The attached information regarding the captionedmatter is submitted in response to your letter dated Janu-ary 13, 1987 which was received on January 20, 1987. Pursu-ant to an understanding reached between Mr. Bradley Wiserepresenting PP&L and Ms. Humane Zia representing RegionIII, the period of time in which to complete submission wasextended through February 20, 1987.
The attached material is submitted in response tothe inquiries set forth within your letter. Each of theattached folders, as applicable, includes documents in replyto the numbered inquiry of your letter and is marked accord-ingly. Additional information is included herein in likeorder.
1. PP&L contracted with Valley Disposal, Inc.during the period September 1975 through 1985, at which timethe then current contract was assumed by another company.The contracts provided for the disposal of "trash" and "rub-bish"; neither term is defined.
(The principal owner of Valley Disposal, Inc. andthe Novak Sanitary Landfill is believed to be Mr. LouisNovak.)
On the basis of available information and recollec-tion, rubbish included utility pole butts, paper goods,

cafeteria wastes, scrap wood, porcelain (in the form ofelectrical insulators), various scrap metals, tree limbs,empty oil and paint cans, cleaning rags, oil filters, etc.
During the period from 1975 to 1977 PP&L may havedisposed of capacitors at this site. If so, the capacitorsoriginally contained PCBs. However, PP&L has no record ofPCBs being disposed of at the Novak Sanitary Landfillbecause it was the practice of PP&L to drain capacitorsprior to disposal. Capacitors which failed due to leakingor rupturing would not have contained PCBs at the time oftheir disposal; similarly, those which were taken out ofservice because they had "bulged" were routinely puncturedin order to permit them to drain, a practice which normallyoccurred at PP&L's substation facilities. Accordingly,while PP&L has no records to demonstrate where the drainedcarcasses may have been shipped for disposal, it is believedall would have been thoroughly drained.
A review of existing records indicates that no-* hazardous waste had been placed for disposal in any of the-1 containers furnished by Valley Disposal, Inc.
PP&L cannot accurately determine the quantities ofthe waste materials accepted by Valley Disposal, Inc. duringthe contract period. However, the contracts themselvesprovide some basis for the determination of reasonable esti-mates, as follows: -

it appears the Lehigh Division facilities disposed of5415 cu.yd.
2. A review of existing files indicates that wastematerials removed by Valley Disposal, Inc. during the periodSeptember 1975 through September 1984 presumably wereremoved to the Novak Sanitary Landfill. However, PP&L wasinformed during early 1985 by Valley Disposal, Inc., andsubsequently by its successor, Hoch Sanitation Company, thatwaste materials from PP&L were being transported by them tothe Berks Landfill. PP&L has been advised by DER the NovakSanitary Landfill was officially closed in December 1985.
3. It is believed any materials accepted by ValleyDisposal, Inc. at PP&L's facilities and disposed of at the ^Novak Sanitary Landfill were such as would be generated bythe normal operations of the facilities described, namely,

service centers and crew quarters. In further explanationof the description furnished in response to inquiry no. 1,above, it is believed that all wastes in question were sol-ids which were delivered to Valley Disposal, Inc. in thecontainers, namely, open top and spring loaded lid contain-ers and compactors, provided by it for ultimate landfillpurposes.
4. PP&L's file search has not disclosed the exis-tence of any correspondence with any regulatory agencyregarding substances which may have been landfilled at thisSite. • - . - . v ? ; : ; ' . . , -
5. With the exception of various items of corre-spondence which comprise a portion of the bidding and con-tract documents furnished in response to inquiry no. 1, PP&Lhas not been able to locate any other correspondence withany party regarding the material in question.
6 . Attached are various documents in the form ofL invoices, pick-up slips, etc. relating to the transportation\J and disposal of materials described in paragraph 1 in the
form issued by Valley Disposal, Inc. and its successor, HochSanitation Company. Similar material for the period 1975through 1979 is manually retrievable from PP&L's corporatefiles. However, in view of the expenditure of time andmoney which would be required, PP&L suggests that EPA acceptPP&L's stipulation that it dealt with Valley Disposal, Inc.during this period in accordance with contracts described inparagraph 1, above. However, the stipulation, if accepted,could not be interpreted as an assurance that any suchrefuse and trash were actually disposed of at the NovakSanitary Landfill.
7. PP&L does not own nor has it previously ownedany of the property identified as the Novak Sanitary Land-fill site. PP&L does have transmission line easementsacross the property together with tree trimming rights, bothof which are described in agreements included in theattached folder. Real estate map no. 600-476-S8 is alsoenclosed to indicate the location of the transmission lineeasement .

PP&L has excess liability insurance through Associ-ated Electric & Gas Insurance Services, Ltd. for claimsbased on occurrences during the period 1977 through 1985.PP&L has excess liability insurance through Lloyd's forclaims based on occurrences during the period 1975 through1977. Since PP&L is unaware of any claims or potentialclaims arising out of the release of substances at the NovakSanitary Landfill, we cannot determine at this time whetheror not such insurance would apply. Therefore, we have notenclosed copies of these policies.

Such work shall be performed and completed in a good, substantial and workmanlike manner in strictconformity with such plans and specifications as may be attached hereto, which when so attached and identified,shall be a part of this contract, and also in strict accordance with the requirements of all municipal, stateor federal authorities having jurisdiction m the premises.

7. This contract is not intended to be one of hiring under the provisions of the Workmen's Compen-sation or any similar law and shall not be so construed. Contractor hereby agrees to indemnify and saveharmless Company from and against all liability for injuries and damages to person or property at any timesustained by any person or corporation, including the Company, whatsoever arising out of, resulting from or inany manner caused by or in connection with Contractor's performance of this contract.
8. Contractor represents that Contractor is financially responsible and competent to perform thework covered by this contract.
9. Upon any violation by Contractor of any of the provisions of this contract, Company may forthwithcancel same and make such other arrangements as it may see fit for the completion of said work withoutincurring any liability to Contractor except to pay to the latter the fair value to Company of labor alreadydone and materials already furnished.
JO. This contract shall bind the heirs, executors, administrators, successors and assigns of the parties,but Contractor shall not assign the same or sub-let the whole or any part of said work without the writtenconsent of Company having been first obtained.
11. Contractor represents and warrants that all articles and services covered by this Contract meetor exceed the safety standards established and promulgated under the Federal Occupational Safety and HealthLaw (Public Law 91-956) and its regulations in effect or proposed as of the date hereof.

la. For the purpose of the Penna. Sales and Use Tax Law, this contractshall be considered to be a contract for the rendering of a service on tangiblepersonal property. Since direct pay permit No. 132 is in effect for theCompany, Contractor shall not bill sales or use taxes.

Itwill be noticed that Link No. 5, consists of a deed in the name of •MaryAnn Eoffman, Executrix, of John Peters.". As eet forth in Link No. 4,she conveys it away signing it individually, without the addition of wordsindicating that she is acting as Executrix. Under Link No. 6, a note hasbeen included, setting forth the chief particulars of the Estate of JohnPeters,in which we become Interested by reason of this peculiar manner ofconveyancing. It appears that under John Peters will, all real andpersonal estate was given to Mary Ann Eoffman for her life. She wasfurther given authority to invest whatever money came'to'her "--onsubstantial land or*Real Estate security," At the termination of herlife estate', the property was to be divided among certain children. To
- this Real Estate it certainly appears that she took r/c as Executrix. The"question then arrises whether she had the power to buy Real Estate out-"right with moneys of the Estate. The further question than arrises whetherafter takljrig title to Real Estate in the name of herself as Executrix, shehad the power the convey it away without the.order of court, or even with

It is also a question whether moneys or personal estate can begiven to a person for life, directly in the hands of the donee with theintervention of a trustee.The partition proceeding in the Orphan's Court set forth in Link No. 7appears to be in proper form, except that there ie no formal exceptance
• filed by Calvin Guth, although there is a formal offer on his part, datedJuly 5i 1865, of $138.05 per acre. This defect would be serious if it.were not so far back, and it would seem that a long acquiescence in thetransaction by the other parties to the partition proceedings would havequieted their claims, if any there be.It will be noted under the name of Fleiretta Scherer that she gave amortgage e'f $6500, covering this property on March 30, 1922 to John
- V. Eckert* Subsequently there are judgments against the property, to theAllentown Industrial Loan Co., Dime Savings and Trust Co., financialCredit Association, Inc. respectively. Then on February 2, 1926, Mr.
. Eckert issued a Pi Fa on his first mortgage bond, and the property was ••" /'sold by the Sheriff, December 3, 1926. The Sheriff's deed was executed' •in favor of Mr. Zckert January 12, 1927, but has not yet been deliveredor recorded, because Mr. Eckert has not yet paid any of his costs. Thisplaces the title to the property somewhat in a peculiar condition at thepresent time, in as much as the transaction^ of the Sheriff has not yet

been entirely oompleted. The interest of Tleiratta Sohsrer andof the subsequent judgment holders is therefore not yet entirelydivested. Dear Sirs:Mary 'Ann Ho ff man died November 6, 1917, Intestate, see Registerof Will's Office File No. 15635. She left one son Francis F.Eoffman, her husband having preceded her in death.
Francis P. Hoffman died June 26, 1922, his will ie found in FileNo. 16094, dated April 5, 1891 ind probated July 6, 1922. Itcontains the following Item;- Item II. The Estate realizedthrough my grandfather John Peter, as el'otrn by the account filedby the executor of my grandfather's estate, and the amountrealized from the sale of the real estate of which he died seizedand since sold by myself, I direct shall be disposed of inaccordance with the directions as contained in the will of JohnPeter* Deceased..It therefore follows that if Mary Ann Hoffman bought Real Estatewith estate funds as is indicated by her appearance in a deed in& fiduciary capacity, and conveyed it away without proper authority
\ , thtfre is still a 'claim of title outstanding in the persons entitled^—^ ' under the will of John Peter after the death of hie daughter and
grandson. ;With regard to the partition proceedings, particular to the lackof the former acceptance on the part of Calvin Guth no furtherevidence of the actual acceptance can be found of record. Theaccounts of the Administrators filed in the estate of Henry Guth,necessarily do not show payment and disbursement of the moneysbecause Administrators have nothing to do with the administrationof real estate, except where it becomes necessary to sell in orderto pay debts. There is no quit- claim deed of record from theHeire of Henry Guth to Calvin Outh. It must be repeated however,that the long acquiescence in the transaction shown by the failureof the other Heire to object or proceed in any manner would almostcertainly quiet their claims.
