En la Gaceta Oficial N39.795 de fecha 8 de noviembre de 2011,

fue publicado el Decreto N 8.579 mediante el cual se dicta elReglamento Parcial de la Ley Orgnica de Ciencia, Tecnologa ennovacin Referido a los Aportes, el Financiamiento y su

Resultado, y la tica en la Investigacin, Tecnologa en Innovacin,emanado de la Presidencia de la Repblica.

El referido Reglamento de la LOCTI, entre otros realiza una serie decambios en las definiciones de aporte, beneficiario e ingresobruto

Con respecto a la normativa anterior, los aportes estn ahoraconstituidos por la contribucin especial impuesta a los sujetosobligados de destinar un porcentaje de sus ingresos brutos,eliminando el trmino recursos (dinero, bienes, servicios, etc) que

estableca el anterior reglamento.Asimismo, se modifica la definicin de ingresos brutos,estableciendo que se excluirn las exenciones y exoneracionesprevistas en otras leyes adems de la LISR.

Con respecto a la base de clculo del aporte, se mantiene que seconsiderarn los ingresos brutos del ejercicio econmiconmediatamente anterior al que corresponda cumplir la obligacin.

En relacin con el momento de pago y declaracin del aporte, elartculo 6 prev que deber realizarse durante el segundo trimestreposterior al cierre del ejercicio econmico en el cual fuerongenerados los ingresos brutos que constituyen la base de clculo

para el cumplimiento de la obligacin prevista en el Ttulo III de laLey.

El nuevo Reglamento incluye entre otras la figura delfinanciamiento, al cual podrn acceder aquellos que deseen serbeneficiarios de los recursos provenientes de los referidos aportes,quienes debern cumplir con una serie de requisitos previstos endicho Reglamento, el cual podr ser otorgado bajo las modalidadesde subvencin y crdito blando.

Finalmente, se indica en la Disposicin Transitoria nica que losngresos brutos que se obtengan durante el ejercicio econmicosiguiente a la entrada en vigencia de la LOCTI publicada en 2010,sern la base de clculo para el pago de los aportes y

correspondiente declaracin a realizarse durante el segundotrimestre posterior al cierre del ejercicio econmico en el cual segeneren los ingresos brutos que constituyen la base de clculo dea obligacin prevista en la Ley.

Publication of the Regulations to the MasterLaw on Science, Technology and Innovation

Decree N8,579 was published in Official Gazette N39,795 of

November 8, 2011, which enacts the Partial Regulations to theMaster Law on Science, Technology and Innovation RegardingContributions, Funding and Results, and Ethics in the Investigation,Innovative Technology, issued by the President of the Republic.

Such Regulations to the Master Law on Science, Technology andInnovation make several changes to the definitions of contribution,

beneficiary and gross revenue, among others.

In relation to the former rules, the contributions are now representedby a special contribution imposed on taxpayers, consisting of anassigned percentage of their gross revenues, eliminating the termresources (money, goods, services, etc.) established in the priorregulations.

Likewise, the definition of gross revenues is modified, establishingthat the exemptions and exonerations set out in other laws inaddition to the Income Tax Law shall be excluded.

The basis to calculate the contribution remains the same, namely,gross revenues of the fiscal year immediately preceding that whenthe obligation must be met.

In relation to payment and declaration of the contribution, Article 6sets forth that it shall be made during the second quarter followingthe close of the fiscal year when the gross revenues that representthe calculation basis to satisfy the obligation set out in Title III of theLaw are generated.

The new Regulations include, among others, a funding figure, withaccess thereto granted to those wishing to become beneficiaries ofthe resources provided by the aforementioned contributions, aftercompliance with a series of requirements set out in suchRegulations, which may be granted as a subsidy or as a soft loan.

Finally, the Sole Transitory Provision sets out that gross revenuesobtained during the fiscal year following the effective date of theMaster Law on Science, Technology and Innovation published in2010, shall be the calculation basis for payment of the contributionsand filing of the respective declaration to be made in the secondquarter following the close of the fiscal year when the grossrevenues that represent the calculation basis for the obligation set

forth in the Law are generated.

Este Reglamento deroga el anterior Reglamento de la LOCTI publicadoen gaceta Oficial N 38.544 de fecha 17 de octubre de 2006, as comoas dems disposiciones de rango sublegal que colidan con el mismo.

These Regulations derogate the former Regulations to the MasterLaw on Science, Technology and Innovation published in OfficialGazette N38,544 of October 17, 2006, as well as any othersublegal standard colliding therewith.

The Regulations are effective from publication in Official Gazetteof the Bolivarian Republic of Venezuela.
