We'llarrangeaninitialmeetingwherebyweprovideanoobligationvaluation.Thiswillbetoadviseoncurrentmarketrentalvalue.We'llalsoadviseonthestandardofpresentationneededtoattractasuitablequalitytenant.Wewillprovideyouwithadviceoncurrentlegislationtowhichbothlandlordsandtheirpropertieshavetoconformandwillprovideyouwithwrittendetailsofourtermsandconditionsandfees.
Wewillmarketyourpropertybyusingtheleadinginternetpropertywebsites,erectingasuitable'ForLet'boardatthepropertytoattractinterestfrompassingtrafficandbycontactingsuitabletenantswhohaveregisteredaninterestinrentingapropertyonourdatabase.WehaveaLettingsCo-ordinatorwhoconstantlymonitorswebsitetrafficandwhoalsorefreshespropertiestoensuretheyremainonthefirstpageofsearcheswithinthepropertyspecificarea.Wewillalsocarryoutaccompaniedviewings.Wecarryoutfullandstringentchecksonallofourtenantstominimiseanyrisktoyou.Thisbeginsafterthey'veconfirmedifthey'reinterestedinproceedingwithyourproperty.WewilltakeacopyoftheirvalidIdentification,mostrecentbankstatementconfirmingtheircurrentaddressandmostrecentwagebeingpaidinandtheirlastthreemonthswageslipsasproofofincome.Wewillthenperformacreditcheckandseeklandlord/employmentreferences.
Onceatenantissuccessfulwiththeapplicationthenwe'llinstructaninventorywhichwilldetailthescheduleofconditionanditemswithinthepropertyandwillbeusedtoassessanydilapidationswhichmayoccur.Thiswillincludemeterreadings,overviewphotographsofeachroom,adescriptionofeachroomandphotographsofindividualitems.Theyareverydetailedandaccuratereportswhicharecarriedoutonanipadconvertingtoapdfdocumentfortenants/landlordstohaveaccessto.
We'll thenarrangeadateforthetenancytostartandtohandoverkeys.Thiswillbeconductedattheproperty. Thiswill include thePrivateResidential Tenancy (PRT).On1December 2017 a newtypeoftenancycameintoforcewhichreplacedassuredandshortassuredtenancyagreementsforallnewtenancies.Yourpropertyshallbe let inaccordancewiththisActandall leasesandnoticesarepreparedandlaiddownunderthetermsofthisAct.
Rentisnormallypaidinadvanceonthe1stofeachmonthbystandingorder(unlessotherwiseagreedbetweenlandlordandtenant).Wewillaimtohavethispaidtoyouwithin10daysofreceiptviafasterpaymentsbanking.Astatementofaccountissenttoyoumonthlydetailingincome/expenditure.Ifthetenantshouldfallintoarrears,thenwewillchaseinitiallytotryandseekrepayment.Wewillalsoliaisewithyoursolicitororinsuranceprovidershouldyouhavearentguaranteepolicyinplace.
Wewillcollectasecuritydepositequalto6weeksrentor£500.000(whicheverisgreater).ThiswillbeheldbySafeDepositsScotland(SDS)inlinewiththetermsoftheTenancyDepositSchemes(Scotland)Regulations2011.
Wewillcarryoutregularinspectionsofthepropertytoensurethatthetermsoftheleasearebeingadheredtoandthattheconditionofthepropertyisbeingmaintained.Wewillalsoensuretherearenooutstandingrepairsorotherissuesneedingaddressed.Wewillsendareportbacktoyouandifrequiredphotographsasandwhenapplicable.
Ifamaintenancerepairisrequired,wewillliaisewithourtrustedboardofcontractorstoassesstheissueinquestion.Thiswillbeinlinewiththepre-authorisedmaintenancespendlimitsyouset.Wearehappytouseyourpreferredcontractorsifyouprefer.
Approximately8weekspriortothetenancyending,wewillcontactyoutodiscussifyou'dliketocontinuelettingtheproperty.Ifyouarehappytodoso,wewillcontactthetenanttodetermineiftheyintendtore-signtoafurthercommitmentoriftheyintendonleavingtheproperty.Shouldtheyrequestanewtermthenwewillensurealloftheirobligationshavebeenadheredtoandwillissuethemwithanewlease.Atthisstagewewillcarryoutamarketassessmentoflocal
comparablerentsandliaisewithbothpartiestosuggesttherentalfigureandthelengthoftermonoffer.
Ifthetenantservesnoticeandvacatesthepropertyandyouarehappyforustodoso,wewillre-markettheproperty.Wewillthenstarttheadvertisingprocedureagainandwillnormallystartcarryingoutviewingsassoonasnoticehasbeenserved(8weekspriortothetenantvacating).
Atthetimeofthetenantvacatingwe'llarrangeafinalinspectionandcarryoutaninventorycheckout.Thiswillfunctionthesameasthemoveinprocedurewiththereportbeingcompletedonouripadandconvertingtoapdfdocument.Thiswilldetermineifanyrepairsarerequiredandwillbecomparedtotheinventorycheckinfordilapidationssubjecttofairwearandtear.
PreparingtoletasaLandlord
Insurance
Youwillneedtoputinplaceadequatecoverforlettingyourpropertyforbothbuildingsandcontentsinsurance.Yourbuildingmaybefactored,inwhichcaseyoushouldcheckwithyourfactortoseeifbuildingsinsuranceiscoveredunderablockpolicy.Youneedtomakesurethatyourinsurancecompanyisawarethatyouarelettingyourpropertyasthismayaffectthetermsofyourpolicy.Weworkalongsidealettingsspecialisedinsurancecompany(StrideLetProtect)whowillbehappytodiscussyourinsurancerequirementsinfull.
Mortgage
Ifyourpropertyismortgaged,youmustobtainpermissionfromyourlenderthatyoucanlettheproperty.Iftheyrequireadditionalclausesinthetenancyagreement,thenpleasemakeusawaresowecanaddthesein.
Tax
IfyouareresidentintheUK,thenitisyourfullresponsibilitytoinformInlandRevenueofanyrentalincomereceivedandtopayanytaxdue.If,however,youareresidentoutsideoftheUK,unlessanexemptioncertificateisheld,weasyouragentareobligedtoretainandforwardtotheInlandRevenueonaquarterlybasis,anamountequaltothebasicincometaxratefromtherentalreceived,lesscertainexpenses.AnapplicationformforexemptionfromsuchdeductionsisavailableonrequestandfurtherinformationcanbeobtainedfromInlandRevenue.
CouncilTax&Utilities
CouncilTaxandanyotherutilityprovisionistheresponsibilityoftheoccupier.Pleaseinformtheproviderofthedateyouareleavingandsettleanyoutstandingbillswiththem.WewillnotifyallCounciltaxandUtilitycompaniesofanewtenantmovingin.Whenthepropertybecomesvacant,theownerwillthenbeliableforbillsuntilanewtenantisfound.Someexemptions/discountscanapplydependingonwhetherthepropertyisunfurnished.
Removals
Shouldyouberelocatingtomovejobsorjusttoanotherpropertythiscanbeastressfultime.WehavearelationshipwitharenownedandcompetitiveremovalcompanycalledZebraRemoverswhowillbehappytodiscussyourremovalrequirements.
Keys
Thereshouldbeonesetofkeysgiventoeachtenant(withasetheldbythelandlordandasetheldbyProBrookPropertiesasyouragentifyouchooseourhassle-freemanagementservice)
Pleaseensurethereisaredirectioninplaceforthedurationthatyouareawayfromtheproperty.
Furnishings
Youhaveachoiceastowhetherthepropertyisletfurnished,unfurnishedorpartfurnished.ProBrookPropertieswillbeabletoadviseatthetimeofyourrentalvaluationastothebeststrategytotakedependentontypeofpropertyandlocalmarketconditions.Thepropertyshouldalsobeneutrallydecoratedthroughout.
Appliances
Anyappliancesleftwithinthepropertyforthetenants’useshouldbeinfullandworkingorder.Pleaseleavemanualsfortheuseofsuchappliancesandalsofortheheating/hotwatersystem.Thiswillhelpresolveanymisuseissuesthroughoutthetenancy.Ifyouhaveanyservicecontractsorguaranteesinplace,pleaseletusknowandwecanaddthistoyourfile.
CleanlinessStandards
Atthestartofatenancythepropertyshouldbeofferedinathoroughlycleancondition.Thetenantisresponsibleforensuringthatthepropertyisleftinasimilarconditionattheendofeachtenancy.Wheretheyfailtodoso,theywillbeliableforthecostofthecleaningaspertheInventoryCheckIn/Outservice.
OutsideAreas
Anyoutsidespacepertainingtothepropertyshouldbeleftneat,tidyandrubbish-free,withanylawnscut.Asperthetermsandconditionsoftheleaseagreement,tenantsarerequiredtomaintainthegardenstoareasonablestandard,providedtheyareleftthenecessarytools.
LegalObligations
Wewillkeepyouup-to-dateofanylegislativechangesasandwhentheyarisesothatyouarealwaysmeetingyourlegalobligationsasaLandlord.
PrivateLandlordRegistration(Antisocialbehaviouretc.(Scotland)Act2004)

TenancyDeposit(Scotland)Regulations2011(TDS)UndertheTDStheLandlordhasalegaldutytopaydepositstoanapprovedtenancydepositschemethatwillsecurethedeposituntiltheendofthetenancy.Thelandlordisalsorequiredtoprovidethetenantwithkeyinformationaboutthetenancyanddepositwithin30workingdaysofthebeginningofthetenancyinaccordancewiththetermsoftheregulations.ProBrookPropertiesuseSafeDepositsScotlandastheirdepositschemeprovider.EnergyPerformanceCertificates(EPC)ThisEUledlegislationwasbroughtintoplacein2008andrequiresallresidentialpropertytoprovideanEPCtobedisplayedatthepropertyandavailableforviewingbyprospectivetenants.Theenergyefficiencyratingisrequiredtobedisplayedonalladvertsandthereforemustbeobtainedpriortothepropertybeingadvertisedforlet.Legionnaire'sDiseaseRiskAssessmentLegionellabacteriaarefoundinthenaturalenvironmentandinmostwatersystems.Intherightconditionsthebacteriacanmultiplyandincreasetodangerouslevels.Itisnowthelawthatifyouarerentingoutyourpropertythenyoumusthavearegularriskassessmentcarriedoutinordertoreducetheriskoftenantscontractingthediseasefromwater-borneinfections.Allwatersystemsmustbeproperlymaintained.SmokeAlarmsInaccordancewiththenewRepairingStandards,allpropertieswhicharerentedoutshouldhaveahigh-levelprovisionofsmokealarms.Anypropertybroughttothemarketforlettingforthefirsttimeorexistingpropertiesrequiringtheexistingbattery-operatedsmokealarmtobereplacedmustbefittedwithanewhard-wiredone.Thisincludesaheatsensoralarmfittedtothekitchenaswellasallroomsbeingfittedwithahard-wiredsmokealarm.Housing(Scotland)Act2006(Chapter4Part1)-RepairingStandardThelandlordmustensure,atalltimesatthestartofandduringthetenancy,thatthepropertymeetstheRepairingStandard.InorderforahousetomeettheRepairingStandard:•itmustbewindandwatertightandreasonablyfitforhumanhabitation;•thestructureandexteriorofthehouse(includingdrains,guttersandexternalpipes)mustbeinreasonablerepairandproperworkingorder;•theinstallationsinthehouseforthesupplyofwater,gasandelectricityandforsanitation,spaceheatingandheatingwatermustbeinreasonablerepairandproperworkingorder;•anyfixtures,fittingsandappliancesprovidedunderthetenancymustbeinreasonablerepairandproperworkingorder;•anyfurnishingsprovidedunderthetenancymustbecapableofbeingusedsafelyforthepurposeforwhichtheyaredesigned;and•theremustbeasatisfactoryprovisionofsmokealarms.
TheFire&Furnishings(Safety)Regulations1988(Amended1989&1993)Anyspecifieditemssuppliedinthecourseoflettingapropertymustmeetminimumfire-resistantstandards.Theregulationsapplytoallupholsteredfurnitureandfurnishingsincludingbeds,headboardsandmattresses,sofa-beds,pillowsetc…Theydonotapplytoantiquefurnitureorfurnituremadebefore1950,bedclothes,loosecoversformattresses,pillowcases,curtains,carpetsorsleepingbags.Mostitemswhichcomplywillhaveasuitablelabel,howeverifyouareinanydoubt,ourrecommendationistocheckwiththemanufacturerofsaiditem.CivicGovernment(Scotland)Act1982(LicensingofHomesinMultipleOccupation)&anysubsequentordersTheLandlordisentirelyresponsibleforensuringthattheyhavethenecessaryHMOlicenceforensuringtheycomplywiththeaboveregulations.ShouldtheHMOLicenceexpire,ProBrookPropertieswillnotacceptanyliabilityforensuringanewapplicationismadeandLandlordsshouldnotethatthelocalauthoritydonotissuereminderstoapplyforrenewal.ItremainstheLandlord’sfullresponsibilitythroughouttheperiodoftherentaltoensurethatanappropriateHMOLicenceisinplace,ifapplicable.
