1. Introduction

Solicitors admitted in Queensland after 17 December 1988 who intend to practise as principals are required to successfully complete a Practice Management Course (PMC) prior to being issued with a principal practising certificate.

Consistent with the consumer protection objectives of the Legal Profession Act 2007, the objective of a PMC is to ensure that solicitors who wish to apply for a principal practising certificate possess the necessary skills and knowledge to be held out to the public as a principal.

Under r.34(1) of Queensland Law Society Administration Rule 2005, this objective is reflected in the requirement that each PMC must be designed to create and maintain a high level of legal and management skills in the provision of legal services by solicitors to the public.

QLS’s PMC covers the nine competency areas detailed in the prescribed content of a PMC in Queensland, as approved by QLS Council. QLS’s course consists of pre-reading, three days of face-to-face workshops, and five assessment tasks. Course participants must pass all assessments to a defined standard in order to successfully complete the PMC.

You can enrol for the PMC at any time throughout the year.

This course is invaluable, not just to those wishing to go it alone, but for those who run their own department.

I would recommend this program to anyone who has expertise to hold this certificate – it is important to be aware of the responsibility of the certificate.

2. QLS PMC

QLS’s PMC offers you the opportunity to expand your managerial skills and assist you to move more easily to the role of principal.

The PMC:

• provides a challenging and stimulating learning environment• is based on contemporary thinking around legal practice management• is facilitated by academically qualified and practising internal and external faculty• applies management concepts and theories to participants’ local environments

in a practical and relevant manner• is the most authoritative source of guidance and professional development

in relation to trust accounting, ethics and risk management• offers extensive support to participants during and after the course.

As a course participant, you can expect to:

• be exposed to the views, thoughts, and ideas of theorists and guest speakers in the field of management, leadership and legal practice management

• develop transferable practical skills and strategies for managing your practice• develop draft business documents as part of the assessment regime that

can then be applied to practice • participate in robust discussions with colleagues and faculty • approach practice management with an increased level of confidence.

Added valueIn addition to the compulsory pre-reading for the course, you will receive:

• a companion text to the required pre-reading materials

• additional QLS resources such as the Practice Succession Guide (QLS 2013), the Starting your practice checklist (QLS 2014) and QLS guide to the Legal Services Award 2010 (QLS 2011).

Overall, this workshop was enjoyable, informative and holistic, whilst ensuring I was very aware of the

importance of careful business venture planning.

Course structureQLS’s PMC consists of:

• pre-reading – an estimated 30-35 hours of readings and DVD viewings• three days of face-to-face workshops tailored to those proceeding to either small/sole practice

or medium/large practice• five assessment items.

Assessment items include:

1. a multiple choice and short answer, 35 minute, closed book trust accounting exam, that tests your understanding and application of trust accounting and costs disclosure concepts and regulations

2. a trust accounting workbook which involves completing appropriate trust accounting records for different scenarios

3. ethics case studies and scenarios for which you must submit an appropriate response4. a self-audit on risk, compliance and standards5 an integrated high level business plan, including a marketing plan and budget (templates

will be provided).

All assessments must be passed to a defined standard for successful completion of the PMC.

The PMC first provides you with a contextual view of the practice of law in Australia. Against this background, you will then consider key operational aspects of business management and optimising the performance of your practice. The third area of study focuses on you as an individual and the relationship between business skills and leadership style.

3. Course units and learning outcomesThe PMC features the following units and learning outcomes.

Strategy

Unit name Description Learning outcomes

Business planning

The process of business planning and determining an agreed business model and strategy focuses thinking and action on the practice’s goals and objectives. This unit challenges you to clarify positioning and to differentiate your practice in terms of business model options, to identify strategic goals and document a plan for achieving those goals.

At the end of this unit, you will be able to:

• identify the key choices principals must make regarding business models, practice structure, and business planning

• demonstrate capability to apply sound judgment to specific choices

• develop a business plan for your practice.

Business development and marketing

Legal practice marketing and business development is becoming increasingly more ambitious, competitive and sophisticated. This unit aims to explain how marketing and business development can help legal practices, provide an overview of common marketing activities, and outline how selling techniques and approaches can assist you to grow your practice.

At the end of this unit, you will be able to:

• describe alternative approaches to business development and marketing

• identify approaches most likely to be effective in your practice, and develop a plan for implementation.

Client service Client perceptions of the quality of client service have a dramatic impact on client retention, referrals, the justification of fee levels, fee recovery, cash flow and ultimately profitability. This unit outlines the key steps required to deliver excellent client service in terms of personal skills, practice systems and culture.

At the end of this unit, you will be able to:

• explain why client service is so important in a legal practice

• describe key concepts in relation to value and client service

• identify how value can be created and excellent client service can be delivered

• describe how to build better, stronger client relationships

• explain the risks and benefits of using client service in a practice’s marketing

• identify how to handle different expressions of client dissatisfaction.

Practice finance

Effective financial management requires planning, monitoring, control and discipline – and a budget should act as the centrepiece of this effort. This unit provides a framework for the development of practice budgets, discusses key practice Key Performance Indicators (KPIs) and emphasises the importance of managing practice cashflow.

At the end of this unit, you will be able to:

• understand the planning and budgeting process

• prepare budgets for fee income, expenses and cash flow

• analyse practice performance using KPIs and benchmarking

• identify alternative strategies to manage cash flow and working capital

• understand the variables involved in valuing a legal practice.

Operations

Costs, billing and profitability

The effective management of costs and billing is critical to ensuring client satisfaction and practice profitability. This unit urges you to look at costs as more than a compliance issue, and to focus on best practice approaches to communication, management and administration.

At the end of this unit, you will be able to:

• describe best practice costs and billing arrangements to comply with regulations and ensure client satisfaction

• demonstrate knowledge and understanding of these elements and their implementation in a range of scenarios

• discuss the potential advantages and disadvantages of alternative fee structures

• identify and discuss alternative approaches to improving practice profitability.

Trust accounting

Trust and office accounting involves a consideration of both basic bookkeeping procedures and the responsibility of solicitors to account for money received on behalf of others. This unit provides a framework for the competent management of both trust and office account records.

At the end of this unit, you will be able to:

• describe and apply the law and practice of trust accounting to competently handle money received in the course of practice

• maintain trust and office account records according to law and professional obligations.

Risk and compliance

Solicitors are vulnerable to not only claims of professional negligence but also compliance, complaints, client dissatisfaction, business continuity concerns and other risks. This unit discusses those aspects in the conduct of legal practice that may bring the careless or unwary solicitor undone.

At the end of this unit, you will be able to:

• understand risk management concepts• identify risks specific to practice and

apply appropriate approaches to minimise and mitigate risks

• identify the functions, products and services that may be subject to compliance requirements, and be able to implement practice arrangements as appropriate

• ensure compliance with the legislation and regulation applicable to legal practice in Queensland.

Information technology (IT) and knowledge management

Performance, productivity and competitive advantage in legal practice are increasingly dependent on how effectively technology and knowledge can be combined and applied. This unit outlines the basic considerations when investing in IT, and urges you to take a broad view of the role and potential of intellectual capital in legal practice.

At the end of this unit, you will be able to:

• discuss the challenges facing legal practices in implementing systems to help manage data and knowledge

• describe the optimal selection process for acquisition of practice management IT systems

• identify the key components of intellectual capital in legal practice

• identify appropriate approaches to the capture, storage and transfer of knowledge in legal practices.

Individual

Ethics and responsibility

Solicitors must have the knowledge and skills to act ethically and to display professional responsibility and courtesy in all dealings with clients, courts and tribunals, the community and other practitioners.

In this unit, you are encouraged to reflect on wider issues facing the legal profession and to have the confidence to voice ethical concerns in practice. You are encouraged to view the knowledge of the formal rules of conduct as only a part of professionalism.

At the end of this unit, you will be able to:

• anticipate, identify, address and resolve ethical issues as they arise in practice

• determine the courses of action most appropriate to serve the best interests of the client, the court, the profession, the employer, society and self

• resolve conflicts between the various duties.

Managing people

In this unit, you will consider culture, staffing, supervision, performance management and the critical skills and abilities that form the basis of the effective management of people. The aim is to remind or acquaint you with models and frameworks that can improve effectiveness in the management of people and teams in a legal practice.

At the end of this unit, you will be able to:

• describe the elements of managing people, supervision and performance management applicable to a legal practice

• apply appropriate skills and systems to managing self and others.

Leadership Leadership is a process of social influence in which one person can enlist the aid of, and support, others in the accomplishment of a common task. This unit discusses the benefits of leadership and suggests approaches and behaviours that can help to engage hearts and minds.

At the end of this unit, you will be able to:

• differentiate between leadership and management

• explain the benefits of leadership• identify key leadership behaviours• explain the importance of flexible

approaches to leadership• discuss how to motivate different

team members.

One of the best aspects of this course was the opportunity to interact with other like-minded

professionals with vastly different backgrounds, who are approaching similar stages in their career.

4. Pre-readingOn confirmation of registration you will be provided with pre-reading including:

• bespoke texts for each of the 11 units of the course• additional materials, such as Ethics Centre readings• a trust accounting DVD.

All pre-reading materials are based on contemporary thinking in legal practice management and have been developed specifically for the course.

You are required to read/view all materials before attending the workshop relevant to each unit. Failure to complete pre-reading will amount to academic misconduct (see section 8 of this prospectus). In the event that you have registered to attend a workshop but have not completed the pre-reading, you must withdraw from the nominated workshop at least one week prior to the workshop by advising QLS in writing or via email.

You should allow 30-35 hours for completion of all pre-reading before attendance at the workshop.

The practice reading materials were interesting, relevant and of good quality.

Value resourcesAs a companion text to the required pre-reading materials, you will also be provided with a selected thought-provoking book on legal practice.

You will be provided with additional QLS practice management resources, including:

• Practice Succession Guide (QLS, 2013)• Starting your practice checklist (QLS, 2014)• Legal Services Award 2010 (QLS, 2011)• QLS commentary on the Australian Solicitors Conduct Rules 2012.

These additional resources are not compulsory reading for the course, but are provided to assist you in your career as principal.

Excellent course – I wish I had access to this material when I started as a legal practitioner.

Extended DISC Personal AnalysisAs a component of the PMC, you will be provided with an Extended DISC Personal Analysis profile prior to the Leadership session.

Extended DISC Personal Analysis assessment tools are designed to provide user-friendly information that changes the way individuals communicate, behave and work together both professionally and personally.

In order to receive this profile, you will need to complete an online questionnaire approximately one week prior to the workshop days. You will receive instructions regarding the online questionnaire by email. After completion of the questionnaire, a profile report will be sent to you and a copy will be provided to our Leadership presenter. The purpose of the report is to provide you with an in-depth guide to your own individual leadership development, which will be explained to you in detail in the Leadership session.

I really enjoyed reading my DISC profile, even if it was a little confronting.

5. WorkshopsEach of the 11 units of QLS’s PMC has a workshop session that develops and applies the concepts identified in the corresponding pre-reading material.

The workshops will be run over three days. Attendance and active participation in all workshop sessions is compulsory for successful completion of the PMC. If you do not attend all or part of your scheduled PMC workshop due to any circumstance, you may be required to attend a subsequent workshop day or complete any other remedial action as considered appropriate by QLS.

Workshop dates will be advised on commencement of each calendar year.

The workshops:

• are set in a challenging and stimulating learning environment with case studies, group discussions and individual learning exercises

• have been developed according to adult learning principles• are facilitated by academically qualified and practising internal and external faculty• apply management concepts and theories to legal environments in a practical

and relevant manner• give you the opportunity to develop draft business documents as part of the assessment

regime that can then be applied to practice • give you the opportunity to participate in robust discussions with colleagues and faculty.

You will be given the opportunity to register for a workshop tailored to either:

• sole/small practice (practices of up to three principals or which do not have professional managers with primary responsibility for handling the operational aspects of managing a practice)

• medium/large practice (practices of four or more principals or which have professional managers with primary responsibility for handling the operational aspects of managing a practice).

6. Assessment The course includes five assessment items. The type of assessment varies, caters for different learning styles and has application to practice after the course is complete.

3. Trust accounting workbook

Completion of a trust accounting workbook which involves completing appropriate trust accounting records for different scenarios.

You will be provided with:• a questions and exercises booklet• a workbook of blank records• the correct answers to check

answers and entries.

Trust accounting Workbook materials will be provided at the commencement of the course, with final submissions due 10 working days after the final PMC workshop day.

Workbooks will be reviewed to ensure you have completed all required tasks successfully.

4. Trust accounting exam

Multiple choice and short answer closed book exam, duration 35 minutes, testing understanding and application of trust accounting and costs disclosure concepts and regulations.

Trust accounting Exam will be held on the morning of workshop day 3.

Pass mark of 70%.

5. Ethics case studies and scenarios

You will be provided with one or more hypothetical ethical dilemmas and asked to submit an appropriate written response.

Ethics and responsibility

During the Ethics and responsibility session on workshop day 3.

Responses must demonstrate understanding of the principles and concepts covered in the workshop and pre-reading.

As the PMC is a competency based course, it is graded on the basis of ‘demonstrates competence’ or ‘fails to demonstrate competence’. A PMC Statement will be issued on the basis of a course participant demonstrating the required standard of competence. If you are considered to have failed to demonstrate the required standard in any of the assessment tasks, you may have to re-take the assessment or undertake alternative/supplementary assessment until the required standard is demonstrated.

7. Ongoing support and assistanceQLS is committed to helping solicitors practise profitably, ethically, efficiently and confidently, and offers phone, email and face-to-face support on substantial ethics, trust accounting and practice management challenges as well as in relation to the course’s pre-reading and assessment requirements – including direct access to the authors of the pre-reading.

We recognise that completion of the PMC is only the beginning of the journey as a law practice principal. Following completion of the PMC, QLS offers you a personal two hour consultation with QLS’s practice support manager to assist in either the initial setting up of a legal practice or the review and further development of an existing practice.

The consultation could cover high level issues such as business planning, finances and marketing or a range of operational or individual challenges. Alternatively, it might focus on a specific task such as the development of a response to the Legal Services Commission’s audit of appropriate management systems for incorporated legal practices.

The consultation can take place either at the practice, at QLS, over the phone or via Skype.

As a QLS member you can also take advantage of a wide range of events, services and resources.

• Limitation of liability scheme – a statutory scheme, enforced by the courts, that caps the amount of damages that can be awarded against a QLS member in negligence cases.

8. Course guidelines and administration

QLS Administration Rule 2005The PMC is governed by the requirements of Queensland Law Society Administration Rule 2005.

EligibilityThe PMC is open to application from any practitioner who is currently enrolled as a solicitor in any jurisdiction.

EnrolmentYou can enrol for the PMC at any time throughout the year.

You are considered to be enrolled for the PMC only on acceptance of a course application by QLS and receipt of the full course registration fee of $2350.

Enrolment will be confirmed via email and course materials will be sent within four working days.

Email will be the primary method of communication regarding course matters. It is your responsibility to provide a functional email account and to check your email account on a regular basis during enrolment.

Regional rebate Attendance at the three face-to-face workshops is mandatory. QLS acknowledges that travel to the workshops may constitute a hardship for some regional participants. As such, QLS offers regional practitioners a rebate to offset the cost of travel. If you are paying the course fee in total, deduct the applicable rebate (as shown on map) from your payment. This rebate is only available to Queensland practitioners and QLS members.

TransfersYou are entitled to transfer the date of your chosen workshop once, with no fee incurred. Any further requests to transfer will incur an administration fee of $220 (inclusive of GST).

Cancellation and refund policyAs with practising certificate fees, the benefit of enrolment attaches to the enrolled participant rather than a practice, regardless of which entity pays the fees. Refunds will be payable to the participant only. The amount of any refund will be determined as follows:

• Withdrawal from the PMC any time after the date of confirmation of enrolment and at least two weeks prior to attendance at the workshop: 90% refund.

• Withdrawal from the PMC any time after the date of confirmation of enrolment and within two weeks prior to attendance at the workshop, or at any time after the workshop dates before the course is completed: 0% refund.

Upon complete withdrawal from a current course, no course credit will be allocated towards any future PMC courses.

Time limitationYou must complete all requirements of the PMC within 12 months of confirmation of enrolment.

Any requests for extensions of this time limit will be at the discretion of QLS. Requests for an extension will only be considered if forwarded in writing to [email protected] at least one week prior to the lapse of the 12 month period since enrolment.

ConfidentialityAll conversations and performance issues relating to participants undertaking the PMC remain confidential between the relevant QLS staff, PMC Committee, QLS PMC Contractors and the respective course participant.

It is the responsibility of the individual participant to notify the QLS PMC administrator or QLS practice support manager of any special requirements in relation to the PMC.

Academic behaviourYou must conduct your PMC studies honestly, ethically, and in accordance with accepted standard of academic conduct.

Whilst you may participate in ‘group study’ situations, any final assessment item undertaken must be entirely your own work.

Examples of behaviours that will amount to academic misconduct includes:

• attendance at a workshop by a PMC participant who has failed to personally undertake all required pre-work prior to attendance

• any form of collaboration or assistance during assessment items.

QLS considers any degree of academic misconduct to be a serious matter.

The penalty for academic misconduct will be considered at the discretion of the PMC Committee and may include (but is not limited to):

• failure of the PMC• referral of the matter to the general manager, professional standards• revocation of any PMC waivers currently in existence• disqualification for a period of time from undertaking the PMC• any other penalty that the PMC Committee considers appropriate in the circumstance.

Complaints handling and appealsIf you are not satisfied with any aspect of the course, including assessment results, you may forward your concerns or complaint in writing to [email protected].

On receiving a complaint, QLS will investigate the matter in consultation with you and make a determination on whether there is any validity to the complaint. Any rectification deemed to be necessary will be documented and a response explaining what action has been taken sent to you within 14 days. All documentation will be filed for future reference.

Formal appeals will be referred to the PMC Committee for their review and consideration.
