INTRODUCTION

Punjab Small Industries Corporation (PSIC) came into being in 1972 after dissolution of OneUnit. It was established under PSIC Act-1973. As per PSIC Act, PSIC has multiple functions.One of primary functions is to establish / develop Small and Cottage Industries estates atprominent places in Punjab Province. The prospective entrepreneur is provided developed plotsfor establishment of their respective industries within boundary area where all necessaryinfrastructure facilities are made available. These industries not only provide job opportunitiesto thousands of skilled and un-skilled manpower thus helping in poverty alleviation but alsocontribute a substantial share in national GDP.

PSIC inherited five (5) Small Industries Estates which were established by West PakistanSmall Industries Corporation (WPSIC) at Lahore, Gujranwala, Gujrat, Sialkot and Bahawalpurduring the period from1960 to 1970. Similarly, prior to establishment of Small IndustriesEstates on Self-Finance basis, 13 SIEs were established by PSIC with Government Funds inprominent cities of Punjab upto 1988. However, with changing trends and also to attractinterested entrepreneurs invest their own money. PSIC has up till now established 11 SmallIndustries Estates and Export Processing Zones, with public funds on Self-Finance basis.

OBJECTIVES

Estate Management Rules were first approved by PSIC Board of Members in its 56th meetingheld on 08-10-2002 and then on 04-05-2004 in its 59th meeting. The New Revised PolicyInstructions / Procedures for Small Industrial Estates were again consolidated and alongwithrevised Fees and charges were approved by PSIC Board of Members in its 85thmeeting held on24.01.2013.The same were notify by Directorate of (ED&W) PSIC videNo.PSIC/ED/GENERAL-46/2931dated 28.09.2011 & No.PSIC/ED&W/GENERAL-46/9151dated07.05.2011 respectively.

It is felt that policy/instruction/procedure/fee/charges approved/notified levied/revised in theyear 2011 are now almost decade old and do not commensurate with the current risingproblems in PSIC SIEs and cost escalation which has resulted in the maintenance of the estate.These state of affairs were discussed with all Regional Director, PSIC who agreed thatprevailing policy/instruction/procedure and present fee/charges structure need revision.

The industrialists of estates are also demanding for revision of New Revised PolicyInstructions/ Procedures so as to cater / cop with their needs to establish a completecomprehensive modern project.

Objective to devise new PSIC Small Industrial EstatePolicy-2019is to make procedures moresimplified/ clarified for benefit of all stakeholders by covering maximum issues relating toSmall Industries Estates for minimizing bottlenecks in their establishment. Hence, existingPolicy Instructions and Procedures have been reviewed / revisited. Moreover, new proceduresfor addressing issues relating to industrialists of these estates have also been devised besidesdefining of “Competent Authorities” to accord approval.

The Procedures adopted in this regard are elaborated as under:-

1. INITIATION OF PROPOSAL FOR ESTABLISHMENT OF SIEs, EPZs,SEZ, ETC.

On receipt of request from any Association or Local Chamber of Commerce and Industry, oron receipt of any direction from Government or PSIC Board of Members or PSIC Managementfor establishment of Small Industries Estate in any particular area(s),matter will be placedbefore Managing Director, PSIC, to accord approval for further course of action.

After approval by Managing Director, PSIC, following procedure will be adopted:-

2. PREPARATION OF PRE-FEASIBILITY / STUDY REPORT

a) The requestfor establishing of SIEs, EPZs,SEZs etc will be referred to Punjab UrbanUnit for assessment of site and feasibility report. In addition to it, PSIC Management will carryout following activities:-

i. Identification of adequate number of prospective entrepreneurs with businessexperience andfinancial credentials.

ii. Identification of suitable land.iii. Identification of available essential facilitiesiv. Profile of the identified area.v. Identification of industries to be established.

vi. Carrying out spatial mapping of the prospective estate.vii. Any other step required for determining the suitability of the project.

b) Regional Director concerned, PSIC, will identify suitable state land or any private land.He will also get average price of land per acre / kanalin that vicinity in case of privateland,from concerned Land Revenue Authority and send his report with proposals/recommendations.c) The feasibility report alongwith recommendation of Director (EM) PSIC will be placedbefore PSIC Board of Members for consideration and approval to proceed further in the matter.

3. PRE-REQUISITS FOR ESTABLISHMENT OF SIE

i. Preparation of DraftPC-I of Scheme by Directorate of Estate Management andDirectorate of Works & Development, PSIC.

ii. Placement of Draft PC-I of Scheme along with a concept paper before PSIC Board ofMembers for getting its approval to proceed further in the matter.

iii. Submission of PC-I to Planning & Development Department, Government of Punjab,for clearance / approval of scheme, in case of Govt. Funded scheme only.

iv. After clearance / approval of Scheme, announcement in media regarding establishmentof Small Industries Estate.

v. Issuance of Notification under Section-4 of Land Acquisition Act, 1894, by concernedRevenue Authority for acquisition of identified land.

vi. Submission of cases for provision of electricity & Gas connections to concernedauthorities in parallel with acquisition of land.

4. REQUISITS AFTER COMPLETION OF ABOVE ACTIONS

i. Calling of applications for booking of plots in Small Industries Estate with 50% downpayment of cost of developed plot of any category. Remaining 50% cost to be collectedin installments within one year.

ii. Receipt of cost of plots in concerned Regional Office and itsonward depositiontoRevenue Authority, Electric Supply Company and transmission to Directorate ofWorks & Development, Head Office, Lahore, for completion of Civil Worksaccordingly.

iii. If response is found appropriate i.e. number of applications received is 80 %equivalent/over and above to created plots, then further steps for acquisition ofidentified land would be taken. However, if response is found poor, implementation ofscheme will be revisited.

iv. Issuance of Notification under Section-6 of the Land Acquisition Act, 1894, fordetermination of cost of land and payment procedure to the land owners.

5. CRITERIA FOR ALLOTMENT OF PLOT

(a) Eligibility criteria for applicants are laid down as under:Applicants must provide following documents with their applications:i. Project Business Plan.

ii. Financial statements.iii. Undertaking of no Bank default.iv. Undertaking to start construction within 3 months of possession.v. National Tax Number certificate.

vi. Sales Tax Certificate (if applicable).

(b) Submission of business plan must cover the following points:

i. Business profile (existing business, if applicable).ii. Company profile with name & experience of technical persons (new

business).iii. Construction Plan.iv. Expected volume of annual exports (if applicable), GDP contribution.v. Expected number of employees.

vi. Construction period / schedule of completion.

6. OTHER IMPORTANT STEPS TO BE TAKEN BY REGIONALDIRECTOR CONCERNED / DIRECTORATE OF WORKS &DEVELOPMENT.

i. After receipt of 50% down payment from all applicants, hiring of Consultants andaward of work to them for preparation of design / Master Plan of scheme.

ii. Take necessary steps for allotment of plots through First come First serve basis.

iii. Issuance of Provisional Allotment Letters to successful applicants (Specimen atAnnexure-A) containing installment payment schedule by Regional Directorconcerned.

iv. Finalization of Lay Out / Master Plan of SIE by Consultants.

v. On clearance of cost of full plot as well as development charges as well as onfinalization of lay out / Master plan of SIE by Consultants, balloting for allotmentof plot numbers will be undertaken and intimation letter will be issued.

However,final Allotment Letter will be issued on completion of estate. (Specimenat Annexure-B).

vi. Enhanced payments could also be received by PSIC from allottees in case ofincrease in estimated cost of land and other facilities or in result of Court Decisionat any stage.

vii. Maintenance cost for one year after completion of civil works will be included inPC-I and will be considered towards calculation of cost of a development plot.

7. FINANCIAL ARRANGEMENTS / PROCEDURE

i. All payments regarding sale of plots will be received by Regional Office concernedand will transfer to Directorate of F&A, PSIC, Head Office, Lahore.

ii. Required funds for acquisition of land and to carry out other development activitieswill be provided by Directorate of F&A, PSIC, to Directorate of W&D, RegionalOffice concerned and other Government Departments, “On Demand”.

8. DESIGNING AND AWARD OF CIVIL WORKS / EXECUTION

i. After taking possession of land, Directorate of W&D will hire Consultants forplanning, designing and cost estimation of civil works.

ii. Directorate of W&D would be responsible for pre-qualification of contractors,bidding and allied matters regarding execution of scheme.

iii. Processes of designing and award of civil works and its execution will be theresponsibility of Director of W&D.

iv. Development of SIE will be as per PC-I and any additional facility / work will beexecuted at cost of allottees.

v. Civil works may include; roads, water supply, sewerage, electricity, gas (subject toavailability), boundary wall, Admn. Office etc.

vi. Directorate of W&D will ensure completion of civil works and allied facilitieswithin two years after assumption of possession of land by Regional Directorconcerned. However exceptions are there due to any un-avoidable circumstances.

vii. Regional Director concerned will submit and pursue cases with relevantdepartments for provision of electricity, gas, water, telephone etc. in SIE.

9. COMPLETION OF THE ESTATE

The date of completion of estate would be that date on which all Civil Work (Road,Sewerage, Boundary Wall, Water Supply) would be completed and main electric lines areenergized. The Corporation would manage and maintain the estate in collaboration with BOMwhich will be formed through prescribed manners. It will exercise power/authority as entitledto it by PSIC Management from time to time.

10. POSSESSION OF PLOTS

i. On completion of civil works and provision of electricity (i.e. completion of estate)Regional Director concerned will issue Registered Notices/Final Allotment letter toallottees directing them to take over possession of their plotsimmediately.

ii. The allottee will get building plan approved from the Regional Director/Estate Officeconcerned on payment of prescribed fee.

iii. The allottee must construct their project buildings and install project machinery within02-years from the date of completion of estate.

iv. Regional Director will get construction schedule from allottee preferably on followinglines:

v. Regional Director will monitor & record the construction on the basis of scheduleof construction submitted by the allottee.

11. MAINTENANCE CHARGES

i. Recovery of maintenance charges will start from the date of completion of estate.

ii. Maintenance Charges @ Rs.1000/- per kanal per month and Water & Sewerage chargesas per WASA rates will be levied from date of completion of estate. These charges willbe recovered on quarterly basis.

iii. Rates will be reviewed after every two (02) years @ 10% per annum by PSIC.

12. CANCELLATION/RESTORATION OF PLOT

CANCELLATION OF PLOT RESTORATION OF PLOT

13. OTHER REASONS FOR CANCELLATION OF PLOT BY REGIONALDIRECTOR(s)

a) Violation of terms & conditions of allotment.b) Violation / non-compliance of directions of PSIC and Government regarding

industrial safety, environment management and other such like instructions.c) Use of plot other than industrial purpose.d) Construction of unit without approval of building plan or in violation of approved

building plan.e) Violation/non-compliance of directions of PSIC and Government regarding

Industrial-Municipal waste management.

2) If allottee fails to complete constructionof project building within two years fromthe date of completion of estate, plot willimmediately be cancelled by RegionalDirector concerned.

1) Plot cancelled due to total Non-Construction will not be restored. It willbe put to auction within 03-monthsfollowing auction Procedure laid down inPSIC auction Policy-2003.

The original amount deposited byallottee on account of cost of plot/landafter deducting all PSIC dues shall berefunded only after auction of thecancelled plot.

2) In case a plot is cancelled on account ofpartial construction, the affectee may fileappeal to Competent Authority.

Competent authority shall decide the casewithin 30-days after filling the case.Competent Authority may restore plotand grant extension in the period ofconstruction. However, Authority shallnot restore plot without imposing fine asprescribed and shall not grant extensionmore than 02-times for a total period of ayear. If the So restored plot is notconstructed completely, within given timeframe, its allotment would be cancelledand it will be put to auction in accordancewith the procedure laid-down in auctionpolicy-2003 and original amountdeposited by allottee will be refundedafter deducting all PSIC dues.

3) Restoration charges will be imposed@ 4%of prevailing evaluation table notified byDistrict Collector concerned.

14. RESTORATION OF CANCELLED PLOTS

a) The allottee whose plot is cancelled on grounds mentioned in section-13, may applyto Managing Director, PSIC, for restoration of plot within 30 days of cancellation.The Committee headed by Managing Director, PSIC, may restore plot on case-to-casebasis subject to payment of PSIC pending dues/liabilities @ 5% of prevailingevaluation table notified by District Collector concerned, as restoration fee byallottee.

b) If allottee does not apply for restoration of plot within stipulated period, plot will betreated as permanently cancelled.

15. RESTORATION OF PLOT COMMITTEE

a) Committee for consideration of restoration of plot cases will consist as under:-

i. Managing Director, PSIC (Convener)ii. Deputy Managing Director, PSIC Member

iii. Director (Estates Management) PSIC. Memberiv. Regional Director concerned. Member

b) Decisions of Committee will be recorded and minutes thereof, duly signed, will bemaintained by Directorate of EM.

c) The above Committee may also consider the cases for condonation of delay upto 3months from expiry of time for filing of appeal against the cancellation order andmay decide the case on merits of case.

d) Aggrieved party may file an appeal before PSIC Board of members against anydecision of Committee.

16. PROCEEDS OF SALE OF PLOTS

a) Regional Director concerned will collect the down payment and subsequent paymentof installments and will retain that amount in an account specifically opened for SIE.

b) This amount will be transferred to Directorate of F&A, PSIC, Head Office onmonthly basis.

c) Directorate of F&A, PSIC Head Office will transfer funds out of these proceeds toDirectorate of W&D and Regional Director concerned / other offices for carrying outactivities as per PC-I of the Scheme.

17. TERMS & CONSIDITIONS FOR ALLOTMENT OF PLOTS

a) The allottee shall pay dues in accordance with payment schedule.b) Transfer of Non-Constructed plots shall be dealt within accordance with section-22.c) The allottee shall complete the industrial unit within 2 years. The term of 2 years will

commence from the date of completion of estate.d) In case of non-construction of the unit within two years, it will be dealt in accordance

with section-12 (2).e) Allottee will be bound to pay maintenance charges from the date of completion of

estate.

18. REFUND UPON CANCELLATION OF PLOT

In case of permanent cancellation of plot, the amount deposited on account ofpurchase of plot will be returned after deducting maintenance charges, non-constructioncharges and other charges due uptodate of cancellation of plot by Regional Directorconcerned and penalty of 20% of purchase value. Deposited amount of default allotteewould be refunded out of funds received from new allottee against cost of plot afterauction.

19. AUCTION OF PLOT

Permanently cancelled plots will be sold out through open auction as per PSICAuction Policy-2003.

20. SIE BOARD OF MANAGEMENT (BOM)a) Composition of BOM

i. Industrialist of the estate concerned nominated Chairmanby Managing Director, PSIC.

ii. Regional Director concerned. Memberiii. Assistant Director/In-Charge of concerned estate Secretaryiv. Representative from the office of Deputy Commissioner Memberv. Representative from concerned Chamber of Commerce& Industry Member

vi. Two industrialists from concerned SIE.(Nominated by RD)Members

21. TRANSFER OF PROJECTS

a) Projects (Constructed but functional or Non-Functional) can be transferred any timeby owner.

b) All Regional Directors will maintain computerized data of all allottees in SIE.c) All cases for transfer / sale of plots/units will be scrutinized and processed by

concerned Assistant Director/In-Charge SIE.d) A Committee headed by Regional Director concerned will examine each case of sale

of plot or industrial unit and decide as per policy, duly approved by PSIC Board ofMembers.

e) Transfer fee and other fee will be charged at rate approved by PSIC Board.

22. TRANSFER OF NON-CONSTRUCTED PLOT

I. Allottees may sale duly allotted but not constructed plot after depositing all dueamount liable to be paid. This sale transaction will be allowed once and only beforethe expiry of construction period. This sale-purchase will be guided by following:-

a. Exit fee @ 10% of prevailing evaluation table notified by District Collectorconcerned will be charged from the seller to avail exit opportunity. In addition toit the seller will also clear all the dues liable to be paid at the time of transfer ofplot. Plots will not be transferred in any case unless he clears the dues.

b. Transfer fee @ 3% of prevailing evaluation table notified by District Collectorconcerned will also be charged from buyer.

II. New allottee/buyer will be bound to complete the project within 15-months from thedate of transfer of plot. In this regard an affidavit on legal paper valuing Rs.1200/-will be submitted by the new buyer/allottee at the time of transfer of plot, wherein, itwill be specified that new allottee will start construction within 03-months from thedate of transfer, complete construction within 15-months and will not sale furtherthe plot to any other person.

III. Regional Director will get construction schedule preferably on following lines:

IV. Regional Director will monitor & record the construction on the basis ofschedule of construction submitted by the allottee.

V. Regional Director, will ensure issuance of Transfer Letter within 05-days fromthe meeting of RPTAC. Regional Director will be personally responsible incase of delay of issuance letter

VI. SIEs/EPZs where Construction period has already been expired butconstruction has not yet been carried-out or completed will be given01-year w.e.f 01.01.2019 for completing construction. In case the building isnot constructed completely on the allotted plot by 31.12.2019, it will becancelled permanently. However, Non-construction charges for the defaultingperiod will remain outstanding and will be recovered as prescribed in thepolicy-2019.Constructionperiod for SIEs to be constructed in future will be02-years and will be calculated from the date of the completion of the estate.Construction period for SIE-Sundar i.e. 02-year, has already been started fromMay-2019.

VII. Regional Director, shall monitor the progress of construction and issue a letterof appreciation or warning/notice, as the case may be after every phase. Ifallottee fails to construct the project within given time frame. His allotmentwill be cancelled immediately by the Regional Director Concerned. In case

Regional Director fails to monitor the progress and issue appreciation orwarning letter/notice he will be held responsible.

VIII.Plot cancelled due to total Non-Construction will not be restored. It will be putto auction within 03-months following the auction procedure laid down inPSIC auction policy-2003. The original amount deposited by the allottee onaccount of cost of plot/land after deducting all PSIC dues shall be refundedonly after auction of cancelled plot.

IX. In case a plot is cancelled on account of partial construction, the affectee mayfile appeal to Competent Authority. The Competent Authority shall decide thecase within 30-days after filling the case. The competent authority may restoreplot and grant extension in period of construction. However, authority shall notrestore plot without imposing fine @ 4% of prevailing evaluation table notifiedby District Collector Concerned and shall not grant extension more than 02-times for a total period of a year. If the so restore plot is not constructedcompletely, its allotment would be cancelled and it will be put to auction inaccordance with procedure laid down in PSIC auction policy-2003 and originalamount deposited by allottee will be refunded.

23. SMALL INDUSTRIES ESTATE LIFE CYCLE

a) Bifurcation of Plot

Bifurcation of a plot may be allowed with deposit of 5% fee of prevailingevaluation table notified by District Collector concernedby allottee(s), asalready approved by PSIC Board in its 101st meeting held on 23.05.2018.

b) Amalgamation of PlotsAmalgamation of two or more plots may be allowed with deposit of 5% ofprevailing evaluation table notified by District Collector concerned by allallottee(s) concerned. Bifurcation & amalgamation will be allowed byManaging Director on recommendations of Regional Estate ManagementCommittee.

24. MISCELLANEOUS PROVISIONS

a) Plot once allotted through open balloting will never be exchanged.

b) If allottee intends to surrender his plot and get refund of deposited amount beforeissuance of final allotment letter, then he will be refunded the deposited amountafter deduction of 5% of deposited amount.

c) Allottee would also be eligible to sell booked plot before issuance of finalallotment letter subject to payment of exit fee and transfer fee by new purchaser.

d) In case, at time of possession of plot, if plot allotted is greater than allotted area /size, then allottee would have to pay cost of excess area of land @ prevailing DCnotified price per kanal plus 40% DC notified price in addition.

e) In case, at the time of possession of plot, if plot allotted is less than the allottedarea / size, then allottee would be refunded cost of less area of the plot depositedby the allottee.

f) In case, at the time of possession of plot, surplus/excess area between the plotshaving same owner appeared, then allottee would have to pay cost of surplus /excess area of land @ prevailing DC notified price kanal plus 40% of DC price inaddition.

g) In case, at time of possession of plot, surplus/excess area adjacent to plot(s)appeared, then interested allottees would have to pay cost of surplus/excess area ofland @ prevailing DC notified price per kanal plus 40% of the prevailing DCnotified price in addition.

h) In case, at the time of possession of plot, surplus/excess area adjacent to plot(s) is10-marla or greater than 10 marlas (regular plot), then plot will be sold out throughopen auction as per PSIC auction policy-2003.

i) Fee and charges in case of different issues pertaining to Estates Management areplaced at Annexure-E.

j) Revised policy instructions/procedures/competent authorities to settle differentissues pertaining to estates management are placed at Annexure-F.

k) Procedure for booking of plots in Regional Offices is placed at Annexure-G.

25. This policy will be applicable to all PSIC industrial estates/EPZs and will renderexisting policy(s) pertaining to SIEs/EPZs inoperative.

iii. That allottee, within a period of two years commencing from the completionof estate i.e._____ shall erect upon the plot a self-sufficient unit of industry/manufacturing unit as per approved line of production, erect building inaccordance with PSIC Building Bye Laws.

iv. That allottee shall abide by all Rules, Regulations, Terms & Conditionscontained in Building Bye Laws / Policy of the Punjab Small IndustriesCorporation (PSIC) as amended from time to time.

v. That allottee shall ensure that manufacturing activities shall not endanger theestate, with atmosphere hazards or environmental pollution in any sort. Itwill be allottee’s legal obligations to take all possible measures to check andcontrol the pollution according to the Environmental Protection AgencyStandard. The allottee shall also dispose off the industrial waste in a manneracceptable to the management of PSIC and estate.

vi. That allottee shall construct a septic tank as per standard design (to beprovided by PSIC) before disposing off waste into Estate Sewerage/Drainagesystem.

vii. That allottee after completion of the unit within the prescribed period shallsubmit a completion report to PSIC and obtain a Completion Certificate.

viii. That allottee shall not change the approved line of production, corporate setup /constitution and name& style of the Approved Industrial Unit / Project withoutprior written approval of the Competent Authority who originally allotted thesaid Plot(s).

ix. That allottee shall neither sell nor change the corporate set up of the un-utilizedPlot without prior written approval of the Competent Authority. In case, theallottee intend(s) to dispose off this plot(s), it will only be sold to PSIC at therate, it was allotted. PSIC, in return will auction the same and return the initialcost of the plot.

x. That in case the allottee intend to obtain any financing to setup and / or to runthe PSIC Approved Industrial Unit/ Project from any of the Scheduled Banks /Financing Institutions and need to mortgage said Plot(s) as security against suchfinancing, the Punjab Small Industries Corporation undertakes to mortgage thePlot(s) as security on his behalf to such Bank I Financial Institution till the timethe Sale Deed is executed in terms of Clause-8 hereunder. Thereafter, liability ofPunjab Small Industries Corporation (PSIC) hence shall only be to the extent ofmortgage of the Plot(s) and the Bank /Financial Institution will not have anyright / authority to invoke any other Provisions of the financial agreement.

xi. In case the above mentioned terms and conditions are not fulfilled by allottee,the plot will be cancelled by the Punjab Small Industries Corporation. The Plot,after cancellation may be sold/allotted by Punjab Small Industries Corporationand the allottee shall be entitled to receive balance amount of consideration afteradjustment of all the expenses incurred, Charges or penalties and its salethereafter.

xii. That allottee will be bound to obtain the approval of the Factory Building Planaccording to PSIC Building Bye Laws 2002 in addition to any other permissionrequired from Local Authority or Government Agency having the lawfuljurisdiction over the matter.

xiii. That the allottee shall pay the maintenance charges /utility charges as per PSICPolicy from the date of completion of the estate.

xiv. That said Plot(s) or its any part shall not be used for residential and commercialpurposes.

xv. That 10% extra price would be charged from allottee for corner plots and thoseat front row.

xvi. That Plot(s) shall liable to be cancelled immediately if PSIC approved industrialunit is not established within two years from the date of completion of estate asmentioned in clause 3(iii) of this letter. Plot cancelled due to total Non-Construction will not be restored. It will be put to auction within 03-monthsfollowing auction Procedure laid down in PSIC auction Policy-2003.The original

FUNCTIONS OF BOM

1. Implementation of rules, policies, guidelines, instructions, etc. issued by the PSICManagement from time to time regarding industrial estates matters.

2. Propose amendments / new policies to the PSIC Management for the development andmanagement of industrial estates.

3. Impose and recover penalties from the allottees on violating building bye-laws, rulespolicies etc. in accordance with PSIC policies.

4. Propose investment scenarios to PSIC Management with regard to development ofindustrial estates and monitoring execution of development works and expenditures inSIEs.

5. Establishment of common/technical facility/service/utility centres with the permissionof PSIC Management.

6. Prepare annual budget of industrial estates and submit to the PSIC Head Office forapproval of PSIC Board.

7. To recover fee / charges from the allottees in accordance with the policy / instructions /guidelines issued by PSIC Management. The amount recovered will be kept in a jointaccount of Regional Director and Chairman of BOM approved by the ManagingDirector, PSIC.

8. Utilize funds collected in consultation with Regional Director, PSIC on the maintenanceand development of SIE concerned.

9. Outsource any operational and management function to reputable entities as and whenrequired with the permission of PSIC Head Office.

10. Grant permission for erecting advertisement sign boards / boarding neon signs / otherand collect rent / charges thereof subject to approval of PSIC Head Office.

11. Establish canteens and other culinary facilities in accordance with approved Master Planand budget and with approval of MD, PSIC.

12. Supervise the execution of development works and incur expenditure thereon in the SIEsubject to provision of approved budget.

13. The BOM may enter into any obligations, contract / agreement for a maximum periodof one year. For obligation, contract / agreement for a period of more than one year,prior approval of MD, PSIC would be obtained. Head Office shall be informed for allobligations / contract / agreement signed / executed within 15-days of approval ofBOM.

14. Custody of record shall remain with the In-charge of concerned Estate.

15. BOM may appoint Legal Advisor on retainer ship basis or otherwise and decideremuneration. BOM shall inform Secretary, PSIC Board within 15-days of newappointment and change in terms of reference, etc. of Legal Advisor.

16. Any claims or demand against BOM will be referred to PSIC Management.

17. BOM will develop structure of management of SIE and assign role to run affairs of theestate, except transfer of land or other such matters.

18. To perform any other role / task as may be assigned by the PSIC Management.

19. BOM of Industrial Estate will submit annual performance report to Managing Director,PSIC.

20. BOM will take measure for colonization of industrial estate within given time period.

21. BOM will ensure maintenance and development of industrial estates.

22. Certain percentage fees/charges, as per (Annex-E) collected from the allottees, asdecided by PSIC Head Office, will be transferred from the account of BOM to RegionalOffice for payment of salaries to the staff of SIE and expenditure on contingencies, therest of the amount would be utilized for the development of concerned Industrial Estate.

23. BOM with the approval of PSIC Head Office may impose additional fee and amount socollected would remain in the account of BOM.

ANNEX-D

TERMS & CONDITIONS

1. Members of the BOM will be nominated for a period of two years by PSICManagement (Managing Director, PSIC). PSIC Management reserves the rights tochange the member prior to expiry of two years by recording the reasons of changein writing.

2. Chairman/member of BOM will not be defaulter of PSIC.

3. Chairman/Members, if they are found to be involved in crime or fraud at any stageduring their tenure, they will cease to be Chairman/Members as the case may be.PSIC Management will immediately de-notify and nominate the other Industrialist..

4. The members of the BOM from private sector would not be given any remuneration,fee etc. for their services.

5. BOM will hold at least one meeting every month in the Estate Office or RegionalDirector’s Office. Minutes of the meeting will be recorded and share with the PSIC,Head Quarter. Regional Director will be responsible for recording the minutes of themeeting and its sharing.

6. In case of any dispute about the status of the BOM or any other issue, decision ofthe Managing Director, PSIC would be final and binding.

7. The In-charge of estate would be secretary of the BOM.

8. BOM will be subservient to the rules, policies of PSIC and its management withoutany legal recourse.

PROCEDURE FOR BOOKING OF PLOTSIN ROS

First Come First Serve Basis

(For Official Use only)

1. Nomination of an officer/official in Regional Office concerned to receive theapplications alongwith requisite documents and issuance of acknowledgementreceipt to applicant indicating date and time of receiving the applications.

2. Sign and Stamp of dealing officer on right corner of application forms for PSICrecord.

3. Maintain a plots control register (category-wise) duly signed by RegionalDirector concerned. The dealing officer will sign on the register at the closing ofbooking on daily basis.

4. Submission of daily progress and later-on consolidated report to RegionalDirector / Director (EM), PSIC, Head Office, Lahore.

ANNEX-H

PROCEDURE FOR THE INVITATION AND RECEIPT OF

APPLICATIONS FOR ALLOTMENT OF PLOT IN PSIC SIES

i) Applications for allotment of plots will be invited on prescribed formsfrom interested entrepreneurs through print media within given timeperiod. Notice for invitation of applications will be published at-least intwo National Dailies one in Urdu and other in English. The applicationsreceived prior or after given dates will not be entertained.

ii) One applicant can apply for only one category of plot. Submission of anapplication does not render entitlement to the right of allotment.

iii) Application forms can be obtained from PSIC Regional Offices onpayment of Rs.1,000/- and alongwith receipt thereof. Applications formscan also be downloaded from Website of PSIC www.psic.gop.pk andapplicant will attach a bank draft of Rs.1,000/- on account of price ofapplication form. The applicant will attach a bank draft of Rs. 5000/-(Non-Refundable) on account of processing charges in favour ofconcerned PSIC Regional Offices and enter its No. in given Column ofapplication form.

iv) The applicant will attach bank draft of 50% of total estimated cost of plotalongwith applications in favour of concerned PSIC Regional Offices andenter its No. in given Column of applications forms, the remainingamount will be deposited in installments as per payment schedule.

v) The applications will be received in office of concerned Regional Officesby post or personally alongwith requisite documents.

vi) In complete applications will not be entertained.
