REPOBT.

Under grants from the congress of the United States the state of Nebraska has acquired title to 3,026,659.90 acres of land, distributed evenly throughout the state. The largest g r m t to the state is contained in section 11, of the enabling act passed by collgress in '1863, whereby sections 16 and 36 are granted to the state for the use and support of its common schools. By this one grant alone one-eighteenth of the entire acreage of' the state passes to the state for the purpose desig- nated,

In addition thereto, the state has received grants of lands under aats of congress in 1864 and 1867 of 46,080 acres for the development of its saline springs; of 32,000 acres for peniten- tiary purposes; of 46,080 for state university purposes, and under territorial grant of 1862 for agriaultural college of 89,462.78 acres.

Nineteen thousand acres of the saline lands were disposed of and the proceeds used in the development of the salt springs; 320 acres were disposed of to aid in building the State Univer- sity and Agricultural College, and 1,280 acres were set aside for model farm.

During the twenty-third session of the legislature an act was passed providing for the disposition of the remaining saline lands under the provisions regulating the leasing and sale of common school lands, the proceeds to be used in the same manner as pro- ceeds of common school lands. Under the provisions of this act these lands have been placed on the market, and all are either deeded, under lease, or contract of sale.

Section 8 of article 8 of the Constitution of the state fixes a I

minimum price of seven ($7.00) dollars per acre for the sale of all the state lands, and sections 3816 to 3849 inclusive of the Consolidated Statutes of the state provide the method of dispos- ing of the lands by leasa or sale.

As compared with my last report, the above table shows that during the biennial period ending November 30, 1894,41,050,33 acres were deeded; 67,677,ll acres were contracted for, and 556,- 575,19 acres were leased. The revenues derived from the leme ~ n d sale of these lands are divided into two funds known as the temporary and permanent school funds. The revenues derived from the lease of school lands and the internet paid on the un- paid principal, where lands are held undercertificates of sale, con- stitotse the temporary school fund. During the biennial periocl from November 30, 1892, to November 30, 1894, revenues amountillg to $602,258.85, belong- ing to the temporary school fund, and revenues amouuting to $~&,700.14 belonging to the permanent school fund, have-been collected and entered of record in this office.

The investment of the permauent school fund is under the ~ n t r o l of the Board of Educational Lands and Funds, and the record of the proceedings of that board are kept in this of- fice. The record of this board shows that during this biennial period the Board of Educational Lands and Funds has or- Jered the investment of $674,742.45 in the interest bearing gecurities denominated in section 8 of article 8 of the Consti- tution.

FORFEITUBEB.

The service of delinquent notices and the forfeiture of scbool land leases and contracts of sale for failure on behalf of the holders to make payments due the state, has formed a spe- cial branch of the work of this office during the past two years.

Section 3831 of Cobbey's Consolidated Statutes provides for the forfeitures of school lands. The section above cited con- tains all the law now governing the forfeiture of all educational lands. Under this section some fifty thousand hotices to delin- quents have been issued and put in the hands of the treasurer of the county in which the lands are located, for service. These no- tices, when served, are returned by the eonuty treasurer to this bffice, with his endorsement thereon, showing the manner in which the delinquent notices have been served, and are preserved in this office as a part of the record evideuce thereof. A great many questions, however, have arisen regarding the legality of the service of theee uotioee, and in nearly every courlty of the state, where forfeiture of school land has been declared, litiga- tion bqa followed, owing to the questionable character of the service of the notices. By reference to the section above eited,

you will observe that its meaning is vague and uncertain, and susceptible of many constructions. I therefore think it advisa- ble to prescribe by statute a direot and explicit manner of service of delinquent school land notices. I t will save needless litigation to the individual, and materially lessen the expense of forfeitures to the state.

Very few forfeitures were entered where lands were occu- pied by parties who owned them. On account of the failure of crops, and consequent scaroity of money, no forfeitures have been declared during the past few months. Most of the lands forfeited during thig biennial period have been based again, and at a premium sufficient to reimburse the state for all lease rental and interest lost by non-payment of former holders.

STATE LOTS IN THE CITY OB LIXCOLN.

The state lots in the oily of Lincoln were sold at avation in June, 1887, the tarms being one-third cash, and balance in one and two years, deferred payments being represented by notes drawing seven per cent interest. There are many uncollected principal notes, and in many oasw iuterest is delinquent. No pro- vision has been made for forfeiture in case of default in payment of prinoipal note and interest. The laws authorizing the sale of these lots should be amended so that the laws' of forfeitures of school lands will be made to apply to city lots.

PENITENTIARY LANDS.

There yet remains a few tracts of Penitentiary lands in the counties d Lancaster and Seward. No provision has been made for the disposition of these lands, and the state derives no reve- nne therefrom. I recommend suoh legislation as will authorize the Commissioner of Public Lands and Buildings to dispose of these lands by lease or sale, as in case of common school 1and.s

CANAL RIGHT-OF-WAY.

I n many localities of the state irrigation ditches am being mnstruoted. There is prautically no law which enables ditch

mmpanies to secure right-of-way over state lands, and I reoom- mend such legislation as will facilitate the procuring of title to such companies to right-of-way over lands belonging to the state.

BE-APPRAIBEMENTS OF SOHOOL LANDS.

The laws of the state at this time provide that in appraising school lands for the purpose of fixing a basis for lease, rental, or certificate of sale, the appraisement shall be made by the county commissionera or boards of supervisors of the county in which the lands are situated, &d the contracts of lease of public lands now provi& for the re-appraisement of the lands by the proper au- thorities every five years. The provisions above set forth have been embodied in every lease issued subsequent to the 14th day of April, 1885. Prior to that date the contracts of leaae prbvided for the appraisement of scboal lands every five years, one ap- praiser to be selectcd by the lessee, one by the county clerk of the county in which the lends were located, and these two to select the third appraiser far the pnrpose of fixing the basis of lease rental due the atate by re-appraisement of the lands embraced in the lease.

The legislature of 1887 made provisions for the re-appraise- ment of all soh031 lands held under lease, and acting thereunder, the board of educational lands and fun& direated the county aommissioners and boards of supervisors of the several muntiea to .make re-appraisement of the lands in their respective counties, fixing a new basis of values for the state for,the five years sac- weding the year 1889, whiob appraisement duly certsed was re- turned to thie office and entered of record.

The question of the legality of the said appraisement beiug rabed the supreme court of the state in a decision rendered January 6,1891 (31 Neb., page 139), hold that that part of the m-appraisement of the school lands made in 1889, of l d held under l&e imued prior to April 14, 1885, whete the contract of Lease provide8 for the lessee naming one of the appraieers eta, as

illegal and void and that the collection of lease rental in such caae

due the state should be based on the old appraisement and not upon the appraisment of 1889.

The setting aside of the appraisement of 1889 has fixed the revenues derived from the lease of the school lands belonging to the state on the basis of values given to the lands by appraise- ment in 1885 and prior thereto, and in a majority of cases the values then fixed are very low. I therefore deem it expedient and for the best iotarests of the state to a@ for a apecific appro- priation for the purpose of having all school lands and other lands subject to the laws governing 'the sohool lands of the state re-appraised by the proper authorities for the purpose of fixing a new basis of values for the ooliection of lease rental due the state for the ensuing of five years.

BOYD COUNTY SCHOOL LANDS.

Bn extended controversy over the ownership of seetione 16 and 36 in that part of Nebraska known as the "Old Ponca Ind- ian Beeervation," now embraced in the territory comprising Boyd county, has at last .been terminated. I n the fall of the year 1891, 1 visited Boyd county for the purpose of making in- demnity selections for lands belonging ia the st&, lost to the school lands of the state in place, by reason of the selections by Indian allotment of sahool lands in the Poncs Indian reservation.

The indemnity selections thus ma& comprised 4,690.06 acres of unoccupied lands. When these lists of indemnity se- lections were forvkrrded to the general land ofice, at Washing- ton, D. C., for approval, they were rejected by the Honorable Uommissioner of the general land offiw in a decision rendered October 31, 1891, on the ground that no grant was made to the state of Nebraska of sections 16 and 36, in place. for common school purpose under the act extending the bovridary line of the state of Nebrask passed by tbe congrees of the Unibsd Btatee and approved March LS, 1883, and that as no grant was made to

the state of sections 16 and 36 in place, no indemnity could be allowed for laud n i t lost in place. Under this decision the lvcal United States land office at O'Neill, Nebraska, allowed home- stead entries on sections 16 and 36, and also upon the indemnity selections made in Boyd county. From the decision of the Hon- orable Commissioner holding that no lands were oeded to the state by the general goverllment in the old Ponca Indian reserva- tion, ' I appealed through the local United States land ofice, at O'Neill, to the Honorable Seoretary of the Interior, claiming .for the state of Nebraska thegrant to the state of sections 16 and 36, by the' act extending the boundary as thoroughly and com- pletely as though the tract in question had been included in the original boundary of the state. I also filed protests against the acceptance of proofs and final pdyments thereon where the same conflicted with the interests of the state by claim of title to the lands above described. I also filed with the secretary of the in- terior a written brief and argumeut in support of the claim made

. . by the state of its ownership of these lands.

On the 26th day of February, 1894, the Honorable Secretary of the Interior rendered a decision supporting the appeal and sus-

' taining the poaition I had taken in the controversy, holding that sections 16 and 36 in plhce were school lands, and that indemnity should be allowed the state for lands lost under the Indian allot- ment ; thus confirming to the state title to the disputed lands in Boyd county, amouuting in all to 14,975 acres of land. The de- cision of the Secretary of the Interior is the final adjudication of the question at bar. By i t all adverse claims to the state's title to the lands in controversy are set aside and the grant confirmed to

pon the confirmation of title to the state, and the settle- of all disputefi relative thereto, and upon the petition from

the oitizells of Boyd county being filed for the appraisement of said lands, the Board of Educational Lands and Funds ordered

said lands appraised and advertised for the purpose of sale and lease as provided by law. This has been done; and the landa in Boyd county have been di~lposed of under the law autborixing the sale of common school lands.

I n addition to the con6rmation of the claims of the state by the general laad office at Washington, D. C., to who01 lands in

the " Old Ponaa Indian Reservation," I have elso secured. during this biennial period, the oonfirmation of the claims of the state for indemnity selections for lands lost in place to the soh001 land grant of 80,918 acres, distributed among the government land districts of the state as follows, via. :

The confirmed list of the lands selected in these land d i ~ - tricts was i ~ u e d by the Honorable Com~niasioner of the General land office on the 18th day of July, 1893, and the title to these lands became absolute in the state. Acting upon the instructions of the Board of Educational Lands aud funds, I have had these lands appraised by the proper authorities, and offered for sale and lease in the manner provided by law. The grant to the common schools of the state during this biennium has therefore been aug- mented by an addition of 45,893 acres.

STATE INSTITUTIONS.

The reports of the superintendents of the different institu- tions belonging to the state are herewith inclosed But little im- provement in the way of new buildings has been added to these institutions since my last report. The reports of the superintend- ents are exhaustive and deal with the absolute necessities of the institutions for the ensuing biennium. The legislature of 1893 dealt in a most parsimonious manner with most of the institutions. The estimates for repairs and improvements made and submitted by the superintendents were wholly ignored, and scanty provisions made for the care and mainte~lance of bu i ld i~ga Repair funds for all institutions were practically exhausted during the first year of the period, and in many instances work that should have been done to protect the buildings from the elements has been postponed because no fuuds were available to pay the required amount when the work had been completed. The reports of the superintendents deal particularily with the items of repairs and care of the buildings under their charge, and merit the closest of scrutiny.

Early in this period the Board of Public Lands and Buildings and the Board of Purchase and Supplies seeking to put all iublic buildings under their control on a uniform basis adopted a set of rules governing and unifying the transacting of business at state institutions. The rales thus adopted bring the business of the state more directly under the supervision of the board and the headsof the institutionsin touch with the Board of Control. On the whole the rules adopted have proven very satisfactory both to the superintendents and the boards above named. I n this eon- nection I desire to call your attention to the statutes governing - the Home for the Friendless. Sections 3368 and 3369 statutes of

1893 constitute the authority for the management of this institu- tion. The sections above cited are ambiguous, and i t is a mooted question whether or not the Boardof Purchase and Supplies and

the Board of Public Lands and Buildings have the authority under the laws quoted to direct the business management of this insti- tution. Taking into consideration the fact that the state appro- priated in 1891, $62,465.00, and in 1893, $33,000.00, for the main- tenance of this institution, and that the board of director8 of the society of the Home for the Frielldless are asking this year for an appropriation amounting to $42,760.00 for the support of the home, I deem it expedient that the laws creating this institution be so modified as to place this institution on a parity with other institutions belonging to the state.

I also submit herewith a tabulated statement showing the history and cost of the different state buildings under my con- trol. This table is as nearly correct as can be made from the data at hand:

THE OFFICE.

OAPITOL BUILDING AND GROUNDS.

During the past two years the grounds around the Capitol Building have been decorated with flower beds and the plots sowed to grasses. During the summer months the grounds have had a cheerful appearance. The building itself, however, is in need of repairs. The roof above the State Library is leaking badly, and the valuable library belonging to the state is in danger of being damaged from the imperfect roof. The heating plant is a1m in need of repairs. On page 15 of my last report, I submitted the report of an expert machinist relative to the battery of boilers used in heating the building. No provision was made by the legislature to carry out the recommendations therein made. The fieveral boilers should be overhauled and reset in order to assure safety in firing them.

A new feature of the biennial report from this office is the half tone engravings of the different state buildings, their interi- ors, and surroundings, and are ljublished for the purpose of showing more clearly the environments of the unfortunate wards of the state.

assistance rendered me by the employees of this office in handling the vast volume of business that has passed through my hands. Their arduous duties have been faithfully and efficiently per- formed and my grateful acknowledgements are due them for ser- vices well rendered.

The work of this office is voluminous and multifarious, em- braoing the keeping of 84,000 open ledger accounts and the work of twa important state boarde namely: the Board of Educational Lands and Funds and the Board nf Purchase and Supplies, be. $des the usual routine work of an office of this magnitude. tracing of the chain of title to the lands sold by the state to the individual aa represented by the 84,000 accounts or customers of state, requires the constant care and attention of every emyloyee

The force of the office consists at present of the deputy; chief clerk, draughtsman, two bookkeepers, one sale contract, one lease contract, one forfeiture, and two assignment clerks, and steno- grapher. These employes are kept constantly at work in their special branches during the greater part of the year, and when not employed in their special department the time is occupied in making copies of records, which by constant handling have be- come worn out or illegible.

is impossible to enumerate them. The correspondence is volnm- inous and daily increasing.
