But it is revealed that Sjri Pastey sold the Turbhe house in 1990 and the none of the neighbourers know about the presents whereabouts of Pastey. Discreet enquiries with the BOI, Chembur, SBI, Chembur revealed that they also could not recover their dues till date & that the SBI has closed the accounts of Shri Bagade. Further the dues confirmed vide OIO dt. 31.10.2000 were further upheld by Comm'r. (Appeals), Pune-II by reducing the penalty u/s 11AC to only Rs.296350/- and imposing interest on Rs.296350/- only. The party paid the Duty Rs.928051/- in full at various times and the penalty also paid partly. Penalty now remained to Rs.179473/- only. Interest worked out to Rs.444494/-. Further Cestat vide order No. A/2084/C-IV/SMB/WZB/2006 dt.05.12.2006 rejected party's appeal and upheld the OIA dt. 29.04.2005.
