Professional Boxing and Combat Sports Amendment Regulations 2013
The Governor in Council makes the following Regulations:

1 Objective
The objective of these Regulations is to amend the Professional Boxing and Combat Sports Regulations 2008 as a consequence of the enactment of the Professional Boxing and Combat Sports Amendment Act 2013 and to make other miscellaneous amendments.
2 Authorising provision
These Regulations are made under section 22 of the Professional Boxing and Combat Sports Act 1985.
3 Principal Regulations
In these Regulations, the Professional Boxing and Combat Sports Regulations 20081 are called the Principal Regulations.

4 Definitions
Insert the following definition in regulation 4 of the Principal Regulations—
"National Police Certificate means a certificate issued by Victoria Police or CrimTrac in respect of a person specifying the criminal history of the person;".
5 Regulation 5 substituted
For regulation 5 of the Principal Regulations substitute—
"5 Promoter's licence
(1) For the purposes of section 6(2)(a) of the Act, the prescribed form of application for a licence to act as a promoter, or the renewal of a licence to act as a promoter, is Form 1 in the Schedule.
(2) For the purposes of section 6(2)(b) of the Act—
(a) the prescribed fee for an application under subregulation (1) is $225; and
(b) the prescribed certificate for an application under subregulation (1) is a National Police Certificate in respect of the applicant issued no more than 3 months before the date of the application.
(3) For the purposes of section 6(3)(c) of the Act, the prerequisites for the issue of a licence to act as a promoter are that the applicant has appropriate knowledge of the following—
(a) the Act and these Regulations;
(b) any relevant rules made under section 23 of the Act;

(c) any conditions to which the licence would be subject if issued.
(4) For the purposes of section 6(4)(c) of the Act, the prerequisites for the renewal of a licence to act as a promoter are that the applicant has appropriate knowledge of the following—
(a) the Act and these Regulations;
(b) any relevant rules made under section 23 of the Act;
(c) any conditions to which the renewal of the licence would be subject if renewed.
(5) For the purposes of section 6(6)(c) of the Act, the prescribed matters for consideration by the Board for the issue or renewal of a licence to act as a promoter are—
(a) whether the applicant is an insolvent under administration; and
(b) whether the applicant is disqualified from managing a corporation under the Corporations Act; and
(c) any information relating to the criminal history of the applicant contained in the National Police Certificate accompanying the application.".
6 Promotion permit
Regulation 6(2)(e) of the Principal Regulations is revoked.
7 Division 2 of Part 2 heading amended
In the heading to Division 2 of Part 2 of the Principal Regulations, for "and judges" substitute ", judges and timekeepers".

8 Regulation 7 substituted
For regulation 7 of the Principal Regulations substitute—
"7 Licence to act as a trainer, match-maker, referee, judge or timekeeper
(1) For the purposes of section 6(2)(a) of the Act, the prescribed form of application for a licence to act as a trainer, match-maker, referee, judge or timekeeper, or the renewal of a licence to act as a trainer, match-maker, referee, judge or timekeeper is Form 3 in the Schedule.
(2) For the purposes of section 6(2)(b) of the Act—
(a) the prescribed fee for an application under subregulation (1) to act as—
(i) a trainer is $70; or
(ii) a match-maker is $70; or
(iii) a referee is $100; or
(iv) a judge is $50; andNote
A fee has not been prescribed for a licence to act as a timekeeper.
(b) the prescribed certificate for an application under subregulation (1) is a National Police Certificate in respect of the applicant issued no more than 3 months before the date of the application.
(3) For the purposes of section 6(3)(c) of the Act, the prerequisites for the issue of a licence to act as a trainer, match-maker, referee, judge or timekeeper are as follows—

(a) that the applicant has appropriate knowledge of the following—
(i) the Act and these Regulations;
(ii) any relevant rules made under section 23 of the Act;
(iii) any conditions to which the licence would be subject if issued;
(b) for the purposes of an application for a trainer's licence—that the applicant has a current First Aid certificate;
(c) for the purposes of an application for a match-maker's licence—that the applicant has sufficient experience in the industry as a trainer, contestant or promoter and has a good knowledge of professional contestants and their relative skills;
(d) for the purposes of an application for a referee's, judge's or timekeeper's licence—that the applicant has adequate eyesight (whether natural eyesight or with the aid of glasses or contact lenses) to act as a referee, judge or timekeeper at a promotion.
(4) For the purposes of section 6(4)(c) of the Act, the prerequisites for the renewal of a licence to act as a trainer, match-maker, referee, judge or timekeeper are as follows—
(a) that the applicant has appropriate knowledge of the following—
(i) the Act and these Regulations;

(ii) any relevant rules made under section 23 of the Act;
(iii) any conditions to which the licence would be subject if renewed;
(b) for the purposes of an application for the renewal of a trainer's licence—that the applicant has a current First Aid certificate;
(c) for the purposes of an application for the renewal of a match-maker's licence—that the applicant has sufficient experience in the industry as a trainer, contestant or promoter and has a good knowledge of professional contestants and their relative skills;

(6) A licence to act as a referee also authorises the person who holds the licence to act as a judge.Note
A licence to act as a judge does not authorise the person who holds the licence to act as a referee.

(7) A licence to act as a referee or judge also authorises the person who holds the licence to act as a timekeeper.Note
A licence to act as a timekeeper does not authorise the person who holds the licence to act as a referee or judge.".
9 Regulation 11 revoked
Regulation 11 of the Principal Regulations is revoked.
10 Conduct at promotions
In the note at the foot of regulation 18 of the Principal Regulations, for "Sections 9" substitute "Sections 9A".
11 Forms 1 to 7 in Schedule substituted

Applicants may be required to submit such further information as is considered necessary for the issue or renewal of a licence.
Under section 6 of the Professional Boxing and Combat Sports Act 1985, before issuing or renewing a licence to an applicant to act as a promoter, the Board must be satisfied that the applicant is a fit and proper person to hold such a licence and that it is not contrary to the public interest to issue or renew the licence.
A copy of this application will be given to the Chief Commissioner of Police under section 6A of the Professional Boxing and Combat Sports Act 1985.

9. I understand that boxing and combat sports are hazardous activities that may lead to serious injury. In particular, successive blows to the head may lead to movement of the brain within the skull of a contestant, rupturing veins, and in rare cases, arteries. The resulting bleeding may lead to the formation of blood clots, causing pressure inside the skull, restricting the supply of oxygen to the brain and causing serious damage to the brain and even death.
