For the subscription nature, the liquidated damages clause made reference to MWS Actual Service availability is less than the Committed
Service Level, the Contractor to pay the Government liquidated damages
The liquidated damages shall be calculated on a monthly basis on the last day of every month
Government can set off the liquidated damages against any further payment
For serious breach, the Government shall be entitled to terminate the Contract
