*11894REMOVAL OF WILLOWS—Mr Greg Aplin asked the Minister for Climate Change and the Environment, and Minister Assisting the Minister for Health (Cancer)—

(1) What risk assessment was conducted along the Mannus Creek and other riparian areas in Tumbarumba Shire in relation to willow debris resulting from the willow removal program?

(2) What methods were employed by the CMA and other agencies to kill the willows along these watercourses?

(3) What measures were taken to reduce the quantity of willow debris alongside the waterways?(4) Are you aware that landholders in the Tooma area consider that the destruction of primary road

bridges, fencing and native trees along the river beds was attributable in part to the enormous load of dead willow trees and debris propelled by the flooding rivers?

(5) Will an assessment be conducted of potential high flow creeks and rivers to minimise the quantity of willow debris caused by the eradication programs?

Answer—I am advised as follows:(1) In areas where the Murray Catchment Management Authority (CMA) coordinated the willow

management program an on-site assessment was undertaken to determine the best method of treating the willows, which included placement of debris. In general, debris piles were located at least 20 metres from the bank of the creek, except where the on site assessment determined this was not possible.The site assessment considered a number of factors including safety of the operation, potential impact to the habitat values of the creek, placement of the willow debris with respect to the creek, and protection of high value assets such as pine plantations. A treatment method was chosen that provided the best solution at that particular site, which then influenced debris placement and management.

(2) The method selected for use at each site to treat the willows was determined by factors including safety of the operation, potential impact to the habitat values of the creek, threatened species habitat, placement of the willow debris with respect to the creek, and protection of high value assets such as pine plantations.The methods used to kill the willows were:

• Stem injection - the stem is cut partially through the whole way around and a poison approved for use near waterways is applied to the cut. This kills the willow on site.

• Mechanical removal - the tree is cut down and removed from the creek and the stump is treated with a suitable herbicide to prevent regrowth. This method leaves the root ball in place to help bind the soil and reduce the erosion risk.

• Foliar spraying - for small willows, using a herbicide approved for use near waterways. (3) Removal of piles of willow debris is the responsibility of the landholder, as set out in the contract

between the Murray CMA and the landholder. Most landholders opted to burn the piles of debris when the bushfire risk was low, in late autumn⁄winter. In rugged, isolated stretches of creeks, the only practical approach was to stack dead willow above normal flood height, where possible.

(4) Murray CMA is aware of the claims being made by some landholders. It is important to note that this was an extreme event. There have been reports of dead willows, live willows, gum trees, grass and other debris being washed downstream by the massive volume of water. The NSW Government instigated a significant emergency response, and I encourage all landholders to seek appropriate assistance and participate in response activities.In addition, the Murray CMA:

• has initiated discussions with the Australian Government about options to address the damage to natural resource management programs

• has engaged a consultant to undertake an assessment of erosion control works that may have been damaged

• is visiting sites where willow control work has been undertaken and • has attended a number of community meetings to talk to affected landholders and hear their

concerns.

*11895NSW AGSTART PROGRAM—Mr Greg Aplin asked the Minister for Primary Industries, Minister for Emergency Services, and Minister for Rural Affairs—

Given that the initial funding of $3 million for the AgStart program was exhausted between 2006 and 2009 and that an independent study of the scheme was commissioned in 2009:(1) When were the report and recommendations on the future directions of the scheme delivered to your

office?(2) What discussions and consultations have taken place on the future direction of the scheme?(3) What is the timeline for a decision on the future of AgStart?Answer—(1) The Independent study of the Agstart program was commissioned by the Agstart Ministerial Board

appointed by the previous Minister Macdonald. The report was made available to Minister Macdonald in September 2009. I received a briefing on the previous Agstart program in December 2009, followed by a copy of the independent study and substantive report.

(2) I have held discussions with the Chairperson, Chief Executive and General Manager of the NSW Rural Assistance Authority, to investigate all options for any replacement program. I understand the issue has been discussed by the Board of the Authority, which is currently completing the assessment, including consideration of the views of the NSW Farmers' Association and financial institutions.

(3) A decision on the future of Agstart will be taken when the issue and potential options have been fully evaluated by the Rural Assistance Board, and their report considered by Government.

*11896SUPPORTED ACCOMMODATION—Mr Greg Aplin asked the Minister for Education and Training representing the Minister for Ageing, Minister for Disability Services, Minister for Volunteering, and Minister for Youth—

(1) What supported accommodation facilities funded by ADHC are currently operating in the Albury electorate?

(2) How many places are provided by each facility?(3) When were the facilities opened and have any been enlarged since opening?(4) What facilities are planned for the existing demand for supported accommodation for adults with

disabilities?Answer—(1) to (4) There are 103 supported accommodation places funded in the Albury region.

*11897LAND AND PROPERTY MANAGEMENT AUTHORITY—Mr Steve Cansdell asked the Minister for the State Plan, and Minister for Community Services representing the Minister for Planning, Minister for Infrastructure, Minister for Lands—

(1) Does the Government intend to phase out the Land and Property Management Authority in Grafton?(2) Since the remaining staff will not be transferred to Coffs Harbour, will they be phased out with

attrition?(3) Why has the Land and Property Management Authority staff been transferred from the State office

block in Fitzroy Street Grafton to the Lands Department in Victoria Street Grafton?Answer—(1) No. (2) Not applicable. Refer to answer (1). (3) LPI has vacated the NSW Government Office Block at the request of the State Property Authority,

while they undertake refurbishment of the building.

*11898STOCKINGS AND SOCKS ALLOWANCE—Mr Steve Cansdell asked the Deputy Premier, and Minister for Health—

(1) Why has the North Coast Area Health Service CEO Chris Crawford told nurses in a memo that they will no longer be paid a stockings and socks allowance which is a part of their uniform allowance?

(2) Has this been endorsed by the Minister's office and if so what reasons have been given for this reduction?

(3) As this will add an extra $106 annually per staff member, how will the department compensate the nurses for this loss of allowance?

Answer—I am advised that:(1) to (3) The current uniform requirements for the North Coast Area Health Service and the allowances

associated with that have recently been reviewed.The Sock and Stocking Allowance is now a matter which is under discussion as part of the statewide Nurses' bargaining negotiations.Nurses receiving the sock and stocking allowance in the North Coast Area Health Service and across NSW will continue to receive this allowance pending the outcome of the statewide negotiations.

In relation to electric cars and given your advice the NSW Electric Vehicles Taskforce will have input to developing Government policy related to electric vehicles (Question 10880):

(a) Who comprises the Electric Vehicles Taskforce and how was their appointment determined?(b) When will related policies be released?

Answer—I am advised as follows:

(a) The Electric Vehicles Taskforce comprises representatives of relevant NSW Government agencies and selected organisations, as follows:

Invitations to participate on the NSW Electric Vehicles Taskforce were issued by DECCW in March 2009, following consideration by the then Minister for Climate Change and the Environment. In the case of NSW Government agencies, Directors General determine who should represent their respective agencies.(b) The Taskforce is presently considering a range of issues relating to the uptake of electric vehicles and will provide advice to the Government. Policies will be released by the Government after they have been considered by Cabinet.

*11900RENEWABLE ENERGY—Mr Peter Debnam asked the Premier, and Minister for Redfern Waterloo—

Given your advice six regionally-based Renewable Energy Coordinators have been appointed by the Government (Question 10611) to work side-by-side with renewable energy investors to assist the development of projects from concept stage to commissioning and generation (Question 8702):(1) How many projects are currently in development as a result of Renewable Energy Coordinator

assistance?(2) Aside from building networks with key stakeholders in their respective communities, in what ways

are the coordinators facilitating investment in renewable energy?(3) How often do the coordinators report back to the Government?Answer—I am advised:The State-wide Coordinator and six regionally-based Renewable Energy Coordinators are working closely with local communities, investors and wind industry representatives to encourage investment in

the renewable energy precincts. The Coordinators are assisting with the development of utility-scale wind farms, small-scale wind power installations and other commercial renewable energy projects. The Renewable Energy Coordinators have facilitated clean energy job forums in each renewable energy precinct. The Coordinators are also holding workshops for landholders on the practical aspects of hosting wind turbines, and have made numerous presentations to potential investors, industry development stakeholders, business chambers and local councils.The Department of Environment, Climate Change and Water employs the State-wide Coordinator and Renewable Energy Coordinators.

*11901AERIAL BEACH PATROLS—Mr Peter Debnam asked the Minister for Primary Industries, Minister for Emergency Services, and Minister for Rural Affairs—

Given the advice the NSW Government will seek Expressions of Interest from companies interested in conducting a trial of helicopter aerial surveillance for sharks (Question 8162), has the Minister engaged a permanent service to operate frequent aerial patrols during spring, summer and autumn 2010-2011?Answer—No, this is a limited trial of fixed wing aircraft and helicopters.

*11902SUICIDE PREVENTION AT THE GAP—Mr Peter Debnam asked the Premier, and Minister for Redfern Waterloo—

(1) Has the Government held discussions with Woollahra Council at any time in 2009 or 2010 concerning suicide prevention measures at Gap Park?

(2) If so, on which dates did the Government meet with representatives from Woollahra Council and what topics were discussed?

Answer—I am advised that Government agencies have met with Woollahra Council on a number of occasions in recent years to discuss suicide prevention issues. A meeting took place on 15 April 2010, for example, to discuss the operation of CCTV at the Gap.

Answer—I am advised:(1) and (4) In 1999, NSW Health introduced a Smoke Free Workplace Policy, which prohibits smoking

in all buildings, vehicles and property controlled by NSW Health. The Policy at both Gosford and Wyong Hospitals is no smoking on hospital property, including the hospital foyers and there are no exemptions by the local implementation committee.

(2) and (3) Current records indicate that in the last two years there have been three written complaints from the public at Wyong Hospital, and 14 complaints recorded at Gosford Hospital. The most recent compliance check was conducted at Gosford and Wyong Hospitals in November 2009 and a further count is scheduled for December 2010.

*11909ILLEGAL DUMPING—Mr Chris Hartcher asked the Minister for Climate Change and the Environment, and Minister Assisting the Minister for Health (Cancer)—

With regard to the recent prosecutions of illegal dumpers (Central Coast Express Advocate - 2 July 2010) by the Environmental Protection Authority in the Land and Environment Court:(1) How many "Specialist Waste Investigators" are located in the following electorates:

(a) Terrigal;(b) The Entrance;(c) Wyong;(d) Gosford?

(2) How many site inspections have been carried out by the "Specialist Waste Investigators" in the electorates of: (a) Terrigal;(b) The Entrance;(c) Wyong;(d) Gosford?

(3) As a result of these site inspections by the specialist waste investigators, how many prosecutions were instigated against offenders in the electorates of: (a) Terrigal;(b) The Entrance;(c) Wyong;(d) Gosford?

I am advised as follows:(1) The Department of Environment, Climate Change and Water (DECCW) does not employ 'specialist

waste investigators'. Four Waste Operations Officers based in Newcastle service the electorates of Terrigal, The Entrance, Wyong and Gosford. DECCW also has 10 officers working across NSW that provide specialised investigation services to these areas as required.

(2) 20 site inspections investigating illegal dumping reports have been conducted since January 2009 by Waste Operations Officers across the electorates of Terrigal, The Entrance, Wyong and Gosford.

(3) From January 2009 to date: (a) Nil.(b) Nil.(c) One.(d) Nil.

(4) Nil. An Eyes in the Sky Campaign was conducted in 2006 (Wollongong, Sydney and Hunter) and one in 2008 (Hawkesbury and Gosford). Campaigns were also conducted in the Great Lakes Council area in June 2010, and the Clarence Valley and Port Macquarie Hastings Council areas in August 2010.

(5) Regarding DECCW's Waste Operations Officers, yes.

*11910REDFERN-WATERLOO HERITAGE TASKFORCE—Mr Brad Hazzard asked the Premier, and Minister for Redfern Waterloo—

Noting at the meeting on 8 December 2009 of the Redfern-Waterloo Heritage Taskforce, heritage groups expressed concern there was no representative from the non-Government aligned heritage groups included in the appointees to the taskforce, will the Government appoint such a non-Government representative?Answer—I am advised:The Redfern-Waterloo Heritage Taskforce has resolved to appoint Mr Peter Phillips, recent former Chairman of the International Council on Monuments and Sites to the Taskforce.

*11911INDEPENDENT HERITAGE REPRESENTATIVE—Mr Brad Hazzard asked the Premier, and Minister for Redfern Waterloo—

(1) Are you aware that three major heritage stakeholders in Eveleigh, namely 3801 Limited, Friends of Eveleigh and WROUGHT Artworks unanimously recommended Mr G Gouvernour be elected as the independent heritage representative on the Redfern-Waterloo Heritage Taskforce (RWHT)?

(2) With respect to the fact that the appointed nominee of these three major heritage stakeholders 3801 Limited, Friends of Eveleigh and WROUGHT Artworks was rejected by the RWHT on 16 March 2010, will you cause the issue to be reconsidered.

Answer—I am advised:The Redfern-Waterloo Heritage Taskforce has resolved to appoint Mr Peter Phillips, recent former Chairman of the International Council on Monuments and Sites to the Taskforce.

What is your response to the Friends of Eveleigh who have indicated that the local community, the volunteers and the heritage community have doubts about having any faith or trust in the decision of the Redfern-Waterloo Heritage Taskforce and the Redfern-Waterloo Authority following rejection of their nominee?Answer—I am advised:The Redfern-Waterloo Heritage Taskforce has resolved to appoint Mr Peter Phillips, recent former Chairman of the International Council on Monuments and Sites to the Taskforce.

(1) On how many occasions has the Department of Environment, Climate Change and Water (DECCW), or its predecessors, investigated Forests NSW for breaching licence conditions, logging old-growth forests, inaccurate surveys or damaging endangered species habitat during: (a) 2005;(b) 2006;(c) 2007;(d) 2008;(e) 2009;(f) to date in 2010?

(2) By year, how many of the above occasions were reported by third party groups and how many were reported by officers of DECCW or its predecessors?

(3) By year, how many of these investigations were proved?(4) By year, how many of these proved offences resulted in financial penalties for Forests NSW?(5) By year, what is the total of the financial penalties that has been paid by Forests NSW?Answer—I am advised as follows:(1) The Department of Environment, Climate Change and Water (DECCW) regularly audits Forests NSW logging operations, and has conducted 66 audits in NSW Forest Agreement regions over the six years from 2005 to 2010. These include proactive audits to monitor Forests NSW compliance against key environment protection and biodiversity requirements, as well as audits to investigate allegations received from the community. Not all of DECCW's audits involve investigating alleged licence breaches. DECCW records compliance information on a financial year basis. The number of audits undertaken annually by DECCW, between 2005-06 and 2009-10, including both proactive and reactive audits, was:

Where appropriate, DECCW also requires Forests NSW to monitor and provide regular reports on the success of remedial action taken. Financial penalties were included in all penalty notices issued to Forests NSW, as detailed in the answer to Question (3).

and viability. Housing NSW sells a very small number of properties each year. Independent market valuations are used to set prices for disposal. All proceeds from the sale of properties are re-invested into providing housing assistance.

(2) For example, Housing NSW sells homes to help breakdown the concentration of social housing in an area and homes that are uneconomical to maintain or repair.

(3) If Housing NSW is proposing to sell a property, it works with the tenant under its Relocation of Tenants for Management Purposes policy and carefully considers the individual circumstances of the tenant who is asked to relocate. A copy of the policy is located on the Housing NSW website.

(4) Housing NSW's Sale of Homes policy is located on its website. (5) Remaining sales were either vacant land or properties vacated and sold on the open market via

auction.

(1) Why hasn't construction started on the Batemans Bay marina?(2) (a) Was there a time requirement within which the successful tenderer for the marina had to have the

work completed?(b) If so, what is that date?

(3) Will the Government address the current problems besetting the bar?(4) Will the Government dredge the bar to ensure the marina is workable?Answer—(1) The successful tenderer for this project, Ariadne Pty Ltd, has found it necessary to review the

commencement and staging of its development program for the marina in light of the global financial crisis. Discussions between representatives of Ariadne and the Land and Property Management Authority (LPMA) on the matter are ongoing.

(2) (a) and (b) Yes. However for the reasons provided above the LPMA has accepted that the project completion date warrants review. In that regard Ariadne has sought approval to amend the staging of the project, which upon granting will require an amendment to the Lease between the parties to reflect revised delivery dates. It is expected that negotiations will be finalised in the near future.

(3) Yes. NSW Maritime regularly monitors conditions over the Batemans Bay bar for safe navigation. Officers from LPMA regularly seek updates from NSW Maritime concerning trends or changes in bar conditions.

(4) Yes. It should be noted that responsibility for the management and implementation of dredging programs in NSW estuaries rests with the relevant Local Government Council. In August 2010 I announced a second round of funding was on offer to Councils under the LPMA's Waterways Program on a 50:50 basis to carry out maintenance dredging to improve navigation for recreational boating. Eurobodalla Shire Council has been contacted in writing and invited to submit an application for funding.

(1) Have you held meetings with members of the Rural Fire Services in which concerns have been expressed about the cost of equipment?

(2) Are you aware of instances where the costs of equipping local brigades, through the Rural Fire Service, were far more expensive than using local suppliers?

Answer—I meet with many hundreds of RFS volunteers and talk with them about a range of issues, I don't recall having specific examples raised with me about cost comparison of particular items.I am though pleased to note the consistent feedback I get from the vast majority of volunteers who note the massive improvement in equipment availability and quality since this Government has been in office.The NSW RFS is committed to ensuring that it obtains the quality equipment needed for operations across New South Wales, for a price that represents value for money. Given the policy of the Government to sell State owned electricity retail companies such as Country Energy:(1) Why are Country Energy sales staff telling companies, which are large employers and power users,

that as Country Energy is severely reducing its maintenance staff, the company will have to take responsibility for all the electricity poles and transmission lines on its property and that they are also required to train staff in high voltage electricity to maintain these lines?

(2) As a result of these cutbacks, will Country Energy have no maintenance staff available in Cowra, and will a maintenance service from Bathurst only be on the basis of "when they are available"?

Answer—(1) Under the NSW Government's Energy Reform Strategy, the NSW Government is maintaining

ownership of the transmission and distribution networks (the poles and wires). I am advised by Country Energy that:Customers who are connected directly to high voltage electricity networks in both metropolitan and regional areas of NSW and are supplied power under a high voltage tariff have been responsible for maintenance of their high voltage infrastructure for many years. This is in line with Section 7.5.10 of the NSW Service and Installation Rules, which states that "The customer must maintain the high voltage installation to ensure the electrical equipment is always in sound operating condition." The Rules also document the requirement for these customers to train staff in carrying out this work. These responsibilities are also contained in Country Energy's Standard Form Customer Connection Contract.Country Energy has also commenced a significant network management plan that will see an investment of almost $4 billion from 2009 to 2014 to secure essential energy services across rural and regional NSW and recruit 300 new apprentices to strengthen the skilled workforce it needs to build and maintain its networks.While Country Energy has, in the past, contracted to provide high voltage customers with maintenance and switching services, all of its available resources are currently committed to completing this extensive network upgrade program.

(2) High voltage customers can choose either to have their own staff trained and accredited in network operation and maintenance, or engage a suitably qualified service provider. Country Energy is no longer the only company able to undertake network operation and maintenance. Country Energy can provide switching services until high voltage customers decide either to train their own staff or formally contract Country Energy or another Accredited Service Provider.

Answer—(1) On 2 July 2010 the National Management Group agreed to a national cost-shared Interim response

plan prepared by NSW. NSW is implementing the Interim Response Plan which involves delimiting the extent of the incursion, quarantining every property where rust has been detected, treating with fungicides and removing infected plants. Follow-up work on all infected premises involves regular inspections and fungicide applications.Any decisions on the likelihood of eradication or of the need for an ongoing management plan will be made nationally.

(2) Yes.Quarantine orders are issued under the Plant Diseases Act 1924 by inspectors authorised under the Act

(3) Not applicable.The response is being managed under the 'Government and Plant Industry Cost Sharing Deed in respect of Emergency Plant Pests' of which all Australian jurisdictions and many industries are signatories. The Deed addresses questions of cost-sharing and compensation for Affected Parties.

(4) Yes.Extensive surveillance and tracing has been undertaken by the operational response teams. Tracing has included private residences of workers at known infected premises.

Information relating to children and young people in out-of-home care is available in the Annual Statistical Reports and Quarterly Statistical reports which can be accessed at www.community.nsw.gov.au(5) The roles and responsibilities of Non-Government Organisations are set out in the Service Agreement Service Specifications and Service Provision Guidelines. Out-of Home Care Service Providers are required to work with the NSW Children's Guardian to meet NSW standards for out of home care through accreditation and quality improvement program (6) The needs of individual children and young people are assessed as part of the ongoing process of case management undertaken by caseworkers in Community Services. When a child or young person enters out-of-home care, the focus of the assessment will be on the type of placement, services and supports required to meet the needs of that child or young person and this is reflected in the case plan.

charges?(4) What plans does the Government have to expand the tariff to more households?Answer—(1) and (2) Standard retailers and distributors are required to report on the number of customers they supply under particular tariff structures as part of their annual pricing submissions to the Independent Pricing and Regulatory Tribunal (IPART) (in the case of standard retailers) and the Australian Energy Regulator (AER) (in the case of distributors). The annual pricing submissions to IPART are not published. The annual pricing submissions to the AER are available at www.aer.gov.au. EnergyAustralia advises around 84 per cent of its network customers in the Sydney local government area are on an inclining block tariff.(3) and (4) Under section 29 of the Electricity Supply Act 1995, distributors have the discretion to determine the type of meter installed at a customer's premises. Answer—(1) The review has commenced.(2) The review will consider the sustainability standard that is part of the legislation and which includes

an assessment of the impact on food security. The impacts of the Manildra ethanol expansion were assessed by the Department of Planning in 2008. The Department was satisfied that the project would not significantly affect food production and supply.Flour processed by Manildra at Nowra yields gluten and starch for food and industrial products before the residual starch is processed into ethanol, so the statement that flour is diverted to ethanol production is simplistic and misleading. Ethanol is just one of many products of an integrated manufacturing operation.The September 2009 Supreme Court case Manildra Laboratories v Campbell actually demonstrates that when Manildra diverted its flour from export to use as a feedstock at its integrated manufacturing operation, another flour miller was quick to step in to replace it in the Indonesian market. The end result was more value-adding processing of grain in regional NSW, more jobs and more sustainable communities.

(3) The NSW biofuel policies have no significant affect on global food prices and therefore have no impact on the price and availability of food in poorer nations.

The VRA State Executive determines the distribution of funds to its units around the State.On March 19, 2008, the President of the NSW VRA informed the State Rescue Board that as at 8am on that date, the VRA Penrith Rescue Squad would "cease primary and secondary rescue response due to a lack of available volunteers".
