AND TO MAKE MINOR AND ADMINISTRATIVE AMENDMENTS TO PLANNING SCHEME POLICIES PURSUANT TO STEP 5 OF STAGE 3

OF PART 3.3.2 OF THE GUIDELINE

At its meeting on 30 August 2016, Council adopted minorand administrative amendments to Brisbane City Plan 2014.The amendments apply city-wide and will commence on9 September 2016.

Purpose and General EffectThe amendments are intended to:

• Correct typographical errors, mapping errors and removeredundant and out-dated terms;

• Improve the presentation of the Heritage overlay;• Reflect current development approvals;• Align the planning scheme with the State Planning Policy;• Reflect current Council policies and standards; and• Reflect the most up-to-date flood information available for

creeks/waterways.

Commissions of Inquiry Act 1950

COMMISSIONS OF INQUIRY ORDER (No. 1) 2016

1. Short titleThis Order in Council may be cited as the Commissions ofInquiry Order (No. 1) 2016 .

2. CommencementThis Order in Council commences on 9 September 2016.

3. Appointment The Governor in Council hereby appoints Kathryn McMillan QCand Professor Megan Davis to conduct in an independentmanner an inquiry into—

(a) the operations of the Cleveland Youth Detention Centreand the Brisbane Youth Detention Centre with respect tothe following matters—

(i) a review of the specific allegations of themistreatment of young people made by formerstaff members and young people (formerly inyouth detention in Queensland) in:

(A) the Australian Broadcasting Corporation’s 7:30and Lateline programs broadcast on Thursday18 August 2016; and

(B) other public commentary (including the reportby Amnesty International) in relation to thoseallegations;

(ii) a review of the policies and practices currentlyoperating within Queensland’s youth detentioncentres in relation to the use of force, separation,restraints, reporting, monitoring, and complaint andinvestigation mechanisms for alleged incidents;

(iii) a review of the effectiveness of existing oversightmechanisms which operate in respect of theallegations referred to in paragraph 3(a)(i);

(iv) with respect to incidents reported under any ofthe existing oversight mechanisms referred to inparagraph 3(a)(iii) since 1 January 2011 (reportedincidents ), a review of any specific allegations thatthe reported incidents were not appropriatelyinvestigated or that any action taken as a result ofthe investigation failed to address the mistreatmentof young people in detention in Queensland;

(v) a review of the effectiveness of current programsand services delivered in Queensland’s youthdetention centres that relate to assisting youngpeople to address the causational issues behindtheir offending behaviour; and

(vi) a review of the current cultural programs and servicesdelivered in Queensland’s youth detention centresand their effectiveness in addressing the specificneeds of Aboriginal and Torres Strait Islander youngpeople in youth detention; and

(b) the operations of Queensland prisons with respect tothe following matters—

(i) a review of the specific allegations of themistreatment of a 17-year-old prisoner in theBrisbane Correctional Centre made in a report inThe Courier-Mail on 29 August 2016; and

(ii) a review of the policies and practices currentlyoperating for 17-year-old prisoners within prisonsin relation to the use of force, separation,restraints, reporting, monitoring, and complaint andinvestigation mechanisms for alleged incidents.

4. Chairperson

For the purposes of the Commissions of Inquiry Act 1950the chairperson of the inquiry shall be:

(a) Ms McMillan; or

(b) whenever Ms McMillan is absent from duty or unable forany other reason to perform the duties of chairperson—Prof Davis.

5. Procedure

The persons appointed to conduct the inquiry—

(a) may receive any document or other material relevant tothe terms of reference that they consider appropriate;

(b) may conduct interviews with any person who hasinformation relevant to the terms of reference either withthe person’s consent or pursuant to a requirement undersection 5 of the Commissions of Inquiry Act 1950;

(c) may not conduct public hearings; and

(d) may conduct their proceedings using any technology thatallows reasonably contemporaneous and continuouscommunication.

6. Report

(1) The persons appointed to conduct the inquiry shall makefull and faithful report on the terms of reference andtransmit it to the Honourable the Attorney-General andMinister for Justice and Minister for Training and Skills by30 November 2016.

(2) The report should include any recommendations aboutthe matters within the terms of reference.

(3) In making any recommendations, the following mattersshould be considered—

(a) whether the mistreatment of young people in youthdetention centres is systemic in Queensland;

(b) a comparative assessment of the current policies,practices and programs relating to the terms ofreference, delivered in youth detention centres inQueensland and other Australian jurisdictions;

(c) whether there are any issues with respect to thematters within the terms of reference that are ofspecific relevance to Aboriginal and Torres StraitIslander young people;

(d) any interim measure that should be implementedprior to the transition of 17-year-olds from prisonsto youth detention centres.

7. Application of Act

Pursuant to section 4(2) of the Commissions of Inquiry Act1950 , it is declared that the following provisions of thatAct apply for the purposes of the inquiry—

youth detention centre has the same meaning as in theYouth Justice Act 1992 .

NOTICE ABOUT CASTROL GOLD COAST 600 TEMPORARY WORKS AND UNATTENDED VEHICLES ON PUBLIC LAND

I, Kate Jones, Minister for Education and Minister for Tourism andMajor Events give notice that for the periods from Monday12 September 2016 until midday on Thursday 20 October 2016 andmidday on Monday 24 October 2016 until Saturday 12 November2016 the major event organiser for the Castrol Gold Coast 600(V8 Supercars Australia Pty Ltd ACN 077 053 484) intends toexercise its powers under section 16 of the Major Events Act 2014to carry out and maintain temporary works and carry out incidentalactivities on public land inside the areas surrounding McIntoshIsland Park in Surfers Paradise, the areas in the SouthportBroadwater Parklands, and 3332 Surfers Paradise Boulevard,Surfers Paradise as shown on the map prescribed under Schedule 2of the Major Events (Motor Racing Events) Regulation 2015.To enable temporary works and maintenance to be carried outduring the stated periods, vehicles left unattended on public land asshown on the prescribed map may be moved and dealt with inaccordance with the Major Events Act 2014 (including moving andstoring vehicles at owners’ expense).
