The Right to Rent
Requirement for landlords of private
rented accommodation, including
Registered Providers operating in this
sector, to conduct checks to establish
that new tenants have the right to rent in
the UK.
Most migrants live in the PRS
61% of migrants live in the private rented sector
Of those who arrived in the UK within the last 4
years, more than 9 in 10 are renting privately.
Around 6% of housing association lettings in
England went to migrants (foreign-born residents)
last year
Home-ownership rates of foreign-born residents are
well below the national average (less than half of all
non-UK born residents own their home).
The Act applies to….
All ‘private’ residential lettings for which rent is
payable (leases, liscences, sub-leases and sub-
tenancies) including those let by registered
providers

All adults (aged over 18) living in the property
The Act doesn’t apply to….
Social housing
Homelessness hostels
Refuges
Care homes
Most student accommodation
Tenants housed in the private sector by local
authorities under a statutory duty

Children under 18 at the time the tenancy is granted
Existing tenants
What does the check entail?
An initial check of original documents before any
tenancy is granted
Follow-up checks at the appropriate date if initial
checks indicate that an occupier has a time-limited
right to rent
In all cases copies to be made and retained
