C. PUBLIC COMMENTS

The public is cordially invited to participate in this meeting of the Board of Education. Item “C” is placed on the agenda for the purpose of providing visitors with an opportunity to address the Board. If there are concerns regarding specific individuals, the speaker is encouraged to refrain from naming them publicly or providing information that would identify the individual in order to respect their privacy. Vulgarity, profanity or accusations naming individuals will not be allowed. The Board will accept and review any written material that would provide more specific information. These materials should be submitted to the Executive Assistant to the Board.

The Brown Act (Government Code) states that Board members may not engage in a discussion of non-agenda items or issues raised during public comments except to ask clarifying questions, make a brief announcement, make a brief report on his or her own activities, or to refer the matter to staff. CLOSED SESSION

President Michelle O’Connor-Ratcliff called the meeting to order at 3:05 p.m. to receive public comment on the closed session agenda items. There were no public comments, and Board members convened to closed session in the Board conference room. The closed session was adjourned at 6:05 p.m., and Board members reconvened in the Community Room to begin their regular meeting and relay any reportable action taken during closed session.

A. PRELIMINARY FUNCTIONS

A-1 Reconvene / Call to Order The regular meeting of the Board of Education was called to order at 6:10 p.m. by President O’Connor-Ratcliff.

A-2 Report Out of Closed Session Clerk Andy Patapow stated that there was no reportable action taken in Closed Session.

A-3 Salute to Flag President O’Connor-Ratcliff led the salute to the flag. Mrs. O’Connor-Ratcliff asked the audience to join in a moment of silence in memory of Alyssa Jensen Brown, a Mt. Carmel student. Mrs. O’Connor-Ratcliff extended the District’s deepest condolences to Alyssa’s family and the Mt. Carmel High School family.

A-5 Welcome to Public Mr. Sellers welcomed the public and offered instructions on the procedure for addressing the Board during the Public Comments segment of the meeting.

Mr. Patapow shared that a Speaker Slip was submitted from Alan Greene to address Consent Items E-106 and E-307. Mr. Sellers requested that Consent Items E-203 and E-310 be pulled for discussion. Mrs. Beatty requested that agenda items E-304 and E-701 be pulled from the Consent Calendar.

Mrs. Beatty, joined by Mrs. O’Connor-Ratcliff, commended the efforts of Leslie Peabody in pursuing a grant as detailed in Consent Item E-309 Resolution 28-2016 City of San Diego Educational Field Trip Grant for Districts 5 and 6. If awarded the funding would greatly benefit PUSD students in offsetting the costs of transportation for field trips.

It was moved by Mr. Zane and seconded by Mrs. Beatty, that with the exception of items E-106, E- 203, E-304, E-307, E-310, E-701, the consent calendar be approved as presented. Motion carried 5-0 Ayes: K. Beatty, M. O’Connor-Ratcliff, A. Patapow, C. Sellers, T. Zane

B. REPORTS / PRESENTATIONS / EARLY AGENDA ITEMS

B-1 Student Board Representative Reports Student Board Representatives Reagan Cloutier from Del Norte High School, Simon Shapiro from Poway High School, Jalen Rasoul from Rancho Bernardo High School, and Ella Smith from Westview High School reported on the events and activities at their respective schools.

B-2 (a) Superintendent’s Briefing Dr. Collins gave a brief update on current issues and events.

(b) Student Recognition Dr. Collins commended the student successes with five middle schools and four high schools finishing in the top ten at the San Diego County Science Olympiad. Seven will move on to the State competition. Dr. Collins recognized Westview High School’s Navy Junior ROTC on its 4th consecutive state championship. They will go on to compete at the National level. Dr. Collins shared his praise for all of the student successes as detailed in the Board agenda.

(c) Staff Recognition Dr. Collins commended Pre-school teachers Michelle Ulrich, Maria Fanianos, Lien Mai and Tracy Robinson. They represented the District at the Early Childhood STEM Conference with their session focusing on MIME (Minds in Motion and Exploration.) Dr. Collins welcomed and introduced the District’s newest principals, Denise Davis at Painted Rock Elementary and Mandy Bedard at Tierra Bonita Elementary.

(d) School Recognition Accomplishments and awards earned by schools were recognized.

(e) District Recognition Dr. Collins shared his appreciation to the many attendees at the District’s Local Control Accountability Plan (LCAP) Community Forums including a Spanish Language LCAP at Valley Elementary. He shared that over 170 people attended the three forums and thanked all those for their invaluable contributions and involvement in education. Dr. Collins further shared that the District’s new mobile app received over 500 submissions adding to the input from community and parents. Dr. Collins shared that the week of March 7th was National School Breakfast Week with nine District schools participating. He commended the hard-working Food and Nutrition staff insuring that so many of our students start their day of learning with a healthy breakfast. A video by Christine Paik, Director of Communications, highlighting the work of Food and Nutrition was shared. Dr. Collins provided an update to the Board and the public on the topic of AB1266 that had been brought to the Board at the February 9, 2016 meeting. He shared that the District has been involved in dialogue with community leaders, staff and students in addressing solutions. Dr. Collins introduced Dr. Mel Robertson, Associate Superintendent of Learning Support Services, who shared that over the past several weeks she has toured each of the middle and high schools with Mike Tarantino, Director of Facilities, Maintenance and Operations, assessing and developing best approaches to provide privacy for all students.

C. PUBLIC COMMENTS Mr. Rich Shea, Vice President of the County Board of Education, addressed the Board. Mr. Shea shared that PUSD fell under his district and he wanted to take the opportunity to recognize and commend the District in its success and ongoing focus on the education of children.

The following individuals representing Poway High School Aquatics and the Poway High School Pool Committee addressed the Board of Trustees with their concerns regarding the Poway pool closings this past school year. Steven Stone, parent; Ashley Purdy, parent; Ali Johnson, student; Jamie Loosbrock, Poway High School swim coach and Chris Hart spoke on behalf of the Poway Pool Committee. Dr. Collins shared that Mike Tarantino, Director of Maintenance and Operations, has been in contact with the Poway High School Aquatics groups and introduced Malliga Tholandi, Associate Superintendent of Business Services, who presented her contact information to the group for future communication.

Reid Johnson, student, representing Robotics Team Spyder, addressed the Board requesting that a resolution in support of Robotics be considered.

Samantha Tran, Del Norte High School student, addressed the Board and spoke in support of Robotics and consideration for increased stipends for the coaches.

Mr. Richard Mason, representing Rancho Bernardo Friends of the Library, spoke in support of libraries and shared praise for the Mt. Carmel library where he had recently visited.

Mr. Bobby Ronsse addressed the Board regarding a proposal to renovate the Tierra Bonita and Twin Peaks fields. He stated that he has been working with a committee of community members and with Poway City Council and is hopeful that a funding plan of $4.5 million will be approved.

Mr. Keith Wilson addressed the Board sharing his ongoing personal issues with the District.

Mr. Chris Garnier, and his wife introduced their children. Mr. Garnier then shared his ongoing personal issues with the District and requested a meeting with Board President Michelle O’Connor Ratcliff.

Ms. Kim Garnier addressed the Board and shared her support of her family.

D. ACTION ITEMS

D-101 Ratification of Student Discipline – Stipulated Agreement for Student Expulsion It was moved by Mr. Patapow, and seconded by Mr. Zane, that the Board ratify student discipline case numbers 2015-2016.09 Motion carried unanimously, 5-0.

D-102 Ratification of Student Discipline – Readmission It was moved by Mr. Zane, and seconded by Mr. Patapow, that the Board ratify student discipline case numbers 2015-2016.01R Motion carried unanimously, 5-0.

It was moved by Mr. Patapow, and seconded by Mr. Zane, that the Board ratify student discipline case numbers 2015-2016.04 Motion carried unanimously, 5-0.

D-104 Public Hearing and Approval of Renewal of General Education Equity of Time Waiver for Transitional Kindergarten Instructional Minutes Requirement Public Hearing was opened at 7:38 p.m.. There was no input and the meeting was closed at 7:39 p.m.. It was moved by Mr. Patapow, and seconded by Mr. Zane, that the Board approve theRenewal of General Education Equity of Time Waiver for Transitional Kindergarten Instructional Minutes Requirement. Motion carried unanimously, 5-0.

Agenda Item E-106 was pulled by Alan Greene for Public Comment. Mr. Greene was not present for comment.

E-106 Adoption of New Elective Courses at Abraxas High School Moved by Mr. Zane, seconded by Mr. Patapow, that the Board approve the Adoption of New Elective Courses at Abraxas High. Mrs. Beatty shared that they looked like great courses and she hoped the courses could be expanded to other sites. Dr. Robertson stated that there is the option to expand since they were online courses. Motion carried unanimously, 5-0. Preferential Vote Aye Student Board Member Neel Pujar.

D-201 Public Hearing and Approval of Initial Proposal from the Board of Education to Service Employees International Union, Local 221 (SEIU) 2016-2017 – Second Reading Public Hearing was opened at 7:41 p.m. There was no public input and the public hearing was closed at 7:42 p.m. It was moved by Mr. Zane, seconded by Mr. Patapow that the Board approve the Initial Proposal from the Board of Education to Service Employees International Union, Local 221 (SEIU) 2016-2017 – Second Reading. Motion carried unanimously, 5-0.

D-202 Public Hearing and Approval of Initial Proposal from the Board of Education to Poway School Employees Association, (PSEA) 2016-2017 – Second Reading Public Hearing was opened at 7:44 p.m. There was no public input and the public hearing was closed at 7:45 p.m. It was moved by Mr. Patapow, seconded by Mr. Zane that the Board approve the Initial Proposal from the Board of Education to Poway School Employees Association (PSEA) 2016-2017 – Second Reading. Mr. Sellers shared that he would abstain himself since his wife was a member of PSEA. Ayes: K. Beatty, M. O’Connor-Ratcliff, A. Patapow, T. Zane; Abstentions: Mr. Sellers

E-203 Approval of Salary Reallocation for Executive Assistant Confidential Series Mr. Sellers motioned to leave the title as it is, Executive Assistant to the Board of Education, allow the Board to delineate the responsibilities, and line of authority of this position and to participate in the hiring of the person who fills it, seconded by Mrs. Beatty, Item E-203 was opened for discussion. Ms. Corrie Amador, Director of Personnel Commission, gave a report to the Board regarding this item. Mr. Sellers withdrew his motion in light of Ms. Amador’s report. It was motioned by Mr. Zane, seconded by Mr. Patapow to approve the Salary Reallocation for Executive Assistant Confidential Series. Motion carried unanimously, 5-0.

Mrs. Amador explained that the members of the Personnel Commission were seeking input from the Board in regard to the job descriptions of the Executive Assistant to the Superintendent’s

D-501 Public Hearing and Approval of Resolution No. 27-2016 Entitled "Adoption of a Mitigated Negative Declaration (MND) for the Expansion of Stone Ranch Elementary School"

Mrs. Tholandi stated that in compliance with CEQA an environmental study is required for the project at Stone Ranch Elementary and the MND as presented for approval requiring a public hearing. Mrs. O’Connor-Ratcliff opened the Public Hearing at 8:30 p.m., with no public input the Hearing was closed. Moved by Mr. Zane, seconded by Mr. Sellers to adopt Resolution No. 27-2016. In response to Mr. Sellers question, Mrs. Tholandi detailed the mitigated negative declarations.

AVID stands for “Advancement Via Individual Determination.” AVID’s mission is to close the achievement gap by preparing all students for college readiness and success in a global society. Every year one senior student from each PUSD high school is selected as an AVID Standout. These outstanding students are selected by their AVID coordinator for their strong academic performance and four-year university potential. • Megan Yip and Allison McClain, seniors at Westview High School, both won regional awards

Megan’s drawings, “Chinese Fans” and “Great Wall of China,” were awarded Honorable Mentions for the Drawing and Illustration category. These students’ entries were among nearly 320,000 works submitted nationwide.

• Westview High students Sarah Henwood, junior; Gracie Hortan, senior; Helen Jin, senior; Rachel Lee, junior; Jessica Peng, senior; Cindy Qiao, sophomore; and Autumn Smith, senior; will have their work on display at the California Center for the Arts, Escondido as part of the 2016 Groff Exhibition: “A Juried Exhibition of the Finest High School Art in San Diego County.” The exhibit runs from April 12 - May 1, 2016.

• Allyson Kusuda, a Poway High senior, has been named a California State Future Farmers of America (FFA) Top Three Finalist for her proficiency application in the area of Placement in Agriculture. Allyson is a third generation member of the Shinoda Family that owns and operates Shinoda Design Centers in San Diego and Santa Ana. Her involvement in her family's business earned her an interview at the State FFA Convention in Fresno next month where she will be vying for the State title.

San Diego Audubon Society’s Sketches April issue. Louie’s drawing of a marsh wren is his second piece of cover art for Sketches. Sketches is distributed in print and online, keeping society members informed of chapter events and activities.

• Robbie Bowers, Head Athletic Trainer at Rancho Bernardo High, has been recognized as the Athletic Trainer of the Year by the San Diego High School Athletic Trainers Association. This is the inaugural year of the award, with Robbie being one of the first recipients. He has been the Head Athletic Trainer at Rancho Bernardo since 1990.

• Rancho Bernardo High’s baseball coach, Sam Blalock, reached the milestone of 900 wins. Only two other high school baseball coaches in California have more career wins and only 26 coaches nationally have reached 900 wins. Coach Blalock started his varsity coaching career in 1975 at Mt. Carmel. He started the Rancho Bernardo baseball program in 1990.

• The Coastal 2016 Regional Odyssey of the Mind Competition took place at San Dieguito Academy in

Encinitas on March 12, 2016. Adobe Bluffs Elementary School, Black Mountain Middle School, Deer Canyon Elementary School, and Westview High School all have teams moving on to the state competition at UC Riverside. Odyssey of the Mind is an international educational program that provides creative problem-solving opportunities for students. Team members apply their creativity to solve problems that range from building mechanical devices to presenting their own interpretation of literary classics.

• Poway High School’s Robotics Team competed in the San Diego FIRST Robotics Regional Tournament, and won the “Underwriters Laboratories Industrial Safety Award,” which honors the team’s safety measures to eliminate or protect against hazards, and the “Entrepreneurship Award,” for the team’s comprehensive business plan to achieve team objectives. The team went on to compete at the FIRST Robotics Utah Regional, where they won the “Imagery Award” which celebrates attractiveness in engineering and outstanding visual aesthetic integration of machine and team appearance.

• Westview High School’s Robotics Team also competed in the San Diego FIRST Robotics Regional

Tournament and won the “Team Spirit Award,” which celebrates extraordinary enthusiasm and spirit through exceptional partnership and teamwork.

• Westview High School’s Speech and Debate Team took first place in the “Public Forum” and “Policy Debate” categories for San Diego County. The team is sending seven students to the California State Competition in San Jose in April.

• Rancho Bernardo High School’s Competition Dance Team finished their season with championship wins at the USA Dance Nationals and the West Coast Elite Dance competition. Their first place finishes included the categories of “Top Overall,” “Elite,” “Medium Contemporary,” and “Best in Contemporary.” Senior Kylie Yamane also won first place in the “Solo” category at both competitions as well.

• Mt. Carmel High School’s Color Guard Team won the Winter Guard International (WGI) Sport of the Arts Western Regional Championship, held in Las Vegas on March 19-20, 2016. WGI Sport of the Arts is the world's premier organization producing indoor color guard, percussion, and wind ensemble competitions.

• Oak Valley Middle School’s “CyberFalcon Millennium 360” team placed first nationally against 460 middle school teams from across the U.S., Canada, and five other countries in the CyberPatriot Semi-Finals. CyberPatriot was started by the Air Force Association (AFA) to inspire students toward careers in cybersecurity or other science, technology, engineering, and mathematics (STEM) disciplines. The students have been working with a coach at Northrup Grumman for about a year, learning how to defend a network from a cyber-attack. The team will be travelling to the CyberPatriot National Finals in Baltimore April 10-14, 2016.

• Oak Valley and Mesa Verde Middle School’s Math Counts teams competed at the recent California Math League competition held March 12th in Irvine, placing in the top ten in each division.

At the 2016 California’s Coalition for Adequate School Housing (CASH) 37th Annual Conference on School Facilities in Sacramento, CASH and the American Institute of Architects, California Council, presented the 2016 Leroy F. Greene Design and Planning Awards. Design 39 Campus received the Award of Excellence for New Construction projects. The planning for Design 39 Campus was driven by a comprehensive community-based symposium that directed the focus on three primary design concepts: Personalized Learning, Flexibility, and Collaboration. The planning process featured a three-day symposium held in September 2011 that included teachers, administrators, business leaders and the local community. The innovative educational program is focused on a “Design-Thinking Environment” and is supported by beautifully composed spaces and an outside-the-box design, where flexible learning allows students the freedom to progress at their own pace, moving between learning spaces, and discovering how they learn best. The innovative educational program that drove the design process and how the individual solutions worked together as a whole, are what jurors liked most about this project. Jurors were also impressed with the planning process that included the three-day symposium. Jon Baker, Partner, BakerNowicki Design Studio will present the award.

Title V – California Code of Regulations, Section 80026, effective July 1, 1994, states that the submission of a Declaration of Need for Fully Qualified Educators by the employing agency shall be a prerequisite to the issuance of any emergency permit for the agency. The Declaration of Need for Fully Qualified Educators by an employing agency shall be valid for no more than 12 months, and shall expire on June 30 following its submission to the Commission.

From time-to-time it is necessary for the Poway Unified School District to submit a request for an emergency teaching permit. The reasons for this are varied but include existing staff with preliminary credentials who are completing course work, special education teaching needs, out-of-state teachers who are fully credentialed in another state but may need to complete coursework in California, and special program teachers who are in the process of completing credential requirements. Additionally, CLAD and BCLAD emergency authorizations are sometimes needed.

DISCUSSION/PROGRAM: With costs rising at a faster pace than revenues, the Director of Food and Nutrition is requesting an increase in school meal prices in order to remain financially solvent. This price increase would be effective beginning July 1, 2016. Since the last meal price on July 1, 2014, the cost of salaries, benefits, food, rent, supplies, and other miscellaneous costs have increased significantly. The Department does not receive financial support from the General Fund, and operates on Federal and State reimbursements plus funds collected from the sale of meals and a la carte items. Since the 2013-2014 school year, the Food and Nutrition Department has incurred $1.5 million in deficit spending, which has drawn down its three (3) months operating reserves that are required by law. Staff is recommending a 25 (twenty-five) cent price increase for student and adult meals at all schools. This increase will provide the necessary revenue to maintain current programs, remain financially solvent, avoid encroaching on the General Fund, and build back the three (3) month operating reserve. The proposed meal price increase is reflected in the table below:

Special meals require additional labor and higher food costs that cannot be offset by regular meal prices. The proposed special meal price increases are as follows:

Approval of the recommended price increases will enable the Department to operate the school lunch and breakfast programs on a break-even basis. We have factored into our analysis the normal reduction in participation that occurs when prices are increased, which gradually builds back over a reasonable period of time. Major factors contributing to proposed meal prices are escalating costs of food, salaries, benefits, rent, fuel, supplies, and overhead necessary to prepare healthy and nutritious meals that are mandated by federal and state laws. Even with the higher meal prices, the Food and Nutrition Department will need to implement other cost-saving measures to offset the rising costs of producing healthy school meals. The requested meal price increases are only for students and adults who pay full price for meals, and will not affect students who qualify for free and reduced-price meals. Students who qualify for free meals will continue to receive meals at no charge. Reduced price meals will remain at $0.40 for lunch and $0.30 for breakfast.

The various Financing Documents being approved by this resolution and a brief description of each document is as follows: A. Bond Indenture. The Second Supplemental Bond Indenture is a contract entered into between the

CFD and Zions Bank, a division of ZB, National Association, acting as “Fiscal Agent,” and is entered into for the benefit of Bond holders. The Bond Indenture provides for issuance and subsequent administration of the Bonds and provides that the Fiscal Agent will hold the applicable Special Tax Revenues in certain funds and accounts for the security of and payment to Bondholders. In addition, the CFD makes certain covenants to the Bondholder, including an obligation to foreclose the lien of Special Taxes if any parcel is seriously delinquent in those payments.

B. Escrow Deposit and Trust Agreement. The Escrow Deposit and Trust Agreement to be entered into by and between the CFD and the Fiscal Agent as Escrow Bank setting forth the terms and conditions relating to the defeasance and the refunding, in whole or in part, of the Bonds with the exception of the Series 2012 Bonds maturing on September 1, 2016.

C. Bond Purchase Agreement. Under this Agreement, the District agrees to sell the Series 2016 Bonds

to the Underwriter, thus generating the proceeds of sale of the Bonds that will be used by the CFD to defease and refund the Series 2012 Bonds.

D. Preliminary Official Statement and Official Statement. The Preliminary Official Statement is a

disclosure document that the CFD is required to provide to the Underwriter in order to disclose to potential Bond purchasers all relevant, material information regarding an investment in the Bonds. The Official Statement will be distributed after the pricing of the bonds.

E. Continuing Disclosure Agreement. Under the Continuing Disclosure Agreement, the CFD agrees to

provide Bond owners and the capital markets with periodic updates of certain key information regarding the Bonds and the security for payment of the Bonds. The Continuing Disclosure Agreement is required by federal and state securities regulation laws applicable to the Bonds.

WHEREAS, the Board of Education did previously conduct proceedings to form and did form

Community Facilities District No. 6 (4S Ranch) and designate an improvement area therein as Improvement Area C (“Improvement Area C”) pursuant to the terms and provisions of the “Mello-Roos Community Facilities Act of 1982”, being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California (the “Act”), for the purpose of financing certain improvements to be owned, operated and maintained by the City of San Diego, County of San Diego, Olivenhain Municipal Water District, and the Rancho Santa Fe Fire Protection District and certain school facilities; and

WHEREAS, Community Facilities District No. 6 previously issued the Poway Unified School District

Community Facilities District No. 6 (4S Ranch) Improvement Area C 2012 Special Tax Bonds (the “Prior Special Tax Bonds”) for Improvement Area C; and

WHEREAS, as a result of the combination of favorable conditions in the municipal bond market and the level of development, diversity of ownership and increase in value of the properties within Community Facilities District No. 6 and Improvement Area C, the Board of Education desires to issue the Poway Unified School District Community Facilities District No. 6 (4S Ranch) Improvement Area C Special Tax Refunding Bonds, Series 2016 (the “Special Tax Refunding Bonds”) for the purpose of defeasing and redeeming the Prior Special Tax Bonds prior to the scheduled maturity thereof in order to reduce the borrowing costs on such indebtedness:

WHEREAS, a reduction in borrowing costs will, in turn, result in the realization of additional special

tax revenues that will be eligible to finance additional school facilities authorized to be financed by Community Facilities District No. 6; and

WHEREAS, any such Special Tax Refunding Bonds shall be issued pursuant to the terms and

provisions of the Act and “Section 6.36 Management of Community Facilities Districts” of the Board of Education Policies containing the statement of goals and policies of the Board of Education regarding the establishment of community facilities districts, as amended to date (the “Goals and Policies”); and,

WHEREAS, this Board of Education desires to set forth the general terms and conditions relating to

the authorization, issuance, sale, delivery, and administration of the Special Tax Refunding Bonds; and

WHEREAS, forms of the following documents have been presented to and considered for approval by this Board of Education:

A. Bond Indenture by and between Community Facilities District No. 6 and Zions Bank, a division of ZB, National Association (“Zions Bank”), as fiscal agent (the “Fiscal Agent”), setting forth the terms and conditions relating to the issuance, sale, delivery, and administration of the Special Tax Refunding Bonds (the “Bond Indenture”);

B. Bond Purchase Agreement by and between the School District for itself and on behalf of Community Facilities District No. 6, and the Underwriter authorizing the sale of the Special Tax Refunding Bonds to Underwriter (the “Bond Purchase Agreement”);

C. Preliminary Official Statement containing information including, but not limited to, Community Facilities District No. 6 and Improvement Area C thereof and the Special Tax Refunding Bonds (the “Preliminary Official Statement”); and

D. Continuing Disclosure Agreement by and between the School District, acting on behalf of Community Facilities District No. 6 and Zions Bank, acting in its capacity as Fiscal Agent, and agreed to and accepted by Dolinka Group, LLC, in its capacity as dissemination agent (the “Dissemination Agent”), pursuant to which Community Facilities District No. 6 will be obligated to provide ongoing annual disclosure relating to Community Facilities District No. 6 and the Special Tax Refunding Bonds (the “Continuing Disclosure Agreement”); and

E. Escrow Deposit and Trust Agreement by and between Community Facilities District No. 6 and Zions Bank, as escrow bank (the “Escrow Bank”), for the Prior Special Tax Bonds setting forth the terms and conditions related to the defeasance and redemption of the Prior Special Tax Bonds (the “Escrow Agreement”):

WHEREAS, this Board of Education, with the aid of School District staff, has reviewed and considered the documents described above and finds those documents suitable for approval, subject to the conditions set forth in this resolution; and

WHEREAS, all conditions, things, and acts required to exist, to have happened and to have been performed precedent to and in the issuance of the bonds as contemplated by this resolution and the documents referred to herein exist, have happened, and have been performed or have been ordered to have been preformed in due time, form, and manner as required by the laws of the State of California, including the Act and the applicable policies and regulations of the School District. NOW, THEREFORE, BE IT ORDAINED, DETERMINED, AND ORDERED by the Board of Education of the Poway Unified School District, acting in its capacity as the legislative body of Community Facilities District No. 6, as follows: 1. Recitals. The above recitals are true and correct. 2. Determinations. This Board of Education, acting in its capacity as the legislative body of Community Facilities District No. 6, hereby makes the following determinations pertaining to the proposed issuance of the Special Tax Refunding Bonds:

(a) The Goals and Policies generally require that the full cash value of the properties within a

community facilities district or an improvement area thereof subject to the levy of the special taxes securing special tax bonds must be at least three (3) times the principal amount of

such special tax bonds and the principal amount of all other bonds outstanding that are secured by a special tax levied pursuant to the Act on property within such community facilities district or improvement area or a special assessment levied on property within such community facilities district or improvement area (collectively, “Land Secured Bonded Indebtedness”). The Act authorizes the Board of Education, acting as the legislative body of a community facilities district, to sell bonds of such community facilities district only if the Board of Education has determined prior to the award of the sale of such bonds that the value of such properties will be at least three (3) times such Land Secured Indebtedness.

The value of the property within Improvement Area C of Community Facilities District No. 6, which will be subject to the special tax to pay debt service on the Special Tax Refunding Bonds, will be at least three (3) times the Land Secured Bonded Indebtedness allocable to such properties.

The foregoing determinations are based upon the assessed of the properties within Improvement Area C. Such determinations were made in a manner consistent with the Goals and Policies.

(b) The terms and conditions of the Special Tax Refunding Bonds as contained in the Bond Indenture are consistent with and conform to the Goals and Policies.

(c) As a result of the complexity of the proposed financing being undertaken the negotiated sale of the Special Tax Refunding Bonds will result in a lower overall cost to Community Facilities District No. 6.

(d) It is prudent in the management of the fiscal affairs of Community Facilities District No. 6 and Improvement Area C thereof to issue the Special Tax Refunding Bonds for the purpose, inter alia, of defeasing and refunding the Prior Special Tax Bonds.

(e) The total net interest cost to maturity of the Special Tax Refunding Bonds plus the principal amount of the Special Tax Refunding Bonds will not exceed the total net interest cost to maturity on the Prior Special Tax Bonds being defeased and refunded from the proceeds of the Special Tax Refunding Bonds plus the principal amount of the Prior Special Tax Bonds; and

(f) For purpose of Section 53363 of the Act, the Board of Education hereby further finds and determines that: (i) it is expected that the purchase of the Special Tax Refunding Bonds will occur on the Closing Date (as such term is defined in the Bond Indenture); (ii) the date, denomination, maturity dates, places of payment, and form of the Special Tax Refunding Bonds shall be as set forth in the Bond Indenture as executed; (iii) the interest rate of the Special Tax Refunding Bonds shall not exceed six percent (6.00%) with the actual interest rate or rates to be set forth in the Bond Indenture as executed; (iv) the place of payment of the Special Tax Refunding Bonds shall be as set forth in the Bond Indenture and the place of payment of the Prior Special Tax Bods shall be as set forth in the bond indenture pertaining the Prior Special Tax Bonds; and (v) the designated costs of issuing the Special Tax Refunding Bonds shall be described in Section 53363.8(a) of the Act, and as otherwise described in the Official Statement for the Special Tax Refunding Bonds and the closing certificates for the Special Tax Refunding Bonds, including but not limited to the fees and expenses of Bond Counsel, Disclosure Counsel, the Financial Advisor, the Special Tax Consultant, the Fiscal Agent, the Escrow Bank, the Underwriter’s discount, escrow verification expenses, and costs of the School District staff incurred in connection with the sale and issuance of the Special Tax Refunding Bonds; and

3. Bonds Authorized. Pursuant to the Act, this Resolution, and the Bond Indenture, the Special Tax Refunding Bonds are hereby authorized to be issued in an aggregate principal amount not to exceed $11,500,000. The date, manner of payment, interest rate or rates, interest payment dates, maturity dates, denominations, forms of bonds, registration privileges, manner of execution, place of payment, terms of redemption, and other terms, covenants, and conditions of the Special Tax Refunding Bonds shall be as provided in the Bond Indenture as finally executed. 4. Authorization and Conditions. Each of the Superintendent, the Associate Superintendent, Business Support Services and such other official or officials of the School District as may be designated by the Superintendent (each an “Authorized Officer”) is hereby authorized, and any one of the Authorized Officers is hereby directed, for and in the name of the Community Facilities District No. 6 to execute and deliver the final form of the various documents and instruments described in this Resolution, with such additions thereto or changes therein as such Authorized Officer may deem necessary and advisable; provided, however, that no additions or changes shall authorize an aggregate principal amount of Special Tax Refunding Bonds in excess of $11,500,000, a true interest cost (“TIC”) on the Special Tax Refunding Bonds in excess of four and three-quarters percent (4.75%) per year and an Underwriter’s discount in excess of one and three quarters percent (1.75%) of the par amount of the Special Tax Refunding Bonds (excluding original issue discount, if any). The approval of such additions or changes shall be conclusively evidenced by the execution and delivery of such documents or instruments by an Authorized Officer, following consultation with and review by Best Best & Krieger LLP, as Bond Counsel. 5. Bond Indenture. The form of Bond Indenture by and between Community Facilities District No. 6 and the Fiscal Agent, with respect to the Special Tax Refunding Bonds, as presented to this Board of Education is hereby approved. An Authorized Officer is hereby authorized and directed to cause the execution of the Bond Indenture pursuant to the provisions of Section 4 above. 6. Official Statement and Continuing Disclosure Agreement. The Board of Education hereby approves the form of the Preliminary Official Statement as presented to this Board of Education, together with any changes therein or additions thereto deemed advisable by an Authorized Officer. Pursuant to Rule 15c2-12 under the Securities Exchange Act of 1934 (the “Rule”) an Authorized Officer is authorized to determine when the Preliminary Official Statement is deemed final. The execution of the final Official Statement, which shall include such changes and additions thereto deemed advisable by an Authorized Officer pursuant to the Rule, following consultation with and review by James F. Anderson Law Firm, APC, as Disclosure Counsel, shall be conclusive evidence of the approval of the final Official Statement by Community Facilities District No. 6. 7. Continuing Disclosure Agreement The form of Continuing Disclosure Agreement by and between the School District acting on behalf of Community Facilities District No. 6 and the Fiscal Agent and accepted and agreed to by the Dissemination Agent as presented to this Board of Education and on file with the Associate Superintendent, Business Support Services is hereby approved. An Authorized Officer is hereby authorized and directed to cause the same to be completed and executed on behalf of Community Facilities District No. 6, subject to the provisions of Section 4 above. 8. Sale of Special Tax Refunding Bonds. This Board of Education hereby authorizes and approves the negotiated sale of the Special Tax Refunding Bonds to the Underwriter. The form of the Bond Purchase Agreement is hereby approved and an Authorized Officer is hereby authorized and directed to execute the Bond Purchase Agreement on behalf of Community Facilities District No. 6 upon the execution thereof by the Underwriter, subject to the provisions of Section 4 above. 9. Special Tax Refunding Bonds Prepared and Delivered. Upon the execution of the Bond Purchase Agreement, the Special Tax Refunding Bonds shall be prepared, authenticated, and delivered, all in accordance with the applicable terms of the Act and the Bond Indenture, and any Authorized Officer and other responsible School District officials, acting for and on behalf of Community Facilities District No. 6, are hereby authorized and directed to take such actions as are required under the Bond Purchase Agreement and

An Authorized Officer is hereby authorized and directed to cause the same to be completed and executed on behalf of Community Facilities District No. 6, subject to the provisions of Section 4 above. 11. Actions. Barbara Barker, Canyon View Elementary School Holly Mehaffie, Canyon View Elementary School Allowance of these waiver requests will assist the District in remaining within the legal limits for resource specialist caseload. The waivers cover the Resource Specialists’ caseload for the remainder of the 2015-2016 school year. Both the teachers and the Poway Federation of Teachers (PFT) have been consulted and are in support of this recommendation. The Resource Specialists will each receive an additional hour per day of instructional assistant support. This information was discussed with the PFT on March 14, 2016.

ARTICLE: 3.0 EDUCATIONAL PROGRAM

SECTION 3.15 INDEPENDENT STUDY PROGRAMS

The Board recognizes its responsibility for the education of all students in the school system. The Board authorizes the Superintendent to establish independent study as an optional alternative instructional strategy by which all enrolled students in any K-12 and adult school may reach curriculum objectives and fulfill graduation requirements outside of the regular classroom setting. The primary purpose for independent study is to offer a means of individualizing the educational plan for students whose needs may be met best through study outside the regular classroom setting. Independent study may be used by all students who are motivated to achieve educationally as well as or better than they would in the regular classroom. Independent study is an optional educational alternative in which no student may be required to participate. Participation is voluntary. Instruction may be provided to the student through independent study only if the student is offered the alternative of classroom instruction. No course required of high school graduation shall be offered exclusively through independent study. No individual with exceptional needs, as defined in Education Code Section 56026, may participate in independent study unless his/her individualized education program (IEP) specifically provides for that participation. No temporarily disabled student may receive individual instruction pursuant to Education Code Section 48206.3 through independent study. However, if the temporarily disabled student's parent or guardian and the district(s) agree, the student may receive instruction through independent study instead of receiving the "home and hospital" instruction provided pursuant to Education Code Section 48206.3. The District shall provide appropriate existing services and resources to enable students to complete their independent study successfully and shall ensure the same access to existing services and resources in the school in which the student is enrolled as is available to all other students in the school. Students requesting independent study and their parents/guardians should recognize that independent study at the elementary level realistically must emphasize a commitment on the part of the student's parents/guardians. At the secondary level and adult level, the major commitment must be made by the student, assisted or supported as necessary by parents and others who may assist directly with instruction. Written Agreement and Contracts The Superintendent or designee shall ensure that each participating student has an executed written independent study agreement with the District as prescribed by law. The agreement shall be between the student, parent/guardian/caregiver, certificated employee, and all other persons

who provide direct assistance to the student. The written agreement with all of the required components must be on file for each independent study student. Individual independent study agreements and any subsidiary student contracts and assignments must be consistent with the District's academic standards. For all students in independent study, the maximum length of time that may elapse between the time the assignment is made and the date by which the student must complete the assigned work shall be no greater than one week or five school days for any student enrolled in a K-12 school including continuation and adult school. When circumstances justify a longer period of time, the Superintendent or designee may extend the maximum length of an assignment. The duration of the independent study master agreement, including the beginning and ending dates for the student’s participation, shall be for no more than one full school year. The Superintendent or designee shall establish appropriate screening procedures to ensure that the necessary levels of understanding and preparation exist to meet the conditions of the independent study agreement before its approval by the designated certificated representative of the district. When any student fails to complete three missed independent study assignments during any period of fifteen (15) school days or misses two appointments without valid reasons, the Superintendent or designee shall conduct an evaluation to determine whether the student should be allowed to continue in independent study. A written record of the findings of any evaluation conducted pursuant to this policy shall be maintained in the student's permanent record. The Superintendent or designee shall report to the Board annually the number of students in independent study by typical categories of study and duration; the ADA generated; a description of their performance on such indicators of quality as the Board may specify; and the number and proportion of students, by typical categories who graduate or successfully complete their studies. The Superintendent or designee shall establish regulations to implement this policy in accordance with law.

California Education Code Section 32286 requires each school site to review and update its Comprehensive School Site Safety Plan in cooperation with local law enforcement agencies, community leaders, parents, staff, students, administrators, and others interested in site safety each year. The plan is designed to be utilized as a resource guide for prevention, mitigation, preparedness, response, and recovery planning. The section of the Comprehensive School Site Safety Plan identifying individual site specific plans, titled, Safe and Orderly Environment Conducive to Learning has been provided to the Board, as required by Ed Code 32282 (a) (2). The plan, as written and updated by the School Site Council or School Safety Planning Committee, requires annual Board approval. Copies of the Comprehensive School Site Safety Plan are available for review in the Superintendent’s office and at school sites. It should be noted per California Education Code that certain elements of the Comprehensive School Site Safety Plan are confidential and not subject to public review.

SECTION 3.34 COMPLAINTS CONCERNING CATEGORICAL AID PROGRAMS AND

The Board recognizes that all consolidated categorical aid programs and services must be

administered in full compliance with state and federal laws and regulations governing such

programs. These categorical programs and services include:

The Poway Unified School District (PUSD) is committed to an active Nondiscrimination Program.

comply with the law in the programs and services listed above.

The Board prohibits retaliation in any form for the filing of a complaint, the reporting of instances

of discrimination, or for participation in complaint procedures. The Board acknowledges and

respects student and employee rights to privacy and all complaints shall be investigated in a

manner that protects these rights.

The Superintendent will designate staff members to receive complaints, investigate complaints,

and ensure District compliance with the state and federal laws and regulations governing the

programs listed above. Designated staff members will be responsible for complaint resolution, and

will annually notify parents, employees, committees, students, and other interested parties of the

identity of the persons responsible for processing the complaints, and of the Uniform Complaint

The District is committed to providing equal opportunities for students in all educational programs and activities. The Board shall ensure equal opportunities for all students in admission and access to academic courses, guidance and counseling programs, athletic programs, testing procedures, vocational education, and other activities. Separate arrangements may be made for students according to gender identity in order to protect modesty in rest rooms, shower facilities, and sex instruction, to adjust grading standards in physical education and athletic competition, or to accommodate the special needs of choral groups, drill teams, cheerleaders, and the like. School staff and volunteers must be careful to guard against discrimination and stereotyping in instruction, guidance, and supervision. It is the responsibility of the District to identify and evaluate students who, within the intent of Section 504 of the Rehabilitation Act of 1973, need special services or programs in order that such students may receive the required free appropriate education. For this policy, a student who may need special services or programs within the intent of Section 504 is one who:

• Has a physical or mental impairment that substantially limits one or more major life activities, including learning; or

• Has a record of such impairment; or

• Is regarded as having such impairment.

Students may be eligible for services under the provisions of Section 504 even though they do not require services pursuant to the Education of All Handicapped Children Act, PL 94-142 (EHA/IDEA). Students who are identified as individuals with exceptional needs, according to EHA/IDEA criteria, are not addressed under this policy. The needs of such students are provided for under Policy 5.12 and its procedures and under state and federal laws and regulations.

They must balance many roles and follow numerous Federal, State and local regulations to ensure safe and healthy meals are available in schools. They are trained sanitation and food safety experts and must maintain a financially self-sufficient program. Between preparing healthy meals for students, adhering to strict nutrition standards, navigating student food allergies and offering service with a smile, food and nutrition professionals are an integral part of the total educational program who always go the “extra mile.” We are pleased to recognize Food and Nutrition employees for their professionalism, commitment, and dedication to our students through the attached resolution.

Required RECOMMENDATION: Authorization to use California Multiple Award Schedule (CMAS) for purchase of synthetic turf at Mt. Carmel High School. DISCUSSION/PROGRAM:

Mt. Carmel High School’s artificial turf field is over twelve years old. The field fabric is well worn and in need of replacement. The California Multiple Award Schedule (CMAS) offers a wide variety of commodity, non-information technology services, and information technology products and services at prices which have been assessed to be fair, reasonable and competitive. The use of these contracts is optional and available to California State and Local Government agencies. Although the installation of turf is considered public work, which would otherwise be subject to competitive bidding, the installation portion of the work falls within the Department of General Services guidelines as “incidental” to the purchase of the turf fabric and since these guidelines are in conformity with law, the District requests to purchase synthetic turf and installation from FieldTurf using this contract. All synthetic turf fields in the District are currently FieldTurf fields. The product is known to meet all athletic field safety requirements and district staff is trained on the maintenance of the product. In addition, the District’s experience with this company has encompassed excellent customer service and excellent product warranties. With this authorization, product orders can be placed immediately, and the project will be completed over the summer break.

Barnhart-Reese Construction, Inc., (BRC) is our energy engineering service provider. Our Board ratified this contract for RFP 2013-19P on May 19, 2014, Agenda Item E-305. BRC is currently working with our sites that qualified for use of Proposition 39 funds. The Proposition 39 program is limited and cannot fund the entire District energy upgrade program. Utilizing “On Bill Financing” (OBF) will allow the District to address the needs of schools not yet modernized and save energy. Our nine selected schools are: Del Norte, Mt. Carmel, Rancho Bernardo and Westview High Schools, Bernardo Heights Middle School, Los Penasquitos, Painted Rock, Rolling Hills, and Tierra Bonita Elementary Schools. The cost of energy projects will be paid directly to SDG&E as part of the monthly utility bill under the OBF Program. This program allows PUSD to finance the entire project with a 0% interest loan paid with the savings from the electric or gas bills. To participate in this program, SDG&E must review, verify, and approve BRC’s energy savings calculations. Energy projects will be agreed to following SDG&E’s approval of the equipment and other energy conservation measures applied for by BRC. The District retains the right to sign the contract or opt-out of the contract after SDG&E approves the estimates. Staff requests authorization to assign Barnhart-Reese Construction, Inc., as an energy conservation vendor.

The Governor of the State of California has designated April 26, 2016, as School Bus Drivers’ Day. Each year we have an opportunity to recognize the accomplishments of our school bus drivers by celebrating School Bus Drivers’ Day. The school bus drivers in the Poway Unified School District are an outstanding group of individuals who transport over 3,500 students twice a day. They drive over two million miles annually, to and from school on activity field trips and for community service trips. Managing up to 84 students on a school bus can be very difficult, yet our drivers continue to do so in a safe, professional, and competent manner. For these achievements, we are extremely proud of our Transportation staff for their entire personal efforts in working with the District to help maintain home-to-school service. The Transportation staff was instrumental in establishing the PUSD Foundation T.A.K.E Committee (Take All Kids Everyday) for the purpose of assisting students with their transportation needs. We are pleased to acknowledge and recognize our school bus drivers for their accomplishments, as well as those of our entire Transportation Team, through the attached resolution.

SECTION 4.106 COMPLAINTS CONCERNING SCHOOL DISTRICT PERSONNEL

It shall be the policy of the Board of Education to manage complaints from parents, students, or patrons, against employees of the District through a well-conceived and defined procedure. Every effort will be made to resolve the matter informally at the earliest possible stage. Complaints will be received by the Board of Education only after the issue has been first referred to the Superintendent. Complaints concerning the Superintendent of Schools are to be sent in writing directly to the Board of Education and copied to the Associate Superintendent of Personnel Support Services. SECTION 4.123 SEXUAL HARASSMENT – EMPLOYEES The Poway Unified School District recognizes that harassment on the basis of sex or gender is a violation of both Federal and State employment anti-discrimination laws as well as District Policy and Administrative Procedures. The District prohibits sexual harassment of District employees and job applicants by any person. The District is committed to providing employees with a work environment free from sexual harassment and will not tolerate such conduct on the part of any District employee or student. In addition, the District will not tolerate sexual harassment of its employees or job applicants by any member of the public affecting the work environment.

1. Provide training to employees in accordance with state and federal law 2. Disseminate the District’s sexual harassment policy to staff, students, and parents 3. Promptly, thoroughly, and fairly investigate complaints of sexual harassment 4. Take appropriate corrective and remedial action(s)

Any employee who feels that he or she has been sexually harassed or has knowledge of an incident of sexual harassment by or against another employee, student, or job applicant, must immediately report the incident to his or her supervisor, the principal, district administrator, or Superintendent. The supervisor, principal, or administrator who receives the complaint shall promptly notify the Superintendent or designee. An employee may file his or her complaint against his or her supervisor, a supervisor in another department, an agent of the district, a fellow employee and/or a non-employee of the district, or a member of the public. In the event that the employee’s supervisor is the reason for the complaint, the employee may notify any site or District-level administrator. Dissemination

1. All employees, supervisors, and administrators shall be notified of this Policy.

2. Each new employee shall receive a copy of this Policy.

3. A copy of this Policy shall be is also located in the Office of Personnel Support Services

and Board policies located at each school site and at the administrative offices.

4. A copy of this policy shall appear in any school or district publications that set forth the school’s or district’s comprehensive rules, regulations, procedures, and standards of conduct.

Current school year enrollment comparison: Month 1 to Month 7 Elementary schools Increase of 53 Middle schools Decrease of 1 High schools Decrease of 96 Special Education Non-Public Schools (NPS) Increase of 5 The District’s total enrollment at the end of the seventh month was 35,687 and represents a net loss of 39 students over month one of this year. The attendance rate for month seven was 96.23 percent.
