Oil from the Nugget formation goes from the FWKO to one (1) heater treater for further separation. Water that is removed in this process is sent to the two (2) 1000 bbl produced water skimming tanks mentioned above and then to the skimming ponds to be discharged through outfall 001. The produced oil is piped to four (4) 400 bbl oil tanks, which is then loaded out by truck for sales once adequate volumes have accumulated. The production stream from the Tensleep formation follows the same treatment process as the Nugget formation with the exception of instead of four (4) 400 bbl oil tanks, there are two (2) 500 bbl oil tanks associated with the Tensleep produced oil. With this renewal application, Legacy would also like to update the qtr/qtr and latitude/longitude for outfall 001 to its as-built location. The analyses must be conducted in accordance with approved EPA test procedures (40 CFR Part 136). Include a signed

17. Will blending of fresh water with produced water be used as a treatment option?

Also, an automated shutdown system must be installed and maintained on site that terminates the discharge of produced water in the event of the shutdown of the fresh water supply.

18. 40 CFR Part 435 Subpart E requires that the permittee document agricultural and wildlife uses of produced water. Provide

documentation that the produced water will be used for agriculture or wildlife during periods of discharge. Agriculture and wildlife use includes irrigation, livestock watering, wildlife watering, and other agricultural uses. Agricultural and wildlife use documentation includes (but is not limited to) a certified letter from a landowner(s), a formal written statement from a state, federal or local resource management agency, or a formal written statement with supporting documentation from a natural resources or environmental professional accompanied by the credentials of the natural resources or environmental professional. Agriculture and wildlife use documentation must be provided for each outfall included in the application.

Agricultural and wildlife certification must be submitted for each outfall’s discharge, and must have original signatures.

Facilities permitted prior to June 10, 2002 are exempt from the above requirement. The Wyoming Game and Fish Department has determined that discharges of produced water from WYPDES-permitted oil production units in Wyoming, existing as of June 10, 2002, are being used to enhance wildlife propagation and habitat.

HUMAN HEALTH HAZARDS - ACUTE : EYE CONTACT : Corrosive. Will cause eye burns and permanent tissue damage. SPECIAL PROTECTIVE EQUIPMENT FOR FIRE FIGHTING : In case of fire, wear a full face positive-pressure self contained breathing apparatus and protective suit. 6. ACCIDENTAL RELEASE MEASURES PERSONAL PRECAUTIONS : Restrict access to area as appropriate until clean-up operations are complete. Use personal protective equipment recommended in Section 8 (Exposure Controls/Personal Protection). Stop or reduce any leaks if it is safe to do so. Keep people away from and upwind of spill/leak. ENGINEERING MEASURES : General ventilation is recommended. Use local exhaust ventilation if necessary to control airborne mist and vapor. RESPIRATORY PROTECTION : Where concentrations in air may exceed the limits given in this section or when significant mists, vapors, aerosols, or dusts are generated, an approved air purifying respirator equipped with suitable filter cartridges is recommended. Consult the respirator / cartridge manufacturer data to verify the suitability of specific devices. In event of emergency or planned entry into unknown concentrations a positive pressure, full-facepiece SCBA should be used. If respiratory protection is required, institute a complete respiratory protection program including selection, fit testing, training, maintenance and inspection. HAND PROTECTION : When handling this product, the use of chemical gauntlets is recommended. The choice of work glove depends on work conditions and what chemicals are handled.
