the results obtained by the purchase of trees. No claim of any kind, whether
after the trees are delivered or for non-delivery of same, and whether or not
based o n negligence, shall be greater in the amo unt than the o riginal purchase
price of the trees in respect to which such claim is made and in no e vent shall
Hilltop be liable for indirect co nsequential dam ages, wh ether or no t resulting
from or caused by negligence of the nursery. H illtop ma kes no other w arranties
of any kind whatsoever, express or implied, and all implied warranties of
merchantability and fitness for a particular purpose which exceed the afore
stated obligations and hereby disclaimed by Hilltop and excluded from the
agreement.
All replace ments FOB. H illtop, Ha rtford, Michigan. The purcha ser is
responsible for all freight and packaging costs on replacement trees.
If trees are delivered damaged, or if trees do not appear to start growingproperly, please contact Hilltop directly immediately, Hilltop may be able to
help correct the problem.
Warning:Ethylene Gas concentration will cause extensive damage or kill
trees if trees are stored with apples or in storage rooms that have not been
completely ventilated.
This warran ty supersedes all previous written o r verbal wa rranties.

SHIPPING:
LOCAL PICK-UP: Mid we s t a nd Ca na d ia n g rowe rs o f t e n ma k eappointments with our nursery office and conveniently pick-up their
trees with their own truck. Growers save big on shipping and packaging
cost. Call a week in advance and well have your order ready! Bringcovers for bare root or have us box your order at cost.
DIRECT POOL TRUCK DELIVERY: When we have sufficient orders
from customers located along or near main routes, we hire an insulatedand temperature controlled truck and deliver directly from our warehouse
to yo u. This assures you of getting yo ur trees in top co ndition. Costs will
be prorated and included in your invoice.
UNITED PARCEL SERVICEcan be used for small shipments but packagescan be no larger than 108 combined length and girth.
MOTOR FREIGHT is usually reserved for la rger shipments. Trucklineswill not usually accept trees in freezing weather so shipment may be
delayed in February and sometimes in March.

2. Carefully grown and free of harmful disease or insect damage.
3. Properly graded for uniformity of size and quality.
4. Carefully stored to maintain their high quality.
Purchaser assumes the responsibility for proper care and maintenance of
trees as outlined below and in the planting guide. This means that all trees
will be carefully stored and protected until planted properly in suitable soil
on a co rrectly prepared site. Trees must be pruned at pla nting time and
planted properly either with a tree planter or in augured holes of adequate
size and ta mped in to seal in soil around the roo t system. Trees should be
wa tered in at planting time and add itionally as needed, m ulched or cultivated
to prevent competition from grass and weeds and protected from rodents.
Warranty is void if manure, fertilizer, or similar material is placed in the hole
with the trees. Warranty is void if trees are planted after June 1 of the year
the trees are delivered. If Hilltop trees do not meet our warranty and have
been cared for properly as stipulated above, Hilltop will replace the trees
subject to availability of the stock at the time of no tification, o r at our o ption,
refund the purchase price o f the trees, providing the purchasers account is
current and Hilltop is notified directly of the loss before July 31, of the yearthe trees are delivered. The replace ment po licy shall extend only to first year
planting of new orchards. It shall not a pply to trees purchased for replants or
to trees furnished und er this replacement policy. Tota l replaceme nts shall
not e xceed ten pe rcent (10%) of the to tal original orde r. Warranty does not
apply to utility grade trees, trees purchased for resale, trees purchased by
non co mmercial growe rs or inventory reduction sales. In the event that Hilltop
trees might prove to be untrue to name and Hilltop is notified directly during
the first fruiting season, Hilltop will replace the trees, or at our option, refund
the purchase price. Such a ction by Hilltop shall constitute full and complete
ORDERS: Minimum order of one hundred (100) trees. All trees willbe invoiced according to the size and quantity supplied and at the
price in effect at the time o f shipping. The q uantity rate w ill be
determined by the total number of trees shipped, without regardfor the numb er of trees ordered . Trees are graded and sold in bundles
of five or ten, depending on size. If a smaller quantity is ordered, a
$2.00 per item broken bundle charge will apply.
DEPOSIT: A deposit of $1.00 per tree is required at time of order.
No de posit is req uired on subject items, replace ment trees. Yourdeposit will be refunded if we are unable to supply the trees.
PACKING & SHIPPING:The co st for packing and shipping will be atcost and included in yo ur invoice. This applies to replaceme nt trees
as well.
PAYMENT: Net cash is due on receipt of order confirmation. If wehave a signed credit application on file which has been approved by
our credit department, the amounts will be due within thirty days of
invoice da te. All late pa yments will be cha rged 1.5% per month o n
the unpa id ba lance (annua l rate 18%). All foreign remittances mustbe in U.S. dollars.
CANCELLATION: Orders, once accepted in writ ing, cannot becanceled without the written consent of Hilltop. If canceled, it must
be based upon terms which will indemnify Hilltop against all lossarising from such cancellation. Deposits will not be refunded ontrees canceled after February 1.
