DEFINITION OF TERMS
Displaced Household All members of a subproject affected household residing under one roof and operating as a single economic unit, who are adversely affected by the Project or any of its components; may consist of a single nuclear family or an extended family group.
Displaced Persons In the context of involuntary resettlement, displaced persons are those who are physically displaced (relocation, loss of residential land, or loss of shelter) and/or economically displaced (loss of land, assets, access to assets, income sources, or means of livelihoods) as a result of (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas.
Compensation Payment in cash or in kind of the replacement cost of the acquired assets.
Cut-of-Date The completion date of the census of project-displaced persons is usually considered the cut-off date. A cut-off date is normally established by the borrower government procedure that establishes the eligibility for receiving compensation and resettlement assistance by the project displaced persons. In the absence of such procedures, the borrower/client will establish a cut-off date for eligibility.
Encroachers People who have trespassed onto private/community land to which they are not authorized. If such people arrived before the entitlements cut-off date, they are eligible for compensation for any structures, crops or land improvements that they will lose.
Entitlement Range of measures comprising compensation, income restoration, transfer assistance, income substitution, and relocation, which are due to displaced persons, depending on the nature of their losses, to restore their economic and social base.
Economic Displacement
Loss of land, assets, access to assets, income sources, or means of livelihood because of (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas.
Involuntary Resettlement
Land and/or asset loss, which results in a reduction of livelihood level. These losses have to be compensated for so that no person is worse off than they were before the loss of land and/or assets.
Meaningful Consultation
Is a process that (i) begins early in the project preparation stage and is carried out on an ongoing basis throughout the project cycle; (ii) provides timely disclosure of relevant and adequate information that is understandable and readily accessible to affected people; (iii) is undertaken in an atmosphere free of intimidation or coercion: (iv) gender inclusive and responsive, and tailored to the needs of disadvantaged and vulnerable groups; and (v) enables the incorporation of all relevant views of affected people and other stakeholders into decision making, such as project design, mitigation measures, the sharing of development benefits and opportunities, and implementation issues.
Physical displacement
Meaning relocation, loss of residential land, or loss of shelter a result of (i) involuntary acquisition of land, or (ii) involuntary restrictions or land use or on access to legally designated parks and protected areas.
Rehabilitation Compensatory measures provided under the ADB Policy Framework on Involuntary Resettlement other than payment of the replacement cost of acquired assets.
Replacement Cost The rate of compensation for acquired housing, land and other assets will be calculated at full replacement costs. The calculation of full replacement cost will be based on the following elements: (i) fair market value; (ii) transaction costs; (iii) interest accrued, (iv) transitional and restoration costs; and (v) other applicable payments, if any. In applying this method of valuation,

depreciation of structures and assets should not be considered.
Squatters Meaning those people who do not own the land but are possessing and using it for residential, commercial, agricultural or other economic purposes, and as such they usually not entitled to land compensation but sometimes provided with assistance if they are found vulnerable; they are, however, entitled to compensation for the loss of built-up structures, trees, crops and other assets.
Vulnerable Groups Distinct group of people who may suffer disproportionately from resettlement effects. The policy defines vulnerable groups as households below the poverty line, the elderly, those without legal title to assets, landless, women, children and indigenous people.

1. INTRODUCTION
A. Introduction to Social Due Diligence Report (SDDR)
1. This Social Due Diligence Report (SDDR) has been prepared to document the land acquisition and resettlement related impacts of Water and Sanitation Project proposed by the Government of Punjab for Sahiwal City, under Punjab Cities Improvement and Investment Program (PICIIP), to be financed by the Asian Development Bank (ADB). The SDDR has been prepared by the social safeguard team of the Project Management Unit (PMU) of the Local Government and community development department, the executing agency for the proposed PICIIP project. 2. Project Background: The PICIIP project is comprised of two phases, phase-1 includes two cities, Sialkot and Sahiwal, and phase-II extended to seven cities, namely Multan, Sargodha, Muzaffargarh, Rahimyar Khan, Bahawalpur, Rawalpindi and Rajanpur. A pre-feasibility study has already been conducted for these seven cities under the City Development Initiative for Asia (CDIA) in 2019. The PICIIP aims to improve the quality of life of the residents living in the selected cities of Punjab. It will transform the intermediate cities into urban centers which are more efficient, accountable and can serve as an engine of economic growth and sustainable development as per concept note. This aim will be achieved by addressing urban development challenges at the city level including city integrated planning, improved institutional framework for urban services, and improved urban infrastructure. Additionally, two cities, Lahore and Lala Musa are also included for institutional support and capacity development. 3. Purpose and Scope of PICIIP: The Punjab Intermediate Cities Improvement Investment Program will build on the policy reforms already undertaken by the Government of Punjab (GoPb) in the urban sector. It will support GoPb’s phased approach to urban development, focusing on broad urban reforms, followed by improvements in urban institutions and finally investments in infrastructure. It will address four core causes of low economic contribution and below optimum service delivery of urban centers, i) absence of strategic vision and integrated urban planning at the city level ii) ineffective and inefficient use of financial and natural resources iii) limited and unreliable financing of infrastructure and operation & maintenance iv) Capacity constraints. 4. The sustainable urban development in cities will be achieved through a two-pronged strategy at the provincial level and in the selected intermediate cities. The sectoral institutional structure and capacity development will be achieved by i) enhancing the capacity of Local Government Staff working in cities ii) re-conceptualizing the effectiveness of Local Government Academy at Lala Musa and establishment of proposed Local Government Academy in Lahore as Centre of Excellence & key Capacity Building Institution for Local Government iii) review and refinement of urban policies, laws, and procedural guidelines for city planning, climate-resilient design and city infrastructure planning and management, integrated development asset management plan. 5. At the city level, the agenda of sector reforms will be implemented through CIU’s and MC’s for following reform and initiatives which will be further refined and approved by Govt. of Punjab during the project implementation. The agenda is as follows; i) The formulation of city development plans & master plans, asset management systems ii) Separation of asset ownership from service delivery through the use of existing or establishment of new corporate entities iii) Strengthened business processes and capacity of utilities and Local Government and iv) Investments in prioritized urban infrastructure 6. The Sub-projects under the scope of PICIIP have been divided into 21 packages, the detail of the packages is given in the Annex-A of this SDDR. Among the total packages, the SDDR is prepared for Package-3, Water and sanitation component, Sahiwal. The design has been finalized for package 3 and the contract is expected to be awarded in October, 2020 followed the implementation in the 1st quarter, 2021. 7. Package-3 cover the procurement of water supply and sanitation sub-projects that distributed into 4 lots of Sahiwal city which divided into two Zones, North and South. The location map of the Sahiwal city (zone wise) is given in Fig 1.1& Fig 1.2 and lot wise detail of the sub-projects are given in Table 1.1.

However, for water supply sector, few priorities were set as reflected in the Master plan, prepared by the EPCM consultant (NESPAK). Accordingly, the water supply sector was bifurcated into eight priorities as given in Table 1.1 below:

8. The water supply component Sahiwal is based upon eight priorities interventions which include construction of twenty-eight (28) new tube wells, four new (04) OHRs and ten (10) new filtration plants. The physical works on these components involve replacement of outlived water supply lines, valves and water bottling plant, improvement and rehabilitation of existing tube wells and OHRs. The details are provided in table 2.1 below>

2. METHODOLOGY
A. Purpose and Methodology of Due Diligence
10. The ADB’s Safeguard Policy Statement (SPS) 2009 (for IR policy) aims to “avoid involuntary resettlement wherever possible or to minimize impacts if avoidance is not possible by exploring project and design alternatives; enhance or at least restore livelihoods of those affected by the project relative to pre-project levels and to improve the standards of living of those poor and other vulnerable groups. Following this aim of the SPS, the PICIIP project has been carefully conceptualized to either avoid all potential social impacts of proposed subprojects where possible or keep impacts to insignificant thresholds through adopting no or least impacts project designs. Following this concept, social team of PMU undertook a due diligence of the proposed sub-projects of Package-3 to assess the land acquisition and resettlements (LAR) impacts of the projects, screen all subprojects and categorize them under the SPS’s projects categorization criterion for involuntary resettlement (IR) and indigenous peoples (IP) impacts, prepare land acquisition and resettlement plans (LARP) as required and compensate all APs prior to start of construction work. 11. In order to achieve this objective, the social team followed the following methodology undertaking the social due diligence of the proposed/selected subprojects. 12. Review of available project documents, concept paper of PICIIP, PAM, detailed design, master plan prepared by the Engineering Procurement and Construction Management (EPCM), land ownership records, Bureau of Statistics (Census 2017 and City Development Initiative for Asia (CDIA) document prepared for Pre-Feasibility Study (PSF) conducted in 2015 for two cities, Sialkot and Sahiwal. 13. Multiple field site visits were conducted to confirm whether the design adequately addressed the LAR issues and measures and steps including alternatives were considered to avoid or minimize the impacts. The collected data was processed according to separate category of the indicators for analysis purposes. All analyzed data was tabulated for interpretation and deriving conclusions and recommendations. 14. Series of consultations and meetings were also held with all the project stakeholders, including ADB (project officer, coordinators, international project specific experts in solid waste, sewerage & water supply and safeguard unit and safeguard unit), P&D (Planning & Development), Metropolitan Corporation Sahiwal, project technical & steering committees, District Administration, revenue officials, Tehsil Municipal Administration, (Public Health Engineering Design (PHED), DPs, general population, EPCM, and internal meetings within the PMU on LAR impacts and sought their views and clarifications on the project design, gaps and the safeguard options to address the potential impacts. Details on consultations are provided in section “3I” of this document. All the proceedings of the consultation meetings are recorded/documented and all the record is maintained with the PMU for any future references.

3. FINDINGS OF DUE DILIGENCE WORK
Key findings of due diligence work are presented below:
A. Project Design and Implementation
16. The proposed project is in its implementation phase, the detailed design was finalized in March 7, 2020 and the efforts made by the project team to avoid or minimize LAR related impacts are reflected in Annex-B of the document. The project is expected to be awarded in October, 2020 followed the implementation in the 1st quarter, 2021. The EPCM and PMU social safeguard team jointly visited all subprojects and assisted PMU in the selection of only those subprojects which have no OR insignificant LAR impacts. The following impacts and design mitigation measures were followed during due diligence:
1. Avoid the residential structures and public building structures.
2. Minimize the impacts to agriculture land.
3. The community assets are completely protected.
4. The impact on private trees is avoided.
5. Efforts were also made to avoid impacts on women headed households and other vulnerable groups such as elderly, orphans, physically handicapped, landless, children and minorities, etc.
6. Protected the business and commercial structures especially protected the temporary structures including the (wooden cabin), encroaches, squatters and vendors.
B. Project Funding
17. USD 200 million is loan from ADB as a cost of construction of sub-projects. Punjab Government is shouldering USD 50 million as counterpart fund. Total cost of PICIIP (phase 1) is USD 250 million.
C. Overall Socio-economic Profile of Project City
18. The socio-economic structure of project area is primarily urban. Most of the population lives in urban area and depends upon business and employment in the private and government sectors. Main occupations of the male economical population include; self-employed, farming, private employees, government employees, farm labor, skilled and unskilled laborers etc. In general, the area has access to electricity and communication networks. Health facilities are not sufficient as people have to consult private doctors to meet their requirements. However, the education facilities are meeting the requirements with the support of private school. Punjabi is mostly predominant language spoken in the area. Old systems of equity and social security such as Punchyat system and Bradri are not fully rooted now and the new system such as NGO’s, Union councils and professional organizations are taking place and are fully penetrated into the decision making of the society.
D. Scope of Land Acquisition and Resettlement (LAR)
19. The SDDR confirms that among the all four Lots, the LAR impacts are involved with Lot-3 and Lot 4 of package 3 only. The Lot-3 has the impacts on 8 APs owing to losing 5.1 acres of agricultural land while 13 APs are reported in the Lot-4 owing to having impacts on their 13.5 acres of their agricultural land. None of the impacts are reported on the residential, commercial and encroached structures in both the Lots as discussed below in Table 3.1. However, to mitigate the impacts on the land, Land Acquisition process has been started and LARP will be prepared and submitted to ADB on September 15, 2020 for Lot-3 and September 30, 2020 for Lot-4. The LARP will be implemented in Lot-3 and Lot-4 until October 15, 2020 and October 30, 2020 respectively.
E. Involuntary Resettlement (IR) Screening and Categorization
20. As per ADB SPS 2009, the LAR impacts are considered significant if 200 or more persons experience major impacts that are physically displaced from housing and lose 10% or more of their income generating resources. As far as PICIIP is concerned, it is a stand-alone project and falls in the IR category A owing to having significant impacts on more than 200 persons. However, the Lot 1 and Lot 2 of package-3 are categorized as category “C” as all the interventions will be carried out within the existing ROW and there are no IR impacts envisaged at this stage. On the other hand Lot 3 and Lot 4 of Package 3 require land acquisition and are categorized as category “B” for IR. The IR categorization checklist is attached as

Annex C. The table 3.1 below provides the details of the screening and categorization of all 4 lots of package 3.

g) IR categorization: As there is no LAR impacts involved, hence sub-projects under Lot 1 stand as the IR category C.
2 Lot 2: North Zone A (Sanitation) Trunk main sewer lines and allied works
Category “C”
Screening result: a) This involves the laying of Trunk main sewer
lines and allied works (sewer transportation line).
b) The entire trunk main sewer 54 km will be laid on the existing route owned by C&W, MC, MECPO& Irrigation, Government of Punjab.
c) The required ROW is 7 to 12 feet including shuttering and timbering and available ROW is 15 to 115 feet
d) The evidence for the landownership document (from revenue department will be available once the lock down situation gets normal. PMU has already requested for the ownership document is given as Annex-H
e) NOCs for the laying of sewer lines is provided in Annex I of the document. The NOCs are not fully obtained, the concerned departments assured to deliver it once the lock down is lifted. PMU will submit the documents to ADB accordingly.
f) No temporary structures (wooden cabin), squatters, and encroachers are affected by the project as sufficient space is available.
g) IR categorization: The project does not involve the LAR impacts, hence fall in IR category C.

3 Lot 3: North Zone B (Sanitation) Trunk main sewer Conduit, Influent pumping station and allied works
Category “B”
Screening result: a) The Lot 3 involve the construction of Influent
Pumping station in North zone in an area of 2.43 acres of private agricultural land.
b) Construction of trunk main sewer conduits (50-60 feet and allied works (force main)in an area of 5 km on the government land.
c) The available ROW is 75 feet against the required ROW 50 – 60 feet (varied), there is sufficient space available referred Annex-B.
d) NOC is obtained from MC and available in Annex-J while C&W assured to provide the NOC once the lock down situation is over.
e) Similarly, the evidence for the land ownership (from revenue department) will be available once the lock down situation gets normal. PMU has already applied for the NOC.
f) IR categorization: The project has the insignificant impacts as per detailed design, hence categorized as B of IR category.
g) A Land Acquisition and Resettlement Plan of category B is under process.
h) Land acquisition is under process, Section 5 has been notified on March 18, 2020 and 5A is under process. LARP will be submitted to ADB by September 15, 2020.
4 Lot 4: South Zone Trunk main sewer, Effluent pumping station and allied works
Category “B”
Screening result: a) This involves the construction of Influent
Pumping station in South zone and will be executed on 4 acres of private agricultural land.
b) The other components include the construction of trunk main sewer conduits and allied works (force main).
c) The required ROW is 7 to 12 feet including shuttering and timbering and available ROW is 20 to 145 feet
d) The conduit and allied work will be installed in an area of 31.12 km and belong to NHA, MEPCO, C&W and MC.
e) NOC is obtained from MC and available in Annex-K while C&W assured to provide the NOC once the lock down situation is over.
f) The project does not have any impact on encroaches, squatters and temporary structures in case of conduit and allied work as sufficient space is available (20 to 145 feet) against the required space (7 to 12 feet).
g) IR categorization: The project has the insignificant impacts as per detailed design, hence categorized as B of IR category.
h) A Land Acquisition and Resettlement Plan of category B is under process and will be submitted to ADB by September 30, 2020.
i) Land acquisition is under process, Section 4 has been notified on March 13, 2020 and 5 is under process.

j) DPAC meeting held on March 21, 2020 and determined per acre rate PKR 7,273,650 (on site) and 1,561,260 (off site) of land.
F. Indigenous Peoples Category
21. The team carefully reviewed the project documents, held meetings with the project staff and consultants with the local communities to determine any presence of IPs communities. It was found that the entire population is mainstream Punjabis and are considered as part of the general community and do not have any distinct cultural and social institutions. The package is categorized as “C” for IP impacts and no Indigenous People Plan is required. The IP categorization checklist is attached as Annex D.
G. Institutional Arrangements:
22. The provincial Local Government and Community Development is the project Executing Agency while the City Implementing Unit (CIU) is the project implementation agency. CIU will manage the project’s day-to-day implementation, approval of project design, contract management and technical input of engineering design through MC and city government. The overall coordination will be provided by Project Management Unit (PMU) at Lahore (headed by the Project Director) in addition to recruitment of consultant, contract signing and preparation of key reports. The Social safeguard team under the PMU is already in place to manage the LAR-tasks and activities including handling/resolving any complaints or grievances of those affected by the project (DPs).The LARP of Lot 3 & 4 will be prepared by the social safeguard team of PMU. The figure 3.1 below elaborates the details of the institutional arrangements of PMU and figure 3-2 provides the institutional setup at CIU level. Detailed roles and responsibilities of the officials is attached as Annex-E

H. Grievance Redress Mechanism
23. A grievance redress mechanism is already in place since 4th May 2020 (Notification of GRC attached as Annex-L). It is three tiers structures, i) Grievance Redress Committee at Field Level, ii) Grievance Redress Committee at Worthy Commissioner Office Level and iii) Grievance Redress Committee at PMU and Local Government & Community Development Department Level. The GRM is a gender responsive, culturally appropriate, and readily accessible to the stakeholders at no cost and without retribution. Step wise grievance redress mechanism is explained below:
Stage 1: The affected person(s) may submit an oral or written complaint to the GRC at Field Level. The GRC will log the complaint along with relevant details in the community complaint register. For each complaint, the GRC must investigate the complaint, assess its appropriateness/eligibility, and identify an appropriate solution. It will provide a clear response within seven working days to the complainant, PMU/CIU and Contractor (where relevant). The GRC will, as appropriate, instruct the responsible entity to take corrective actions. The GRC will review the responsible entity’s response and undertake additional monitoring as needed. During the complaint investigation, the GRC will work in close consultations with the Contractors, the CSC Consultants, PMU/CIU and other relevant agencies. The responsible entity should implement the redress solution and convey the outcome to GRC within seven working days.
Stage 2: If no solution can be identified by the GRC or if the complainant is not satisfied with the suggested solution under Stage 1, the complainant can approach to stage 2 at City Level (Commissioner Office). The committee will review the case and give the solution within seven days of its submission.
Stage 3: In case of dissatisfaction of the complainant at stage 2, he/she can approach to stage 3 at PMU level. Here, the GRC is headed by the Additional Secretary Development. The GRC at PMU level will resolve the complaint/grievance and the agreed action thus determined should be implemented within twenty-one days (if additional time is needed to implement the corrective action, it should be discussed and decided during the meeting). In case of failure to address the complaint, the complainant can approach the legal/judicial process under the National Laws.
24. A total of 6 complaints were referred to GRC and only one complaint filed specifically for package-3 has been resolved while the remaining five complaints pertinent to package – 8 are under process. The detail is discussed in Table 3.2.

I. Meaningful Consultations
25. The consultation meetings were held with the entire stakeholders including APs, general public, local leadership (MPA), Officials of MC, TMA, Provincial government, and EPCM.A total of 410 (360 males and 50 females), general public (from the local community) including APs were consulted through 54 FGD, 29 Individual household interviews and 10 groups meetings held between August 2019 to January, 2020. The list of the participants of the meetings is attached as Annex-M. The main discussion points and the findings of the consultation’s meetings are discussed in table 3.3 below:

26. The action required from the government side was explicitly discussed and got their commitment over the required actions along with timelines. Regular follow ups through meetings, emails and formal letters to complete or implement the timed actions. 27. The social team of the PMU in order to address the concerns of the local communities will propose adequate mitigation measures in the LARPs that will be prepared to address the LAR impacts of the Lot 3 and Lot 4 interventions.
J. Unanticipated Impacts
28. The PMU Resettlement team, CIU and project Management Consultant (PMC) will identify any unanticipated safeguards (LAR) impacts during implementation of project. If any such impacts are found, these will be addressed in accordance with the approved LARP and SPS 2009.
4. Conclusion and Recommendations
29. The SDDR team based on the findings of the due diligence work makes the following conclusion and recommendations for the project implementation.
a) It is concluded based on the detailed design that the subproject (WATSAN for Sahiwal) has been examined carefully for actual and potential LAR impacts and will be dealt in according to ADB social safeguards policy, as provided in SPS 2009.
b) With this detailed assessment, the Lot 1 and Lot 2 is placed under IR category C. These Lots do not have any LAR impacts as ROW is clear from any kinds of encroachments and there is sufficient construction work area where work may start but after issuance and acceptance of internal and external monitoring reports of these Lots.
c) The remaining Lot 3 and Lot 4 involves the LAR impacts and no construction can commence unless a LARP is prepared, implemented, all APs are fully compensated, verified through internal monitoring reports and validated by external monitoring consultant’s report. The land acquisition process is underway and the land is acquired through LAA 1894 by normal land acquisition process, not through the urgency acquisition procedure of 17/4/6. The LARP is under preparation and will be submitted to ADB by September 15 & 30, 2020 respectively.
d) For Indigenous Peoples Policy, it is concluded that all subprojects fall in IP category C as no IP groups as described in SPS 2009 exist in the project areas. More specifically, the people in the project areas do not recognize themselves to be IPs. Hence, IP policy is not triggered in PICIIP project so an IP plan is not required for this project.
e) The project has established appropriate institutions including the PMU and social team to assess and address LAR impacts of the project and implement and monitor the LARPs. The GRM is also in place to resolve the complaints of the local community including the affected persons.
f) The APs demanded the compensation for the loss of their land and other assets as per replacement cost of the lost assets.

Recommendations
30. The DDR team based on the study findings makes following recommendations for implementation before any construction activities commence:
i. The PMU will continue monitoring the impacts at Lot-1 and Lot-2 during the implementation stage and in case it is identified, it will be addressed in accordance with the SPS 2009 through the preparation and implementation of LARP and validation by External Monitoring Consultant.
ii. All the Lots (Lot 3 and Lot 4) requiring acquisition of land need to have the
implementable LARPs prepared in accordance SPS 2009.
iii. The LARP elaborating on displaced persons’ entitlements, the income and livelihood restoration strategy, institutional arrangements, monitoring and reporting framework, budget, and time-bound implementation schedule.
iv. The LARP approved by ADB will be fully implemented with all APs fully compensated and validated by an ADB acceptable independent/external monitoring consultant before start of construction work in any subproject.
v. Meaningful consultations with affected persons, host communities, and concerned
nongovernment organizations need to be undertaken for all category B subprojects. Special attention needs to be given to vulnerable groups, especially those below the poverty line, the landless, the elderly, women and children, and Indigenous Peoples, and those without legal title to land, and ensure their participation in consultations.
vi. The GRM will be accessible to the locals including the residents of Lot-1 and Lot-2 to facilitate them in the resolution of their complaints.
vii. An effective training program emphasizes policy training for senior management including CIU and operational training for land acquisition staff. Sending staff to similar projects can be an inexpensive yet effective way of building resettlement capacity.
viii. A comprehensive livelihood restoration program will be prepared based upon the detailed assessment of LAR impacts to ensure the restoration of livelihoods for the affected persons. The livelihood activities will be monitored (internally by the PMU & externally through hiring the External Monitor Consultant)
ix. An awareness program will be continued with the surrounding community of the pumping station as shared the information brochure during consultation meetings held in May, 2020. Next phase will happen in July during census and socio-economic survey followed the session held in September for the disclosure of LARP. These sessions will continue with the local community throughout the project cycle (on quarterly basis) in order to clear their minds that the project will not cause any adverse impacts. Same information is already shared with the EIA team of the PICIIP for inclusion in the Environment Management Plan (EMP).

Explanation of IP Impact Categorization
A. Summary of Categorization
The IP categorization depends on the nature and magnitude of the project’s potential positive and negative impact on indigenous peoples, which may result from its location, the type and scale of the project, and sensitivity of indigenous peoples’ issues.
Category A - Indigenous Peoples Development Plan (IPDP) and/or Indigenous Peoples
Development Framework (IPDF) is required Category B - Specific action is required, but not within the framework of an IPDP Category C - No impact
B. Definition of Categories
Category A
A proposed project is classified as Category A if it is likely to have significant positive or negative impacts on indigenous peoples. An Indigenous Peoples Development Plan (IPDP) and/or Indigenous Peoples Development Framework (IPDF) is required for Category A Project to avoid negative impacts and ensure appropriate benefits. The circumstances where an intervention is considered having a significant impact on indigenous peoples include:
(i) positive or negative effects on their customary rights of use and access to land and natural
resources; (ii) positive or negative effects on their socioeconomic and cultural integrity; (iii) positive or negative effect on their health, education, livelihood, and social security status; (iv) impacts that may alter or undermine indigenous knowledge, preclude customary
behaviors or undermine customary institutions; (v) project will be located in, or pass through, areas of significant indigenous peoples’ settlement
and/or use; and (vi) project proposes to specifically target indigenous peoples in one or more of its main activities; or
is anticipated to have significant negative effects on indigenous peoples(Appendix 72).
In terms of community impacts, the impact area may be considerably broader than the immediate area physically affected by a project. Category A applies to project and its impact area where indigenous peoples maintain distinctive customs or economic activities that may make them particularly vulnerable to hardship. It also applies to project that is likely to adversely affect or disrupt community life. A full-blown IPDP should include specific deliverables, budget and schedules.
An IPDF is required for a project if it is financed under sector investment loans, financial intermediary loans, or a credit line or equity investment to a third party, and other ADB-assisted project with multiple sub-projects, which are anticipated to have either positive or negative significant impacts on indigenous peoples but where the nature of the impacts cannot be determined until the sub-projects are prepared or until after the detailed technical/engineering design is completed, or following a process of community consultation.
Other projects that require an IPDF include program, sector development program, and sector loans that are likely to cover an area where indigenous peoples live. An IPDF sets out the indigenous peoples policy together with the screening and planning procedures, which apply to subprojects, components, or investments that are to be approved during loan implementation. An IPDF provides a strategy to ensure that the requirements of the Policy on Indigenous Peoples are met.
Category B

A proposed project is classified as Category B if it will have limited impacts on indigenous peoples or when there is a risk that the project may not bring the intended benefits to the affected indigenous peoples within a specific plan. Specific action in favor of indigenous peoples is required in order to ensure appropriate benefits and mitigate adverse impact, which action is not necessarily within the framework of a full-blown Indigenous Peoples Development Plan. The favorable action does not require specific deliverables, budget and schedules since it can be embedded in project components or dealt with through the Resettlement Action Plan, the general Community Participatory Plan, or any other appropriate means.
Category C A project is classified as Category C if it is likely to have very minimal or no adverse or significant impact on indigenous peoples. For this category of project, no IPDP or specific action is required although impact on indigenous peoples still needs to be properly reviewed.

3 Chief Engineer
Perform the Technical sanctions of all engineering
packages related to Civil/Elect/Mechanical works
under PICIIP program.
Approve and supervise the concept designs, detail
engineering designsand PC-Is of PICIIP sub
projects.
Assist for all technical matters regarding the
procurements, tendering and shortlisting of the
contractor/consultant under PICIIP.
Endorse the specifications of goods and works
prepared by the EPCM Consultants (The Engineer).
Endorse/verify the Engineering Estimates, BOQs
(MRS and Non-MRS Items) of all projects under the
PICIIP.
Assist in preparing the terms of references for hiring
of multiple consultancies under PICIIP.
Verify the work plans of Consultant and Contractor
and monitor the progress of on-going civil works at
sites.
Ensure the Quality and Quantity of the works/goods
at site as per specifications and standards
mentioned in the tender document and detail
engineering design.
Verify the payment claims of contractor/consultant
technically in coordination with Infrastructure
Engineers at Cities.
Verify and approves the contract variations, if any,
after detailed due diligence of project on site activity
in coordination with city staff.
Evaluates all costs associated with each project
including materials, costs of labor, and time
expended.

Negotiates contracts with contractors and
consultants to ensure the most cost effective means
of reaching the PICIIP needs.
Approves plans and budgets for each project and
makes any adjustments required in consultation with
the Project Director.
Assist in the identification and acquisition of land
required for PICIIP projects in coordination with
different Government/ Private Agencies.
Coordinates the engineering team, assigning short
and long term goals for successful completion of the
projects under PICIIP.
Ensure all projects stay on budget and complete

contract management issues, review of outputs,
monitoring of program results and follow up on
reform proposal, amongst other;
Responsible to review all unit activities related to
infrastructure improvements and provide

execute program activities and provide advisory
services to the departments for aligning PC-1 s with
overall Program objectives;

Support in urban planning including review of the infrastructure and provincial urban planning component.

Deal with infrastructure plans and highlight issues for development projects throughout the planning process.
Coordinate & Communicate with the Municipal committee/corporations, District councils, development authorities and departments to ensure infrastructure components alignment with sustainability.
Develop terms of reference, review proposals and manage consultant as necessary to support the component of Master and Regional Planning of cities.
Perform sectorial analysis in master planning, its impact and define possible solutions in achieving sustainable development principles in its preparation and implementation.
Gather and analyze data related to housing, economic, transportation & environmental studies, censuses, and market research.
Conduct field investigations to analyze factors affecting land use, assess the feasibility of proposals and identify needed changes.

viiL Proper consideration will be given to avoid the grievances rather than going through a redress process.
ix. To ensuring full participation and consultation with the DPs and by establishing extensive communication
and coordination between the community and PMU.
x. To inform the displaced persons about GRC and mechanism by pasting the information at prominent places.
Names and contact numbers of the members of the GRC members and will be disseminated to DPs through
information brochures.

xi. The issues/ community concerns relating to the land will be addressed by the revenue department (LAC)/
and or can be referred to GRC, while issues other than land will be directly addressed by the CIU/PMU and
can be placed with GRC at project level to resolve the community issues.

xiiL Documentation and collection of all investigations including field visits, consultation

additional time is needed to implement the corrective action, it should be discussed and decided during the
meeting).
viii. In case, the grievance redressal system does not satisfy the Affected/ displaced persons, then they can pursue
further by submitting their case to the appropriate court of law as per the process set out in Section 18 to 22
of the LAA 1894.
