I write concerning Mr Samuel David Cyprys who is currently out on bail awaiting trial for various criminal charges.

I have known Mr Cyprys and his family (parents, siblings and children) for many years. I hereby affirm that during all of that time he has been an observant, practicing member of the Jewish faith.

This raises a number of problems for him regarding his current bail conditions.

l. According to the rituals of our observance of the Jewish Sabbath and the Jewish Festivals he is prohibited from entering the police station on those days if that will mean activating the electronic entrance doors or any other electrical device. He is also prohibited from writing on those days - that would proscribe his signing the register on those days during his daily reporting to police as dictated by his current bail conditions. I therefore strongly support any request to alleviate the necessity for him to abide by bail conditions that would force him to have to transgress his religious convictions vis a vis the Sabbath and Festival laws.

2. As a practicing member of the Jewish faith Mr Cyprys is required to attend Synagogue prayer services each morning and evening. This is particularly so during the upcoming High Holyday period surrounding the Jewish New Year and the Day of Atonement- the holiest days of the Jewish calendar. It would be important for him to therefore receive clarification of his current bail conditions and to receive concessions, if at all possible, given that many of the Synagogues in Melbourne are in proximity to schools. It should be noted that the services are invariably conducted in most of those synagogues outside of school hours.

3. I am aware that Mr Cyprys has had ample opportunity to attempt to leave the country since the allegations against him were first raised. My own observations, as confirmed to me by members of his immediate family, are that he has never planned nor attempted to do so.

Although Mr Cyprys is currently facing criminal charges I trust that we can be assured of the fact that the usual Australian standards and expectations of freedom ofreligion for any Australian citizen and resident will be honoured and that his bail conditions will be clarified and reassessed if need be accordingly.
