PRO SE INSTRUCTIONS FOR FILING A CIVIL CASE IN U. S. DISTRICT COURT 1. $350 Filing Fee - unless you are GRANTED the right to proceed without prepayment of fees. If you are DENIED the right to proceed without prepayment of fees, you will have 30 days to pay the filing fee or your case will be converted to a miscellaneous case and automatically dismissed by the court. See IFP Instructions attached. 2. Complete Civil Cover Sheet (FS-44) - 1 copy - must be signed & dated. 3. Prepare complaint listing your complete address and telephone number. You will need an original for the court, one for each defendant and a copy for your files. 4. Submit 3 summons for each defendant - one for the court, one to serve with the complaint and a copy to return to the court after service has been effected. For instructions on filling out a summons, see attached sample summons. 5. Disclosure of Corporate Affiliations - an original for the court and a copy for your files. Pursuant to Federal Rules of Civil Procedure 5.2, addressing the privacy concerns created by internet access to court documents, unless otherwise ordered by the court, the filing party shall not include personal information in pleadings. See attached Notice concerning privacy issues. SERVICE OF THE COMPLAINT Service of the complaint may be effected by certified mail, return receipt requested or by personal service by anyone over the age of eighteen (18) years of age who is not a party to the case. A “Return of Service” must be made to the court showing proof of service. This is a document that you will prepare listing your case caption and case number and attaching the green return receipt card to your document. Service for applicants applying “In Forma Pauperis” who are granted the right to proceed without prepayment of fees will be made by the United States Marshal Service. For instructions on making service on the United States, its agencies, corporations, and/or government officers, see Instructions attached. Authority For Civil Cover Sheet

The JS 44 civil cover sheet and the information contained herein neither replaces nor supplements the filings and service of pleading or other papers as requiredby law, except as provided by local rules of court. This form, approved by the Judicial Conference of the United States in September 1974, is required for the useof the Clerk of Court for the purpose of initiating the civil docket sheet. Consequently, a civil cover sheet is submitted to the Clerk of Court for each civil complaintfiled. The attorney filing a case should complete the form as follows:

I. (a) Plaintiffs-Defendants. Enter names (last, first, middle initial) of plaintiff and defendant. If the plaintiff or defendant is a government agency, use onlythe full name or standard abbreviations. If the plaintiff or defendant is an official within a government agency, identify first the agency and then the official, givingboth name and title.

(b) County of Residence. For each civil case filed, except U.S. plaintiff cases, enter the name of the county where the first listed plaintiff resides at the timeof filing. In U.S. plaintiff cases, enter the name of the county in which the first listed defendant resides at the time of filing. (NOTE: In land condemnation cases,the county of residence of the “defendant” is the location of the tract of land involved.)

II. Jurisdiction. The basis of jurisdiction is set forth under Rule 8(a), F.R.C.P., which requires that jurisdictions be shown in pleadings. Place an “X” in oneof the boxes. If there is more than one basis of jurisdiction, precedence is given in the order shown below.

United States plaintiff. (1) Jurisdiction based on 28 U.S.C. 1345 and 1348. Suits by agencies and officers of the United States are included here.
