The Nursing Board is a govern-mental body responsible for pro-tecting the health and safety of theIndiana public as it relates tonursing practice.

In the last issue, I discussed howwe were appointed and that twomajor functions of this mandate areto be sure we license only qualifiedapplicants and that we disciplinenurses that violate the Nurse PracticeAct. A third major activity that isincluded in this mandate is to

accredit schools of nursing in Indiana and to monitorany major changes that take place in these schools.

The monitoring aspect is done primarily by havingeach school send in an annual report which includesa fair amount of detail concerning the curriculum, fac-ulty (including full/part-time, degree obtained or howthe faculty is meeting degree requirements of therules), student/faculty ratios, graduation rates and anumber of other organizational and demographicdata. Any aspect of the program that does not meetthe rule requirements results in a board investigation.A great deal of this monitoring is done by the nursingboard staff with some Board input.

The one thing the Board does watch quite careful-ly is the annual pass rate for each program.The rulesare very clear on what the pass rate must be in eachprogram for a school to maintain full accreditation.Each year the program must maintain an NCLEX passrate no lower than one standard deviation below thenational pass rate. If a school is below this rate forthree consecutive years, the school must send in areport containing a faculty review of the factors thatmay have contributed to the low pass rate and thefaculty’s plan for correction. If this does not correctthe problem, the Board will visit the program andwrite a report with recommendations that the pro-gram must meet within a certain time period. A pro-

gram may be put on conditional accreditation anytime the program fails to meet the requirements ofaccreditation. Full accreditation status is restoredwhen a program has three consecutive years ofNCLEX pass rates above the minimum standard.

If the program continues to have difficulty main-taining a minimum annual pass rate after reviewingand correcting the identified deficiencies of the cur-riculum, the Board will make another survey visit. Atthis point, the Board may make further recommenda-tions, as before, or recommend that accreditation sta-tus be withdrawn.The Board is very hesitant to with-draw accreditation status of any program that is work-ing in good faith to correct its deficiencies. But, after aperiod of time, if a school is unable to upgrade stan-dards of their program to meet the minimum gradu-ate pass rate, the Board’s responsibility of protectingthe “potential student nurse public” becomes thedriving factor. Qualified students admitted to a schoolof nursing should have the reasonable expectationthat they will have the knowledge and skills to passthe NCLEX exam upon graduation.

These survey visits take a lot of time and not allBoard members have the time or feel qualified to dosuch a visit. Unless one has worked in academia forsome time, it takes some “on site” education to feelqualified to do these visits. Even though I have beenin academia for over 30 years, I still went with anotherperson on a visit to understand the total process.

Alicense to practice nursing in the State ofIndiana is a privilege, and not a right. Toqualify for and practice as a professional

nurse an individual must complete specific edu-cational requirements and successfully pass anational licensing examination. A nursinglicense is required to practice nursing and mustbe valued and protected.

Nurses are required to know the specificscope of practice according to the NursePractice Act as well as the regulations promul-gated by the Indiana State Board of Nursing. TheNurse Practice Act of Indiana can be found atIndiana Code § 25-23-1-1, et seq. or on theIndiana Professional Licensing Agency websiteat www.in.gov/pla, under Indiana State Board ofNursing. Regulations regarding nursing practicecan be found under the Indiana AdministrativeCode at 848 IAC 2-1-1, et seq. or on the samewebsite.

Ignorance is not bliss. It is your professionalresponsibility to regularly review the state NursePractice Act and regulations affecting your prac-tice to protect your license. The Indiana NursePractice Act clearly defines the practice of pro-fessional nursing, licensed practical nursing, andadvanced practiced nursing. The AmericanNurses Association has also published Standardsof Practice and a Code of Ethics which guide thepractice of nursing. (See Appendix A and B) Inaddition, the nurse should be familiar with theirwork place policies and procedures and followthem, or your license could be in jeopardy.

The rules and regulations under the IndianaAdministrative Code more fully explain thestatute. The Board promulgates these rules tohelp nurses define and understand the scope oftheir practice. Rules and regulations are easierto change than a statute or law because the rulesand regulations are created through a rule-mak-

ing process whereas, a statute or law requireslegislative action tomake changes. Theyare both equallybinding on the nurseas a matter of law.Specifically, 848 IAC2-2-2 requires that anurse “function with-in the legal bound-aries of nursingpractice based onthe knowledge ofstatutes and rulesgoverning nursing.”If you are asked when you last read the statute orrules governing nursing, and it has been awhile,you could be in violation of this regulation.Therefore, it is important to read the laws andregulations affecting your practice. This articlewill discuss a few of the laws affecting nursingpractice so that you can be informed and protectyour license.

A. Impaired NursesIt is a violation of the Indiana Administrative

Code to divert prescription drugs for your ownor another person’s use. It is also a violation topractice under the influence of drugs or alcohol.If a nurse is impaired, the statute provides thatthe nurse can seek help confidentially throughthe Indiana State Nurses Assistance Program. If anurse turns herself in and seeks assistance fromthe Program, her license is usually protected ifshe complies with the contract of the program.

B. Patient Abuse“Abusing a patient/client verbally, physically,

emotionally or sexually” is a violation of the continued on the following pages

Indiana Administrative Code and a nurse’slicense is at risk. Usually, when there is a ques-tion of verbal abuse, it can be a “he said/shesaid” situation. The best way to protect yourlicense is to resolve these types of issues ratherthan allowing them to escalate.

C. Patient AbandonmentYour license requires you to provide nursing

care regardless of socio-economic status, per-sonal attributes, or nature of health problems.Refusing to accept a patient assignment can beconsidered patient abandonment. If you aregiven an unsafe work assignment and leave thejob, that is patient abandonment. Notify yoursupervisor of any unsafe work assignment andcomplete the assignment to the best of your abil-ity. Do not stay in a facility that provides unsafecare or unsafe assignments. Be sure to resign inwriting and keep a copy of your resignation foryour records.

D. License RenewalOn your license renewal application to the

Indiana State Board of Nursing, it asks severalquestions, such as, “Have you ever been convict-ed of, pled guilty or nolo contendere to anyoffense, misdemeanor or felony in any state?”,and “have you ever been terminated, reprimand-ed, disciplined or demoted in the scope of yourpractice as a nurse or health care provider?” Itis important that you answer truthfully to thisquestion if you have ever been disciplined inyour nursing practice. You will be given anopportunity to explain why you checked yes, butif you do not check yes, and the Board discoversthat you were disciplined, you will be asked toappear before the Board. It is therefore, veryimportant to be truthful on the license renewalapplication. If you are leaving an employer, bevery clear whether you are resigning or arebeing terminated so that you can answer thatquestion truthfully, as well.

E. Delegation ofNursingFunctions

It is a viola-tion of theIndiana rules todelegate nurs-ing care, func-tions, tasks or responsibilities to others when thenurse knows or should know that such delegationis to the detriment of patient safety. The nurse isultimately responsible for ensuring that anyoneto whom they delegate tasks is prepared, quali-fied and licensed to perform. The supervisingnurse will be held responsible for the acts per-formed by those under her direct supervision.

F. Confidentiality“Disregarding a patient/client’s dignity, right

to privacy, or right to confidentiality” is a viola-tion of the nursing regulations. In addition, nevergive anyone your computer password or Pyxiscodes. It is important to keep individual identi-fying information confidential. Make sure no oneis standing behind you when you are enteringyour password into the computer or enter yourcode into the Pyxis machine. Never sign in foranother individual. If your code is used or stolenby another, it is very difficult to defend yourselfwhen it looks like your code is being utilized.

G. Affirmative Duty to ReportIndiana law requires you to notify, in writing,

the appropriate party, which may include theOffice of the Attorney General, ConsumerProtection Division, his or her employer or con-tracting agency or the Board of any unprofes-sional conduct which may jeopardize thepatient/client safety. You could be held respon-sible if you know a nurse is impaired or if youobserve a nurse providing unsafe care and donot report it.

(ISNAP) effective August 1, 2005.

The Program is required by state

law and is funded by a portion of

RN and LPN license renewal fees.

ing program for licensed nurses

affected by the use or abuse of

The function of the MedicalLicensing Section of the Office ofthe Attorney General (OAG) is toinvestigate consumer complaintsagainst licensed health profes-sionals to determine whether aviolation of a licensing statute orregulation has occurred. If suffi-cient evidence of a violationexists, the Attorney General willprosecute the matter before theappropriate health professionalboard. The OAG receives hun-dreds of new complaints involv-ing nurses each year.

The Medical Licensing Sectionis part of the ConsumerProtection Division of theAttorney General’s Office andwas granted authority in 1981 toinvestigate and prosecute com-plaints filed with the officeinvolving the twenty-one healthboards and committees, includ-ing the Indiana State Board ofNursing (ISBN) under IC § 25-1-7-2. There are currently twenty-five employees working withinthe Medical Licensing Section,

consisting of the section chief,deputy attorney generals, med-ical analysts, complaint analysts,law clerks and support staff. Thisteam of dedicated and hardworking individuals is committedto upholding the section’sMission Statement:

“To protect the consumers ofIndiana in a fair and efficientmanner through the investigationand analysis and prosecution ofcomplaints filed against licensedhealth professionals.”

According to IC § 25-1-7-4, allcomplaints must be written andsigned by the complainant andinitially filed with the office.Except for employees of the OAGacting in their official capacity, acomplaint may be filed by anyperson, including members ofany of the boards. Complaintsagainst licensed health profes-sionals, including LicensedPractical Nurses, RegisteredNurses and Advanced PracticeNurses, can be filed by employ-ees of any state agency, hospital,

nursing homes and concernedconsumers.

The complaints can be filedusing various resources such asAttorney General Steve Carter’swebsite: http://www.in.gov/attor-neygeneral/ and downloading acomplaint form to complete andmail in or submit it online. Use ofan official complaint form is notnecessary, as any information sub-mitted to the address below andsigned by the complainant withthe intent to file a complaint willbe accepted and screened. If acomplaint is emailed, a writtencomplaint form will be mailedback to the complainant for signa-ture, to continue the investigation.

The complaints are approvedfor processing, after which anopening letter is sent to the com-plainant and the licensee. Thelicensee receives with theiropening letter, a copy of thecomplaint as received by theOAG and is requested torespond to the allegations pre-sented in the complaint. The

opening letter to the complainantrequests any further documenta-tion to be submitted that supportsthe allegations made in the com-plaint. The OAG database issearched to determine whetherthe licensee has any old or pend-ing complaints which may bepertinent to the investigation ofthe new complaint. If so, old com-plaints may be reopened. No

statute of limitations exists forprosecutions of disciplinary vio-lations against licensed healthprofessions.

The analyst assigned to theinvestigation proceeds with gath-ering pertinent information tocomplete the file. IC § 25-1-7-5(5)provides the OAG with the powerto subpoena witnesses and tosend for and compel the produc-

tion of books, records, papers, anddocuments for the furtherance ofthe investigation. Documentscommonly subpoenaed includeemployment records, medicalrecords, criminal documents andother vital pieces of informationto provide the complete picturefor the analyst to base theiranalysis upon.

Pursuant to Indiana Code § 25-23-1-31, the ISBN has establishedthe Indiana State NursesAssistance Program (ISNAP), arecovery-monitoring program forRegistered and Licensed PracticalNurses who suffer from a chemicaldependence. Under the policiesof the ISBN, a nurse who qualifiesfor the program and signs a recov-ery-monitoring agreement withISNAP in a timely manner mayavoid disciplinary action beforeISBN. The OAG often receivescomplaints against nurses contain-ing allegations of drug diversionand/or substance abuse. The OAGhas established a relationship withISNAP in order to refer nursesinvolved in this type of activity toISNAP immediately. All consumer complaints filedwith the OAG are held in confi-dence through IC § 25-1-7-10.This statute prevents the OAGfrom disclosing any informationconcerning an investigation of anurse until the OAG has filed anadministrative complaint againstthe licensee with the ISBN. If anadministrative complaint filed withthe ISBN, then the informationbecomes public and availablethrough the ISBN director.

Once all of the information hasbeen gathered, the file is ready tobe analyzed. The purpose of theanalysis phase is to review thealleged licensing violations,

licensee’s response, subpoenaed information, relevantlicensing statutes, rules and regulations, and past com-plaint allegations, if relevant. The analyst will make adetermination as to whether or not the licensee hasviolated their license. If the information does lead theanalyst, board designee and section chief to the con-clusion that the licensee has violated their license, thenthe deputy attorney general will file an administrativecomplaint against the licensee’s license.

If there is not enough evidence to convince the ana-lyst, board designee and section chief that the licenseehas violated their license, then the file will be closed,the complainant and licensee will be notified, and thefile will remain confidential with the OAG. Closed filesmay be reopened in the future if there is new evidencethat was not available at the time of the original investi-gation, since there is no statute of limitations for med-ical investigation files to be prosecuted by the OAG.

Consumer complaints that are found to have licens-ing violations develop into litigation files and willappear on the ISBN agenda after an administrativecomplaint has been filed with the board director. In afashion that is similar to civil court proceedings andgoverned by the trial rules, the case is presented by adeputy attorney general before the ISBN or an appoint-ed administrative law judge. The licensee is sent notifi-cation of this hearing to have the opportunity to defendthemselves against the violations identified by theOAG’s administrative complaint. The licensee also hasan opportunity to ask for a settlement. If no settlementcan be reached, the case will be heard. After hearingeach party’s side, the ISBN will then issue its rulingafter taking a vote.

In summary, the OAG protects the public health andsafety of every Hoosier through the investigation ofeach complaint filed. The OAG also works hard to pro-tect the reputation of licensed health professionals whohave had unsubstantiated complaints filed against themby investigating those complaints thoroughly and clos-ing them as expeditiously as possible.

What are the advantages torenewing online as opposedto sending in the applica-tion?It is quick, efficient and there is noneed for cumbersome forms ormailings.What happens if I answer"yes" to one of the ques-tions on the renewal?Your payment will be processedand a code will be placed on yourlicense. You will be required tosubmit a written statement explain-ing your positive response. Yourinformation will be reviewed andyour license will either be renewed

based on what you submitted oryou will be required to make a per-sonal appearance before theBoard. The Board has 90 days inwhich to act upon a renewal appli-cation with a positive response.

If I answer yes on myrenewal and it hasn’t beenapproved by 10/31 will I beable to work?Yes, you will be sent a letter thatstates that you are able to practicewhile your license is being investi-gated during that 90-day period.

My place of employmentstates they are going to ter-minate employment on anynurse that doesn’t have

Youwould need to talk with your facil-ity’s personnel director. As longas your license is updated by10/31/05, you are considered tohave a valid license to practice.

I did not get informationconcerning the renewal ofmy license. Do I still haveto pay the late fee?Yes, all practitioners that renewafter 10/31 are required to pay the$50.00 late fee. It is your responsi-bility to make sure you renew yourlicense on time. Therefore, it isimperative that you keep the Boardapprised of your current address atall times. You can renew on line forthe $50.00 fee right up until mid-night on 10/31.

I have an RN license andPrescriptive Authority asan Advanced PracticeNurse. Will I get a renewalfor each type?Yes, there is a separate renewalapplication for your RN license,one for your prescriptive authorityand one for your CSR. TheControlled Substance Registrationrenewal notice will be sent to yourpractice location. If you renewonline you will also need to makesure you renew all types separately.

How can I put my licenseon Inactive Status?Indiana does not offer Inactive sta-tus. Your only options are to renewor let your license expire.
