Dear Mr. Peterson, Legacy Reserves Operating, LP (Legacy) respectfully submits the enclosed WYPDES renewal application for its WY0027316 Bailey Dome oil facility. Enclosed for your consideration are the following:

Under the current permit, Legacy pipes produced water from up to six (6) production wells completed in the Tensleep and Nugget formations. The production streams from the two (2) producing formations are kept separate. The Nugget production stream first passes through a free-water knockout (FWKO) for initial separation. Free water is sent to two (2) 1000 bbl produced water skimming tanks. From the skimming tanks, the water is piped to two (2) fenced and netted skimming ponds that are situated in a cascading fashion that discharges water to an unnamed drainage through outfall 001. Oil from the Nugget formation goes from the FWKO to one (1) heater treater for further separation. Water that is removed in this process is sent to the two (2) 1000 bbl produced water skimming tanks mentioned above and then to the skimming ponds to be discharged through outfall 001. The produced oil is piped to four (4) 400 bbl oil tanks, which is then loaded out by truck for sales once adequate volumes have accumulated. The production stream from the Tensleep formation follows the same treatment process as the Nugget formation with the exception of instead of four (4) 400 bbl oil tanks, there are two (2) 500 bbl oil tanks associated with the Tensleep produced oil. With this renewal application, Legacy would also like to update the qtr/qtr and latitude/longitude for outfall 001 to its as-built location. 11. Describe the control measures that will be implemented to prevent significant damage to or erosion of the receiving water

channel at the point of discharge. Rip rap and or geotextile is placed at discharge point to prevent erosion.




12. Provide the results of a water analyses for a sample collected from a location representative of the quality of water being proposed for discharge for the parameters listed below, in Table 2.

The analyses must be conducted in accordance with approved EPA test procedures (40 CFR Part 136). Include a signed

copy of your lab report that includes the following: a. detection limits b. results of each of the chemical parameters at the chemical state given below c. quarter/quarter, section, township and range of the sample collection location d. Time and date of sample collection e. Time and date of analysis for each parameter f. Detection limit for each parameter as achieved by the laboratory.




*The values listed in the Standard or Limit column are associated with water quality standards (Chapter 1 of Wyoming Water Quality Rules and Regulations) or technology-based effluent limits (Chapter 2 of Wyoming Water Quality Rules and Regulations). **This parameter is only required for those discharges located within one stream mile of a class 2 water.

c. Describe how the exceedance was addressed. The oil and grease value of 21 mg/L does not reflect historical data and may be due to sampling error. Two (2) skimming ponds are also situated in a cascading fashion to help separate oil and grease and sulfide-hydrogen sulfide from discharging to waters of the state via outfall 001.

17. Will blending of fresh water with produced water be used as a treatment option?

YES NO If the answer to question # 17 is yes, answer 17a.–17.c below. If no, proceed to question 18.

What is the anticipated blending rate of fresh water and produced water? _________________________________ Be advised that permit will require water quantity and quality monitoring before and after blending occurs. Also, an automated shutdown system must be installed and maintained on site that terminates the discharge of produced water in the event of the shutdown of the fresh water supply.

b. Provide confirmation from the State Engineer’s office of fresh water use.

c. What is source of fresh water to be blended? No surface water source is allowed.

18. 40 CFR Part 435 Subpart E requires that the permittee document agricultural and wildlife uses of produced water. Provide

documentation that the produced water will be used for agriculture or wildlife during periods of discharge. Agriculture and wildlife use includes irrigation, livestock watering, wildlife watering, and other agricultural uses. Agricultural and wildlife use documentation includes (but is not limited to) a certified letter from a landowner(s), a formal written statement from a state, federal or local resource management agency, or a formal written statement with supporting documentation from a natural resources or environmental professional accompanied by the credentials of the natural resources or environmental professional. Agriculture and wildlife use documentation must be provided for each outfall included in the application.




Agricultural and wildlife certification must be submitted for each outfall’s discharge, and must have original signatures.

Facilities permitted prior to June 10, 2002 are exempt from the above requirement. The Wyoming Game and Fish Department has determined that discharges of produced water from WYPDES-permitted oil production units in Wyoming, existing as of June 10, 2002, are being used to enhance wildlife propagation and habitat.

HUMAN HEALTH HAZARDS - ACUTE : EYE CONTACT : Corrosive. Will cause eye burns and permanent tissue damage. SKIN CONTACT : May cause severe irritation or tissue damage depending on the length of exposure and the type of first aid administered. INGESTION : Not a likely route of exposure. Corrosive, causes burns to gastro-intestinal tract. Nausea, vomiting and stomach pain may occur. In severe cases blood may be vomited. INHALATION : Irritating to the eyes, nose, throat and lungs. SYMPTOMS OF EXPOSURE : Acute : A review of available data does not identify any symptoms from exposure not previously mentioned. ENGINEERING MEASURES : General ventilation is recommended. Use local exhaust ventilation if necessary to control airborne mist and vapor. RESPIRATORY PROTECTION : Where concentrations in air may exceed the limits given in this section or when significant mists, vapors, aerosols, or dusts are generated, an approved air purifying respirator equipped with suitable filter cartridges is recommended. Consult the respirator / cartridge manufacturer data to verify the suitability of specific devices. In event of emergency or planned entry into unknown concentrations a positive pressure, full-facepiece SCBA should be used. If respiratory protection is required, institute a complete respiratory protection program including selection, fit testing, training, maintenance and inspection. HAND PROTECTION : When handling this product, the use of chemical gauntlets is recommended. The choice of work glove depends on work conditions and what chemicals are handled. Please contact the PPE manufacturer for advice on what type of glove material may be suitable. Gloves should be replaced immediately if signs of degradation are observed. SKIN PROTECTION : Wear chemical resistant apron, chemical splash goggles, impervious gloves and boots. A full slicker suit is recommended if gross exposure is possible.
