At present, she is a licensed associate broker with Century 21 Grand in the Pomona office. She has served as a director of the Rockland County Board of Realtors for the past four years and during that time, Nettie was instrumental in the revision of the RCBOR Bylaws that created an all REALTOR board that enabled all members to vote and hold office. On December 1, 2005 the RCBOR honored Nettie as the 2005 Realtor of the Year in Rockland County. Nettie and her husband, Jules are life members of the W.P. Faist Ambulance Corp in Chestnut Ridge that they helped found. Nettie and Jules have two married sons and six wonderful grandchildren. Raj Bajaj - Raj is a licensed associate broker with Remax Cornerstone Realty. A native of Rockland County since 1974, Raj held various management positions in IBM Supply Chain Operations and was Director of Sales at Solving International, a management consulting firm, before his real estate career. Raj is the current Vice President of the West Nyack Rotary Club Board. He lives in New City with his wife, Sheela and has 2 children Shallini and Anish, son-in-law, Ashim and 2 grandchildren who live in New York City. Raj enjoys tennis, golf and travel. W arr en Switzler - In the past 23 years Warren has served as a classroom teacher, school principal, adult educator and lecturer in the suburbs of Washington D.C. as well as NYC. He has held titles of Property Manager, Operating Manager and Sales Agent in Manhattan, Queens, Nassau and Suffolk Counties. 1983 was the year he first acquired a real estate license. However, his school position and family responsibilities resulted in real estate becoming a part time activity. In 2002 he and his wife, Arlene, found themselves empty nesters. Warren then joined IBNA Spoon River RE in Stony Point. In March of 2006 he opened IBNA Greater Hudson Valley Homes in Highland Falls. He has four grown children, Anthony, Katharine, Victoria and Elizabeth, and a dog named Charlie. He is AKA "Poppy" to a four-year old grandson, Louie. Denise Mur ph y – Denise was born in the Bronx and lives in Rockland County for 31 years. Married 31 years to her husband, Jim, they have four children, Regina, Kristen, James and Michael. Denise is a licensed broker and manager of the Weichert New City Office. She has been in real estate for eight years and before managing the New City Office, was a top producer as a sales associate. Her prior work experience was in banking, and she currently owns weekly newspapers in Westchester County. Denise loves the ocean, reading, travelling and especially spending time with her family and friends.

We have celebrated the holiday season andthe installation of the 2007 Board membersand are now ready to undertake the work athand. However, before we go any further, Iwant to thank all who devoted their timeand energy maintaining a vital andconcerned Board in past years. We couldnot be where we are today without thosewho diligently performed before us.

This year we are off to a great start. Therewere about 170 agents at our first meetingwhere we clarified the new 2007 NYSdisclosure forms for Realtors. Everyonewho attended said it was perfect timing,since the new disclosures are in effect as ofthe first of this year. Roberta Bangs did agreat job. If you missed it, call the Boardoffice to find out about future courses.

Because it was so successful, we arealready planning our next meeting forFebruary 28th, so mark the date on yourcalendars now. If you were unable to attendthe first meeting, try not to miss this one.The program will deal with anti-trust issuesand there is a film that is very enlightening.It reveals how many real estate agents com-mit anti-trust violations in innocent com-ments on a daily basis. It will be a greatlearning experience. Throughout the yearwe hope to offer several programs that willhelp you further your real estate careers.

Also, included in this issue is a list ofmembers who head various committees.Please feel free to contact them and becomea member of a committee. This is yourprofessional organization and you areinvited to participate.

Please note there have been some changesto the 2007 Code of Ethics that have beenincluded in this issue. Take some time toreview them. As a reminder, NAR requiresyou to complete Code of Ethics trainingevery four years, so this is a good time tocall the Board and register for the nexttraining course.

Some of the events that we will beparticipating in the coming year are theOrange and Rockland Realtor Convention,Community Service Programs, RPAC,Lobby Day and the Installation of newofficers for 2008.

People will always need a place to live, toretire, to down size or to trade up. There isa market out there. Go to it.

APPRAISAL CORNERYES – WE HAVE ENTERED A NEW CYCLE

After eight years of unprecedented appreciation – where thesun, the moon and the stars were all in perfect alignment, themajor economic factors have finally caught up to the market.

The changes from 2005 to 2006have been considerable as follows:

• Supply now outweighs demand.

• There are measurably more listings during2006 versus 2005.

• Sellers are reducing their asking prices.

• Houses are taking much longer to sell.

• Taxes, especially in North Rockland are taking a toll.

• Wages are not nearly keeping up with the 250% priceincrease from nine years ago.

In conclusion, if a homeowner really wants to sell their housein a 90 day period, you can bet that the sale will be less thanwhat it would have been during the last quarter of 2005.

All that being said, this is the first year that I have been doingmy “Market Performance Chart” that an accurate analysis ofthe market has been so difficult.

Although my best analysis is that we have experiencedsomewhere between 2% - 4% decline in values, there is notmany examples to meet the burden of proof. Some may agreethat the market is “flat” and that values have neitherappreciated or depreciated. This is true of many sales. Thereis, however, a few that would fall into the “decline” category.I believe that the first quarter of 2007 will make thingsclearer. So, considering all, I am going with a 2% decline.Therefore, last year’s typical BiLevel of $557,000 istoday 545,000.

Now, as for 2007, I believe that many of those sellers, who areselling and waiting, will get to a point where they must selland it will be 2007, that will experience the more obviousdecline in values – maybe in the 4% - 6% category. However,the year 2007 will give wages a chance to catch up to pricesand, hopefully, it will not be much longer before the cyclechanges again.

Cycles are inevitable. They will always come and they willalways go. Let’s just hope and pray that our present cycle isshort lived and that we will be moving onward and upward ina short time.

Roberta Bangs - Roberta is the Director ofTraining and Compliance at Prudential Rand. Sheis a 23 year veteran in real estate sales,management and training. Roberta also holds theABRM, GRI, ITI, and Prudential's CCDS designa-tions. She is a certified REBAC instructor, and areal estate instructor for RCBOR, RCC and PaceUniversity. She is also the author of severalapproved NYS continuing education courses. Veryinvolved in the community, Roberta is the VicePresident of the Nanuet Civic Assoc. and Treasurerof Hi Tor Animal Center. Roberta and her husband,Jon live in Nanuet with their two dogs. They havetwo grown sons, Al and Chris and four wonderfulgrandchildren.

Merrill Starostiak - Merrill is a licensed associatebroker and the manager of Coldwell BankerResidential Brokerage in New City. She has beenan active member of the Board for the past eightyears and has chaired many committees. Adam DiFrancesco - Adam is a licensed associatebroker with Joyce Realty in Suffern. He was bornand has lived in Rockland for 29 years. Adam isgoing into his fourth year in Real Estate. He has aBA in Communication from Ramapo College ofNew Jersey. In his spare time, Adam enjoysshooting photographs and playing hockey.

Elizabeth Rosenblatt - Liz moved to RocklandCounty 12 years ago from South Florida. Liz is anassociate broker with Fuerst and Fuerst, Inc. Shealso started her own company in Florida and has aFlorida broker’s license. Liz is a certified aerobicsand line dance instructor as well as a certifiedpersonal trainer. She teaches country line dance andaerobics for the Town of Ramapo, JCC-Y, NorthRockland High School, RCC and the RetiredTeachers Association. Liz also teaches and dancesin Tappan every Thursday evening. She has adegree in Dental Hygiene that she received atColumbia. Liz has eight children and presentlylives in Wesley Hills. She takes cooking classes andenjoys cooking for her friends. Her hobbies includedancing, ice skating, water skiing, ceramics andcrocheting yarmulkes for her boys.

Marta Segarra-Allen - Marta has been a licensedRealtor with ERA Tucker Associates in Nanuetsince 2003. Marta retired from a successful careeras Vice President with JPMorgan Chase after thirtyone years where she managed Retail CustomerService Delivery. Marta holds a B.A. from FordamUniversity, as well as a business certification as aCertified IRA Service Professional (Institute ofCertified Bankers). Along with her husband, Zeke,they have lived in Valley Cottage for over fifteenyears, and have raised three sons, Paul, Zeke, andMatt.

Ellen Murphy - Ellen has been a salesperson withBaer & McIntosh Real Estate in Nyack since 2003.Her prior work experiences include more than 20years with the Rockland Children’s PsychiatricCenter, where she did fund raising, outreach andpublic relations; journalism and free-lance writingand one-year stint on the staff of a member of theNY State Assembly. She is a lifelong Rockland res-ident and holds a BS Degree in Fine Art fromSkidmore College.

Michael Nuzzo - Mike is a licensed broker and themanager of Weichert Realtors’ in Suffern. He hasbeen in real estate since 1988. Mike has chairednumerous committees and received RealtorAssociate of the Year for the United Association ofRealtors and Realtor Associate of the Year for theState of New Jersey in 1997. He is a 1970graduate of Montclair State University where hereceived a B.A. in Education. Mike resides in NewJersey with his wife, Angela and has three children,Michael, Marc and Brielle.

William Thorne - Mr. Thorne is an experiencedand results oriented real estate consultant with abroad base of knowledge and experiences. Barbara Corrente - Barbara is a licensedassociate broker with Prudential Rand Realty. Shewas born in the Bronx and has resided in ValleyCottage for nineteen years with her husband, Joeand her daughters, Lauren and Jenna. Barbara isstarting her thirteenth year in real estate and hasbeen an active member of the Board. Barbara wasthe 2002 recipient of the Realtor Associate Awardand received the 2006 President’s Award. Prior toher real estate career, Barbara was the Director ofTherapeutic Recreation in hospitals and nursinghomes. Barbara attended Queens College andLehman College, where she received a B.S. inTherapeutic Recreation and minored in Psychologyand Communications. Barbara enjoys involvementin the community, reading, dancing, traveling andspending time with family and friends.

Diane Wanamaker - Diane is a broker and co-owner of Country Sun Realty. She was born in theBronx and has been a Rockland resident for fortyplus years. Diane is starting her fourteenth year inreal estate and has prior working experience in boththe banking and accounting fields. She has been amember of the Rockland County Board ofDirectors for the past four years and has previouslyserved as Treasurer. Diane lives in Stony Point withher husband George. She and George have twodaughters, Jen, 24, living in Boston and Kristen,21, attending college in Rhode Island. Diane lovesto read, travel, redecorate their home and spendtime with family and friends.

Rachel Taub - Rachel an associate broker has beenin the Real Estate business for more than 20 years.Together with her husband, David, an actuary, theyraised their three children in the “country”. Theymoved from Brooklyn in 1984 and have made theirhome in Monsey/Wesley Hills. Rachel is active inmany charitable organizations. Six years ago herdaughter Miriam Perkowski joined the business,and they are now known as the #1 Mother DaughterTeam. In her “free” time she enjoys hergrandchildren and loves to shop.

Sharon Tucker - Sharon is owner/broker of ERATucker Associates, which is located in Nanuet. Shewas born in the Bronx and raised in Yonkers.Sharon attended STAC, where she received a B.S.in accounting. Sharon has lived in Westchester,Putnam, and Rockland Counties. Prior to her careerin real estate, Sharon was a Chief Financial Officer,Corporate Controller and Benefits Administratorfor an international medical manufacturer. Sharonis married to her hudsband, Wayne, who is also inthe business. Together they are raising two boys,Alex and Matthew, who round out their life. Sharonwas 2003 President for Rockland County Board ofRealtors, Realtor of the Year in 2006 and is current-ly a State Director for New York State Associationof Realtors.

Drew Kessler - Drew is a Senior MortgageConsultant with Hudson Home Loans. He enteredresidential financing in 2001 with M&T MortgageCorporation. Drew is a native Rocklander andcurrently lives in the county with his wife Callieand their three children. He is currently Presidentof the Rotary Club of North Rockland and is pastrecipient of the Rockland County Board ofRealtors’ “Affiliate of the Year” award.

Arcenio Pena - Arcenio is the President of theHomeTeam Inspection Service, a national franchiseand has been performing home inspections forseven years. He is licensed in New York and NewJersey. Before becoming a full-time homeinspector, he worked in electrical engineering. Hewas also a project manager for TishmanConstruction, a major New York constructioncompany, for seven years and has worked in allphases of construction and project management.Arcenio has been a Rockland County resident for17 years. He is very active in his church andcommunity services. Arcenio lives with his wifeand three children in Montebello.

REVISED AGENCY DISCLOSURE FORMTAKES EFFECT JANUARY 1st

Beginning on January 1, 2007, all real estatelicensees will be required to use a new agencydisclosure form (RPL 443). The new formwas approved by state lawmakers in 2006.Although the new formatting change(separate form for sale and lease transactions)is noteworthy, we would like to draw yourattention to the fact that when you areexplaining agency options you shouldindicate that you cannot provide undividedloyalty as a “designated sales associate.”

In the past when you have served as adesignated agent, you should have attached anotice to the listing agreement whichexplained your role as a designated salesassociate. The new agency disclosure formnow includes a section on “Dual Agency withDesignated Sales Associates,” thuseliminating any need for a separate form.

In the old designated agency attachment,typically you would have explained howdesignated agency would work including yourability to provide undivided loyalty. The newform describes designated agency and statesthat a designated agent cannot provideundivided loyalty.

The new RPL 443 Disclosure Noticespecifically addresses the duties of adesignated agent with regard to undividedloyalty in accordance with the common law ofagency. Designated agents are a subset of dualagents who cannot provide the full range offiduciary duties, as they are required to actwith “fairness” to each party and to respectthe “confidential information” of each party.The dual agent “is under no duty to discloseand has a duty not to disclose to one principalconfidential information given to him by theother, such as the price that he is willing topay.” (Restatement of the Law (Second),Agency, Section 392).

The change in the statutory disclosure noticedoes not fundamentally alter the ability of adesignated agent to be effective as anadvocate for the buyer or seller for whom theagent is designated. In seeking to arrangea mutually agreeable transaction, thedesignated agent simply must function withinthe boundaries of “fairness” to both partiesand must not reveal confidential informationsuch as the other party’s “bottom line,” whichwas revealed in confidence to a licensee or thefirm with which the licensee is associated.

REALTOR CODE OF ETHICS CHANGESTAKE EFFECT JANUARY 1st

Every May and November the NationalAssociation of REALTORS approves andimplements changes to the REALTOR Codeof Ethics. This year’s changes reflectREALTORS increasing reliance on theInternet as a transactional and marketing tool.

A Joint Work Group of the Interpretations andProcedures Subcommittee and the MultipleListing Issues and Policies Committeedeveloped a list of 26 key issues andconcerns. From the issues identified, 54recommendations were developed andpresented to the Professional StandardsCommittee and the Multiple Listing Issuesand Policy Committee. While not all of thoserecommendations were acted on, you andyour agents should be aware of the changesthat are scheduled to take effect in early 2007.

The Delegate Body defined “electronically,”“electronic means,” “technology,” and“technological means.”

Standard of Practice 1-2 amended. As it nowreads: The duties imposed by the Code ofEthics encompass all real estate - relatedactivities and transactions whether conductedin person, electronically or through any othermeans.

A New Standard of Practice related to Article9 - When electronically assisting or enablinga client in establishing a contractualrelationship (e.g., listing and representationagreements, purchase agreements, leases,etc.), REALTORS shall make reasonableefforts to explain the nature and disclose thespecific terms of the contractual relationshipbeing established prior to it being agreed to bya contracting party.

Standard of Practice 12-5 amended. REALTORS shall not advertise nor permitany person employed by or affiliated withthem to advertise listed property in anymedium without disclosing the name of thatREALTOR’s firm in a reasonable and readilyapparent manner. (Adopted 11/86). Amended5/2006.

New Standard of Practice related to Article 12- REALTOR firm websites shall disclose thefirm’s name and state(s) of licensure in areasonable and readily apparent manner.Websites of REALTORS and non-memberlicensees affiliated with a REALTOR firmshall disclose the firm’s name and thatREALTOR’s or non-member licensee’sstate(s) of licensure in a reasonable andreadily apparent manner.

New Standard of Practice related to Article 12- The obligation to present a true picture in

representation to the public includesinformation presented, provided or displayedon REALTOR websites. REALTORS shalluse reasonable efforts to ensure thatinformation on their websites is current.

New Standard of Practice related to Article 12- REALTORS intending to share or sellconsumer information gather via the Internetshall disclose that possibility in reasonableand readily apparent manner.

New Standard of Practice related to Article 12- REALTORS obligation to present a truepicture in their advertising and representationto the public includes the URLs and domainnames they use, and prohibits REALTORSfrom:

- Engaging in deceptive or unauthorizedframing of real estate brokerage websites.- Manipulating (e.g. presenting content devel-oped by others) listing content in any way thatproduces a deceptive or misleading result.- Deceptively using metatags, keywords orother devices/methods to direct, drive ordivert Internet traffic, or to otherwise misleadconsumers.

New Standard of Practice related to Article 15- The obligation to refrain from making falseor misleading statements about competitors’businesses and competitors’ business prac-tices includes the duty to not knowingly orrecklessly repeat, retransmit or republish falseor misleading statements made by others.This duty applies whether false or misleadingstatements are repeated in person, in writing,by technological means (e.g. the Internet), orby any other means.

Standard of Practice 17-4 amended - Where alisting broker has compensated a cooperatingbroker and another cooperating broker subse-quently claims to be the procuring cause ofthe sale or lease. In such cases the com-plainant may name the first cooperating bro-ker as respondent and arbitration may proceedwithout the listing broker being named as arespondent. When arbitration occurs betweentwo (or more) cooperating brokers and wherethe listing broker is not a party, the amount indispute and the amount of any potentialresulting award is limited to the amount paidto the respondent by the listing broker and anyamount credited or paid to the party to thetransaction at the direction of the respondent.Alternatively, if the complaint is broughtagainst the listing broker, the listing brokermay name the first cooperating broker as athird-party respondent. In either instance thedecision of the hearing panel as to procuringcause shall be conclusive with respect to allcurrent or subsequent claims of the parties forcompensation arising out of the underlyingcooperative transaction.

Sandy Comely of the Pearl River Schooldistrict is looking for support from theboard to print a small brochure for allRealtors to provide to their customers andclients. Roberta Bangs motioned to agree to thisbrochure for all public schools, MerrillStarostiak second, motion carried.

Education: Sharon Tucker reported on anew facility to help the overflow forcontinuing education classes. HiltonGardens in Nanuet has 2 rooms that willaccommodate 70-75 people.

Professional Standards: Roberta Bangsreported on the decision of an ethicshearing panel. The committee concludedthat an agent had, in fact violated Section16 of the Code of Ethics resulting in aletter of reprimand, required attendance of3 hour Code of Ethics course; and a$200.00 fine. Roberta Bangs motioned toaccept hearing panel decision, SharonTucker second, motion carried. RobertaBangs recommended all board membersattend the Professional Standards Trainingwith 6 hour class on 3/15/07 in Westchester.

PAC: Adam DiFrancesco reported 2007Goal- $24,615. YET Collections -$12,643.

Re: Little Tor Homes Development

Plans are drawing closer to the construction of new homes on the parcel of land previously known as Smith Farms.The largest development is known as Little Tor Homes and will include approximately 55 homes.

This is to inform all realtors from the start, that the elementary-aged students residing in this development will attendLittle Tor Elementary School, NOT Woodglen Elementary School. More specifically, they will begin attending LittleTor School as soon as we complete the addition to that school which has already been approved by the voters and iswell along in the preparation process.

If any homes precede the completion of the addition to Little Tor Elementary, the elementary-aged students residingin this development may be assigned to any of Clarkstown’s ten elementary schools, though we will naturally try tolocate them as close to the development as possible. We hope that this awkward transition will not occur. However,Woodglen is a school already housing the highest number of elementary students in the district and we need toprotect its quality by not assigning an excessive number of students, even in the short run.

All elementary-aged students who will attend Little Tor Elementary will be transported to and from the school.

The students in the Little Tor Homes development will attend the Felix Festa Middle School and North High School,as you would anticipate.

Properly conveying this information to prospective buyers will help avoid customers who are later upset with youand the Clarkstown Central School District.
