GENERAL SESSIONS JUDGE/ COMMISSIONER
AFFIDAVIT FOR SEARCH WARRANT 1602020020
3730 Appling Road, Bartlett, TN, 38133
STATE OF TENNESSEE,SHELBY COUNTY
Detective Mark Gaia, Being duly sworn, deposes and says:
1. I am currently a Detective employed by the City of Bartlett Police Departmentand assigned to the Narcotics Unit of the Investigative Services Division. I havebeen employed with the City of Bartlett Police Department, since July of 2004,and have 11 years of total law enforcement experience. I have been exclusivelyassigned to the Narcotics Unit since January 2013. I have received specializedtraining in narcotics investigations, undercover operations, confidential informantmanagement, and writing search warrants. I have participated hi theplanning/execution of over 100 search warrants.
2. Based on my training, experience and participation in narcotics investigations andcomputer and cellular phone investigations I know:
a. That those involved in narcotic sales and trafficking frequently conductthe majority of their business via cellular devices, due to their portability, perceived security, ease of use, and availability to all levels of society.
b. These devices are used to set up purchases and sales of illicit narcotics, arrange meetings with co-conspirators, using various methods of availablecommunication on the device, i.e: text messaging, instant messaging, internet service messaging, social media posts, voice messages, andphone calls.
c. These cellular phone devices work much the same as a computer, keepingeven deleted information for extended periods of time, which can beaccessed using forensic software and devices.
d. These devices contain information that documents the narcotics activity, such as photos, videos, social media posts bragging about nature andextent of the illegal activity.
e. The information on these devices often contains time and date stamps and"geo tagging" which can lead to the location of the illegal activity and toothers committing it.
f. The information is easily manipulated and vulnerable to tampering ordestruction by the user and the devices contain "wiping" software thatallows the user of the device to send a cellular signal to erase the data onthe phone remotely or if a certain action has not been taking within aspecified time period.
g. That cellular phones can be secured with the use of passcodes or swipecodes that prevent examination except through forensic means.
h. That analyzing a cellular phone system, beyond a basic examination of itscontents, requires experience in the field of computer and cellular examsand a properly controlled environment.
3. Based on information provided to me by other law enforcement officers, I amfamiliar with the facts and circumstances referred to in this affidavit. On the basisof that familiarity, I have determined the following:
4. On February 02,2016,1 received a phone call from Detective Adam Collins withthe Visalia Police Department in Visalia, CA. Del Collins advised that hereceived a complaint from the local FedEx Express package center regarding asuspicious package.
5. Management officials with the FedEx facility in Visalia, CA, stated that acustomer dropped off a package to be delivered to 2552 Jenwood Road, Bartlett,TN, 38134. The customer said that the package contained baby clothing butneeded the package to be shipped overnight at a cost of $90.22. This seemed outof the ordinary for shipping baby clothing. Employees issued the package aFedEx Tracking* 808857073374.
6. After the customer left the store, management opened the package to inspect itscontents. FedEx reserves the right to open any package shipped from any facilityto determine if the contents are safe for shipping. They discovered a vacuumsealed bag, which contained clear crystalized rocks and one baby outfit. Fearingthe crystalized rocks were drugs, management contacted Det. Collins. Det.Collins determined the crystalized rocks were approximately one pound ofsuspected methamphetamine, also known by the street name "Ice". Pure formsof methamphetamine were given the name "Ice" due to its similar appearance toice cubes.
7. Because the package being addressed to the Bartlett, TN area, Det. Collinsrequested the assistance of the Bartlett Police Department Narcotics Unit toconduct a controlled delivery of the package to 2552 Jenwood Road. Thepackage (Tracking* 808857073374) was men rerouted to 3730 Appling Road,Bartlett Police Headquarters.
8. I conducted a computer check of the 2552 Jenwood Road. According to theShelby County Assessor's web page, the correct address for this residence is2552 Jenwood Street, Memphis, TN, 38134. This address is located within thecity limits of Memphis, TN. Computer records show that an individual namedKristina Yuette Cole has utilities currently in her name at 2552 Jenwood Street.Cole also listed 2552 Jenwood as her current residence on her Tennessee Driver'sLicense* 076399506.
9. On February 03,2016, the package FedEx Tracking* 808857073374. Arrived at3730 Appling Road, Bartlett, TN, 38133. The contents were examined andphotographed. The suspected methamphetamine was tested and weighed. Themethamphetamine weighed 480.6 grams tgw and tested positive as such using aMarquis Reagent, Test* 902.
10.The Bartlett Police Department Narcotics Unit conducted a controlled delivery ofthe package FedEx Tracking* 808857073374 to the original destination of thepackage, 2552 Jenwood Street, Memphis, TN, 38134.
11 .At approximately 1530 hours, detectives delivered FedEx packaged808857073374 to 2552 Jenwood Street. The package was placed at the frontdoor. Detectives observed, Kristina Yuette Cole, exit the residence, collect thepackage, and walk back inside of 2552 Jenwood Street with the package.
12.Detectives executed a previously obtained search warrant for 2552 JenwoodStreet. Kristina opened the front door to the residence and allowed detectives toenter. The FedEx packaged 808857073374 was located just inside of the frontdoor.
13. A search of the residence revealed the following items: a laptop computer in thedownstairs office of the residence. A search of the browsing history revealedmultiple searches for the FedEx packaged 808857073374; indicating KristinaYuette Cole was checking the deliver status of the package in anticipation of itsarrival. Also found in the office were three cellular phones (a Samsung Galaxy JlIMEI# 99000488422037, a HTC ADR6400L IMEI# 990000334906783, and aLG P870 MEW 013237-00-138699-7. These phones belong to Kristina YuetteCole.
14.Based upon the aforementioned facts, the Affiant has reason to believe and doesbelieve, that located within the property: a Samsung Galaxy Jl IMEI#99000488422037, a HTC ADR6400L IMEI# 990000334906783, and a LG P870IMEI# 013237-00-138699-7 (All three belonging to Kristina Yuette Cole),Shelby County, Tennessee is evidence of criminal activity including but notlimited to all other materials evidence of violation of Unlawful Possession of aControlled Substance w/Intent to Sell/Deliver/Manufacture TCA 39-17-417.
