already marketed brand name drug in dosage, form, safety, strength, route of administration, quality, performance characteristics, and intended use.
• Brand Name Drug: Medications protected by patents. • Specialty Drug: A drug with a insurer-negotiated monthly
cost that exceeds the threshold for a specialty drug under the Medicare Part D program (Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (Public Law 108-173)). In 2018, the threshold amount is $670 for a one-month supply.
