Dear Fellow Conservatives,

I am pleased to present the American Conservative Union Foundation’s ratings for the 2015 meeting of the California State Legislature. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The California legislators with the strongest scores voted most consistently with the ideals articulated in the US Constitution: limited and transparent government, individual rights, personal responsibility, and a healthy culture.

The 2014 election completed a political transformation that began in 2010 and resulted in voters of almost half the states, 23 in all, entrusting Republicans with the governorships as well as control of both chambers in the respective state, the biggest sweep since the first half of the 20th Century.

By examining all our State Ratings (which cover a wide variety of issues) we can see which states have best used their Republican majorities to apply conservative principles, how others have struggled, and in yet other states, how conservatives have stood up against liberal majorities. I know that this guide will provide you with the most comprehensive evaluative tool to learn how your legislators measure up.

1. SB 3 Minimum Wage. This bill raises the state’s minimum wage to $13 an hour by 2017 and then automatically increases the wage based on inflation without legislative approval beginning in 2019. ACU opposes these artificial wages that hurt those who find it hardest to get employment such as students and less experienced workers and opposed this bill. The Senate passed the bill on June 1, 2015 by a vote of 23-15.

2. SB 140 E-Cigarettes. This bill bans vaping (e-cigarettes) everywhere that smoking is prohibited. ACU believes that both tobacco and e-cigarettes are a personal liberty issue and government regulations on products are only appropriate when their use substantially impacts others and opposed this bill. The Senate passed the bill on June 2, 2015 by a vote of 25-12.

3. SB 788 Offshore Oil Drilling. This bill repeals the California Coastal Sanctuary Act of 1994 which authorized leases for offshore oil drilling. ACU believes that all forms of energy should compete within the free market and government should refrain from helping favored energy sources or prohibiting less favored sources and opposed this bill. The Senate passed the bill on June 3, 2015 by a vote of 23-14.

4. SB 185 Pension Mandates. This bill requires the state’s two largest public employee pension systems to sell holdings in any company that receives more than half its income from coal mining. ACU opposes these mandates that forces pension systems to make decisions based on ideology rather than what’s in the best interests of their members and opposed this bill. The Senate passed the bill on June 3, 2015 by a vote of 24-14.

5. SB 32 Global Warming Mandates. This bill requires the California Air Resources Control Board (CARB) to devise mandates that will cut petroleum use in cars and trucks by half over the next 15 years as well as reducing all greenhouse gas emissions to 40% below the 1990 level by 2030 regardless of the technology available. ACU opposes these mandates that will dramatically raise the cost of energy to consumers and do little to change the climate and opposed this bill. The Senate passed the bill on June 3, 2015 by a vote of 24-15.

6. AB 359 Employer Mandates. This bill requires new owners of large grocery stores to retain existing employees for 90 days and retain any employee who receives a satisfactory work evaluation. ACU opposes this interference in the free market that drives up the cost to consumers and opposed this bill. The Senate passed the bill on July 13, 2015 by a vote of 22-14.

7. AB 464 Sales Tax Increase. This bill allows for a 50% increase in county sales taxes from 2% to 3%. ACU opposes a major tax increase in lieu of spending reductions that could bring the combined sales tax rate to a prohibitive 11% in some areas and opposed this bill. The Senate passed the bill on July 13, 2015 by a vote of 22-15.

8. AB 1100 Ballot Initiatives. This bill increases the filing fee for a ballot initiative tenfold to $1,000. This fee is refunded if the ballot initiative is qualified for the ballot. ACU opposes this backdoor tax that is used for other programs and is meant to discourage grass roots ballot initiatives and opposed this bill. The Senate passed the bill on August 17, 2015 by a vote of 23-14.

9. AB 768 Chewing Tobacco. This bill prohibits the use of chewing tobacco or snuff on the playing field of professional baseball games or at practice even though members of the California State Senate are allowed to use chewing tobacco on the Senate floor. ACU believes that both tobacco and e-cigarettes are a personal liberty issue and government regulations on products are only appropriate when their use substantially impacts others and opposed this bill. The Senate passed the bill on August 24, 2015 by a vote of 24-14.

10. AB 465 Arbitration Laws. This bill prohibits labor agreements that require disputes to be settled by an arbitrator rather than by the courts. ACU opposes this interference in the free marketplace that is primarily designed to increase litigation and opposed this bill. The Senate passed the bill on August 24, 2015 by a vote of 22-15.

11. AB 219 Prevailing Wage. This bill expands California’s prevailing wage law to cover ready mix concrete drivers that the state Department of Transportation estimates will cost the taxpayers between $21 million and $41 million per year. ACU opposes prevailing wage laws that set wages above the free market level and drive up the cost of projects and opposed this bill. The Senate passed the bill on September 1, 2015 by a vote of 24-13.

12. AB 1017 Ban on Salary Information. This bill prohibits an employer from basing current employee pay on past salary history or seeking any information regarding past employee pay. It does not apply to information available under the California Public Records Act. ACU opposes this interference in the free market and opposed this bill. The Senate passed the bill on September 1, 2015 by a vote of 23-14.

13. AB 622 E-Verify. This bill discourages the use of E-Verify to ascertain whether a person is eligible for employment by imposing a civil penalty of up to $10,000 every time the system is used “improperly,” restricting its use to the final stage of hiring and prohibiting its use for existing employees. ACU supports the use of E-Verify to determine whether an employee is legally entitled to work in the U.S. and opposed this bill. The Senate passed the bill on September 2, 2015 by a vote of 23-12.

14. AB 96 Ivory Ban. This bill bans all sales of anything with ivory in it, including knives and firearms unless they are part of a musical instrument or at least 100 years old as well as banning the purchase or sale of rhinoceros horns. ACU opposes criminalizing ivory that was legal at purchase and opposed this bill. The Senate passed the bill on September 2, 2015 by a vote of 26-13.

15. SB 707 Firearms Restrictions. This bill makes it a criminal offense to carry a firearm or ammunition for self-defense on California school grounds, even for trained firearm owners who have a license to carry from local law enforcement. ACU supports the founding fathers’ belief in the Second Amendment and opposed this bill. The Senate passed the bill on September 2, 2015 by a vote of 24-15.

16. AB 1134 Concealed Carry. This bill gives county sheriffs the right to review and override the decisions of local police chiefs on concealed carry adding to the bureaucratic red tape of obtaining a concealed carry license. ACU supports our founding fathers’ belief in the Second Amendment and opposed this bill. The Senate passed the bill on September 2, 2015 by a vote of 23-16.

17. AB 775 Abortion Information. This bill requires crisis pregnancy centers to provide information on the availability of abortion regardless of their beliefs. ACU considers abortion to be a human tragedy, supports efforts to educate patients on an abortion, supports restrictions on the practice, and opposed this bill. The Senate passed the bill on September 3, 2015 by a vote of 24-14.

18. AB 665 Hunting Rights. This bill prohibits local governments from restricting hunting rights to stop waterfowl hunting. ACU supports our founding fathers’ belief in the Second Amendment and supported this bill. The Senate passed the bill on September 8, 2015 by a vote of 26-11.

19. AB 787 Charter Schools. This bill establishes charter schools as government entities to make them easier to unionize. ACU supports school choice and opposed this bill as an attempt to negate the flexibility charter schools have over the public school system. The Senate passed the bill on September 8, 2015 by a vote of 22-15.

20. SB 178 Digital Record Privacy. This bill requires the government to get a warrant or other court authorization to access digital records, including emails and texts. ACU supports the requirement of a warrant to access records whenever possible and supported this bill. The Senate passed the bill on September 9, 2015 by a vote of 34-4.

21. AB 1177 Abortion Regulations. This bill repeals the requirement that an abortion clinic must have a hospital transfer agreement in order to provide prompt care for women suffering from botched abortions. ACU believes abortion is a human tragedy, supports restrictions on the practice and opposed this bill. The Senate passed the bill on September 9, 2015 by a vote of 26-13.

22. AB 2 Property Rights. This bill creates a new bureaucracy called Community Revitalization and Investment Authorities that can use the power of eminent domain to seize property designated as “blighted” and hand it over to developers. ACU opposes the use of eminent domain for anything other than needed public use and opposed this bill. The Senate passed the bill on September 9, 2015 by a vote of 29-10.

23. AB 339 Healthcare Price Controls. This bill would place price controls on out-of-pocket costs for prescription drugs. ACU supports a freer market for healthcare and opposes price controls that distort the marketplace and opposed this bill. The Senate passed the bill on September 10, 2015 by a vote of 25-13.

24. SB 331 Government Transparency. This bill places severe restrictions on government transparency laws that cover labor negotiations. It exempts a number of types of contracts, including contract renewals and creates bureaucratic red tape for local government that adopt public disclosure requirement ordinances known as Civic Openness in Negotiations (COIN) laws. ACU supports increased government transparency and opposed this bill. The Senate passed the bill on September 10, 2015 by a vote of 22-15.

25. AB 1461 Automatic Voter Registration. This bill requires drivers eligible to vote to be signed up automatically when they get a new drivers’ license whether they want to or not. In California, illegal immigrants are eligible for drivers’ licenses. ACU opposes voting law changes that make it easier to commit voter fraud and opposed this bill. The Senate passed the bill on September 10, 2015 by a vote of 25-15.

26. AB 329 Sex Education. This bill mandates sex education for local school districts. ACU strongly believes in parental rights and that sex education and matters of morality, should be handled in the private context of the family. ACU supports local control of education and opposed this bill. The Senate passed the bill on September 10, 2015 by a vote of 26-14.

27. SB 4 Illegal Immigrant Benefits. This bill allows illegal immigrants under the age of 19 to be covered under the state’s medical health care program and seeks a federal waiver to allow illegal immigrants to purchase health insurance under Obamacare exchanges, which is specifically prohibited in the law. ACU opposes granting government benefits to those in the country illegally and opposed this bill. The Senate passed the bill on September 11, 2015 by a vote of 28-11.

28. SB 292 Public Pensions. This bill creates a special carve out for public employees, exempting them from contributing to their own pensions. The bill would instead place this fiscal burden on property owners in the relevant counties. ACU opposes this fiscally irresponsible measure that will put the burden of insolvent pensions on homeowners and opposed this bill. The Senate passed the bill on September 11, 2015 by a vote of 27-12.

29. SB 350 Energy Mandates. This bill requires that 50 percent of utilities’ power come from renewable energy by 2030 regardless of the cost. ACU believes that all forms of energy should compete within the free market and government should refrain from helping favored energy sources and opposed this bill. The Senate passed the bill on September 11, 2015 by a vote of 26-14.

30. SB 376 Private Contractors. This bill prohibits the use of private contractors by the University of California unless the contractor pays its employees more than the government pays its employees, virtually eliminating outside contracts. ACU supports the use of private enterprise whenever possible and opposed this bill. The Senate passed the bill on September 11, 2015 by a vote of 24-15.

31. SB 548 Childcare Workers. This bill encourages the unionization of child care workers. ACU opposes this effort that will drive up the cost of child care for working families and opposed this bill. The Senate passed the bill on September 11, 2015 by a vote of 26-14.

1. AB 665 Hunting Rights. This bill prohibits local governments from restricting hunting rights to stop waterfowl hunting. ACU supports our founding fathers’ belief in the Second Amendment and supported this bill. The Assembly passed the bill on April 30, 2015 by a vote of 77-0.

2. AB 359 Employer Mandates. This bill requires new owners of large grocery stores to retain existing employees for 90 days and retain any employee who receives a satisfactory work evaluation. ACU opposes this interference in the free market that drives up the cost to consumers and opposed this bill. The Assembly passed the bill on May 26, 2015 by a vote of 46-27.

3. AB 775 Abortion Information. This bill requires crisis pregnancy centers to provide information on the availability of abortion regardless of their beliefs. ACU considers abortion to be a human tragedy, supports efforts to educate patients on an abortion, supports restrictions on the practice, and opposed this bill. The Assembly passed the bill on May 26, 2015 by a vote of 49-26.

4. AB 575 Teacher Evaluation. This bill makes teacher evaluations subject to collective bargaining and takes away management authority to establish teacher evaluation criteria. ACU supports educational policy that puts kids first and allows for objective teacher evaluation and opposed this bill. The Assembly passed the bill on June 4, 2015 by a vote of 41-31.

5. AB 20 Illegal Immigrant Work Permits. This bill legalizes illegal immigrant farm workers by granting them work permits and relief from deportation. ACU opposes state-sponsored amnesty that under the Constitution is governed by federal law and opposed this bill. The Assembly passed the bill on June 4, 2015 by a vote of 69-2.

6. AB 464 Sales Tax Increase. This bill allows for a 50% increase in county sales taxes from 2% to 3%. ACU opposes a major tax increase in lieu of spending reductions that could bring the combined sales tax rate to a prohibitive 11% in some areas and opposed this bill. The Assembly passed the bill on July 16, 2015 by a vote of 46-32.

7. AB 1100 Ballot Initiatives. This bill increases the filing fee for a ballot initiative tenfold to $1,000. This fee is refunded if the ballot initiative is qualified for the ballot. ACU opposes this backdoor tax that is used for other programs and is meant to discourage grass roots ballot initiatives and opposed this bill. The Assembly passed the bill on August 20, 2015 by a vote of 48-31.

8. AB 465 Arbitration Laws. This bill prohibits labor agreements that require disputes to be settled by an arbitrator rather than by the courts. ACU opposes this interference in the free marketplace that is primarily designed to increase litigation and opposed this bill. The Assembly passed the bill on August 27, 2015 by a vote of 46-31.

9. AB 768 Chewing Tobacco. This bill prohibits the use of chewing tobacco or snuff on the playing field of professional baseball games or at practice even though members of the California State Senate are allowed to use chewing tobacco on the Senate floor. ACU believes that both tobacco and e-cigarettes are a personal liberty issue and government regulations on products are only appropriate when their use substantially impacts others and opposed this bill. The Assembly passed the bill on August 27, 2015 by a vote of 54-23.

10. SB 707 Firearms Restrictions. This bill makes it a criminal offense to carry a firearm or ammunition for self-defense on California school grounds, even for trained firearm owners who have a license to carry from local law enforcement. ACU supports the founding fathers’ belief in the Second Amendment and opposed this bill. The Assembly passed the bill on September 1, 2015 by a vote of 54-24.

11. SB 185 Pension Mandates. This bill requires the state’s two largest public employee pension systems to sell holdings in any company that receives more than half its income from coal mining. ACU opposes these mandates that forces pension systems to make decisions based on ideology rather than what’s in the best interests of their members and opposed this bill. The Assembly passed the bill on September 2, 2015 by a vote of 47-30.

12. AB 219 Prevailing Wage. This bill expands California’s prevailing wage law to cover ready mix concrete drivers that the state Department of Transportation estimates will cost the taxpayers between $21 million and $41 million per year. ACU opposes prevailing wage laws that set wages above the free market level and drive up the cost of projects and opposed this bill. The Assembly passed the bill on September 3, 2015 by a vote of 51-27.

13. AB 1017 Ban on Salary Information. This bill prohibits an employer from basing current employee pay on past salary history or seeking any information regarding past employee pay. It does not apply to information available under the California Public Records Act. ACU opposes this interference in the free market and opposed this bill. The Assembly passed the bill on September 3, 2015 by a vote of 42-33.

14. AB 622 E-Verify. This bill discourages the use of E-Verify to ascertain whether a person is eligible for employment by imposing a civil penalty of up to $10,000 every time the system is used “improperly," restricting its use to the final stage of hiring and prohibiting its use for existing employees. ACU supports the use of E-Verify to determine whether an employee is legally entitled to work in the U.S. and opposed this bill. The Assembly passed the bill on September 4, 2015 by a vote of 51-26.

15. AB 96 Ivory Ban. This bill bans all sales of anything with ivory in it, including knives and firearms unless they are part of a musical instrument or at least 100 years old as well as banning the purchase or sale of rhinoceros horns. ACU opposes criminalizing ivory that was legal at purchase and opposed this bill. The Assembly passed the bill on September 4, 2015 by a vote of 54-21.

16. AB 1134 Concealed Carry. This bill gives county sheriffs the right to review and override the decisions of local police chiefs on concealed carry adding to the bureaucratic red tape of obtaining a concealed carry license. ACU supports our founding fathers’ belief in the Second Amendment and opposed this bill. The Assembly passed the bill on September 4, 2015 by a vote of 49-30.

17. SB 331 Government Transparency. This bill places severe restrictions on government transparency laws that cover labor negotiations. It exempts a number of types of contracts, including contract renewals and creates bureaucratic red tape for local government that adopt public disclosure requirement ordinances known as Civic Openness in Negotiations (COIN) laws. ACU supports increased government transparency and opposed this bill. The Assembly passed the bill on September 8, 2015 by a vote of 48-29.

18. SB 32 Global Warming Mandates. This bill requires the California Air Resources Control Board (CARB) to devise mandates that will cut petroleum use in cars and trucks by half over the next 15 years as well as reducing all greenhouse gas emissions to 40% below the 1990 level by 2030 regardless of the technology available. ACU opposes these mandates that will dramatically raise the cost of energy to consumers and do little to change the climate and opposed this bill. The Assembly defeated the bill on September 8, 2015 by a vote of 30-35 but it was later revived for reconsideration in 2016.

19. SB 178 Digital Record Privacy. This bill requires the government to get a warrant or other court authorization to access digital records, including emails and texts. ACU supports the requirement of a warrant to access records whenever possible and supported this bill. The Assembly passed the bill on September 8, 2015 by a vote of 57-13.

20. AB 787 Charter Schools. This bill establishes charter schools as government entities to make them easier to unionize. ACU supports school choice and opposed this bill as an attempt to negate the flexibility of charter schools over the public school system. The Assembly passed the bill on September 9, 2015 by a vote of 45-29.

21. SB 376 Private Contractors. This bill prohibits the use of private contractors by the University of California unless the contractor pays its employees more than the government pays its employees, virtually eliminating outside contracts. ACU supports the use of private enterprise whenever possible and opposed this bill. The Assembly passed the bill on September 10, 2015 by a vote of 51-27.

22. AB 1177 Abortion Regulations. This bill repeals the requirement that an abortion clinic must have a hospital transfer agreement in order to provide prompt care for women suffering from botched abortions. ACU considers abortion to be a human tragedy, supports restrictions on the practice and opposed this bill. The Assembly passed the bill on September 10, 2015 by a vote of 52-28.

23. SB 4 Illegal Immigrant Benefits. This bill allows illegal immigrants under the age of 19 to be covered under the state’s medical health care program and seeks a federal waiver to allow illegal immigrants to purchase health insurance under Obamacare exchanges, which is specifically prohibited in the law. ACU opposes granting government benefits to those in the country illegally and opposed this bill. The Assembly passed the bill on September 11, 2015 by a vote of 52-23.

24. SB 292 Public Pensions. This bill creates a special carve out for public employees, exempting them from contributing to their own pensions. The bill would instead place this fiscal burden on property owners in the relevant counties. ACU opposes this fiscally irresponsible measure that will put the burden of insolvent pensions on homeowners and opposed this bill. 25. AB 329 Sex Education. This bill mandates sex education for local school districts. ACU strongly believes in parental rights and that sex education and matters of morality, should be handled in the private context of the family. 26. AB 339 Healthcare Price Controls. This bill would place price controls on out-of-pocket costs for prescription drugs. 27. SB 350 Energy Mandates. This bill requires that 50 percent of utilities’ power come from renewable energy by 2030 regardless of the cost. ACU believes that all forms of energy should compete within the free market and government should refrain from helping favored energy sources and opposed this bill. The Assembly passed the bill on September 11, 2015 by a vote of 52-27.

28. SB 548 Childcare Workers. This bill encourages the unionization of child care workers. ACU opposes this effort that will drive up the cost of child care for working families and opposed this bill. The Assembly passed the bill on September 11, 2015 by a vote of 50-26.

29. AB 1461 Automatic Voter Registration. This bill requires drivers eligible to vote to be signed up automatically when they get a new drivers’ license whether they want to or not. In California, illegal immigrants are eligible for drivers’ licenses. ACU opposes voting law changes that make it easier to commit voter fraud and opposed this bill. The Assembly passed the bill on September 11, 2015 by a vote of 52-26.

30. AB 2 Property Rights. This bill creates a new bureaucracy called Community Revitalization and Investment Authorities that can use the power of eminent domain to seize property designated as “blighted” and hand it over to developers. ACU opposes the use of eminent domain for anything other than needed public use and opposed this bill. The Assembly passed the bill on September 12, 2015 by a vote of 58-15.
