Andhra Pradesh Government constituted the existing A.P.Pollution Control Board under section 4 of Water(Prevention & Control of Pollution) Act,1974 and undersection 5 Air (Prevention & Control of Pollution) Act, 1981vide G.O.Ms.No. 1, Dt. 02.01.2018 through EFS&TDepartment.

The Board consists of a Chairman, 5 officials, a MemberSecretary, 5 members from local authorities, 3 non-officialmembers, 2 members from Corporations.

CONSENT MANAGEMENT

Pollution Control Board issues two types of consents:

a) Consent for Establishment: All the industries need consentto establish before actual commencement of work forestablishing the industry U/S 21 of Air Act and U/S 25 ofWater Act.

b) Consent for Operation: The industry shall obtain CFObefore commencement of actual production U/S 22 of AirAct and U/S 26 of Water Act.

INSPECTION OF UNITS / INDUSTRIES

Monitoring high risk industries by randomized inspection

using a software tool. 2 / 3 industries / month / inspectors

are randomly allotted to 19 inspection teams and reports

uploaded in system within 48 hours for downloading by

industry.

The Board is imposing Bank Guarantees to ensure

compliance in certain cases, issuing time targeted

RESTRUCTURING AND STRENGTHENING

• The APPCB earlier had 5 Zonal Offices and 19 Regional Offices.

• After bifurcation, the APPCB has 3 Zonal Offices and 9 RegionalOffices. Subsequently, Government accorded permission videG.O.Ms.No.6, dated 21.01.2019, to establish four Regional Officesat Srikakulam, Prakasam, Kadapa and Anantapur. Accordingly, fournew Regional Offices are established.

• For effective usage of the existing meager staff, a restructure of theexisting system is necessary.

• To catch up with the present Government’s industrial policies, theAPPCB has to be strengthened.

• ASCI was entrusted with the study on the restructuring of APPCB.ASCI submitted final report.

EASE OF DOING BUSINESS

• In 2015, APPCB Scored 85.19% on Environmental

parameters helping the AP State to get second place.

• In 2016, out of 350 parameters, 49 belonging to APPCB,

implemented all the environmental parameters, secured -

100%. Andhra Pradesh got 1st place.

• In 2017, out of 372 parameters, 44 reforms belong to

APPCB, implemented all the reforms. Andhra Pradesh got

1st place.

• In 2019, the overall portal score of Andhra Pradesh is 100%

and overall implementation score is 52.40%. With these

scores, the Andhra Pradesh State secured First rank.

• In 2020, State Business Reform Ranking is solely based on

the feedback. APPCB got 100% on feedback evaluation.

Issue: Re-constitution of Board of APPCB

Status: The tenure of the present Board will expire by 01.01.2021. The APPCB addressed a letter dt.25.11.2020

to the Government regarding re-constitution of the Board.

Issue: Re-constitution of SEIAA / SEAC

Status: The MoEF & CC, Govt. of India, New Delhi constituted State Level Environment Impact Assessment Authority

(SEIAA) and State Level Expert Appraisal Committee (SEAC), Andhra Pradesh vide notification S.O. No. 4001(E),

dt.20.12.2017 for a period of 3 years. The term of SEIAA and SEAC will expire on 19.12.2020. The APPCB addressed

a letter dt.19.09.2020 to all the Universities and Organisations to send the mails of experts for re-constitution of SEIAA

and SEAC. Further, the government vide G.O. Rt. No. 86, dt.04.11.2020 constituted a committee to short list and

recommend the names of the experts to the Government.

Recruitment of staff to fill existing vacancies in APPCB

Status: The APPCB is pursuing the Government through protracted correspondence since 2015 to accord the

permission to fill up vacancies in APPCB. The Board had submitted replies to the queries raised by the Government

from time to time. The Hon'ble NGT in its order dt.28.08.2019 in O.A.No.95 of 2018 directed that the State PCBs to fill

up all the vacant positions within 4 months. Accordingly, a letter dt.17.10.2019 was again addressed to the

Government in this regard.

The orders from the Government are awaited. It is learnt that the file is under process in the Finance Department.

There is no financial burden to the Government to fill the existing vacancies in APPCB. The Board will meet all the

expenses for the proposed new staff from its own funds.

Issue: Processing of proposals received to issue clearance under CRZ Rules

Status: The AP Coastal Zone Management Authority (APCZMA) was constituted by the MoEF & CC, GoI, New Delhi vie

SO: 1423 (E), dt. 01-05-2020 under the Chairmanship of Special Chief Secretary / Prl. Secretary to the Government,

EFS&T Department. The Authority examines the proposals received for obtaining clearances under CRZ Rules issued by

the MoEF & CC, GoI, New Delhi.

There are 6 proposals received with complete information and same and to be placed before the APCZMA. Hence, a

convenient date and time is to be fixed to convene the meeting. File will be circulated in this regard.

Issue: Preparation of CZMP for the State of Andhra Pradesh by National Centre for Sustainable Coastal

Management (NCSCM), Chennai.

Status: The MoEF&CC, Govt. of India, New Delhi had approved the Coastal Zone Management Plan (CZMP) of Andhra

Pradesh on 28.02.2019 as per CRZ Notification 2011. The approved CZM Plans are uploaded in APCZMA website i.e

http://apczma.ap.gov.in.

The CRZ Notification, 2011 was amended by MoEF&CC, GoI, New Delhi vide G.S.R.37 (E), dated 18th January 2019 with

a condition to consider the amendments be applied only after updating the Coastal Zone Management Plan (CZMP). Until

the revision of CZMP, the appraisal of the projects shall be taken up as per the provisions of the CRZ Notification, 2011

only.

The Government of Andhra Pradesh entrusted the work to National Centre for Sustainable Coastal Management

(NCSCM) Chennai for preparation of APCZMP. The APPCB has released an amount of Rs.1,98,66,480/- to NCSCM,

Chennai vide Procds. No.12 (a)/APCMZA/CRZ/APCZMP/2019, dt.03.09.2020 for the same. The APCZMP is under

preparation.

Issue: Air & Water Amendment Rules

Status: The proposed amendment to Water (P&C of pollution) Rules & Air (P&C of pollution) Rules along with Board

Resolution was submitted to the Government vide letter dt.02-11-2020.

Issue: Extension of tenure of State Level Expert Committee on Environment (SLECE)

Status: The SLECE constituted under the Chairmanship of Dr. T. Chatterjee, I.A.S., ( Retd) by the Govt of AP., vide

G.O.Rt. No: 96, dt. 08.11.2019. The SLECE has been given specific Terms of Reference (TORs) covering the

essentials of interventions required that would enable the State of Andhra Pradesh to proceed on an environmentally

sustainable development.

A letter dt.05.11.2020 was submitted to the Government to extend the validity of tenure of the SLECE, upto

06.05.2021. Orders are awaited from the Government.

Issue: Appointment of Project Director (PD) and Additional Project Director (APD), ICZMP Project

Status: The Board addressed letters dt.10.12.2019; 06.03.2020 and 12.06.2020 for appointment of the Project

Director (PD) and Additional Project Director (APD) along with supporting staff as per the qualifications given by the

Society of Integrated Costal Management (SICOM) for further implementation of the Integrated Coastal Zone

Management Project (ICZMP).

Issue: Revision of CFE / CFO Fees

Status: The proposal was already submitted to the Government. The Government sought legal opinion on the draft

G.O.Ms.... of A.P. on par with G.O.Ms.No.22, Environment, Forests, Science & Technology (III) Department, dt.09-

07-2018 by the Telangana Government. The legal opinion dt. 05.11.2020 received from Standing Counsel of APPCB.

Issue: Board meeting of APEMC

Status: The APEMC conducted its 3rd Board meeting on 19.11.2020 and has to conduct its 4th Board meeting

before 31.12.2020, as APEMC has to conduct minimum 4 Board meetings in a year. File under circulation.

RIVER REJUVENATION

Central Pollution Control Board (CPCB), Delhi has identified 351 river stretches as

polluted river stretches in the Country for not meeting the prescribed water quality

standards. Five river stretches among them in Andhra Pradesh have been identified as

polluted river stretches for exceeding the prescribed standard limit of Bio-chemical

Oxygen Demand (BOD), 3.0 mg/lit during the period of two years, 2016 & 2017. Details of

RIVER REJUVENATION

The Hon’ble National Green Tribunal, New Delhi by taking Suo-Motu cognizance of a

report in “The Hindu” news paper, dated 17.09.2018 under the title “more river stretches

are now critically polluted: CPCB” has issued certain directions in its Order dated

20.09.2018 in O.A. No. 673 of 2018.

The Environment, Forest, Science & Technology Department, Govt. of Andhra Pradesh

has issued the Government Order Rt. No.177, dated 05.12.2018 constituting the "River

Rejuvenation Committee (RRC) with the following Members for performing the functions

as ordered by the Hon’ble National Green Tribunal and to formulate & for finalization of

Action Plans for restoration of the water quality of the five identified polluted river

stretches in Andhra Pradesh.

Plastic Waste Management Rules, 2016 and amendments thereof

Less than 50 microns plastic carry bags prohibited.

About 676 TPD (10% of Solid Waste) of plastic waste is generated and 223 TPD (1/3rd) is

collected by Municipalities and remaining 2/3rd (i.e.446 TPD)is directly sent to recyclers and left

BIO-MEDICAL WASTE MANAGEMENT

• Bio Medical Waste Management Rules, 2016 were issued to

deal with Bio Medical Waste generated in HCFs during the

diagnosis, treatment or immunisation of human beings or in

research activities.

• There are 10,225 Health Care Facilities (HCFs) with bed

strength of 1,41,916.

• The Bio Medical waste is transported to Common Bio Medical

Waste Treatment Facility (CBMWTF) for incineration. There

are 12 common facilities operation in 13 districts of the state.

• CBMWTFs are in operation in all the districts individually

except in Vizianagaram & Kadapa districts due to less

number of HCFs / Beds.

• About 15 TPD of Bio Medical Waste is being treated in

common facilities.32

• Earlier, organic residues generated from Bulk Drugs &Pharmaceuticals units were incinerated wasting the heat value ofthe Hazardous waste.

• The MoEF, GoI issued notification dated 23rd March 2016 on e-Waste (Management) Rules, 2016 and these Rules came intoeffect from 1st October, 2016.

• These rules were issued under the provisions of E(P) Act, 1986.

• CPCB issued Guidelines for implementation of the e-WasteRules, 2016.

• These Rules shall apply to every Producer, Consumer or BulkConsumer, collection center, dismantler & recycler involved inthe manufacture, sale, purchase and processing of Electrical andElectronic Equipments (EEEs).

• The generation of e-waste is about 550 TPA and is beingcollected by e-waste collection centre operated by privateagency (i.e Green Waves) in Visakhapatnam which is sent torecycling facility at Bangalore.

Andhra Pradesh Environment Management

Corporation Limited (APEMC)

The State of Andhra Pradesh has 8836 industries, out of which Red Category

- 3399 (including 298 no. of 17 category industries), Orange Category - 3993

and Green Category – 1444. Out of total no. of industries, 2683 Red &

Orange category industries are hazardous waste generating industries and

remaining are Stone crushers, Mining, Re-rolling mills, Spinning mills, Para

Boiled Rice Mills, etc.

According to the hazardous waste inventory during 2019-20, about 6.21 lakh

tonnes of hazardous waste is generated in the State of Andhra Pradesh, out

of which around 3.42 lakh tones is utilizable waste (55.07%) i.e., suitable to

use as raw material or as alternative fuel viz. Co-processing in Cement Plants

so as to conserve the resources, 1.16 Lakh tones is recyclable (18.68%) i.e.,

suitable for recycling /recovery of material viz. oil reclamation units, lead and

zinc recovery units, 0.046 lakh tonnes is incinerable (0.74%) i.e., not suitable

for any recycling / reuse and having high calorific value i.e. > 2500 K cal/kg

and 1.58 lakh tones is landfillable (25.44%) i.e. not suitable for any recycling /

reuse and having low calorific value i.e. < 2500 K cal/kg.

Formation of APEMC

In order to manage the waste in a more organised way, with a

proper mechanism for scrutiny and Audit, the EFS&T Dept,

Govt. of AP formed Andhra Pradesh Environment

Management Corporation (APEMC) vide G.O. Ms. No. 39

dated 05.12.2019, for providing effective mechanism of

collection, transportation, storage, treatment, processing,

delivery and disposal of the industrial waste and other

wastes.

The Hon’ble Chief Minister, Government of Andhra Pradesh

has launched the APEMC i) Website (apemcl.ap.gov.in), ii)

Online Waste Exchange Platform and iii) Poster of Online

Waste Exchange Platform, on 05.06.2020 on the eve of “World

Environment Day 2020”.

The salient features of the corporation are:

i. India’s 1st online waste exchange platform

ii. A proactive initiative of Govt. of AP towards environment

improvement

iii. 100% safe disposal of toxic wastes

iv. Proper tracking, scrutiny and audit of the waste

v. Encouragement towards utilization of wastes such as co-

processing.

vi. Promoting 6Rs – Reduce, Reuse, Recycle, Refurbish,

Redesign & Remanufacture.

The EFS&T Dept, Govt. of AP vide G.O.RT.No. 27 dated 24.04.2020 issued

orders for Constitution of Pricing Committee with 13 members, for fixing the

charges for the waste management plus a service charge for the Corporation

and nominated the representatives from BDMA, Cement Industries

Association, CETPS, TSDFs, APFICCI, Pre-Processing units and Oil

Reclamation (Recycling) units for the pricing committee, on 24.08.2020.

Accordingly, the Pricing Committee fixed-up the service charges for the

corporation for the waste management, for a period of 6 months, on

09.10.2020.

The APEMC commenced its online waste exchange operations from

05.11.2020.

APEMC is offering services like i) proper tracking and scrutiny of hazardous

waste being transported till it reaches the designated disposal facility, ii)

verifying the marine discharge into the sea, through SOP developed which

includes automation of sample collection, analysis, approval for discharge.

Till 13.12.2020, the APEMC collected an amount of ₹ 66,49,949 [₹12,63,622

under (pay now option) and ₹ 53,86,327 under (pay later option)], towards

service charges, from the industries who generated 2737 manifests (liquid -

1170 and solid – 1567). About 37 manifests were randomly verified.

Society of Integrated Coastal Management (SICOM) has released an

advance amount of Rs 30 Lakhs and was deposited in the separate

bank account opened under this project to SPMU-Andhra Pradesh for

procurement of the IT equipments & infrastructure under stipulated

World Bank guidelines.

Letters were addressed to the Spl. Chief Secretary EFS&T

Department, on 10.12.2019, 06.03.2020 & 12.06.2020 for appointment

of fulltime Project Director and Additional Project Director along with

Supporting Staff as per prescribed qualification given by SICOM for

further implementation of the Integrated Coastal Zone Management

Project.

Letters were addressed to Society of Integrated Coastal Management

(SICOM) on 20.09.2020 to kindly extend the time for another 3

months i.e upto December 2020 for procurement of the IT equipments

& infrastructure

• To ensure livelihood security to the communities in the coastalarea, to conserve and protect the coastal structures and topromote development through sustainable manner, the MoEF,GoI, New Delhi issued Coastal Regulation Zone (CRZ)Notification 2011 and its subsequent amendments, under theprovisions of Environment (Protection) Act, 1986 and itsamendments thereof.

• The CRZ areas are categorized as CRZ–I, CRZ-II, CRZ-III &CRZ-IV from the high tide line up to 500m in the land ward sideand towards water side 12 Nautical Miles. The area between LTL& HTL is also covered under CRZ.

• Also declared No Development Zones (NDZ) in the EcologicallySensitive Areas.

• The APPCB has provided secretariat service to APCZMA for dayto day activities.

• The MoEF&CC, GoI, New Delhi has constituted the AndhraPradesh Coastal Zone Management Authority (APCZMA) toappraise the projects/activities/building proposals requiring CRZClearance vide Notification No.S.O.1423 (E), dated 01.05.2020.

• The Special Chief Secretary (or) Principal Secretary toGovernment, EFS&T Dept., Govt. of A.P. is the Chairman for theAPCZMA & the Member Secretary, APPCB is the MemberSecretary for the APCZMA.

• The complete applications pertaining to the permissible activitiesare to be appraised by CZMA within a period of 60 days and therecommendations of the CZMA shall be considered for clearancewithin 60 days by MoEF or SEIAA.

• The MoEF&CC, GoI approved the Coastal Zone ManagementPlan (CZMP) of A.P as per CRZ Notification 2011. The approvedCZM Plans are uploaded in APCZMA website i.ehttp://apczma.ap.gov.in.

• The MoE&F, GOI, New Delhi vide S.O. 1533 dt. 14.09.2006

issued Environmental Impact Assessment Notification, 2006

(EIA-2006) and its subsequent amendments, under the

provisions of Environment (Protection) Act, 1986 and its

Appraisal

• Appraisal means the detailed scrutiny by the Expert Appraisal

Committee or State Level Expert Appraisal Committee of the

application and other documents submitted by the applicant

for grant of environmental clearance

• The proponent shall apply in the prescribed application format

i.e. Form- 1/Form -2 along with relevant documents to the

concerned authority through online in MoEFCC - EC website:

http://environmentclearance.nic.in. The proponents will be

invited to the meeting of the State Level Expert Appraisal

Committee (SEAC), an advisory committee to the State Level

Environment Impact Assessment Authority (SEIAA). The

applications are subjected to screening and scoping. In case

of Category 'B2' projects, the SEAC recommends for the

issue of Environmental Clearance (EC).

• In case of Category 'B1' projects, the SEAC issues Terms of

References (TORs) to the project proponents based on the

climatic conditions of the region, surroundings of the site,

manufacturing process, pollution generated from the

proposed project etc.

• The proponent has to prepare a draft Environment Impact

Assessment (EIA) report based on the TORs issued by the

SEAC. The proponent approaches concerned State Pollution

Control Board to undergo the process of public consultation.

• The proponent prepares the final EIA report incorporating the

issues arouses in the public hearing and submits to the

concerned authority i.e. MoE&F, GOI for Category-A projects

and SEIAA for Category-B projects

• The concerned authority appraises the final EIA report,minutes of the public hearing and representations receivedfrom the public and the reply /commitments of the proponenton the issues arouse in the public hearing. A final decision istaken regarding issue of environmental clearance, conditionsto be stipulated in the EC. Accordingly, environmentalclearance is issued. • Cluster Notification: MoEF&CC, GOI, New Delhi vide S.O.2269(E) dt. 01.07.2016 issued notification on the applicabilityof Cluster stated for project or activity of mining of minorminerals of Category ‘B1’ in case of cluster of mining leasearea;”;

• A cluster shall be formed

– when the distance between the peripheries of one lease is lessthan 500 meters from the periphery of other lease in ahomogeneous mineral area which shall be applicable to the mineleases or

– Quarry licenses granted on and after 9th September, 2013.”

– The leases not operative for three years or more and leaseswhich have got environmental clearance as on 15th January,2016 shall not be counted for calculating the area of cluster, butshall be included in the Environment Management Plan and theRegional Environmental Management Plan.”
