Legalization of Marijuana is on the California Ballot this Fall It’s official! California voters will decide this fall whether their state will be the first in the country to legalize the possession of marijuana for non-medicinal use.The ballot initiative legalizing adults' possession of up to one ounce of marijuana collected almost 700,000 signatures, according to a statement from the Marijuana Policy Project. Roughly 434,000 signatures were required to place an initiative on the statewide ballot and over a quarter of a million more were obtained.

Should marijuana become legal in California later this year, city and county govern-ments would be allowed to impose a sales tax under the proposed statute. They also would be allowed to establish local ordinances relating to distribution.

Although this is promising news, and in all likelihood the voter turnout will be the “highest” on record to make sure this happens, it will be very interesting to see how state laws will battle it out with federal laws. VOTE NOV. 2010

The Festival of Spring“Bhanging” in Spring with Holi: The Festival of SpringS pring has sprung, not just here but in India as well. We may have 420 to

celebrate spring but in northern India, spring celebrations come in with a “bhang.”

The festival is generally celebrated in March however it depends on the lunar calendar. Bhang is a potent milkshake that’s made with marijuana.

Holi Festival is celebrated every spring and the extravagant spring celebration of color is an occasion during which men, women and children go wild with water guns and colored powder. And the fact that "bhang thandai," an almond-flavored milk shake blended with cannabis, is a prominent part of the celebration doesn't hurt the festive atmosphere one bit.

For some individuals, Holi is all about being a kid again, shedding inhibitions, having a good time in a colorful fashion. On the first day of Holi, a bon fire is lit in the night as a symbol to signify the triumph of good over evil; this is also known as Holika Dahan.

The most striking characteristic of this spring festival is that here Lord Balaram replaces Lord Krishna as the presiding deity of the festival. There is a temple dedicated to him in the heart of the town of Baldeo and that is the prime location of this celebration.

A colorful wild craze marks the festivities. Men and women assemble within the premises of the temple. Sangeet Samaj, a kind of devotional music helps to create the atmosphere. Then they drench each other with colorful water. From the roof tops of the temple, women pour buckets of colored water on the men. The men tear off their clothes ‒ or in some cases, the women tear off the men’s clothes. Men engage in a game called huranga in which whips are made with the wet clothing and are used to hit each with; but this is done in the right spirit. Under no circumstances are the men permitted to touch the women or remove the veil from their faces.

Technically marijuana is illegal in India since the nation is a signatory to Harry Anslinger's 1961 Single Convention narcotics treaty. No matter, marijuana has been a part of India's cultural heritage for thousands of years and a law that's been around less than fifty years hasn't made much of an impact. Bhang is sold for consumption through government-licensed outlets.

The marijuana milkshakes are widely served from exclusive private gatherings to street parties. On this day of celebration, drinking bhang is completely acceptable for everyone to drink, even children with parental consent.

According to legend, bhang was offered to the gods and was particularly loved by Lord Shiva.

Interestingly, the only factor that ruins the celebration is when some people become rowdy and violent and this is because there is a massive increase consumption of alcohol.

No matter, having a bhang is a totally acceptable way to not only celebrate the arrival of spring, but an acceptable way of life.

Bhang 2 cups water

1 ounce marijuana (fresh leaves and flowers of a female plant preferred)

4 cups warm milk

2 tablespoons finely chopped blanched almonds

1/8 teaspoon combined mixture of cloves, cinnamon, and cardamon

1/4 teaspoon powdered ginger

1 teaspoon rosewater

1 cup sugar

Bring water to a rapid boil and pour into a clean coffee or teapot. Remove as many seeds or twigs as possible from the marijuana, add it to the water and cover. Let this steep for 10 minutes.

Strain the water and marijuana through a piece of muslin cloth, save the water.

Take the leaves and flowers and squeeze them with your freshly-washed hands to extract any liquid that remains. Add this to the water. Place the leaves and flowers in a mortar and add 2 teaspoons warm milk. Slowly but firmly grind the milk and leaves together. Gather up the marijuana and squeeze out as much milk as possible.

Repeat this process until you have used about 2 cups of the milk (it may take up to 5 times). Collect all the milk that has been extracted and place in a bowl. By now the marijuana will have turned into a pulpy mass.

Add the chopped almonds and some more warm milk. Grind this in the mortar until a fine paste is formed. Squeeze this paste and collect the extract the same as before. Repeat until all that is left are some fibers and nut meal. Discard the residue.

Combine all the liquids that have been collected, including the water the marijuana was brewed in. Add the cloves, cinnamon, cardamon, ginger and rosewater. Add the sugar and remaining milk.

Chill, serve and have a bhang!

Cooking marijuana for pain relief has some advantages over smoking or vaporizing. Although it may take up to an hour (even longer for some people) for an oral dose of marijuana edibles to take effect, it prolongs the effects for several hours longer than if smoked. This is great for individuals using medical marijuana for arthritis.

The medicated state from ingested marijuana can last up to five hours and sometimes longer. This also can help reduce the impact on the lungs because it eliminates the need to smoke every couple of hours or so to help

relieve pain. Eating marijuana sounds simple but it really does involve some work first. Although marijuana is absorbed through the digestive tract, one cannot just start sprinkling it on salads or eat a raw bud. THC in

marijuana is both fat-soluble and unable to be released without binding to fatty acids or to alcohol.

When binding to alcohol, the marijuana does not need to be heated. Actually, this method is ill-advised due to the volatile and flammable nature of alcohol.

Cooking is the more popular method of ingesting marijuana. This requires bonding the THC to butter, lard, oil,

or other fat. Generally this is accomplished by heating the oil and marijuana to significant temperatures to release the THC and bind it to the lipid molecules. Once "bud butter" has been created,

And what better way to enjoy freshly picked strawberries is to eat them with a whipped cream topping. The following recipe for Cannabis Whipped Cream appears at ‘thecannabischef.com’.

Cannabis Whipped Cream ToppingUnless you want to eat a lot of whipped cream, we recommend using about seven grams of marijuana. This way you can add a small amount to ice cream, pie, or other sweet dish.

Ingredients: 4-8 grams of finely ground marijuana 1 cup heavy cream 1 teaspoon vanilla extract (optional) 1 tablespoon confectioners' sugar

Instructions: 1. Add the cream and cannabis to a pan over medium heat in a double boiler.

2. Allow the cannabis cream to simmer for about an hour.

3. Allow to cool and then pour into an airtight container in the refrigerator until cold.

4. Using a large bowl, whip cream until peaks hold their form or desired consistency. Beat in vanilla and sugar. Do not over-beat as it will become lumpy.

5. Serve on fresh strawberries or anything else you'd like!

Aprivileged suburban life, a gorgeous girl next door and loving marijuana-dealing parents: what more could a teenagerask for?

Steven Yaffee stars as Quinn, the home-schooled son of boutique marijuana dealers; Rosanna Arquette (Diana) and Wallace Langham (Bryce). Quinn is a strident non-inhaler with a desire to connect with others in society that becomes intensified when Crystal (Rachel Blanchard) moves in across the road. Meanwhile, Quinn’s sister, Hope (Katie Boland), also home schooled, earns her living dealing to local high school students. This unusual dilemma of how a teenager rebels against his marijuana-dealing parents has some great dialogue and funny moments. Every roomin the house is a used for the ‘family business.’ Throughout the years, their mom taught Quinn and Hope their formal education and their dad taught them to always ask questions and to reject conformity.

There are some subtle yet brilliant jabs peppered throughout the dialogue at how certain establishments

have told us how some things are good for us – yet they are not. In one scene a Hummer drives by their house

and Bryce questions “Why is it that the smoke from that thing is legal and ours isn’t?”

Quinn is on a mission to see what he has missed in life and his adventures along

the way have some funny moments that lead up to a surprise ending.

This movie is not for those expecting fast-action intense drama. This is a laid-back

movie with some humor, some drama, and good acting.

Writer and director Michael Melski put together

a strong cast. Wallace Langham is an American actor and stars as lab technician

David Hodges in CBS’s hit series CSI:Crime Scene Investigation. Rosanna Arquette has a

long list of television and movie credits to her name including

American Pie Presents: The Book of Love (2009). Both Steven Yaffee and Katie Boland

are Canadian-born and have appeared in numerous television shows and movies.

Despite Initiatives Denver Citizens Are Still Being Charged

I t’s been more than two years after Denver voters approved a measure making minor marijuana crimes the city’s lowest law-enforcement priority yet city officials are continuing to prosecute marijuana cases at a steady rate.

In 2009, Denver city attorneys prosecuted 1,696 cases in which possession of less than an ounce of marijuana was at least one of the charges. 2008 saw 1,658 cases prosecuted. Interestingly, in 2006, the year before this “reduction” initia-tive was approved prosecutors saw 1,841 marijuana cases. Doing the math tells us that there were only 145 fewer cases between 2006 and 2009 ‒ hardly seems like this is low-priority.

Police citations for possession of small amounts of marijuana continue unabated which totally contradicts the measure. Voters have clearly stated police need to focus their efforts on real crime, not on something that is legal. Meanwhile, Denver prosecutors claim that their hands are tied in these marijuana cases because they are legally bound to follow state laws, not local laws.

Denver voters approved a ballot measure that basically legalizes marijuana possession of up to one ounce by residents 21 years of age or older in the fall of 2005. At the denverpost.com there is an ongoing forum and some comments posted there make some valid points.

A portion of one comment stated: “If the people really want pot legal, then work to legalise it. How can we seriously ask our police and our prosecutors to enforce laws selectively?” This is a valid question to ask. Layers of the laws convolute not only this issue, but many other marijuana-related issues as well. Denver residents indeed voted for change at the local level, but police and prosecutors have state and federal laws to take into consideration. These laws, for the most part, will override local ordinances.

Another example of how the layers of laws come into play is banking. Last month Post420 MMM reported on how dispensaries are being turned away at banking institu-tions. Federal law requires that banks not do business with companies operating ille-gally, and marijuana distribution, for medical purposes or not, is still illegal federally.

Mason Tvert, who runs the pro-marijuana-legalization group SAFER and is a member of Denver’s Marijuana Policy Review Panel states that Denver city attorney’s office has discretion to stop prosecuting marijuana cases and force the Denver district attorney’s office to pick up the load.

“It’s probably worth admitting to ourselves that we can talk a lot but we can’t accom-plish a lot in terms of enforcement,” Philip Cherner, a defense lawyer who sits on the panel, said at the panel meeting last week.

Councilman Doug Linkhart, another panel member, said the panel would be better off including all its recommendations and frustrations in a comprehensive report to the City Council, which might have more authority to compel changes.

Denver activists still have state and federal hurdles to clear and until then, going out in public with medical marijuana still comes with the risk of being charged.

Ventura sets the tone for his book with this reflective philosophical thought.

All four of these individuals were adored by the masses and all four of these men had the influence and abilities to make positive changes; and these changes were not what others in authority wanted. Ventura uncovers and presents evidence that provokes the reader to ask questions.

Jim Jones was a man who, at the time, was a “lone-nut” cultist who led 900 people to their deaths. Ventura explains to his readers that mainstream media reported that this was mass-suicide caused by cyanide-laced Kool-Aid. Investigations that were not accurately reported in the media revealed that the first doctor on scene observed many bodies with puncture wounds on the shoulders of countless victims, suggesting they were held down and injected.

Ventura presents a lot of well-sourced, documented evidence that tells an entirely different story. He

states that the government should release all files on Jim Jones for public-scrutiny.

Jesse Ventura has done a thorough job in presenting proof about the

C.I.A.’s role in importing heroin into the United States, the C.I.A.’s

war against Nixon, the plot to overthrow Franklin D. Roosevelt, the

assassination of President Abraham Lincoln, recently

rigged elections, the Wall Street conspiracy and of course, 9-11.

In the final chapter, Ventura provides some eye-opening evidence with

what has been happening since George W. Bush was in office. There are no

surprises that Americans are witnessing their civil liberties erode, and Ventura urges people to open

their minds to the possibility that the U.S. is on the brink of losing everything that the founders of this

nation stood for.

For those who want to learn about what exactly these “conspiracy theorists” are talking about or for those who want to see “the other version”, Ameri-

Domestic Violenceand Alcohol are Linked

Noam Chomsky In an article, titled Noam Chomsky on Drugs, Chomsky was quoted as saying, “At the time the drug war in the US was launched, deaths from tobacco there were estimated at about 300,000 a year, with perhaps another 100,000 from alcohol. But these aren't the drugs the Bush administration targeted. It went after illegal drugs, which (all drugs together) had caused many fewer deaths- 3,500 a year." This article appeared in the 2008 spring issue of Cannabis City Amsterdam. This article addresses that marijuana has not caused any known deaths among 60 million users worldwide.

Alcohol Bans Alcohol causes a lot of problems for millions of people. Some countries have bans on holidays and on other special days; or there are bans in designated areas because of the problems drunken people create. Some of these countries include: India, Saudi Arabia, Kuwait, Qatar, Pakistan, Morocco, Russia, Tunisia, Thailand, and The Maldives.

Across Canada, provincial parks are a favorite destination for campers and in most parks there are now alcohol bans ‒ especially on long holiday weekends.

In Greenland, a coupon-based alcohol rationing system was implemented in the 1980’s that entitles adults to the equivalent of 72 beers a month. Once that system was implemented, police saw a subsequent 58% reduction in the number of calls for domestic quarrels.

Holland’s liberal-minded outlook is now considering banning alcohol on Queen’s Day. This is the country’s biggest annual celebration held in late April. Jesse Ventura, in an interview with Post 420MMM, stated that when he was in Holland he learned that it appears an alcohol ban will be in place for Queen’s Day. “I was told there are fights, people are throwing up in the streets, disruptive behavior annoying others who are trying to enjoy the day.” The cost of cleaning up the mess has increased in recent years. Ventura asserted, “Cannabis smokers are not a problem. You don’t see a cannabis smoker puking in the streets and beating up someone.”

One thing is for sure, hypocrisy is at its most flagrant in a society allowing a drug that causes so much pain, destruction and death to be legal, and not cannabis.

T here are numerous strong links between drinking alcohol and the occurrence of intimate partner violence in several countries. Plenty of evidence suggests that alcohol use increases not just the occurrence but also the severity of domestic violence.

Studies of intimate partner violence routinely identify consumption of alcohol by those who perpetrate physical abuse. In the United States, England, and Wales, victims of domestic violence believe that their partners had been drinking prior to committing a physical assault in 55% of cases. In Canada 43% of domestic violence cases stem from alcohol use. In Australia this statistic is at 36% while in Russia, 10.5%. In South Africa, 65% of women experiencing physical abuse at the hands of their spouse, report that their partner was drinking alcohol prior to the assault.

Although there are no recorded statistics, men also are victims of domestic violence at the hands of their wives. Steve Christensen is a prominent accountant and his family witnessed on numerous occasions his wife hitting and kicking him, always after drinking alcohol. This is not an unusual situation.

The economic costs of partner violence include those to health care, the legal system, refuge, and lost wages. Estimated costs of partner violence per year are as follows: United States $12.6 billion - Canada $1.1 billion

Canada’s population is approximately ten times less than the United States.) Every year in the U.S., alcohol in domestic violence situations costs Americans $6.3 billion. Keep in mind the total of alcohol’s devastation is much higher when you factor in traffic collisions and fatalities, bar fights and home parties.

They are nurses, teachers, community leaders, and war heroes. They could be your neighbors, your friends, and your family. They are people just like you, however, something is encouraging them to find a natural alternative to the hardcore prescriptions drugs that their medical condition requires them to take-in order to try and function and live a normal life. They are trying to improve their lives by finding something that will help them cope with their pain, and they deserve our consideration.

Frank M., a Vietnam veteran came to us with a goal of improving his health, both physically and mentally by finding an alternative to his drug therapy. He is up 20 something different types of narcotics and other prescription drugs that he has been on for years.

I am proud to say that two weeks after Frank was introduced to medicinal marijuana he is off of two of those drugs, Morphine and Oxycotin, (Oxycodone). These two narcotics are of particular interest because they are so strong and were never intended to be used for any length of time and offer a profound list of side effects. These include but are not limited to nausea, constipation, sleeplessness, headache and vomiting, also, psychiat-ric adverse effects reported include paranoia, psychosis, and hallucinations just to name a few.

Frank served in Vietnam and is a hero based on that solely, not to mention his achievements while serving our county. He is an “old school and old fashioned” values man. Most would consider themselves lucky calling someone like Frank their neighbor. He has suffered from Post Traumatic Stress Disorder, (PTSD) for decades and his disability is 100% service-connected including combat wounds.

The second time Frank came into our dispensary, I couldn’t believe my eyes, I barely recognized him. He was upbeat, energized and in a hurry. He told me he had to be quick; he was running errands and had double parked. It has been a long, long time since Frank has been able to drive around town and run errands without his wife in the car and who usually is the one doing the driving. Obama Continues Bush-Era“Drug War” HypocrisyBy Jesse Ventura

I In my new book, American Conspiracies, I included a chapter called "Your Government Dealing Drugs." It traces the history of how the CIA has funded a lot of its operations over the years with drug money, and still looks the other way in places like Afghanistan -- where President Hamid Karzai's own brother is getting regular CIA payments while being simultaneously involved in the heroin trade. Meantime, according to reports by Congress and the Treasury Department, American banks are "collectively the world's largest financial beneficiary of the drug trade" -- with an estimated inflow of about $250 billion a year!

The hypocrisy is staggering when you consider that the Obama administration's "drug war" budget has about twice as much money going into the criminal justice system than to treatment and prevention. This is despite President Obama having said many times that drug use needs to be looked at as a health issue. In California, where you can get a prescription for medical marijuana, the L.A. County District Attor-ney claims that state law doesn't allow dispensaries to sell it - and they recently busted a popular distributor and charged him with 24 felonies!

In January, President Obama nominated a holdover from the Bush years, Michele Leonhart, to head up the Drug Enforcement Administra-tion. She has a history of cracking down on medical marijuana dispensaries, and most recently denying the research application of a University of Massachusetts botanist. This is a ludicrous appointment, since Attorney General Eric Holder has already ordered federal agents not to go after medical marijuana outlets. So is the administration talking out of both sides of its mouth? What follows is an excerpt from American Conspiracies:

But isn't it high time for complete reform of our drug policy? We've got a shadow economy happening, friends. One hundred million Americans have sampled marijuana, and that includes almost half of all the seniors in high school. More than 35 million Americans have tried cocaine at some point, and almost as many have taken LSD or other hallucinogenic drugs. Meantime, we've got "grows" or "gardens" of pot springing up all across our western states on public lands--and that includes almost 40 percent of national forests. About 3.1 million marijuana plants were confiscated in national forests over a one-year period, September 2007 to September 2008, carrying a street value calculated at $12.4 billion.

I mean, how stupid are we? Go back to Chicago and Prohibition, when Al Capone became more powerful than the government because we'd outlawed the selling of liquor. Legalize marijuana, and you put the cartels out of business! Instead, we're going to further militarize our border and go shoot it out with them? And if a few thousand poor Mexicans get killed in the crossfire, too bad. I don't get that mentality. I don't understand how this is the proper way, the adult answer, when they could do it another way. Eventually, after thousands more people get killed, they'll probably arrive at the same answer: legalization. Because there's nothing else that will work.

And legalization would go a long way toward giving us a more legitimate government, too--a government that doesn't have to shield drug dealers who happen to be doing its dirty work. There are clearly people in government making money off drugs. Far more people, statistically, die from prescription drugs than illegal drugs. But the powers that be don't want you to be able to use a drug that you don't have to pay for, such as marijuana. Thirteen states now have voted to allow use of medical marijuana. Thank goodness Barack Obama just came out with a new policy stating that the feds are not going to interfere as long as people are following state law. That's a great step toward legalization.

You can't legislate stupidity, is an old saying I used in governing. Just because you make something illegal doesn't mean it's going away, it just means it'll now be run by criminals. But is using an illegal drug a criminal offense, or a medical one? I tend to believe medical, because that's customarily how addictions are treated, we don't throw you in jail for them. In a free society, that's an oxymoron--going to jail for committing a crime against yourself.

The government is telling people what's good for them and what's not, but that should be a choice made by us, not those in power. Look at the consequences when it's the other way around.

Legal Cannabis Therapy Takes Back Stage as Colorado Government and Law Enforcement Step Up their Game.

Distorted Realities:

Legislature ready to pass two medical marijuana bills this session.

T he 120 day Colorado State Legislative session isn’t very long. With the projected May 12 end date looming, politicians on all sides of the fence are weighing in with some vision for regulation of the burgeoning medical marijuana industry. It is a mix of good, bad, and ugly, but one thing is for sure, ‘dirty trick’ tactics are alive and well in the Rocky Mountain State.

A recent hearing on HB1284 is a golden example. A shell game was in place where a proposed copy of the bill (which had been available online for months), was completely altered in the final hour before public comment. So, as the March 4th hearing was held, almost no one received access to an actual copy of the ‘altered’ version of the bill. It was also not available on the Internet prior to the public hearing, so the testimony taken all day and into the night involved something most people had not seen. Public hearing testimony has since closed, so no one will have the opportunity to testify on the actual bill. The move apparently was destined to eliminate dialogue from the real stakeholders in this, the patients, and keep them out of the process.

Jessica LaRoux, a patient, showed up at noon and was eleventh in line to testify. She did not get a chance to testify for over seven hours. Why? Jessica testified that there were four pages of witnesses, all in the same handwriting, which had already "signed up" when Jessica arrived. As you remember, this was hour after hour of law enforcement testimony. Able-bodied people, who were getting paid from their government employers to be there, took precedence over the dozens of patients that had to go home because they were too sick.

It is also now written in the history books that the same deplorable tactics were employed with the hearing on SB109, with many waiting almost eight hours to even begin the process of taking patient testimony. The ploy worked, as once again dozens of patients couldn't wait out the opportunity, and had to go home, physically ill and disgusted with the process.

Law enforcement testified over and over again at both hearings that "crime has increased" in areas with dispensaries. Yet when pressed on the fact that they don't have any studies that show this, they say they are "too busy" to do that research.

The Colorado legislature, led by the House Judiciary committee, has trampled and tried to destroy the constitutional rights of patients in Colorado in order to appease law enforcement concerns over problems that do not exist. The committee did not hear any testimony on the actual current version of the bill at the HB1284 hearing. The patients all went home because they couldn't play the state politicians game of attrition.

House Bill 1284 is a 48-page monstrosity seeking to eliminate 80% of existing dispensaries. HB1284 would:

Create a "Medical Marijuana Enforcement Investigator" that would be allowed to carry out dispensary searches without warrants. They would be able count and weigh a dispensary's cannabis and check patient records to make sure the dispensary doesn't have "too much." They would be able to do this repeat-edly and without warning

Set up a state medical marijuana licensing board run by the Department of Revenue, not the Department of Health

Require 75% of all the cannabis used by the dispensary would have to be grown onsite

Patients will have to name their dispensary when they get their license, without the opportunity to shop around or change their minds

Prohibit patients who live near schools from engaging in the use of medical marijuana inside their homes

Dispensary owners will have to pass background checks and submit fingerprints to the FBI

If a dispensary owners have any felony drug convictions, they will be prohibited from owning a dispensary

Caregivers will have to give up their 5th Amendment right against self-incrimination.

Rep. Sal Pace has also offered an amendment to HB 1284 which would allow individuals diagnosed with post-traumatic stress disorder to have access to medical marijuana, if they have a recom-mendation from a psychiatrist. The Colorado Department of Public Health and Environment is said to have been actively lobbying members of the legislature to oppose this amendment. This is in stark contrast to the governmental actions in neighboring New Mexico.

Colorado State Director of Campaigns for Marijuana Policy Project, Steve Fox, has expressed public outrage, saying that the Health Department is attempting to deny veterans and other individuals with PTSD a legitimate treatment alternative based on nothing more than fear mongering and misinformation. He is upset that that lobbying effort is telling state legislators that allowing psychiatrists to recommend medical marijuana to PTSD patients is like giving alcohol to an alcoholic.

Fox reports the sad irony that many PTSD patients have serious alcohol problems that worsen their overall state of health. As has been seen in New Mexico, the psychiatrist-advised use of medical marijuana can actually help PTSD patients reduce their alcohol intake, dramatically increasing their quality of life. Moreover, it is widely known that both alcohol and many of the pharmaceutical drugs given to PTSD patients increase the risk of suicide. Marijuana use does not. ‘The department officials’ callous disregard of this fact alone should make them ashamed of their actions,’ Fox reports.

Meanwhile, Attorney General John Suthers has been outspoken with his prediction that if the measure passes in anything like its current form, legislators will look back on it years from now and realize they made a serious mistake. His alignment with the philosophies expressed by a recent Denver Post Editorial which suggests that before legislators create a dispensary system, voters should first be asked if they want one. Suthers does not believe Amendment 20, approved by the voters in 2000 Article 18 Section 14 of the Colorado Constitution, and allows for such a beast to exist.

While Suthers is quick to reference Boulder Caregiver Stacey Clendenin’s Colorado Court of Appeals decision which establishes that ‘primary caregivers’ must have a relationship with their patients akin to “significant responsibility” elements of Article 18 Section 14 another, similar appeals case remains waiting clarity

In 2006, the Longmont police raided Clendenin's home, finding 44 marijuana plants. At the core of the case, a Boulder County District Court judge ruled that because she hadn't met with all of the individuals in question, the caregiver was not afforded protection under the law.

Larimer County Caregiver Frank Marzano has been waiting over two years for the Colorado Court of Appeals to render a decision in his case, an unusual circumstance for a process which normally has ‘only’ an eighteen month backlog, according to sources. Marzano’s appeal is currently hinging on one of multiple requests for continuance from the Attorney General’s office pending a response to defense motions. Could it be that the justices’ decision following the awaited response does NOT work in favor of the current regulation climate developing. Just another reason why the case has been allowed to be cobwebbed?

One thing is for sure, prosecutions statewide are on the rise by law enforcement officials as associated with medical marijuana, and the climate seems to incorporate a “let the courts shake it out” attitude by police officers in the field. It is unknown whether the current change in attitude may be associated by the overload of media attention and publicized abuses of the legal cannabis therapy system in this state.

This equates to more work and potential conflicts for the court and probation systems statewide. This means unnecessary stress for the legal system and patient caregivers involved as they wade through an era of uncertainty that does not show any possibility of short-term improvement.

The Colorado Department of Health and Environment’s Medical Marijuana Registry continues to work through a backlog of new and renewal applications to be processed adding to the seven month backlog for receiving a state issued certificate.

It is true that local governments across the state have been actively introducing more prohibitive ordinance languages that appear to be earmarking a near future lawsuit climate by patients, caregivers, dispensary and collective owners, alike. There is painful irony in the fact that some bodies seem to be providing a moratorium timeframe which mirrors a “wait and see” attitude for the state legislative response.

On every level it appears that legal patients’ safety issues are on a “back of the bus” wavelength for the time being. Hasn’t history taught us anything? End the failed DRUG WAR now!
