PMCBank...The“in-principle”approvalhasbeen given to Centrum inaccordance with the offer itmade in response to theexpression of interest (EoI) totake over PMC Bank, the RBIsaid in a statement.

TheconsortiumofCentrumandBharatPehadexpressedaninterest in taking over PMCBank. According to reports,both Centrum and BharatPewill hold 50 per cent in thesmall finance bank and theassetsandliabilitiesofthemul-tistatecooperativebankwillbetransferred to it. “BharatPe isdelightedat theopportunity tobuild a high-performing tech-nology-led small finance bankserving the payment, invest-ment, and credit needs of theunder-served,” said AshneerGrover, chief executive officerand co-founder, BharatPe.

PMC Bank was placedundercurbsinSeptember2019.Its administrator had floatedan expression of interest onNovember 3, 2020, invitinginvestors for revival/recon-struction. Initially, fourinvestors had shown an inter-est and three of them partici-pated in further process.

In 2019-20, PMC Bank’sdeposits stood at ~10,727.12crore with advances at~4,472.78crore.Thebankpost-edanet lossof~6,835crorewithnet worth at a negative~5,850.61 crore. The RBI hadplaced the bank under restric-tions in 2019 following revela-tionsofallegedirregularities incertain loan accounts. OnMarch 26, theRBI had extend-ed the spell of curbs for threemonths beginning from April1, 2021, to June 30, 2021. Giventhe financial conditionofPMCBank, the process is complexand is likely to takesomemoretime. The process of recon-struction will start as soon asthe objectives are achieved tothe best possible extent, theRBI said.

Centrum Capital is plan-ning to raise equity capitalthrough a rights issue or a pri-vate placement (including butnot limited to a qualified insti-tutionalplacement). The issue of reading down of anti-terror law UAPA is “important”and can have “pan-India ramifi-

cations”, the Supreme Court said onFriday, making it clear that the DelhiHighCourt verdicts grantingbail to threestudent activists in northeast Delhi riotscase will not be used as a precedent bycourts in the country.

A vacation bench of Justice HemantGupta and Justice V Ramasubramaniantermedas “troubling” that thehighcourthaswrittenover 100pagesdiscussing theentire anti-terror lawUAPAwhile decid-ing the bail applications in the case andsaid it will require interpretation by theapex court.

The apex court agreed to hear theappeals filedbyDelhi Police challengingthe HC verdicts and issued notices toJNU students Natasha Narwal andDevanganaKalita andJamia studentAsifIqbal Tanha seeking their responses.

While refusing to stay the high courtverdicts granting bail to the three

accused, the bench said these judge-ments will not be treated as a precedentby any party before any court.

“In the meantime, the impugnedjudgment shall not be treated as a prece-dent andmay not be relied upon by anyof the parties in any of the proceedings.It is clarified that the release of therespondents (Narwal, Kalita and Tanha)on bail is not being interfered at thisstage,” the bench said in its order.

“Issuenotice,” it said, adding, “Let the

counter affidavits be filed within fourweeks.List in theweekcommencingJuly19, 2021 on a non-miscellaneous day.”

The bench took note of SolicitorGeneralTusharMehta’s submission thatthe UAPA has been “turned upsidedown” by the high court in granting bailin the case.

“We would like to issue notice andhear the other side,” it added.

Mehta urged the apex court to staythe high court verdicts saying the find-ings arrived at in these judgements “vir-tually recordacquittal for these accused”and other accused would also seek bailrelying on them.

“The way the Act has been interpret-ed, probably itwill require interpretationby the Supreme Court. That is why weare issuing notice,” the bench said.

Senior advocate Kapil Sibal, appear-ing for the student activists, said there isnodoubt that the apex court should con-sider the ramificationsand interpretationof theUAPA so that there is a judgementon the issue from the top court.

“We are dealing with bail applica-tions,” Sibal said.
