. Such disbursement costs include fees for registering the deed and mortgage, building and tax certificates, hydro, water, status reports, etc. On a standard residential purchase, these costs will run between $300.00 and $500.00.

6. Adjustments: The annual real estate taxes will be apportioned to the seller and the purchaser as of the date of closing. If the seller has prepaid the taxes for the year, the purchaser will be required to reimburse a pro rata portion to the seller. If the property is heated by oil, the purchaser will be required to reimburse the seller for the value of the oil remaining in the storage tank on closing. The purchaser’s lawyer arranges for these adjustments with the seller’s lawyer as part of the closing process.

7. Moving Costs: Moving costs vary depending upon the distance moved and the amount of possessions moved. It is wise to get an estimate from more than one mover. It is also wise to book your mover well in advance of closing.

8. Insurance Policies: You may wish to consider a closing insurance policy (about $40.00) and/or a home warrant policy ($200.00-$350.00). As well, you will need property insurance and occupier’s liability insurance. Contact an insurer well in advance of closing in order to ascertain the costs, and to have the policies in place at closing. (We do this process for you).
