Considering:
a. that rice isastrategic foodcommodityfor the Indone
siansociety, thereforeactivitiesin the production, sup-
ply, procurement, anadlstrlbutron of lice beromesvelY
essential for food tenacity, increasing the income and
prosperityof rice farmers, inteffiCiot of mnSllmp~~and
thecreationof nationaleconomicstability;
b. that in order to achievefood tenadty, increasing the
incomeand prosperityof ricefanners, interestofcon
sumers, andcreation of national economicstability, it
require,5 d rnore effective ana aaequat~ polIcy sup~
ports, particularly polices in the field of import and
export of rice;
c. that Decree of the Ministerof Industry andTrade No.
9/MPP/Kep/1/2004 concerning Provisions on Rice Im
port which had been ametlded several times, lastlyby
Decree of the Ministerof Industryand TradeNo. 368/
MPP/Kcp/5/2004 is no longer in conrormarxe with

CHAPTER I
GENERAL PROVISIONS
Artide 1
In thisMinisterRegulation, what is meantby~
1. Rice is a kind of grainswith/without skin, either pro
cessed or not, originating from the OriZa sativaspe
des, with types ascontained in Attachment I of this
Minister ReguJatlon.
2. The import of rice for the purpose of price stabiliza
tion, tacklingeX ernergendes, poorcommunities, and
food vulnerablftties, is the procurementof rice from
overseas as reserve to be used by the Govemment at
anytime.
3. The import of rice forcertainpurposes isthe procure
ment or nee rrorn overseas related With factors of
health/dietary, special consumption or certain seg
ments, and procurement of seeds aswell asrequire
ments of industryrawmaterial/aidnotsupplied or nat
yet fully supplied by domestic sources.
4. The import of donated nee i::. lilt:! procurement at rice
from overseas by sodal institutions/organization or
government agendes ta be giVen to the publicinIndo
nesia and notforsale.
5. Rice importersare companies performing rice import
activities.
6. Rice Importer-Producer, hereinafter referred to as RiCe
IP, isa processing industry of lice products ad<nowf
edged andapproved by the Diredor General to import
certain rice needed or required merely as raw mate
rial/aid in the production process of its industry.

IMPORT OF RICE FORlHE PURPOSE OF PRICE
STABIUZATION, MmGATION OF EMERGENOES, POOR
COMMUNITY, AND FOOD VULNERABlL.m'

(1) Rice that areentitled to be imp::»ted for thepurposeof
pricestabilization, tackHng ofemergendes,poor-com
munity, and food vulnerabilityare rice(tariff postfHS
1006.30.90.00) on condition that the highestlevelof
breaka~ is 25% (twenty five percent).

(2) The rice referredto insub-artide (1) mayonly be im
ported outside of the one (1) month period before
grand harvest, grand harvest period, and two (2)
monthsafter the grand harvest.
(3) Stipulation of the-grand harvest period referred to in
sub-article(2) is made-by the Ministerof Agriculture.
(4) The executionof rice import referred to in sub-article
(2) maybeexemptedonly by the Ministerbased on an
agreementresultof the CoordinationTeam.
Artide"l
(1) The import of ricemeant in Article 3 sub-article(l) is
onlyauthorized to be perfonned byBULOO Public Com
pany.
(2) In order to be stipulated as anunporter as meant in
sub-artide(1), BULQG Public Company mustsubmita
requestinwriting to the Ministerby attaching:
a. Photocopy of General Importer IdentificationNum
ber (API-U);
b. Photocopy of Special Rice Importer Idcntificotion
Number (NPIK);
c. Photocopy ofTaxpayer Basic Number; and
d. Photocopy of Customs Identity Number(NIK);
(3) BULOG Public Company referred to in sub-article (l)

IMPORTOf RICE FOR CERTAIN REQUIREMENTS
ArticleS
(1) The import of ricefor certain purpose related with fac
tors of health(dietary, sp€Cfal consumptionor certain
segments, and procurement of seeds is ae contained
in Attachment II of this MinisterRegulation.
(2) Rice lmportreferred to-in sub-art:ide (1) maybe per
formed only by importers who havereceived import
approval from the Director General on behalf of the
Mini~r.
(3) In order to obtain the import approval referred to in
sub-article(I}, the impOrter must submit a requestin
writing to the Minister, in this case the DirectorGen
eralby attaching:

of LIe.(4) On the written request referred to in sub-article (3),
the Director General can issueail approval or rejec
tion, five (5) working daysat the latest from the date
the requestis received.
Article 6
The imported rice meant in Article 5 should be
packed in containers with clearidentity containing at least
the following information:
a. type and volumeof rice;
b. breakage level if required;
c. countryof origin; and
d. nameand address of importer.
Article7
(1) Rice importfor certainpurposes to meetrequirements
on raw material/aid for industries not produced or not
yet fully produced domestically, iscontained inAttach
ment II uf til is Minister Regulation.
(2) Theimportof ricereferred to in sub-article (1) may be
performed only by importers who had received
acknOWledgement as Rice-IP from the DirectorGen
eralon behalfof the Minister.
(3) The imported rice referred to in sub-article (1) 15 pro
hibited for sale-purchase or transfer.
(4) In order to be acknowledged asRice-IP, the importer
mustsubmita request inwriting to the Minister; in this
case the DirectorGeneral, by attachfng:
a. Photocopyof Importer-Producer IdentifICation Num
ber (API-P) or Limited Importer Identification Num
ber (API-T);

b. Photocopy of Special Rice Importer Identification
Number (NPIK);
c. Photocopy of TaxpayerBasic Number;
d. Photocopy of Customs Identity Number (NIK);
e. Recommendation from the Director General of Agro
IndustryandChemicals (IAK) of the Department of
Industries, and from the DirectorGeneral of Pro
cessing andMarketing of Farming Products, Depart
ment of Agriculture;and
f. Steat:ement Letter from Q foreign exchange bunk stot
ing that the requestor possesses financial ability

(5) On the written request referred to in suo-ernde (4),
the Director General can issue an approval or rejec-

CHAPTER IV
IMPORT OF RICE ORIGINATING FROM DONATIONS

Article9
(1) The perfotmance of rice import meat'lt in Artide 8 sub
article (1) may be performed only by social institu
tions/organizatians Qr government agencies after hav
ingreceived an Import approval from the Director Gen
eral on behalf of the Minister.
(2) In order to obtain the imPOrt aODfOVClI referred to in
sub-article (1)~ the sodal institution/organization or
government agenq mustsubmita requestinwriting
to the Minister, In this case the Director General by
attaching the follOWing doa.Jments:
a. Gift certifICate from the institution/agency in the
country granting the donation whichhad been ac
knowledged by the representative of the Republic
of Indonesia in the related country granting the
donation;
b. Oistribution planacknowledged by the Ministerof
SOCial Affairs or the appointed offICial having the
authority; and
c. Recommendation containing infonnation on the
amountandqualityof donated riceand the portof
destination, from theDirector General of Processing

andMarketing of Farming Products, Department of
Agriculture, for requirements other than disaster
li:lckfing; or
d. Recommendation containing information on the
amountandqualityof donated riceandport r:i des
tination port from the agency/body appointed by
the Government to taclde disasters;

CHAPTER V
RICE EXPORT
Article 10

tion.
(2) Rice exportreferred to Insub-article (1) forhusked

mum breakage Jev~1 between 5% until 25%1 is en

rectorGeneral af Processing and Marketing of Farm
ing Products.
(5) Inordertoobtain theapproval forriceexport, thecom
panies refprred to in <;;ub-arlirle (2) and sub-artide (3)
mustsubmitrequest in writing to the Minister through
theDirector General byattaching:
a. Trade Business PermitLetter(SIUP);
b. Company Registration Proof(TOP);
c. Recommendation fromthe Coordination Teamfor
exports referred to in sub-artide (2); or
d. Rec.olllJllt:I1IJatlon (ram the Mrnlster ofAgriculture,
in thiscase the DirectorGeneral of Processing and
Marketing of R:trming Products for exports referred
to in sub-article (3).
(6) On the written requestreferred to in sub-article (5),
the Minister, or the DirectorGeneral on behalfof the
Minister, shall issue an approval or rejection on the
request for riceexportapproval, five(5) working days
at the latestaccounted for from the datethe request is
receIVed.
(7) The exported rice referred to in sub-article (2) and
sUb-article (3) must be packed inoontai~with identity
in accordance with the request of the countryof desti
nation.

CHAPTER VI
VEPlFICATION OR TECHNICALTRAONG OF RICE
IMPORT AND EXPORT
Article 11
(1) Anyexecution of riceimport must firstly be veriFlE!d or
technically traced at the portof loading of the country
oforigin of the imported rice.
(2) Anyexecution of riceexport must firstly be verifiedor
tpchnically traced at the port of loading of the rice.
(3) Performance of the verification or technical tradng
referred to in sub-article (1) and sub-article (2) shall
bemade bya surveyor stipulated by the Minister.
(4) Onthe perfonnance of theverification or technical trac
ing referred to in sub-article (1) and sub-article (2),
the surveyor is authorized to collect fee for services
provided to the importer or exporter, the amouot there
of is determined by observingtile principleOfbenefit.
Artide 12
(I) The verification referredto in Article 11sub-article (1)
shall be carried out on:
a. Rice import for the purpose of pricestabilization,
tadding of emergencies, poor community,ond food
vulnerability, and rice import for certainpurposes
covering data or informationon:
1. countryof origin of rice loading;
2. ricespecifICation consisting of tariff post or HS
numberanddescription of rice;
3. typeandvolumeof rice;
4. brcakogc level(if required);
5. time of shipment;and
6. portof destination.

(2) Result of the verification referred to iii sub-article (1)

used as customs complementary documents in the
settlement ofcustoms ih the fieldof Itnport.

Article 13
(l) In order to be stipulatedas performerof verification
or technical tracing d rice importand export meant In
Artic}e 11sub-article(3), the surveyormustmeet the
follOWIng requirements:
a. experienced as rice surveyor for at least five (5)
years;and
b. haVing branches tir representatives aU over Indo
nesia for verification of exportor affiliate overseas
fur ImP'Jrt v~rifir.;dLlulI.
(2) The surveyor referred to inArticle l1sub-artide (3) is
obliged to submitreports in writingonthe execution of
the verification or technical trac:lng of riceimportsand
riceexportsit hadperfonned to the DirectorGeneral

Article 14
The verification or technical tracing activitiesan
the import and export of rice by the Surveyor shall not
reduce the authority of the Director General of Customs
and Excise of the Rnance Department to makecustoms
checks.

REPORTING ONTHE PERFORMANCE OF fUCE IMPORT
ANDEXPOIIT
ArtJde 15
(1) BULOG Public Company referred to in article 4 sub
artide(3) and Arttde 10 sUb-artlde (2) having n!CeiVed
rice import appl'tlVcdor~ export e:pprovol, is obliged
tosubmit report on the peiforrnanceof the import of
riceand ticeexport Inwritingtothe Minister, with copies
to:
a. COordinating Mfnister inthe Ftefd ofEconomy; and
b. Mlnlsferof~.
(2) Therep>rt referred to Insub-attide '1) should be sub
mitted each month no later than day 15 of the fol\ow
ingmonth.
Article 16
(1) Importers andexporters whohad received riceimport
approval or rice exportapprovaf meantinArtide 5 sub
article (2) or Article 7 sub-artide (1) and Artide 10
sub-artide (4)areoGfiged tosubmit report onthe per
fonnance of rice import and rice l"!lI.:port in writing to
the DirectorGeneral, with copies to:
a. Director General of Processing and Marketing of
Farming Products; and
b. Director General of Domestic Trade of the Trade
Depal'hnMt_

(1) Importerswho hadreceived acknowledgement asRice

General, with copies to the DirectorGeneral of Agro
and Chemical Industries, in this case the Director of
Agro Industries Of the Department at Industries,and
to theDirector General of Process.ing and Marketing of
Farming Products; Departmentof Agriculture.
(2) Thereport referred to in sub-article (1) shallbe sub
mitted nolater thanday 15 of the FoHowing month.
Article 18
(1) SOCial institutions/organizations or government agen·
cies who had recel>v\:!CI approval to import rice origi
nating from donations asmeantinArticle 8 sub-article
(2) ate obliged to submit report in writing on the per
formance of rice importeach monthno laterthanday

SANCTIONS
Article19
Stipulation as rice importerand/or rice import
approval or export approval will befrozen if the importer
or exporterdid not perform the obligation to submit the
written report referred to in articles 1S, 16, 17 or 18 for
three (3) times.
Article20
Freezing of the stipulation asriceimporterand/or
riceimport approval or export approval referred to in Ar
ticle 19 may be re-activated if the importer or P'ltporter
had resumed performing allof its obligations to submitthe
written report referred to in articles 15,16,17 or 18within
a peri<xl of two (2) monthsafter beingfrozen.
Article 21

or export approval will be revoked if the rice importer or
exporter:
a. did not perform the obligations referred to in artides
14, lS, 16, or 17 within the two (2) months period
after bemg imposed of the freezing sanc:tkJn meant in
Article 19;
b. is proved ofchanginginfonnation contained inthe docu
mentonstipulation as rice imfXrlerand/or rice import
approval or export approval;

Article 22(1) The freezing, revocation andre-attivation of the stipu
lattonas rice Importerand/or rice Import approval orexportapproval provided to Importers, Rice-IP, socialinstitutions/organizations or government agendesmeant in Article4 sub-article(2). ArtIcle6 sub-article(2), Article 7 sub-articfe (2), or Article9 sub-article (1)or Article 10sub-artlde (3) shall be stipulatedby theDirectorGeneral on behalfof theMinister.
(2) The treezing, revocation and re-activation ot rice import approval or export approval provided to BUlOGPublic Company referredto in Article3 sub-article (3)or Article 10 sub-article (2), and to social lnstitutlons/
organizations shall be stipulatedby the Minister.
Artide23TheSurveyor referredto in Article 11sub-article
(3) Shall be revoked asof itsstipufation if:a. It commits anyviokltion in the perfonnanceof verifi
cation or technical tracing of rice import or export;
and/orb. Itdid not fulfill the provisions on the obligation to sub
mit the written report referred to in Article 13 subarticle (2) for two (2) times consecutively.
