    We,HamadBenKhalifaAlThani,EmiroftheStateofQatar,HavingconsideredtheTemporaryAmendedBasicLaw,particularlyarticles(23),(34),(51),LawNo.(5)of1970determiningthepowersoftheministers,theministriesandtheothergovernmentalbodies,anditsamendments,PenalCodeofQatarissuedbyLawNo.(14)of1971,anditsamendments,PenalProcedureCodeissuedbyLawNo.(15)of1971,anditsamendments,CivilandCommercialLawissuedbyLawNo.(16)of1971,amendedbyLawNo.(10)of1982,LawNo.(2)of1983concerningthepracticeofhumanmedicineanddentistry,CivilandCommercialProcedureCodeissuedbyLawNo.(13)of1990,amendedbyLawNo.(7)of1995,LawNo.(1)of1994concerningjuveniles,LawNo.(3)of1995abouttheregulationoftheprisons,LawNo.(10)of2002aboutthepublicprosecution,LawofJudicialAuthorityissuedbyLawNo.(10)of2003,Proposaloftheministerofjustice,DraftlawpresentedbytheCabinet,AndafterconsultingtheAdvisoryCouncil,Decidedthefollowinglaw:

    Article(1)ThePenalCodeannexedtothislawisapplicable.

    Article(2)ThePenalCodeofQatar issuedbyLawNo.(14)of1971mentionedabove isrepealed.

    Article(3)All the competent authoritieswithin its competency, shall carryout this law,whichshallbevalidinfteen days from its publication in the ofcial gazette.

    PART1-INTRODUCTORYPROVISIONS

    Article(1)Islamic Shariaprovisions concerning the following crimes are applicable if thesuspectorthevictimisaMuslim:

    1-Thecrimessuchastheft,adultery,defamation,drinkingalcoholandapos-tasy.2-Thecrimesofretaliationandthebloodmoney.Otherwise,thecrimesandthepunishmentsaredeterminedduetothislawandanyotherlaw.

    Article(2)Theprovisionsofpartoneofthislawareapplicableonthecrimesmentionedinanyotherlawifnotcontradictedwithanyothertext.

    Article(3)Inapplyingthislaw,publicemployeesarethosechargedtodothepublicauthor-ity,theemployeesandworkersintheministries,theothergovernmentalcorps,andpublicorganizationsandinstitutions.Publicemployeesare:

    1-Arbitrators,experts,receivers inbankruptcy, liquidators,andsequestra-tors.2-Boardofdirectorsheadsandmembers,managers,allotheremployeesinprivateinstitutionsandassociations,companiesandcooperativeassociations,ifoneoftheministriesoroneoftheothergovernmentalcorpsorpublicin-stitutionsororganizationsparticipateinit.3-Whoeverdoesanyworkconnectedwiththepublicserviceuponachargingfromapublicemployee.4-Headsandmembersofmunicipalandlegislativecouncils,andotherswhohavepublicparliamentarycapacitywhetherelectedorappointed.Thefunction,thework,ortheservicecanbetemporaryorpermanent,paidorunpaid,voluntaryorobligatory.The end of service or capacity doesnt prevent the application of this lawwhenthecrimeiscommittedduringtheserviceorwhenthecapacityisstillexisting.

    Article(4)Inapplyingthislaw,publicfundareallwhatisownedorsubjectpartiallyorto-tallytothecontrolandadministrationofthefollowingauthorities:

    1-Theministriesandtheothergovernmentalcorps.

  • 72-Thepublicinstitutionsandorganizations3-Theprivateinstitutionsandassociationsandthecooperativeassociations4-Thecompaniesifoneoftheministriesoroneoftheothergovernmentalcorpsoroneofthepublicorganizationsorinstitutionsparticipateinit.5-Anyotherauthoritywhosefundsareofpublicfundsaccordingtolaw.

    Article(5)Inapplyingthislaw,thepublicplaceistheplacewhereitisallowedtoenterandexistwithoutdistinction.

    Article(6)Inapplyingthislaw,thepublicmeansare:

    1-Sayingorshouting,orrepeatingitdirectlyorthroughoneofthemechanicmethods,or ifbroadcastedbyanothermeans inapublicgrouporapublicplace.2-Acts,signs,ormovementsifhappenedintheplacesmentionedinitem1ofthisarticle,orcanbeseenfromtheseplacesortransferredtothembyanymeans.4-Writings,drawings,photos,lms, cassettes, signs or others of means ofexpression,ifexposedorcanbeseenorheardbypersonsintheplacesmen-tionedinitem1ofthisarticle,ordistributedwithoutdistinctiononpeopleorsoldorexposedforsale.

    Article(7)TheperiodsandthedatesprovidedforinthislawarecountedaccordingtotheGregoriancalendar,withoutinfringinganyotherlaw.

    Article(8)Theprovisionsofthislawshallnotviolatebynomeantherightofretrieval,com-pensation,expendituresoranyotherrightofthelitigantsoranyotherperson.

    PART2-VALIDITYOFTHELAW

    Article(9)Theprevailinglawwhenthecrimeiscommittedshallbeapplied.Nevertheless,ifalawwasissuedaftercommittingthecrimeandbeforejudgingitabsolutely,anditwasbetterfortheaccused,itshallbeapplied.Iftheverdictbecamenal and another law that makes the act or abstention fromactnotsubjecttopenaltywasissued,theexecutionofthejudgmentwillstopanditspenaleffectswillend.

  • 8Ifthenewlawonlyextenuatesthepenalty,thecourtthatissuedthenal judg-ment,upontherequestofthepublicprosecutionortheconvicted,shallreviewthejudgedpenaltyaccordingtothenewlaw.

    Article(10)Asanexceptionofthepreviousarticle,ifalawissuedtoimposepunishmentforanactorabstentionfromanyactortoemphasizethedecidedpenalty,anditwastemporaryorduetoexceptionalandurgentconditions,theterminationofthedesignatedperiodortheendoftheurgentandexceptionalconditionsdoesntpreventfromling a penal suitcase for the crimes committed during it or duringtheexecutionofthejudgedpenaltyinvirtueofthislaw.

    Article(11)Thenewlawisapplicableonthecontinuous,successiveorhabitualcrimescom-mittedbeforeitseffectiveness,ifcommittedunderthislaw.

    Article(12)Ifanewlawwasissuedtoamendtheprovisionsofrecidivism,ormulti-crimes,theprovisionsofcondemnationissuedbeforeitsvalidityareapplicable.

    Article(13)TheprovisionsofthislawareapplicableonwhoevercommitsinQataracrimementionedinit.ThecrimeisconsideredcommittedinQatarifoneofitscon-stituentactswascommittedinQatar,oritsresultwasrealizedinQatar,oritwasmeanttoberealizedinQatar.

    Article(14)Theprovisionsofthislawareapplicableoncrimescommittedonboardofshipsandairplanesownedbythestateorcarryingitsag, or managed by it for anyreason,whereveritwas.

    Article(15)Inrespectingtheagreementsandconventionsinwhichthestateisaparty,theprovisionsofthislawarenotapplicableonthecrimescommittedonboardofforeignshipsandairplanesinorpassingthroughtheregionofthestateunlessittouchedthenationalsecurity,orthefelonortheguiltywasQatari,orthecap-tainorthepilotaskedhelpfromtheQatariauthority.

    Article(16)Theprovisionsofthislawareapplicableon:

    1-WhoevercommittedoutsideQataranactthatmakeshimacommitteroranaccompliceinacrimeoccurredtotallyorpartiallyinsideQatar.

  • 92-WhoevercommittedinsideQataranactthatmakeshimacommitteroranaccompliceinacrimeoccurredtotallyorpartiallyoutsideQatar,whenheispunishedforinvirtueofthislawandthelawinwhichitwascommitted.3-CommittedorparticipatedoutsideQatar inacrimeagainsttheinternalortheexternalnationalsecurity,orthecrimesoffalsication and imitationofofcial documents, seals, marks, or governmental stamps, or the falsica-tionandimitationofanypapercurrencyorcoinsinQatar,orpossessingorpromotingthesefalseorimitatedcurrencies.

    Article(17)Theprovisionsof this lawareapplicableonwhoeverexists in the stateaftercommittingabroad,asacommitteroranaccomplice,anyofthecrimesoftradingofdrugsorpersonsorthecrimesofpiracyorinternationalterrorism.

    Article(18)EachQataricommitsoutsideQataranactthatisconsideredafelonyoramis-demeanoraccordingtothislaw,andtheactwassubjecttopunishmentinvirtueofthelawinthestatewhereitwascommitted,heshallbepunishedupontheprovisionsofthislawifhereturnstoQatar.

    Article(19)ThecommitterofacrimeoutsideQatarisnotsubjecttopenalsuitcaseifitwasprovedthattheforeigncourtshasissuedanal acquittal or condemnation andhemethispenaltyoritwascancelled,orthesuitcasewasterminated.Iftheacquittalissuedinoneofthecrimesprovidedforinitem3ofarticle16ofthelaw,basedonthefactthatthelawofthestatewherethecrimeiscommit-teddoesntimposeapenaltyforit,thepenalsuitcasecanbeled in front of thecourtsinQatar.

    Article(20)WhoeverreachesthesevenyearsoldanddoesntreachthesixteenyearsoldissubjecttotheprovisionsprovidedforinthelawofJuveniles.Ajuvenilewhodoesntreachtheeighteenyearsoldwhilecommittingthecrimeisnotsubjecttodeathsentence.

    PART3-THECRIMECHAPTER1-KINDSOFCRIMES

    Article(21)Thecrimesarethreekinds:thefelonies,themisdemeanors,andthecontraven-tions.Thekindofthecrimeisdesignateduponthemaximumlimitofthepenaltypro-videdforinlaw.

    Article(22)Thefeloniesarethecrimespunishedbysentencetodeath,lifeimprisonment,orimprisonmentformorethanthreeyear.Theimprisonmentinfeloniesshallnotbelessthanthreeyears,withoutinfring-inganyotherlaw.

    Article(23)Themisdemeanorsarethecrimespunishedbyimprisonmentfornomorethanthreeyearsandbyne of no more than one thousand riyals, or by one of the twopenalties,withoutinfringinganyotherlaw.

    Article(24)Thecontraventionsarethecrimespunishedbyane of no more than one thou-sandriyals.

    Article(25)Thekindofcrimedoesntchangeifthecourtreplacedthepenaltyimposedforitbyanotherextenuatedpenalty,whetherforlegalexcusesorforextenuatingconditions,withoutinfringinganyotherlaw.

    CHAPTER2-ELEMENTSOFTHECRIMEFIRST:MATERIALELEMENT

    1-THECOMPLETECRIME

    Article(26)Thematerialelementofthecrimeisthecriminalactivity,whichisdoinganactor abstention fromdoing an actwhere the doingor the abstention is legallyconsideredacrime.

    Article(27)Oneisnotaskedforacrimeifitisnotaresultofhiscriminalactivity,butheisaskedforthecrimethatisaresultofhiscriminalactivityalthoughanotherprevi-ous,current,or laterreasonparticipate incausing it,wheneverthisreasonisexpectedorpossible.Whereasifthereasonissufcient alone to cause the result of the crime, one inthiscaseisaskedonlyfortheactcommitted.

    2-THEATTEMPTS

    Article(28)Theattemptistostartdoinganactwiththeintentiontocommitafelonyoramisdemeanor,thentheactwasstoppedforareasonnotconnectedwiththewillofthecommitter.Theintentiontocommitafelonyoramisdemeanororthepreparationforitisnotconsideredanattempt,withoutinfringinganyotherlaw.

    Article(29)Theattempttocommitafelonyispunishedbythefollowingpenalties,withoutinfringinganyotherlaw:

    1-Lifeimprisonment,ifthepenaltyofthefelonyisdeathsentence.2-Imprisonmentfornomorethanfteen years and not less than ve years, ifthepenaltyofthefelonyislifeimprisonment.3- Imprisonment fornomorethanhalf themaximumlimitdecided forthecompletefelony,ifthepenaltyofthefelonyisimprisonment.

    Article(30)Thelawshalldesignatethemisdemeanorswhoseattemptsaresubjecttopen-alty,andthepenaltyofthisattempt.

    Article(31)Theattempt is subject to theprovisionsof the sub-penaltiesdecided for thecompletecrime.

    SECOND:MORALELEMENT

    Article(32)Themoralelementofthecrimeconsistsoftheintentandtheerror.Theintentisthewillofthecommittertocommitanactorabstainfromanact,inordertoproducetheresultthatissubjecttopenalty.Theerrorisavailablewhentheresultonwhichthelawimposepenaltyhappens

    becauseofthefaultofthecommitter,whetherthiserrorwasduetonegligence,carelessness,incaution,rashness,ornoncomplyingwiththelawofthelists.Thecommittershallbeaskedforthecrimewhethercommittedonpurposeorbyerror,ifthelawdidntstipulatetheintentopenly.

    Article(33)Goingbeyondthepenalintentisrealizedwhenthewillofthecriminalistopro-ducearesultlessseverethanthatproducedandwhichhedidntintent.

    Article(34)Theignoranceoflawisnotanexcuse.

    Article(35)Theincentivetocommitacrimeisnotconsidered,withoutinfringinganyotherlaw.

    Article(36)If theact iscommittedunder theeffectofmistake in fact, the liabilityof thecommittershallbedeterminedonthebasisoffactsthathethoughttheyexist,iftheyweretonegateoreasehis liability,providedthathisbelief isbasedonreasonablereasons.If themistake thatmakes thecommitterbelievehisnon-liability isdue tohisnegligenceorincaution,heshallbeaskedforanunintentionalcrime,ifthelawpunishesforthisactasanunintentionalcrime.

    Article(37)Exceptfortheministries,theothergovernmentalcorps,andthepublicorganiza-tionsandinstitutions,thelegalpersonisapenalliableforthecrimescommit-tedbyhisrepresentative,managers,andagentsforhimorinhisname,anditsnotallowedtojudgehimwithotherthanane, and what is convenient of thesub-penaltiesdecidedbylaw;ifthelawdecidesforthecrimeanoriginalpenaltydifferentfromthene, the penalty shall be limited to the ne whose maximumlimitisve hundred thousand Riyals.Thisdoesntpreventfrompunishingthecommitterpersonallywiththepenaltydecidedbylaw.

    CHAPTER3-PENALPARTICIPATION

    Article(38)Acommitterofthecrimeistheonewho:

    1-Committeditsolelyorwithanother.2-Didonpurposeanactoftheconstituentactsofthecrime,ifisconsistsofseveralacts.3-Didactstoassistthecommitmentofthecrimeandwaspresentduringitsexecution.4-Usedotherpersonby anymeans toexecute the constituent actof thecrime,andthelattershallbeconsiderednon-liableforanyreason.

    Article(39)Aparticipantinthecrimeistheonewho:

    1-Promptedanotherpersontocommittheconstituentact, ifthisacthap-penedduetothisprompting.2-Agreedwithanotherpersontocommitit,andithappenedaccordingtothisagreement.3-Gavethecommitteraweapon,machines,oranythingelseusedincommit-tingthecrimewithhisknowledge,orhelpedhimbyanyotherwaywiththeworksthatprepared,eased,orcompleteditscommitment.

    Article(40)Whoeverparticipatesinacrimeshallbepunishedwithitspenalty,withoutin-fringinganyotherlaw.

    Article(41)Ifoneoftheparticipantswasunpunishedforanycauseofnon-responsibility,orforthelackofthepenalintentorforotherprivateconditions,theotherpartici-pantsshallnotbenet from this.

    Article(42)Ifthematerialconditionswereavailableinthecrime,itshallaggravateorextenu-atethepenalty,anditshallbeapplicableonwhoeverparticipatedinitscommit-ment,whetherhewasacommitteroranaccomplice,whetherknewordidntknowaboutit.Ifthecommitterhadsomeprivateconditionsthatrequirethechangingofthecrimedescription,theyshallnotbeapplicableonotherthantheonerelatedto,unlessheknewaboutthem.Concerningtheotherconditions,theireffectshallnotexceedtheonetowhichtheyarerelated,whethertheywereaggravatedorextenuated.

    Article(43)Ifaparticipant,whetheracommitteroranaccomplice,hadpersonalexcusesrelievingfromthepenaltyorextenuatingit,theeffectofthesepersonalexcusesshallnotexceedthisparticipant.Thematerial excuses that relieve frompenaltyor extenuate it are applicableonwhoeverparticipatesinacrime,whetherhewasacommitteroranaccom-plice.

    Article(44)If thedescriptionof thecrimeor thepenaltywaschanged inconsidering theintentofthecommitterorhisknowledgeofitsconditions,eachparticipantinthecrime,whetheracommitteroranaccompliceshallbepunishedaccordingtohisintentorknowledge.

    Article(45)Aparticipant inacrime,whetheracommitteroranaccompliceshallbepun-ishedwiththepenaltyofthecrimecommittedeventhoughitwasnottheonehe intendedtocommit,whenthecrimecommitted isapossibleresultoftheparticipantsacts.

    Article(46)1- If twoormorepersonsagreedtocommita felonyoramisdemeanor,andpreparedforitinawaythattheywontchangetheirmind,eachshallbeconsid-eredliableforapenalagreement,evenifthecrime,subjectofagreementwasnotcommitted.2-Thepenaltyofthepenalagreementisanimprisonmentofve years at most,ifthepenaltyofthecrime,subjectofagreementisdeathsentenceorlifeimpris-onment.Ifthepenaltyofthecrimewaslessthanthat,thepenaltyofthepenalagreementshallbeanimprisonmentofatmostone-thirdtheperiodofimprisonmentde-cidedforthecrime,orthene whose value is no more than one third of the nedecided,withoutinfringinganyotherlaw.Ifoneofthecriminalsinformsthecompetentauthoritiesaboutthepenalagree-mentandtheparticipantsinitbeforecommittingthefelonyorthemisdemeanor,andbeforeinvestigatingthecriminalsbythisauthority,heshallberelievedfromthepenaltiesdecidedinthisarticle.Iftheinformingtookplaceafterinvestigatingthecriminals,heshallnotberelievedfrompenaltyunlessthisinformingreallyleadtoseizeanyofthecriminals.

    PART4-CAUSESOFNON-RESPONSIBILITY

    Article(47)Thereisnocrimeiftheactwasdoneingoodfaith,inusingarightdecidedbylaworIslamicSharia,withinthisright.Thefollowingareconsideredusageofright:

    1- Practicingmedicalworkswhen it is according to the common scienticprinciplesinthelegalizedmedicalprofessions,withtheconsentofthepatientorhis representative,expresslyor implicitly,or if themedical interferencewasnecessaryinurgentcases,orthepatientwasinaconditionthatdoesntpermithimtoexpresshiswillor itwasdifcult in the appropriate time tohavetheconsentofhisrepresentative.2- Violence donewhile practicing sportswithin the limits decided for thegame,incomplyingwiththerulesofcaution.3-Violencepracticedonthecommitterwhilecommittinghiscrimenecessaryenoughtoseizehim.4-Theappealofthepartiesagainsteachotherduringthewrittenorverbaldefenseinfrontoftheinvestigatingauthoritiesorthecourtswithinthelimitsthatthisdefenserequires.

    Article(48)Thereisnocrimeifapublicemployeemadetheactinanyofthefol-lowingcases:

    1-Executingtheorderofachiefthathemustobey,orhethoughtitwashisdutytodoso.2-Executingthelaw,orthinkingingoodfaiththatitshisdutytoexecuteit.Inallcases,theemployeemustprovethathedidntcommittheactuntilhein-vestigatedaboutitandbelievedthatitslegalaccordingtoreasonablecauses.

    Article(49)Thereisnocrimeiftheactwasdoneinusingtherightoflegaldefense.Therightoflegaldefenseexistswhenthefollowingconditionsareavailable:

    1- If the defendant faced danger that threatens him, hismoney or othersselformoney,orbelievedthatthisdangerexistedaccordingtoreasonablecauses.2-Ifthedefendantwasunabletorefertothepublicauthorityattheappropri-atetimetoavoiddanger.3-Ifthedefendanthadnootherwaytopushawaythedanger.4-Iftheactwasnecessarytopushawaytheattackandproportionatetoit.

    Article(50)Therightoflegaldefensedoesntallowthekillingonpurpose,unlessmeanttopushawayonethefollowing:

    1-Anactthatmaycausedeathorsevereinjuries,ifthisfearwasduetorea-sonablecauses.2- Sexual intercoursewith a female by force, or disgracing any person byforce.3-Kidnappingaperson.4-Enteringaninhabitedhouseoroneofitsannexesbynight.

    Article(51)Ifthepersonsurpassesingoodfaiththelimitsoflegaldefense,usingpowermorethanthatusedbyanormalpersoninthissituation,withoutintendingtocauseharmmorethanthatrequiredfordefense,thejudge,iftheactwasafelony,mayexcusethepersonandjudgeonhimwiththepenaltyofmisdemeanorinplaceofthepenaltydecidedinlaw,andconsiderthisanextenuatingconditioniftheactwasamisdemeanor.

    Article(52)Thecaseoflegaldefense,evenifthepersonagainstwhomthisrightisusedwaspenal irresponsible, is foundaccordingtotheprovisionsoftherestrainsof li-abilitydecidedbylaw.

    PART5-IRRESPONSIBILITYOFCRIMES

    Article(53)Ifajuvenileisundersevenyearoldwhencommittingthecrime,heshallnotbeconsideredresponsiblefromapenalpointofview.Theproceduresprovidedforinthelawofjuvenilesconcerningthecommitterofafelonyoramisdemeanorwhoreachedthesevenyearoldbutnotthefourteenyearoldshallbeapplied.

    Article(54)Ifapersoncommitsacrimewhileheisunconsciousorincapacitatedduetocra-zinessormentaldefectorcomaresultingfrommedicines,drugsoralcoholicma-terialsofwhateverkind,giventohimagainsthiswillorhetookwithoutknowingorforanyotherreasonthatthesciencedeclaresitisacauseforunconscious-nessorincapacity,heshallnotbeconsideredresponsiblefromapenalpointofview.Ifcraziness,mentaldefect,medicines,drugs,alcoholicmaterials,orotherreason

    causesonlydeciency or weakness in consciousness or in capacity when thecrimeiscommitted,itshallbeconsideredanextenuatingexcuse.Ifthecommittercauseswillfullythelossordeciency or weakness of consciousbytakingdrugoralcoholicmedicines,heshallbepunishedforthecrimecommit-tedevenifitrequiresspecialpenalintent.

    Article(55)Heshallbeconsideredresponsiblefromapenalpointofview:

    1-Whoeverisunabletochooseatthetimeofcommittingthecrime,forareasonagainsthiswill.2-Whoevercommitsanacttoprotecthimselforotherpersonfromanex-treme danger about to occur and hurt the soul or themoney and itwasagainsthiswill.

    Inbothcases,itisprovidedthatthecommitterisnotabletopushthedangerawaybyanothermeans,andtheactcommittedmustbeequivalenttothedanger.

    Article(56)Whoevercommitsacrimewhosedamageorpossibledamageissonegligibleinawaythatanormalpersonwontcomplainfrom,shallnotberesponsiblefromapenalpointofview.

    PART6-PENALTIESCHAPTER1-ORIGINALPENALTIES

    Article(57)Theoriginalpenaltiesare:

    1-Deathsentence2-Lifeimprisonment3-Temporaryimprisonment4-Fine

    Article(58)Thedeath sentence shall not be executedunless after the legalizationof theEmir.

    Article(59)Deathsentenceisexecutedbyhangingorring till death.

    Article(60)Imprisonmentisputtingtheconvictedinoneofthepenaltyconstructionsspe-cializedforthispurposebylaw,for lifetimeif itwaslife imprisonment,ortheperiodsentencedifitwastemporary.

    Article(61)Thecourtcanlinkimprisonmentwithhardlabor,iftheperiodofimprisonmentwassixyearsormore,andthecrimeorthecircumstancesinwhichitwascom-mittedjustifythis.

    Article(67)If theconvicted,condemned toacriminalpenaltyenjoys,when the judgmentbecomesenforceable,oneoftherightsprovidedbythepreviousarticle,heshallbeprohibitedthereofimmediately.Ifhedoesnotenjoysuchrights,helosesthecapacityofenjoyingthereof.

    Article(68)Inanyjudgmentbearingacriminalpenaltyagainstapersonexercisingaliberalprofessionorganizedby the lawwith its exercise requiring theobtainingof alicense, foranoffenceperpetratedduringtheexerciseoftheactivitiesofsaidprofessionorcausedbyitandincludingviolationoftheobligationssetbythelawortheconventionalethicsoftheprofession,thejudgemaydecidetoprohibittheconvictedfromexercisingsaidprofessionforaperiodnotexceedingtenyears.Ifthejudgmentbearsimprisonmentforaperiodexceedingsevenyears,thejudgeshalldecidetoprohibittheconvictedfromexercisingsaidprofessiontoaperiodequaltotheperiodofimprisonmentoftheconvicted.

    Article(70)Thecourt shall,when rendering a judgment against a publicofcer bearing amisdemeanorpenaltyinoneofthecrimesprovidedforinchaptersone,twoandthreeoftitlethreeofbooktwoofthepresentlaw,decidetocondemnhimtodismissalforaperiodnotlessthanoneyearandnotexceedingthreeyearsasfromthedateoftheaccomplishmentofthepenaltyoritsforfeiture.

    Article(71)Inadditiontothespecialcasesprovidedbythelawforlockout,thecourtshallordertolockouttheplaceorpublicestablishmentwheretheworkisexercised,inanyofthetwofollowingcases:

    1-Ifitdecidestheprohibitionfromtheexerciseoftheprofessionpursuanttoarticle(68)ofthepresentlaw,thelockoutshallbeforthesameperiodoftheprohibitionofexercise.2-Ifitdecidesofapenaltyfortheexerciseofacraftinapublicestablishmentwhichdoesnotfulll the terms required by the law, this leading to threatenthelifeofthepersons,theirhealthorsecurityortodisturbthem,thelockoutshalllastuntilsaidtermsarefullled.

    Article(72)AnyonewhoiscondemnedtoimprisonmentforaperiodexceedingsevenyearsforanoffenceagainsttheexteriororinteriorsecurityoftheState,inanoffenceofbribery,embezzlement,damageofthepublicfunds,forgeryofmoneyorgov-ernmentnancial bills, intentional re, possession of explosives or intentionalmurder,shallbeputbyvirtueofthelaw,afteraccomplishmentofhispenalty,un-derpolicecontrolforaperiodequivalenttothehalfoftheperiodofhispenalty,providedthatthepolicecontrolshallnetexceedve years.However,thecourtmaydecidetoreducetheperiodofcontrolorexemptthevictimthereof.

    Article(73)Everyjudgmentbearingcondemnationagainstarecidivistinanoffenceofforg-ery,theft,mistrust,fraudorhidingthingsresultingfromanoffenceoracom-mencementofoneofsaidoffencesmaybear,inadditiontothedecidedpenalty,puttingtheconvictedunderpolicecontrolforaperiodnotlessthanoneyearandnotexceedingtwoyears.

    Article(74)Eachpersonsubjecttopolicecontrolshallhavetocomplywiththefollowingterms:

    1-Informthepolicesectionintheareaofhisdomicileandanychangethereof;thepolicesectionmaynotapprovehisresidenceinsaidplaceiflocatedinthe

    regionwheretheoffencewasperpetrated;ifhehasnodomicile,thepolicesectionshalldetermineaplacewhereheshalllodge.2-Permanentlycarryacarddeliveredtohimbythepolicesectionofhisareabearingallthespecications about his personality and which he shall submittothepolicesectionuponanyrequest.3-Appearbeforethepolicesectioninhisareaonceaweek,atthetimesetonthecardandatanytimeheisassignedbythepolicesectiontodoso.4-Tobeathisdomicileat theperiodbetween the sunsetand the sunriseunlessheobtainsanauthorizationfromthepolicesectionallowinghimtobeabsentinsaidperiodorpartofit.

    Article(75)Thepenaltyofimprisonmentforaperiodnotexceedingoneyearandane notexceedingve thousand Riyal or one of these two penalties shall apply to anyonewhoinfringesanyofthecontroltermsprovidedbythepresentlaw.

    Article(76)Thecourtmay,whenpassingajudgmentinacrimeormisdemeanor,decidetoconscate the seized things resulting from the offence, used or might have beenusedthereinwithoutprejudicetotherightsofthirdpartiesofgoodfaith.Ifsaidthingsbelongtoacategory,whichmanufacture,use,possessionordealingwithisconsideredasoffenceinitself,ajudgmentbearingconscation shall be passedinallcircumstances,evenifsaidthingsdonotbelongtotheaccused.

    Article(77)Withoutprejudiceoftherightoftherelevantadministrativeauthoritiesinde-portinganyforeignerpursuanttothelaw,thecourtmay,whenitcondemnsaforeignertoapenaltyrestrictiveoflibertyinacrimeormisdemeanor,decidetodeporthimfromtheStateafteraccomplishmentofthepenalty.If the judgmentbearing thepenaltyprovided for in thepreviousparagraph isissued foranoffenceagainsthonorortrust, thecourtshalldecidetodeporttheforeignerfromtheStateaftertheaccomplishmentofthepenaltyoritsfor-feiture.

    Article(78)The courtmay, inmatters ofmisdemeanors, decide to deport the foreignerfromthecountry insteadofcondemninghimforthepenaltyprovidedforthemisdemeanor.

    CHAPTER3-SUSPENSIONOFTHEEXECUTIONOFTHEPENALTY

    Article(79)Thecourt,whenrenderingajudgmentforanoffencebearingimprisonmentforaperiodnotexceedingoneyearorane, may order the suspension of the execu-tionofthepenaltyifitconsidersthatthemoralsoftheconvicted,hispast,ageorthecircumstancesinwhichtheoffencewasperpetratedleadtobelievethatheshallnitperpetrateanotheroffence.Thecourtmaydecidethatthesuspensionoftheexecutionshallincludeanysub-sidiarypenaltyandallthecriminaleffectsexceptconscation.

    Article(80)Thesuspensionof theexecutionof thepenalty shall last threeyearsas fromthedaywhenthe judgmentbecomesdenitive. If said period elapses withoutrenderingajudgmentbearingannulmentofthesuspensionoftheexecution,thejudgmentbearingthepenaltyshallbeconsideredasinexistent.

    Article(81)Thesuspensionofexecutionmaybeannulledinthetwofollowingcases:1- Ifduringtheperiodofsuspension,athe judgmentbearing imprisonment isrenderedagainsttheconvictedformorethanthreemonthsinanintentionalof-fenceperpetratedduringsaidperiodorbeforeandthecourtdidnotknowaboutitwhenorderingthesuspensionofexecution.2-Ifitappearsthatajudgmentofimprisonmentforaperiodofmorethanthreemonthsinanintentionalcrimewasrenderedbeforeorderingthesuspensionofexecutionandthecourtdidnotknowaboutit.

    Article(82)Thecourtcompetentforannullingthesuspensionofexecutionisthecourtwhoorderedsuchsuspensionorthecourt,whichrenderedagainsttheconvictedajudgmentofimprisonmentduringtheperiodofsuspension.Thejudgmentbear-ingannulmentofthesuspensionshallberendereduponrequestofthegeneralprosecutionorthevictimafterassignationoftheconvictedtoappear.

    Article(83)Thejudgmentbearingannulmentofthesuspensionoftheexecutionofthepen-altyshallresultinitsexecution.

    CHAPTER4-PLURALITYOFOFFENCESANDPENALTIES

    Article(84)Ifoneactconstitutesapluralityofoffences,theoffencewiththemostseverepenaltyshallbetakenintoconsiderationanditspenaltyshallbeappliedattheexclusionofanyother.

    Article(85)Ifapluralityofoffencesisperpetratedforonepurposeboundtoeachotherinawaynotsubjecttodivision,theyshallbeconsideredasoneoffenceandajudg-mentbearingthemostseverepenaltyprovidedforanyofsuchoffencesshallberendered.

    Article(86)Thejudgmentbearingthemostseverepenaltyfortheoffence,inthetwoprevi-ousarticles,shallnetpreventfromapplyingthesubsidiarypenaltyprovidedfortheotheroffences.

    Article(87)If theperpetratorbeing in thecaseprovidedbyarticle85of thepresent lawwasprosecutedfortheoffencewiththelowestpenalty,heshallbeprosecutedafterwardsfortheoffencewiththemostseverepenalty.Inthiscase,thecourtshallordertoexecutethepenaltyprovidedbythe lastjudgment,withdeductingthepartofthepreviousjudgment,whichwasactuallyexecuted.

    Article(88)Ifapersonperpetratesapluralityofoffencesbeforeheisjudgedforoneofthem,andsaidoffencesdonotfulll the terms provided by articles 84 and 85 of thepresent law,heshallbecondemnedforthepenaltyset foreachofthem,andallthedecidedpenaltiesshallapplytohimsuccessively,providedthatthetotalexecutedperiodsofthejudgmentsissuedandbearingapenaltyofimprisonmentforacrimeormisdemeanortogethernotexceedingtwentyyears,andprovidedthatthetotalperiodsoftheexecutedjudgmentsissuedandbearingapenaltyofimprisonmentformisdemeanorsshallnotexceedtenyears.Thecrimepenaltyshallbereplacedforitsperiodbyanypenaltyrestrictiveofthelibertyforanyoffence,whichwasperpetratedbeforerenderingthejudgmentbearingsaidcrimepenalty.

    Article(89)Thecapitalpunishmentshallreplaceallotherpenaltiesexceptne and consca-tion.

    Article(90)Thenes and subsidiary penalties shall be executed whatever their number is,providedthatthetotalperiodsofpolicecontrolshallnotexceedve years.

    PART7-LEGALEXCUSESANDEXTENUATINGCIRCUMSTANCES

    Article(91)Thelawstatestheapologiesexemptingfromthepenaltyandextenuatingit.

    Article(92)If thecourtconsiders,whenexaminingacrimethat thecircumstancesof theoffenceoroftheperpetratorrequiremercy,itmayreducethepenaltyprovidedforsaidcrimeasfollows:

    1-Ifthepenaltyprovidedthecrimeisthecapitalpunishment,itmaybere-ducedtoperpetualimprisonmentorimprisonmentforaperiodnotlesthanve years.2-Ifthepenaltyprovidedforthecrimeisperpetualimprisonment,itmaybereducedtoimprisonmentforaperiodnotlessthanthreeyears.3- If the penalty provided for the crime is imprisonment for a period notabovetwentyyears, itmaybereducedtoprisonforaperiodnotlessthanoneyear.4-Theprovisionsofsaidarticleshallnotbeappliedwhenrenderingajudg-mentinaterroristoffence.

    Article(93)Ifthecourtconsiders,whenissuingajudgmentforamisdemeanorthatthecir-cumstancesoftheoffenceortheperpetratorrequiremercy,itmayreducethepenaltyasfollows:

    1-Ifthereisaminimumlimitforthepenalty,thecourtmaynotcomplythere-with.2-Ifthepenaltyisimprisonmentandne together, the court shall apply oneofthemonly.3-Ifthepenaltyisimprisonmentwithoutminimumlimit,thecourtmayapplyane in replacement not exceeding ve thousand Riyal.

    Article(94)Thelawstatestheaggravatingcircumstancesandtheireffectinthepenaltypro-videdfortheoffence.

    Article(95)Shallbeconsideredasrecidivisteachofthefollowing:

    1-Theperson againstwhoma nal judgment bearing a crime penalty waspreviouslyissuedandthenitisestablishedthatheperpetratedacrimeoramisdemeanor.2-Thepersonagainstwhomanal judgment bearing a misdemeanor penaltywas previously issued due to an offence of forgery, theft, breach of trust,trickery,receivingstolengoodsorthingsresultingfromanoffenceorcom-mencementofanysuchoffenceheperpetrated,thenheperpetratedwithinve years as from the judgment one of said offences or commenced any ofthem.

    Thecourtmayapplyontherecidivistmorethanthemaximumlimitprovidedbythelawfortheoffenceprovidedthatthedoubleofsaidlimitshallnotbeex-ceededandthattheperiodofimprisonmentshallnotexceedtwentyyears.

    Article(96)Iftherecidivistwaspreviouslycondemnedtotwopenaltiesrestrictiveofliberty,bothforaperiodofoneyearatleastorthreepenaltiesrestrictiveoflibertyoneofwhichatleastisforoneyear,fortheft,trickery,breachoftrust,forgery,re-ceivingtheftthingsresultingfromanoffenceorthecommencementofanysuchoffence,thenitappearedthatheperpetratedoneofsaidoffencesorcomence-mentofsame,onwhichhewassanctionedafterhewascondemnedtothelastofsaidpenalties,thecourtmayissueajudgmentbearingimprisonmentforaperiodnotlessthanthreeyearsandnotabovesevenyears.

    Article(97)Ifaggravatedcircumstancesarecombinedwithextenuatingexcusesorcircum-stancesinoneoffence,thecourtshallapplyrst the aggravating circumstancesthentheextenuatingexcuses,thentheextenuatingcircumstances.However,iftheaggravatingcircumstancesandtheaggravatingexcuseshavedif-ferenteffects,thecourtmayapplythemostsevereofthem.

    Article(98)Thecapitalpunishmentshallapplyforthefollowing:

    Article(99)The capital punishment shall apply to anyQatariwho joined, in anyway, thearmedforcesofaStateinstateofwarwiththeStateofQatar.

    Article(100)Thecapitalpunishmentshallapplytothefollowing:

    1-Anyonewhoseeksbeforeaforeigncountry,contactsitoranyoftheagentsworkingforit,toundertakehostileactsagainsttheStateofQatar.2-Seeksbeforeanadversaryforeigncountry,contactsitoranyoftheagentsworkingforittohelptheminitswarfareoperationsortoharmthewarfareoperationsofthestateofQatar.

    Article(101)Thecapitalpunishmentshallapplytothefollowing:

    1- Anyonewho interferes intentionally in anyway in raising soldiers, men,funds,provisions,ammunitionsorplansanyofthatforthebenet of any StateinstateofwarwiththeStateofQatar.2-Anyonewhoinstigatesthesoldiers intimeofwartoserveacountry instateofwarwiththeStateofQatarorfacilitatessuchact.3-Anyonewhointerferesforthebenet of the enemy to plan for jeopardiz-ingthedelity of the armed forces, weakening their morals, the morals of thepeopleortheirresistanceforce.

    Article(102)Thecapitalpunishmentshallapplytoanyonewhofacilitatestheentryoftheen-emytothecountry,givesuptohimapartofitsterritory,itsports,afortressoramilitarysite,aship,anaircraft,weapons,ammunitions,apparatus,provisions,food,militarymissions,ameansoftransport,afactory,aplantoranyotherissuemeantforself-defenseorusedforsuchpurpose.

    Article(103)Thecapitalpunishmentshallapplytoanyonewhohelpstheenemybygivinghiminformationorinstructinghim.

    Article(104)Theperpetualimprisonmentshallapplytoanyonewhorendersanyservicetotheenemyforcestoobtainabenet or a prot or promises to do so by himselforby the intermediaryof anotherperson,whetherdirectlyor indirectly andwhetherthebenet or the prot is material or non-material.

    Article(105)Theperpetual imprisonment shall apply toanyonewhodestroys,damagesorruinsintentionallyweapons,ships,aircrafts,missions,plants,meansoftransport,publicutilities,pipelines,ammunitions,provisions,medicinesorothersmeantforthedefenseofthecountryoruseinsuchpurpose.Thesamepenaltyshallapplytoanyonewhobadlymanufacturesorrepairsanyofthementionedobjects intentionally,or intentionallycommitsanact,whichrendersitnotvalideventemporarilyforusefortheintendedpurposeorsourceofdamage.Thecapitalpenaltyshallapplyiftheoffenceisperpetratedintimeofwar.

    Article(106)Iftheactsmentionedinthepreviousarticlearecommittedduetonegligenceordefault,thepenaltyshallbetheimprisonmentforaperiodnotexceedingveyears.Thepenaltyshallbeimprisonmentforaperiodnotexceedingfteen years if theoffenceisperpetratedintimeofwar.

    Article(107)Thecapitalorperpetualimprisonmentshallapplytoanyonewhoseeksbeforeanothercountryoranyoftheagentsworkingforit,orcontactsanyoftheminawaydamagingthewarfare,politicaloreconomicsituationoftheState.

    Article(108)Thepenaltyofimprisonmentforaperiodnotexceedingtwentyyearsshallap-plytoanyonewhodestroysintentionally,hidesorfalsies papers or deeds if heknowsthattheydealwiththesecurityoftheStateoranypublicinterest,thisresultinginwarfare,politicaloreconomicdamageofthesituationoftheState.

    Article(109)ShallbeconsideredasoneofthedefensesecretsoftheStatethefollowing:

    1-Warfare,politicalandeconomicinformationknown,duetotheirnature,

    onlybythepersonswhohavethecapacityforthatsincetheinterestofde-fenseofthecountryrequirestokeepassecretawayfromothers.2-Correspondence,writtendocuments,deeds,drawings,maps,plans,pic-turesandotherthings,thedisclosureofwhichmayleadtorevealingthein-formationmentionedinthepreviousparagraphwhiletheinterestofdefenseofthecountryrequirestokeepthemassecretnotknownfromotherthanthoseinchargeofmaintainingandusingthem.3-Newsandinformationconcerningthearmedforces,theirselection,move-ments, apparatus,provisions, staff andother issues involvingmilitaryques-tionsandwarfareplans,providedthatnowrittenauthorizationwasissuedbythemilitaryauthoritiesfortheirpublicationordiffusion.4-Informationdealingwiththemeasuresandproceduresadoptedtorevealtheoffencesprovidedforinthistitle,arrestthecriminals,andtheinformationconcerningtheprogressoftheinvestigationandtrial,whentheinvestigationauthorityortherelevantcourtprohibitstheirpublicationordiffusion.

    Article(110)Thepenaltyofimprisonmentforaperiodnotexceedingfteen years shall applytoanyonewhodisclosestoa foreignStateortoanyagentsworkingfor itorrevealstoanyoftheminanyway,anyhowandbyanymeansanyofthesecretsofdefenseofthecountry,managesinanywaytoobtainoneofsaidsecretswiththeintentiontodiscloseorrevealittoaforeignStateoroneoftheagentswork-ingforsaidState,oranyonewhodestroyssomethingconsideredasoneofthesecretsofdefenseoftheStateorrendersitinappropriateforuse.Thepenaltyshallbethecapitalpunishmentiftheoffenceisperpetratedintimeofwar.

    Article(111)Thepenaltyofperpetualimprisonmentshallapplytoanypublicemployeewhodisclosesoneof the secretsofdefenseof theState.Thepenalty shallbe thecapitalpunishmentiftheoffenceisperpetratedintimeofwar.

    Article(112)The penalty of imprisonment for a period not exceeding ve yearsshallapplyasfollows:

    1-ToanyonewhoobtainsbyanillegalmeansoneofthesecretsofdefenseoftheStatewithoutintendingtodiscloseorrevealittoaforeigncountryoranyagentworkingforit.2-ToanyonewhodisclosesbyanywayoneofthesecretsofdefenseoftheState.

    Article(113)Thepenaltyofimprisonmentforaperiodnotexceedingsevenyearsshallapplyanyonewhodisclosesintentionally,intimeofwar,information,statementsandrumors,whichare false,biasedpropapaganda,whichresults indamageof thewarfarepreparationsforthedefenseoftheState,themilitaryoperationsofthearmedforcesorinscaringthepeopleandweakeningthemoralsoftheState.Thepenaltyshallbetheimprisonmentforaperiodnotexceedingfteen years iftheoffenceisperpetratedasresultofcontactwithaforeignState.WhenperpetratedasresultofcontactwithanenemyState,thepenaltyshallbeperpetualimprisonment.

    Article(114)Thepenaltyofimprisonmentforaperiodnotexceedingtenyearsshallapplytoanyonewhoundertakeswithout the authorizationof the relevant authoritiesraisingsoldiersoranyotherhostileactagainstaforeignStateinawayexposingthecountrytothedangerofwarorbreachofdiplomaticrelations.Thepenaltyshallbethecapitalpunishmentortheperpetualimprisonmentifsaidactresultedinstartingthewarorbreachofthediplomaticrelations.

    Article(115)Thepenaltyof imprisonment foraperiodnotexceedingve years and a nenotexceedingfteen thousand Riyal shall apply to any Qatari who discloses in-tentionallyabroadfalseorbiasedinformation,statementsorumorsconcerningtheinternalsituationoftheState,thisleadingtoweakenthetrustintheStateeconomyorharmitsinternationalpositionorconsideration,orwhostartsinanywayanactivityresultingindamageofthenationalinterest.Thepenaltyshallbetheimprisonmentforaperiodnotexceedingtenyearsiftheoffenceisperpetratedintimeofwar.

    Article(116)Thepenaltyofimprisonmentforaperiodnotexceedingtenyearsandane notlessthanfteen thousand Riyal and not exceeding one hundred Riyal shall applyasfollows:1-Toanyonewhoundertakesdirectlyorthroughanothercountry, intimeofwar,toexportmerchandises,productsorotherstoahostilecountryorimportssuchmerchandisesfromsaidcountry.2-Toanyonewhostartspersonallyor throughotherparties, in timeofwar,trade activities other than those provided by the previous paragraph,with apersonresidinginahostilecountryorwithanyofthenationalsofsaidcountry,hisrepresentatives,agentsorcommittees.Inallcircumstances,ajudgmentbearingconscation of the objects subject mat-teroftheoffenceshallberenderedand,iftheyarenotseizedtheperpetratorshallbecondemnedtoanadditionalne equivalent to the value of said objects.

    Article(117)The penalty of imprisonment for a period not exceeding ve yearsshallapplyasfollows:

    1-Toanyonewhoies over the territory of the country without authoriza-tionoftherelevantauthorities.2-Toanyonewhotakespictures,drawingsorplansofsitesorplacesagainsttheprohibitionissuedbytherelevantauthorities.3-Anyonewhoentersa fortress,anydefenseplants,camporplacewheretherearemilitary forces,militaryorcommercialships,militaryaircraftsorvehicles,anarsenal,anymilitaryplace, locationorfactorywhereanactfortheinterestofdefenseofthecountryisstartedandwherethepublicisnotauthorizedtoenter.4-Anyonewhoresides inorattendsanyoftheplaceswhereresidenceorattendanceisprohibitedbytherelevantauthorities.

    Thepenaltyshallbetheimprisonmentforaperiodnotexceedingfteen years, iftheoffenceisperpetratedintimeofwarorbyuseofameansoftrickery,fraud,disguise,hidingofpersonality,nationality,professionorcapacity.Thesamepenaltyshallapplytoanyonewhocommencestoperpetrateanyofsaidoffences.

    Article(118)Thepenaltyofimprisonmentforaperiodnotexceedingfteen years shall applytoanyonewhoabstainsintentionally,intimeofwar,fromexecutingallorpartoftheobligationsrequiredbyacontractofundertakingtransport,exportation,enterpriseorpublicworkstowhichheisboundwiththeStatefortheneedsofthearmedforces,therequirementsofthecivilians,orcommitsanyfraudintheirexecution.Thepenaltyshallbethecapitalpunishmentiftheoffenceiscommittedwiththeintention todamagethedefenseof theStateor theoperationsof thearmedforces.Thetwopreviousparagraphsshallapplytosubcontractors,agentsandbrokersifthedefaultofexecutionofthecommitmentorthefraudintheexecutionisduetotheiracts.

    Article(119)Ifthedefaultofexecutionofallorpartofthecommitmentsprovidedbythepre-viousarticleisduetonegligenceorfailure,thepenaltyshallbetheimprisonmentforaperiodnotexceedingthreeyears.

    Article(120)Thepenaltyofimprisonmentforaperiodnotexceedingtenyearsandane notexceedingfteen thousand Riyal shall apply for anyone who requests for himself

    orforotherparties,acceptsortakes,evenbyintermediary,fromaforeignStateorfromanyoftheagentsworkingforit,moneyoranyotherbenet, promisinganythingofthatwiththeintentionofperpetratinganactdamagingthenationalinterest.Thepenaltyshallbetheimprisonmentforaperiodnotexceedingfteen yearsandane not exceeding one hundred thousand Riyal if the offence is perpetratedintimeofwaroriftheperpetratorisapublicofcer or a person entrusted withapublicutility.Thesamepenaltyshallapplytoanyonewhogives,promisesorofferssomeoftheprovidedissueswiththeintentiontoperpetrateanactdamaginganationalinterestevenifwhathegives,promisesoroffersisnotaccepted.Thesamepenaltyshallalsoapplytoanyonewhoisanintermediatefortheper-petrationofanyofthepreviousoffences.

    Article(121)Thepenaltyof imprisonmentforaperiodnotlessthanve years and not ex-ceedingfteen years any person who is assigned for negotiations with a foreignState,orwithaphysicalorlegalforeignperson,inoneoftheStatesubjects,andintendedtocarryoutsaidnegotiationsagainsttheinterestofhisState.

    Article(122)Thepenaltyofimprisonmentforaperiodnotexceedingve years and a ne notexceedingfteen thousand Riyal shall apply to anyone who discloses, to a foreignStateoroneiftheagentsworkingforit,inanywayormanner,orbyanymeans,news,information,things,correspondence,deeds,maps,drawings,picturesorothersbelongingtotheStatewhilethereisanorderissuedbytherelevantau-thorityprohibitingpublicationanddiffusion.

    Article(123)Thepenaltyof imprisonment foraperiodnotexceedingtenyearsshallapplytoanypublicofcer assigned for the guard of a prisoner of war or any of theprisonerscondemnedforoneofthecrimesprovidedbythepresenttitlewhoallowsorhelpsintentionallysaiddetainedorprisonertoescapefromhisprisonorplaceofdetention.

    Article(124)Thepenaltyofimprisonmentforaperiodnotexceedingsevenyearsshallapplytoanyonewhohelpsorassistsoneoftheprisonersforoneofthecrimespro-videdforinthepresenttitleoraprisonerofwartoescape,commencessuchact,giveshimaccommodation,food,drink,money,weapons,ammunitionsoranymeansoftransport,hideshimafterescapementorresiststohisarrestwhileheisawareofhiscondition.

    Article(125)Thepenaltyofimprisonmentforaperiodnotexceedingthreeyearsandanenotexceedingfteen thousand Riyal anyone who collects, registers or diffusesany informationpertainingtothemovements,number,specication or condi-tionofanyofthearmedforces,militaryshipsoraircraftsoftheStateofQatarwithoutauthorizationoftherelevantauthority.

    Article(126)Thepenaltyofimprisonmentforaperiodnotexceedingthreeyearsandanenotexceedfteen thousand Riyal or one of the two penalties shall apply to any-onewhoknowsabouttheperpetrationofoneoftheoffencesprovidedforinthepresentsectionoraboutcommencementofanyofthemanddoesnotinformtherelevantauthoritiesthereofpromptly.Thetwopenaltiesofimprisonmentandne shall be doubled and decided t geth-eriftheoffenceisperpetratedintimeofwar.Theprovisionsofthepresentarticleshallnotapplytothespouseoftheperptra-tor,hisascendantsordescendants.

    Article(127)Apenaltyshallapplytotheanyofthefollowingconsideringthatheisacollabora-torintheoffencesprovidedforinthepresenttitle:

    1- If he knows the intention of the perpetrator and offers him assistance,meansofsubsistence,accommodations,ashelter,aplaceformeetingorotherfacilities.2-Ifhehidesthingsthatwereusedormeantr use in perpetrating the of-fenceorwhichresultedthereofinknowledgeofreason.3- If he destroys, hidesor changes intentionally a document,whichwouldfacilitatethediscoveryoftheoffence,itsevidencesorthepunishmentofitsperpetrator.Insuchcases,thecourtmayexemptfromthepenaltythespouseoftheperpetrator,hisascendantsanddescendantsiftheyarenotpunishedbyanotherlegalprovision.

    Article(128)Thepenaltyofimprisonmentforaperiodnotexceedingfteen years shall applytoanyonewhoparticipatestoacriminalagreementwhetherthepurposeistheperpetrationofoneofthecrimesprovidedforinthepresenttitleortheiruseasmeanstoreachthepurposesearchedforsaidcriminalagreement.Thesamepenaltyshallapplytoanyonewhoinstigatestotheagreementorplaysaroleinmanagingit;ifthepurposeoftheagreementistoperpetrateonede-terminedoffenceoruseitasmeanstoreachtheintendedpurpose,thepenaltyprovidedforsaidoffenceshallapplytohim.Thepenaltyofimprisonmentforaperiodnotexceedingve years shall apply to

    anyonewhocallsanotherpersontotakeparttoanagreementofthiskindevenifhiscallisnotaccepted.

    Article(129)Anycriminalwhoundertakestoinformtherelevantauthoritiesbeforethecom-mencementof thecrimeorbeforestarting the investigation thereonshallbeexemptedfromthepenaltiesstatedinthepresenttitle.The courtmay exempt from the penalty if the information is given after theperpetrationoftheoffenceandthebeginningoftheinvestigation;saidcourtmayalsoreducethepenaltyiftheperpetratorfacilitatestotheauthoritiesthearrestofanyofthecriminalsduringtheinvestigationorthetrial.

    PART2-OFFENCESAGAINSTINTERIORSECURITYOFTHESTATE

    Article(130)Thecapitalpunishmentshallapplytoanyonewhotriestooverthrowtheregimeofthecountry,seizeitbyforceorbythreateningtousesuchmeans.Iftheoffenceisperpetratedbyanarmedguerilla,thecapitalpunishmentshallapplytoanyonewhoformedtheguerilla,undertookitsleadershiporcommand-ment.

    Article(131)ThecapitalpunishmentshallapplytoanyonewhoattacksthelifeoftheEmir,hissecurityorliberty,orintentionallyexposeshislifeorlibertytodanger.Thesamepenaltyshallapplytoanyonewhoperpetratesanyofthepreviousactsonthevice-Emir.

    Article(132)Thecapital punishment shall apply to anyonewhoaggressesby force the au-thoritiesentrustedtotheEmir,whetherbypreventingfromallorpartofsaidauthorities,deposinghimorcompellinghimtodesist fromallorpartof saidauthorities.Thesamepenaltyshallapplytoanyonewhoperpetratesoneofthementionedactsonthevice-Emir.

    Article(133)Thepenaltyof perpetual imprisonment shall apply to anyonewho resorts tothreateningortoanyotherillegalmeanstocausetheEmir,thevice-Emirtoac-complishanactorabstainfromanactattributedtohimbythelaw.

    Article(134)Thepenaltyofimprisonmentforaperiodnotexceedingve years shall apply toanyonewhochallengesbyanypublicmeanstheexercisebytheEmirofhisrightsorauthoritiesorcriticizeshim.Thesamepenaltyshallapplytoanyonewhoperpetratesanyofthepreviousactsonthevice-Emir.

    Article(135)Thepenaltyofcapitalpunishmentorperpetualimprisonmentshallapplytoany-oneattacks,ontheterritoryoftheState,thesecurityofthePresidentoftheRepublicofaforeigncountryorhisliberty,orintentionallyexposeshislifeorlibertytodanger.

    Article(136)Thepenaltyofperpetualimprisonmentshallapplytoanyonewhoinstigatesbypublicmeanstooverthrowtheregimeofthecountry,undertakessuchpropa-gandaorcallsbypublicmeanstoadoptadoctrineaimingtodestroythefunda-mentalvaluesoftheState,tochangethesocialoreconomicsystemprevailinginthecountrybyuseofforceorthroughanyillegalmeans.

    Article(137)Thepenaltyofimprisonmentforaperiodnotexceedingve years shall apply toanyonewhoisfoundinpossessionofanytract,letterorprinteddocument,oranyothermaterialincitingtooverthrowtheregimebyforce,byillegalmeans,infringegeneralsecurityorpromoteanyofsaidsubjects.

    Article(138)Thepenaltyofimprisonmentforaperiodnotexceedingthreeyearsandanenotexceedingfteen thousand Riyal, or one of these two penalties shall apply toanyonewhooffendsbyanypublicmeanstheStateag or the ag of anon-hos-tileState,whetherbydestroyingorloweringit,orbyanyotheractexpressinghateanddisdain.

    Article(139)Withoutprejudiceofanymoreseverepenalty,apenaltyofimprisonmentforaperiodnotexceedingthreeyearsandane not exceeding fteen thousand Riyaloroneofthetwopenaltiesshallapplytoanyonewhoparticipatestoacrowdcomposedofve persons at least in a public place, in a view of perpetrating anoffence,infringingpublicsecurityandremainsinthecrowdaftertheagentsofpublicforcehaveorderedtoleavetheplace.Thesamepenaltyshallapplytoanyonewhoparticipatesinacrowdwhilehold-ingaknifeweapon,acanesorothersolidinstrumentnotusuallyheldinnormal

    cases.Ifthepersonparticipatinginthecrowdholdsare weapon, the penalty shall betheimprisonmentforaperiodnotexceedingve years.

    PART3-OFFENCESCONCERNINGPUBLICOFFICE

    CHAPTER1-BRIBERY

    Article(140)Anypubicofcer who asks for or accepts, for himself or another party, money,benet or a simple promise of something against undertaking any act or abstain-ingfromanyactincludedinhisofce shall be considered as receiver of bribery;thepenaltyofimprisonmentforaperiodnotexceedingtenyearsandane notexceedingwhathewasgivenorpromisedtobegivenshallapplytohim,providedthatitshallnotbelessthanve thousand Riyal.Thesamepenaltyshallapplytothepublicofcer who asks for or accepts, forhimself or another party, money, benet or a simple promise of somethingagainstundertakinganactorabstainingfromanact,whichisnotincludedintheattributionsofhisofce, but who believes by error or pretends that it is includedtherein.Thespecialbenet reverting to the ofcer or to another party from the sale ofamovableassetorarealestateatapricehigherthanitsvalue,itspurchaseatapricelowerthansaidvalueorfromanycontractconcludedbetweenthegiverofthebriberanditsreceivershallbeconsideredasbribery.

    Article(141)Thepenaltyprovidedbythepreviousarticleshallapplytoanypersonwhoof-feredmoney,benet or promise to the public ofcer in said respect, with theofcer accepting what was offered or promised to him.Thesamepenaltyshallapplytotheintermediarybetweenthegiverofthebrib-eryanditsreceiver.Thegiverofthebriberyortheintermediateshallbeexemptedfromthepenaltyifheinformstheconcernedauthorityabouttheoffenceordeclaresitbeforeitsdiscoveryevenafteritsaccomplishment.

    Article(142)Thepenaltyofimprisonmentforaperiodnotexceedingsevenyearsandanenotexceedingfteen thousand Riyal shall apply to any public ofcer who acceptsmoneyorbenet from a person to whom he does an act included in his ofce orabstainsfromdoinganactofsaidofce, after the accomplishment of said act or

    abstaining,withtheintentionofobtainingarewardonhisactorabstainingandwithoutpreviousagreement.

    Article(143)Thepenaltyofimprisonmentforaperiodnotexceedingthreeyearsandanenotexceedingfteen thousand Riyal shall apply to any of the following:

    1-Anyonewhoreceivesmoneyorbenet pretending that it is bribery for anofcer, while he intends to keep it or a part of it for himself.2-Anyonewhoreceivesmoneyorprot while knowing its purpose even if theofcer intended to receive the bribery did not appoint him or did not knowabouthim,providedthatheisnotanintermediaryinthebribery.

    Article(144)Ifthepurposeofthebriberyistoperpetrateanactpunishedbythelawwithapenaltymoreseverethantheoneprovidedforbribery,thesetpenaltywiththene provided by article 140 of the present law shall apply to the giver of thebribery,thereceiverofthebriberyandtheintermediate.Thegiverofthebriberyortheintermediateshallbeexemptedfromthepenaltyfheinformstheconcernedauthoritiesabouttheoffenceandsaidinformationleadstothearrestofanyoftheperpetrators.

    Article(145)Thepenaltyofimprisonmentforaperiodnotexceedingve years and a ne notexceedingfteen thousand Riyal shall apply to anyone who offers bribery to apublicofcer who refuses it.

    Article(146)Anyemployeewhoasksforhimselforforanotherpartymoneyorprot or asimplepromiseofsomethingofthekindwithoutknowledgeofhisemployerandhisconsent,toundertakeanyoftheactsassignedtohimorabstainfromsaidact,shallbeconsideredasreceiverofbriberyandapenaltyofimprisonmentforaperiodnotexceedingthreeyearsandane not exceeding fteen thousand Riyaloroneofthetwopenaltiesshallapplytohim.

    Article(147)Inadditiontothepenaltiesmentionedinthepresentchapter,theconscation ofwhatthegiverofthebriberyortheintermediateofferedshallbedecided.Theperpetratorshallalsobecondemnedtodismissalfrompublicofce and ane equal to the amount of money subject matter of the offence.

    CHAPTER2-EMBEZZLEMENTANDDAMAGETOTHEPUBLICTREASURY

    (Article148)Thepenaltyof imprisonmentforaperiodnotlessthanve years and not ex-ceedingtenyearsshallapplytoanypublicofcer who embezzles money, papersorother,whichwereinhispossessionduetohisofce.Thepenaltyshallbe imprisonment foraperiodnot lessthansevenyearsandnotexceedingfteen years if the perpetrator is responsible of deposits or ex-changer,ifheisassignedtocollectnes, fees, taxes or the like and the money isdeliveredtohiminsaidcapacity.

    (Article149)Apenaltyofimprisonmentforaperiodnotexceedingtenyearsshallapplytoanypublicofcer who takes possession in an illegal way of funds, papers or otherownedbytheStateoranyauthoritymentionedinarticle4ofthepresentlaworfacilitatessuchactforanotherparty.

    Article(150)Thepenaltyofimprisonmentforaperiodnotexceedingtenyearsshallapplytoanypublicofcer who damages intentionally the funds or the interests of theinstitutionwhereheworks,theassetsofathirdpartyorhisinterestsentrustedtosaidinstitution.

    Article(151)Thepenaltyofimprisonmentforaperiodnotlessthanoneyearandnotexceed-ingthreeyearsshallapplytoanypublicofcer who caused by his fault a seriousdamagetotheassetsortheinterestsoftheinstitutionwhereheworks,theas-setsofthirdpartiesortheirinterestsentrustedtosaidinstitutionifthisresultsfromnegligence incarryingouthisofce, failure in performing its obligations,abuseofpower.

    Article(152)Thepenaltyofimprisonmentforaperiodnotexceedingtenyearsshallapplytoanypublicofcer infringes by means of trickery or by any other illegal means, thelibertyorsecurityofthebidsorauctionspertainingtotheState,oranyoftheauthoritiesmentionedinarticle4ofthepresentlaw.

    Article(153)Apenaltyofprisonforaperiodnotexceedingtenyearsshallapplytoanypublicofcer entrusted to protect the interest of the institution in which he works, inatransactionorsubject,andwhointentionallyharmssuchinterest,toobtainabenet for himself or for another party.

    Article(154)Apenaltyofprisonforaperiodnotexceedingtenyearsshallapplytoanypublicofce involved in the preparation, management or execution of undertaking,export,worksorenterprisesdealingwithoneoftheauthoritiesmentionedinarticle4ofthepresentlaw,whoobtainsorcommencestoobtainforhimselforotherpartly,directlyorbyintermediary,byanyillegalway,aprot, a benet oracommissionfromoneofthementionedacts.

    Article(155)Apenaltyofimprisonmentforaperiodnotexceedingve years shall apply toanyonewho intentionally commits trickery in the execution of all or part ofhiscommitmentsimposedbythecontractofundertakingorexport,thepublicworksorothercontractsorenterprisestowhichheisboundwithoneoftheauthoritiesmentionedinarticle4ofthepresentlaw.Thepenaltyshallbeimpris-onmentforaperiodnotlessthanve years and not exceeding fteen years if theoffenceresultsinaseriousprejudiceorifthecontractpertainstotherequire-mentsofdefenseandsecurityiftheperpetratorwasawareofsaidpurpose.Anyof said penalties, according to the circumstances, shall apply to the sub-cotractors,agentsorintermediariesiftrickeryisduetotheiract.

    Article(156)Apenaltyofimprisonmentforaperiodnotexceedingtenyearsshallapplytoanypublicofcer involved in collecting the nes, fees, taxes or the like, who asksforor takes non-due amountsor amounts exceeding theduepaymentswithknowledgeofthefacts.

    Article(157)Apenaltyofimprisonmentforaperiodnotexceedingsevenyearsshallapplytoanypublicofcer involved in employing workers in jobs related to his ofce, whoretainsforhimselfallorpartoftheirduesalariesorthelike,employsdirectlyorindirectlychoreworkersandtakestheirsalaries,writesdowninthebooksoftheauthoritiesmentionedinarticle4ofthepresentlawthenamesoffactiousortruepersonswhodidnotcarryoutanyofthementionedjobs,takesposses-sionoftheirsalariesorgivesthemtosaidpersonswithcalculatingthemonsaidauthorities.

    Article(158)Thecriminalshallbecondemned,inadditiontothepenaltiesprovidedfortheoffencesmentionedinthepresentchaptertodismissalfrompublicofce, revo-cationandane equal to the value of the funds subject matter of the offence orresultingthereof.

    CHAPTER3-EXPLOITATIONOFTHEOFFICEANDABUSEOFPOWER

    Article(159)Apenaltyforaperiodnotexceedingve years shall apply to any public ofcerwhousestorture,forceormenacewithanaccused,awitnessoranexpertororderssuchmeasurestocausehimtoconfessacrime,makestatementsordis-closeinformationinthisrespectortohideanysaidissues.Iftheactoftheofcer results in a permanent wound of the victim, the penalty oftheperpetratorshallbeimprisonmentforaperiodnotexceedingtenyears.If theact results in thedeceaseof thevictim, thepenaltyof theperpetratorshallbethecapitalpunishmentortheperpetualimprisonment.

    Article(160)Apenaltyofimprisonmentforaperiodnotexceedingthreeyearsandane notexceedingtenthousandRiyaloroneofthetwopenaltiesshallapplytoanypublicofcer who uses the power vested in him by virtue of his ofce to damage anyindividual,ortobringanillegalbenet for himself or to third parties.

    Article(161)Apenaltyofimprisonmentforaperiodnotexceedingthreeyearsandane notexceedingtenthousandRiyaloroneofthetwopenaltiesshallapplytoanypublicofcer who uses harshness with any person during his ofce or compels him toanyactexceptforthecaseswherethelawauthorizessuchacts.

    Article(162)Apenaltyofimprisonmentforaperiodnotexceedingthreeyearsandane notexceedingtenthousandRiyaloroneofthetwopenaltiesshallapplytoanypublicofcer who, under pretext of his ofce, enters the house of aperson or any of itsdependencies,withouttheconsentoftheconcernedpersonorcausessomeoneelsetoenterthereinexceptforthecasesprovidedbythelaw.The same penalty shall apply to any public ofcer who searched a person, ahouseorastorewithouttheconsentoftheconcernedperson,orcausedsome-oneelsetosearchexceptforthecasesprovidedbythelaw.

    Article(163)Apenaltyofimprisonmentforaperiodnotexceedingve years shall apply to anypublicofcer who arrests a person, imprisons or seizes him except in the casesprovidedbythelaw,orordersapenaltyforacondemnedmoreseverethanthisprovidedbyhelaworapenaltytowhichsaidcondemnedwasnotconvicted.

    Article(164)Apenaltyofimprisonmentforaperiodnotexceedingthreeyearsandane notexceedingtenthousandRiyaloroneofthetwopenaltiesshallapplytoanypublicofcers who infringes the provisions of the law with the intention to reach oneofthefollowingpurposes:

    1-Protectapersonfromservingorexecutinghisduesentence,reducesaidpenaltyordelayitsexecution.2-Protectanyassetfromconscation, seizure, any restriction set by the lawonsaidasset,delayitsconscation or seizure, impose or execute any restric-tiononit.

    Article(165)Theperpetratormaybecondemned, inadditiontothepenaltiesprovidedfortheoffencesmentionedinthepresentchaptertoexclusionfrompublicofce.

    CHAPTER4-HUMILIATIONOFPUBLICOFFICERS,AGGRESSIONAND

    MENACESAGAINSTTHEM

    Article(166)Apenaltyforaperiodnotexceedingsixmonthandane not exceeding threethousandRiyaloroneofthetwopenaltiesshallapplytoanyonewhohumiliatesbyword,signormenaceapublicofcer during the exercise of his ofce or duetosaidexercise.Thepenalty shall be the imprisonment for a periodnot exceeding two yearsandane nor exceeding ten thousand Riyal, or one of the two penalties if thehumiliationaffectsacourt,acomitywithjurisdictionalattributionoranyofitsmembersduringthehearing.

    Article(167)Apenaltyofimprisonmentforaperiodnotexceedingthreeyearsandane notexceedingtenthousandRiyalshallapplytoanyonewhoattacksapublicofceroranyoneentrustedwithapublicutility,ifheresiststohimwithforceorvio-lenceduringtheexerciseofhisofce or utility.Thepenaltyshallbeimprisonmentforaperiodnotlessthansixmonthsiftheaggressionorresistanceisaccompaniedwithbeating,withoutprejudiceofanymoreseverepenaltysetbythelawforanyactaccompaniedwithaggressionorforce.

    Article(168)Apenaltyofimprisonmentforaperiodnotexceedingve years shall apply toanyonewhousesforce,violenceormenacewithapublicofcer to cause him inanillegalwaytoexerciseoneoftheactsofhisofce or to abstain thereof anddoesnotreachhispurpose.Iftheperpetratorreacheshispurpose,thepenaltyshallbeimprisonmentnotlessthanve years and not exceeding ten years.

    Article(169)Theoffensesmentioned in thepresentchapter shallbeconsideredasperpe-tratedinaggravatingcircumstanceif:

    1-Theoffenceisperpetratedwithpremeditation.2-Theoffenceisperpetratedbymorethanoneperson.3-Theperpetratoroftheoffencecarriesvisibleweapons.Thepenalty shallbedoubled incaseofpresenceofanaggravatingcircum-stance.

    CHAPTER5-CLAIMINGAFALSEOFFICE

    Article(225)Inallcasesofthecrimementionedinthischapter,alltheforged,counterfeitedor falsied currencies or bonds in addition to their machines are conscatedunderacourtjudgment.

    Article(226)Any of the convicts who inform the competent authorities before using theforged, counterfeited ot falsied currency or bond and before disclosing thecrime isexempted fromthepenaltiesstipulated in thischapter. If theconvictreportsafterdisclosingthecrime,thecourtcanexempthimfromthepenaltywhenevertheinformationresultinarrestinganyoftheconvicts.

    CHAPTER4-FALSIFYINGWEIGHTANDMEASUREUNITS

    Article(227)Oneisconvictedtonomorethanayearinprisonandtoane of no more thanve thousand riyals, or to one of these two penalties in case of making, selling ordisposingofanyforgedorfalsied measure or weight units being aware of thepossibilityofusingitastrueunits.

    PART6-CRIMESOFPUBLICDANGERCHAPTER1-ARSON

    Article(231)Anyonewhopurposelysetsre to anothers property is convicted to no morethanve years in prison.Incaseofjeopardizingpeopleslivesorproperties,theconvictspenaltydoesnotexceedsevenyears.

    Article(232)Whopurposelysetsre to ones own property and jeopardizes peoples livesandpropertiesisconvictedtonomorethansevenyearsinprison.

    Article(233)Oneisconvictedtono lessthanve years and no more than fteen years incaseofpurposelysettingre to an occupied place or a house, a bank or a ship,anoilwell,machinesorequipmenttoproduce,rene and transport oil, an oilwarehouse,oroneofthepublicwealthresources.

    Article(234)Anyonewhopurposelysetsre indirectly to objects is convicted to the above-mentionedpenaltiesaccordingtothecase.

    CHAPTER2-TRANSGRESSIONOFPUBLICFACILITIES

    Article(237)Oneisconvictedtonomorethantenyearsinprisonincaseofpurposelyde-stroying, ravaging or damaging machines, pipes, or equipment related to thefacilities ofwater, electricity, gas, oil, telegraph, telephone,wireless, radioortelevisionoranyotherpublicfacilitiesifthisleadstothedisablementorinvalid-ityofthefacility.

    Article(238)Oneisconvictedtonomorethansevenyearsinprisonincaseofpurposelyde-stroying,ravagingordamagingxed health facilities, ambulant health units or itsmaterials,machinesortoolsifthiswillmakeitinvalid,oruseless.

    Article(239)Anyonewho purposely destroys or damages any project of public sewers ordrains,airports,roadsorpublicbridgesisconvictedtonomorethanve yearsinprison.Thesamepenaltyisimposedonanyonewhopurposelydestroysordamagesanyofthexed signs in airports or public ports, or changes their place or makestheminvalidoruseless.

    Article(240)Oneisconvictedtonomorethanve years in prison in case of purposely de-stroyingordamagingalight,alighthouse,abuoyoranyotherobjectsusedinnavigation,orchangingtheirplaceormakingtheminvalidoruseless.
