The Legal Aid Forum is a membership based network encompassing over 30 national and international NGOs, international organisations, professional bodies, universities and faith based initiatives that provide legal and services to the indigent Rwandan population or vulnerable groups (or that provide support to legal aid service providers in Rwanda). The mission of the Legal Aid forum is to promote equitable access to justice for the indigent population and vulnerable groups, through the provision of accessible and high quality legal aid services. It is governed by its Statutes adopted by the members on 12 May 2009, amending the initial Charter adopted on 26 October 2006.

Foreword
The Legal Aid Forum’s (the Forum) Strategic Plan 2011-2015 has been a collaborative and participative process informed by research, consultations with stakeholders and through the facilitation of a strategic planning retreat with the Forum’s Secretariat and Steering Committee. The process was
designed so that ownership of the strategic plan would genuinely lie with the Secretariat, Steering Committee and Forum members.
We used an eight-step planning process:
1. Information gathering and initial analysis;
2. Interviews with Forum members, former Steering Committee members and current Steering Committee members and Secretariat staff;
3. Facilitation of a strategic planning workshop with current Steering Committee members and Secretariat staff which identified critical strategic issues for development around the Forum’s Vision, Mission, Strategic Objectives, Outputs and Activities;
4. Analysis of transcript of workshop by the Secretariat and finalising the Logical Framework Analysis;
5. Consultant analysis and synthesis of collated information leading to the developing of the first draft of the strategic plan;
6. Feedback received from the Steering Committee and Secretariat on the first draft of the strategic plan;
7. Consultants producing the final draft of the strategic plan;
8. Final draft of the strategic plan approved and adopted by the General Assembly of the Forum.
The theme of the strategic planning intervention was “Alive with Possibilities” and we believe that our strategic plan for the period 2011-2015 resonates with this.

Introduction
The role of the strategic plan is to articulate the Forum’s five-year strategy to effectively and efficiently enhance its work in order to achieve its mission. The plan covers the period 2011-2015 and the planning framework used is the Logical Framework Analysis (LFA). This strategic
plan is as comprehensive as we can currently make it. However, it must be borne in mind that a good plan must be flexible enough to be tailored to meet our ever-changing environment. Accordingly, we will continue to monitor and amend the LFA to ensure its continued relevance.

Access to Justice and Legal AidSituation in Rwanda
Equitable, functioning and accessible justice is crucial to combating poverty, promoting good governance and the rule of law. It is a basic human right and an indispensable means towards conflict resolution.
Access to justice should not depend on wealth, education levels, religion or ethnicity. Therefore in order to realise the goal of equitable access to justice it is essential to put in place mechanisms for the provision of legal aid services1. Only in this way can access to justice become accessible to those in need rather than remaining a prerogative of those who can afford it.
To date, there is no specific legislation on access to justice and/or legal aid in Rwanda. However, efforts are being made by the Government of Rwanda under the Ministry of Justice to promote and develop the infrastructure for legal aid through the ‘Maison d’Accès à la Justice’ (MAJ), which are Access to Justice Bureaus intended to be established in all districts2. In addition, the Ministry has also started to undertake the process of developing a legal aid policy.
The environment within which legal aid is provided in Rwanda is characterised by a high population density (376/km²)3, with a large rural, semi-literate population. Approximately 9.9 million people live in an area of 26’338 square kilometres4 and 56.9% of the population live below the poverty line with only 62.5% of rural men and women consider themselves literate5.
Rwanda currently has a very low Advocate to population ratio. The ratio is currently 1 Advocate for 16,203 people6 even though the Bar is committed to increasing the number of Advocates on the roll.
The historical context has also put huge pressure on the Rwandan justice system both in terms of trying genocide suspects and in creating complex legal issues

associated with land rights, inheritance rights and family law issues7. However, as Gacaca Courts have tried substantial amounts of cases, the Government is now focusing on other types of cases.
In practice many obstacles continue to exist which inhibit the effective provision of legal aid services. The 2007 Legal Aid Baseline Survey identified a number of key limiting factors:
The absence of an enabling legal and regulatory framework;•
Limited monitoring and evaluation and poor documentation of challenges, •best practices and client information;
Limited and disjointed funding;•
The limited number of Advocates and the limited geographic reach •(urban bias) and capacity of legal aid service providers (both civil society organisations and the Bar Association/Corps of Judicial Defenders);
Limited awareness of available legal aid services amongst the population.•
These factors impact on each other. For example, a stronger and more enabling legal and regulatory framework would lead to more systematic training and continuing legal education of service providers. Monitoring, evaluation and documentation provides data and information that can be used to improve methodologies. Furthermore, the use of these tools has also the potential to attract funding.
However, a number of processes and policy decisions provide the basis for further work and positive developments in the area of legal aid:
Adoption of • ‘Universal Access to Quality Justice in Rwanda’ as a high level objective in the EDPRS 2008-2012 and inclusion of ‘the number of vulnerable groups/poor people accessing legal aid services’ as an indicator;
Adoption of the JRLO Sector Strategy and Budgeting Framework 2009-2012 •which aims at a ‘universal access to quality justice’ (Output 1) with ‘access to legal advice and representation universally available at the sector level’ (Target 1) and a ‘legal aid scheme fully operational nationally with coverage down to sector level’ by June 2012 (Milestones Output 1);
The creation in 2007/08 of a new Department within the Ministry of Justice •to focus on ‘Legal Aid, Human Rights and Community Services’;
The drafting process of the new Law on the Bar with the opportunity to •work on the draft based on new developments;

The process of putting in place a legal aid policy framework currently being •worked on by the Ministry of Justice;
The continued engagement of the Forum, the Ministry of Justice and the •Justice Sector to analyse and make recommendations on the draft Law on the Bar and on the national policy framework for legal aid in Rwanda.
Based on this analysis, the Forum has navigated its efforts since its creation in October 2006 towards improving the delivery of legal aid services in Rwanda.

Learning ApproachThe Forum recognises that both the internal and external environment contribute to its impact. The Forum is committed towards an action-learning approach to its work. In this way the Forum will continuously reflect on past actions to understand their positive or negative impact, thereby being better able to plan effectively and efficiently for the future.
The Forum recognises that within the internal environment serious and committed work must be conducted to carry out all activities in order to achieve impact. The Forum has committed itself to this.

PART A
Milestones
2004:
Following preliminary study about legal aid services available at field level, an idea emerged to create the Forum; a ‘space’ for organisations to share information and best practises, and collaborate both in capacity building and identified areas within which advocacy and research can be made. The study highlighted the determination of organisations to provide legal aid services to indigent and vulnerable groups, and the positive initiatives and projects aimed at providing legal information, advice and representation services. Nevertheless, limited collaboration was identified as one factor constraining the effectiveness and efficiency of legal aid service provision. Thus, the initiative to create the Forum was identified as an essential step towards the improvement of access to justice in Rwanda.
2006:
On 26 October 2006, the Forum was established and a Charter adopted; the culmination of a process in which civil society organisations worked together to build a common understanding of legal aid, identified the Forum’s vision, mission, aims and objectives, and agreed on work modalities.
A Legal Aid Baseline Survey and Needs Analysis was conducted by the Forum in collaboration with the Ministry of Justice and the findings showed a number of key factors limiting the impact of legal aid activities (see above ‘Access to Justice and Legal Aid Situation in Rwanda’).
2007:
Based on the findings and recommendations from the legal aid baseline survey, the Forum developed a three-year logical framework 2008-2010 and focused its work on improving the quality and accessibility of legal aid services. This included capacity building, monitoring, research and advocacy initiatives, and support to a number of pilot legal aid projects at community level and in the criminal justice system.

2009:
The Forum was registered as a national NGO (network) and for the first time became a fully independent entity. Up to this time, the Forum was a voluntary and informal association and its Secretariat was hosted by the Danish Institute for Human Rights.
2007-2009:
Among the Forum main results and developments:
Countrywide • Legal Aid Baseline Survey carried out in collaboration with the Ministry of Justice, completed in January 2007;
Engagement throughout 2007 with the Ministry of Justice in the • Task Force on Legal Aid to analyse and make recommendations on the national framework for legal aid8;
Contribution to the Justice, Reconciliation, Law and Order Sector of •EDPRS;
Monitoring• in 2008-09 of EDPRS Indicators in the Justice Sector;
Launch in July 2007 of a periodical information exchange • Bulletin;
Development in 2008-09 and implementation of an • improved documentation and monitoring system for legal aid providers amongst a pilot group of legal aid providers;
Development of a • Paralegal Practice Manual launched in November 2009;
Research• project in 2009 on locus standi and amicus curiae;
Implementation in 2009 of a • Legal Aid Week in Rwanda – Initiative led by the Ministry of Justice in collaboration with the Forum:
▪ Covering 10 prisons and 27 sectors;
▪ Provided through 20 legal aid providers (including the Bar Association, the Corps of Judicial Defenders, NGOs, trade unions, university legal aid clinics);
▪ Benefiting 350 minors detained legally represented and 1’368 indigent and vulnerable people benefiting legal information, legal advice and/or mediation;

Pilot projects from May 2008 to provide • legal aid services at community based level and in the criminal justice system9 – benefiting 2’776 indigent and vulnerable persons in 2008, 6’354 persons in 2009;
Annual • exposure visits, internships and staff exchanges with organisations in the region (notably in Kenya, Malawi, South Africa, Tanzania, Uganda).
2010:

The Forum has its headquarters in Kigali, where the Secretariat is housed. The Secretariat is staffed by paid employees. The Secretariat is headed by a Coordinator with the following support officers, Finance and Administration Manager, Finance and Administration Assistant and Liaison Officer to the Secretariat. The Secretariat and the Steering Committee work closely together with the Secretariat reporting to the Steering Committee. The Steering Committee is accountable to the General Assembly, which is made-up of the member organisations of the Forum.

How We Will Measure Our Success
Our chosen framework for monitoring and evaluation is the Logical Framework Analysis (LFA), as already alluded to. The LFA is a tool favoured for development projects and one mainly used by our donors.

The LFA allows us to track our activities, outputs, strategic objectives, mission and vision against objectively verifiable indicators. In terms of risks, the LFA also includes a set of assumptions made which underpin the success of our actions. The LFA will form the basis for our Budget, Operational Plan and Monitoring and Evaluation Plan.
Our Approach to Monitoring1.
Monitoring provides an ongoing assessment of performance and the environment of the Forum. Its purpose is to bring to the attention of staff of the Secretariat any changes relevant to implementation. They can then decide how best to respond to these changes. The Forum views monitoring as an internal activity and as an essential aspect of good management practice.
During monitoring, some of the questions the Forum will ask are:
How are the resources being used?•
What progress is being made?•
Are the results of the work being used by the target groups?•
Are there any important changes in the Forum’s context?•
In so far as monitoring goes, the Forum has a five step process:
Developing a framework for monitoring • (see Appendix A)
The Forum has already decided on the elements of the framework, and will now proceed to complete the information for the remaining elements. As can be seen from Appendix A, the monitoring plan is based on the LFA, and includes baseline information, targeted and actual data, means of verification, frequency of data collection, responsibilities and time frames.
Gathering information•
The Forum will use numerous methods to collect data including but not limited to:
▪ Surveys;
▪ Interviews;
▪ Focus group discussions;
▪ Statistics and reports from Legal Aid Providers;
▪ Narrative and financial reports from grantee members;
▪ Baseline surveys;
▪ Geographical mapping;

Analysis of the information•
The Forum will analyse the information in order to:
▪ Establish if there are any significant changes;
▪ Identify the reasons for the changes; and
▪ Draw out recommendations.
Acting on the analysis•
The analysis will allow for:
▪ Internal and external learning;
▪ Effective decision-making; and
▪ Enhanced accountability.
Reporting findings•
The Forum will disseminate monitoring reports to key audiences, including its members, communities and other stakeholders. Our monitoring will ensure that we are delivering the results on time and within the expected cost. Ensuring proper budget management is key to maximising the value created by the Forum’s interventions.
To ensure that reports can be read and used, the Forum will pay attention to the following factors:
▪ Timeliness
Reports will be made available as soon as they are completed.
▪ Relevance
The information will address concerns relevant to the stakeholders. As different stakeholders have different interests, the Forum will prepare a small range of reports, each highlighting aspects relevant to different audiences.
▪ Marketing and distribution
The Forum believes that monitoring reports can play an important role in building public perception of the Forum. The Forum will accordingly draw the attention of stakeholders to the reports.

▪ Credibility
As the quality of reports impact on the credibility of the Forum, all reports will be of the highest possible quality.
We will report on our delivery of the actions set out above in our Biannual Reports as well as during our Annual General Meetings.
Our Approach to Evaluations2.
Evaluation is a periodic assessment of the relevance and performance of the Forum. It provides feedback to the Forum on what it can do differently to accomplish its three strategic objectives. It can also be used to assess the Forum’s impact.
The Forum will use evaluations to address such questions as:
Is the Forum likely to achieve its strategic objectives with its existing •approach?
Has the Forum made a lasting improvement in the issues it was trying to •address?
The Forum will carry out specific types of evaluations to address the various evaluation questions that are relevant at different points in the Forum’s project cycles. These types include:
Ex-Ante:• An assessment of the project plan and approach, before it starts, to assess whether or not it has a good potential of achieving its objectives;
Mid-term:• A review, carried out midway through the life of the project to determine if the project is likely to be successful and to assess whether or not any changes in approach should be made to ensure success;
Terminal:• An evaluation at the close of the project or project cycle to determine if it has accomplished its objectives; and
Impact:• An assessment of whether or not any benefits resulting from the project have led to a sustained improvement in the issues it was addressing.
The above will be carried out by independent consultants.
The Forum will itself, through its Secretariat, be responsible for Formative Evaluations. In other words, an evaluation that is ongoing or continuous, and which provides feedback to inform ongoing changes and improvements in services or products.

Our Approach to Implementing the Strategy3.
The Forum has already started working on its action plans that will make this strategy a reality. Please refer to Appendix B for our framework for the action plan.
Fundraising and Resource Mobilisation4.
The Forum’s approach to fundraising and resource mobilisation (FR) is that these are not separate activities from the strategic objectives of the Forum, but rather activity that supports the achievement of those objectives by helping to build a constituency for the organisation. We suggest that FR at its core, is not about raising funds, but about winning hearts and minds.
Appendix C shows the Forum’s plan for Year 1 (2011) and Appendix D indicates the Forum’s budget for 2011-2015.
Our strategy will take into account our learning through previous experiences including the need to:
Be more targeted;•
Focus on long-term sustainability of the Forum;•
Ask tough questions to develop a comprehensive development program for •the Forum;
Match the FR strategy with the overall strategic plan;•
Diversify funding sources;•
Establish the Forum’s readiness to embark on fund development programmes; •and
Ensure the Forum has the resources to advance the organisation’s mission.•
The Forum will target:
▪ Annual Giving
A year-round effort to raise renewable funds from individuals and groups, for unrestricted and restricted purposes using a variety of solicitation methodologies and techniques.
▪ Capital Giving
An intensive, organised fundraising effort to secure philanthropic gifts for specific capital needs or projects, executed within a specific time period, usually over one or more years.

▪ Estate or Planned Giving
The integration of individual donor’s plans to make a charitable gift with his or her personal financial and estate plans.
Our institutional strategy looks at ways of getting grants from funding agencies, such as development agencies, foundations, trusts and other institutions, whose main function is to give grants. Currently, all Forum funds are institution-based.
Our strategy will include:
Ways to improve our chances of getting support from major funders;•
Managing our funder relationships much more effectively;•
Prioritising our time and energy, so that we are spending enough on FR to •get the funds that we need for our work;
Describing the Forum effectively to funders; •
Manage our approaches to a range of funders; and•
Producing project proposals that follow a logical structure• .
In Public fundraising, we look at other ways of FR. Our strategy will include:
Identifying potential sources of support; •
Raising money and support locally;•
Communicating effectively with our supporters; •
Earning and saving money;•
Organising fundraising events; •
Getting support from the private sector; •
Getting support in kind;•
Generating self-generated income;•
