GMAR Education is Setting a New Standard

GMAR members have been taking advantage of an education “option” that is setting a new standard for REALTOR® boards across the country. This option that was developed by GMAR and is exclusively offered to GMAR members may soon be duplicated nationwide. We all understand the importance and value of education, and this “option” has positioned GMAR as THE industry leader in member education. The accolades are nice, but the benefits and value is to our members and their clients. The results from members taking advantage of this option’s success speak for themselves.

This “option” was born from “out of the box,” member centric thinking that is a part of what makes GMAR great for

its members. GMAR continues to provide the services and options that will benefit our members in the ever changing world of real estate. Our ambition at GMAR drives our directors to explore new ideas that can continue to improve our association as we benefit our members.

The option I speak about is MemberMax. MemberMax allows for monthly board dues billing, as opposed to annual billing, and provides an educational component that affords members free classes for continuing education. Learn more about MemberMax and see if this “option” can work for you like it does for so many of our members.

Every Day is Different – Change Management

It is no surprise that no two days are alike for a real estate professional. This void of order has physical and mental consequences. Some of which we may never be aware of. In an article entitled, “Principles of Change Management,” authors John Jones, DeAnne Aguirre and Matthew Calderone outline some basic points of change management.

1. The human side of change is vital to acceptance. Remember that change is sometimes difficult as it changes patterns with which we are most comfortable. Be tolerant and understanding on both sides—change driver or change receiver.

2. Change involves many layers. Identify all the affected elements that are involved and ensure attention is paid.

3. Make a strong case for the change. Confront the realities that make the change necessary, demonstrate that the change will be good in the long run and provide a viable road map that will outline how the change will proceed.

4. Communicate boldly and often the core message that reinforce the need for change and the outcome it will produce.

5. Understand that previous cultures within the organization still exist. Make sure that you and the organization are ready to begin the change process.

6. Be ready for the unexpected. Try to anticipate what outcomes and impediments could surface and plan to address them.

7. Change, again, is very personal. Make it an individual centric process. Speak one on one with those involved.

The real estate profession appears to be in an era of changes. A lot of new efforts are underway to alter the way we do business. Data sharing, new forms, core standards, codes of excellence, emphasis on safety, CE delivery and maintenance, a robust market, interest rate increases, the emergence of a new buyers culture are all on the horizon. Change is all around us and you will need to adeptly manage the process so you can serve you clients better and relate to those that are providing the services you use in the real estate transaction.

Governor Signs Legislation Promoting More Access to Tax Record Data

Governor Rick Snyder has signed important legislation promoting access to property tax records. Sponsored by Representative Bruce Rendon (R – Lake City), House Bill 4075 became Public Act 39 of 2015.

Access to property tax information is important to the health of Michigan’s real estate market. Realtors® work every day marketing commercial property to help grow economic opportunity and jobs in our state. Realtors® also sell residential property to Michigan citizens and visitors from other states and countries. As a part of these transactions, disclosing in a timely manner this vital public information about a property is important. Potential private property owners need access to this public information to promote quality tax planning and decision making. This realizes a healthy transaction.

The new law modernizes the Transcripts and Abstracts of Records Act (TARA) of 1895 to promote more reasonable costs of property tax record information that is electronically collected by counties. This legislative initiative continued from extensive work done during the last legislative session. The Michigan Realtors® are thankful for quick attention by House Local Government Committee Chair Lee Chatfield (R – Levering) and Senate Local Government Committee Chair Dale Zorn (R – Ida) to this issue through the Committee process and all legislative efforts in the House and Senate to advance this legislation early in the current legislative session.

If you are not aware of the new TRID rules by now, you’ve got a little more time to figure them out. TRID (TILA-RESPA Integrated Disclosures) was originally scheduled to go into effect this August but has been pushed back to October 1 (more on that in a moment). According to the CFPB (Consumer Financial Protection Bureau) the purpose of TRID is to protect consumers. In essence, it states that any changes to a transaction that result in the APR being affected by as little as 1/8 of a point will require a new “closing disclosure” as well as a new 3 day waiting period designed to give the consumer ample time to review the changes and closing disclosure. This fall, you’ll erase the acronym “HUD-1” from your closing repertoire and add the term “closing disclosure.”

The CFPB Director, Richard Cordray, stated:The CFPB will be issuing a proposed amendment to

delay the effective date of the Know Before You Owe rule until October 1, 2015. We made this decision to correct an administrative error that we discovered in meeting the requirements under federal law, which would have delayed the effective date of the rule by two weeks. We further believe that the additional time included in the proposed

effective date would better accommodate the interests of the many consumers and providers whose families will be busy with the transition to the new school year at that time.

As you are already aware, seller credits and other fees are quite often negotiated during the course of an average transaction. In addition, new fees are often generated if a transaction goes beyond the original closing date or if repairs come into play. Yes, even last minute seller credits will delay a closing. Plan accordingly. Adding a bit more time to the purchase agreement will make the closing process smoother for your clients and affiliate partners. Yes, the pontoon boat still needs to be removed from the purchase agreement. TRID does not give a pass on that.

My advice: Welcome TRID with educated open arms. It will take some time to get used to, but in the end it will elevate our industry to a higher professional standard, and we will be able to manage our business, client expectations, and schedules all that much better. Industry professionals have no choice but to get on board, so we are all in this one together. Your GMAR Affiliate Committee continues to provide opportunities to learn more about the changes ahead. A very good friend of mine, James Cristbrook, coined the phrase: “turning competitors into colleagues” a few years back when he held the position that I am privileged to hold this year, State Chapter President. It captured my attention and imagination then as it still does today.

Webster defines colleague as “an associate in a profession.” Breaking it down further, an associate, or to be associated, is to be brought together or into a relationship in any of various ways. Maybe we’re representing the buyer and seller in a real estate transaction. Maybe we’re associated because you are the buyer’s lender on my listing. Or, you’re providing the owner’s policy on a transaction for my buyer.

Isn’t this a much more favorable way to think of our brothers and sisters in the industry than competitors? Competitor is adversarial. Colleague is cooperative. Isn’t cooperative at the very heart of a real estate transaction? Don’t we refer to the agent representing the other party as our “co-op” broker? Don’t our transactions unfold much more smoothly when we are associated with the agent on the other side?

I’m sad to say that I’ve experienced my share of uncooperative folk in this industry. But, when dealing with a Women’s Council colleague in any of the many roles and professions needed to affect a sale/transfer of real estate, I’ve received full cooperation.

My experience in Women’s Council has gone way beyond “associations.” Through WCR I’ve become associated with many fine REALTORS®, lenders and title experts I never would have met otherwise. And, I’ve had more pleasant experiences when dealing with those associates in a transaction. The bonus has been that many of those associates have become my dearest friends.
