B. Course Description/Descripción del curso
The course is an introduction to the constitutional development of United States, with
emphasis on the civil rights provisions in the Constitution.

1. Describe the general principles of Constitutional Law.
2. Interpret the functions and limits of the three branches of the federal government
of the United States: Executive Branch, Legislative Branch and Judicial Branch.
3. Justify the individual rights granted to the people under the jurisdiction of the
United States of America.
4. Distinguish between the supremacy of the federal government and the sovereign
powers of the states, by identifying the powers and limits of each one.
5. Differentiate between the jurisdiction of federal courts and state courts.
6. Analyze the Florida Constitution and identify the three branches of the State’s
government.

3. Research, study and analyze the topics assigned, comparing various resources
and references to hold the information to the highest academic level.

D. Specific Course Guidelines
The student will follow these specific course guidelines:
1. Refer to the Student Guide to glance at general policies, resources, and other
important elements. This guide can be accessed in the Supporting Documents
section in Blackboard.
2. Hand in all assignments through Blackboard. Assignments that are not submitted
in Blackboard will receive a score of zero.
3. Use professional and legal language while preparing all assignments and oral
presentations in the language that corresponds to each workshop.

Case Study The case study will present a hypothetical scenario in which students will be required to interpret legal clauses and statues concerning the Constitutional rights of individuals. The guided discussion and inquiry will be evaluated as follows: 70% content and 30% language. 30% of language will be evaluated using the rubrics indicated in detail in the workshops, and 70% of the content will be evaluated by assessment instruments developed by the facilitator or otherwise stipulated.

Essays Two essays will be required during the course, where students will need to elaborate on the background of the Constitution of the United States and the doctrine of Judicial Review and the Case and Controversy.

7. Estudie la Doctrina de Separación de Poderes y las funciones de cada una de
las tres ramas del gobierno federal de los Estados Unidos: Poder Ejecutivo,
Poder Legislativo, Poder Judicial. Prepare un resumen detallado y seleccione
cinco palabras clave (aparte de los tres conceptos principales) que encuentre
consistentemente durante su lectura. Lleve su resumen y las palabras
seleccionadas a clase para una participar en una discusión colaborativa.
8. Lea y estudie Los Artículos I, II y III de la Constitución de los Estados Unidos de
América y prepárese para realizar una actividad colaborativa en clase.
9. Estudie el sistema de “checks & balances” establecido por la constitución y
prepare una tabla ilustrando cómo este funciona para proteger al ciudadano
cuando una de las ramas de gobierno ejerce exceso de poder sobre las otras
ramas de gobierno. Prepárese para realizar una actividad colaborativa en clase.

D. Actividades de aplicación durante el taller
1. El facilitador explicará detalladamente los objetivos generales del curso, los
criterios de evaluación, sus expectativas y la importancia de que el estudiante
entregue todas sus tareas a través de la plataforma de Blackboard.
2. El facilitador discutirá las directrices sobre el Digital Performance Porfolio y
aclarará dudas. Explicará a los estudiantes la importancia de someter el
Portafolio Digital a través de la plataforma Blackboard y cómo evaluará el mismo.
3. El facilitador discutirá el vocabulario técnico de la disciplina permitiendo amplia
participación estudiantil.
4. Los estudiantes se dividirán en parejas, discutirán la pirámide preparada sobre la
Jerarquía de las Leyes y tratarán de llegar a un consenso sobre la preparación
de esta tarea. Al finalizar esta actividad, el facilitador permitirá a los estudiantes
presentar sus pirámides y luego discutirá el orden y jerarquía de leyes en
Estados Unidos. El lenguaje de esta actividad se evaluará utilizando el
Apéndice E: Rúbrica de comunicación oral.
5. El facilitador realizará una actividad de participación oral donde los estudiantes
expondrán y comentarán los hallazgos más relevantes sobre el trasfondo y
desarrollo histórico de la Constitución de los Estados Unidos de América. El
lenguaje de esta actividad se evaluará utilizando el Apéndice F: Rúbrica de
participación.
6. El facilitador discutirá ampliamente la Doctrina de Separación de Poderes y la
función constitucional del Presidente, el Congreso y el Sistema Judicial de los
Estados Unidos. El facilitador discutirá la soberanía que posee cada estado de
la nación norteamericana, Estado Soberano, y cómo operan e interactúan el
gobierno federal y el gobierno estatal. A través de la discusión, el facilitador
pedirá aleatoriamente a los estudiantes a que compartan una de las palabras
que seleccionaron durante el ejercicio de estudio en las actividades antes del
taller. Cada estudiante deberá elaborar, dentro de su conocimiento y lectura,
sobre la palabra. Las palabras compartidas por los estudiantes no deberán
repetirse. El lenguaje de esta actividad se evaluará utilizando el Apéndice F:
Rúbrica de participación y el Apéndice E: Rúbrica de comunicación oral.

7. Los estudiantes se dividirán en tres grupos, el facilitador le asignará a cada
grupo uno de los siguientes artículos de la Constitución Federal: Artículo I,
Artículo II y Artículo III. Cada grupo discutirá el Artículo de la Constitución
asignado y preparará un bosquejo donde se elaboren los puntos más
importantes del tema asignado. Al finalizar la actividad, cada grupo escogerá un
estudiante que exponga el propósito e importancia del Artículo de la Constitución
asignado. Debe someter su bosquejo a través de la plataforma de Blackboard
utilizando el enlace correspondiente e incluir su tarea en el Portafolio Digital. El
lenguaje de esta actividad se evaluará utilizando el Apéndice E: Rúbrica de
comunicación oral.
8. El facilitador dividirá la clase en grupos, los estudiantes discutirán la tabla
asignada sobre el tema de “checks and balances” de la constitución. Luego, el
facilitador dirigirá una discusión oral sobre este tema, permitiendo amplia
participación estudiantil. Debe someter su tarea a través de la plataforma de

2. Distinguish between Federal Jurisdiction and State Jurisdiction in a collaborative
activity during class.
3. Summarize the enumerated powers of Congress, under Article I of the United
States Constitution in a carefully proofread.
4. Explain the Dormant Commerce Clause doctrine in an oral exercise.

1. Demonstrate understanding of the class discussion and the key legal vocabulary
discussed, while elaborating on the concept of Federalism, properly defining the
appropriate terminology.
2. Explain the Dormant Commerce Clause doctrine in an oral exercise by employing
accurate oral skills, emphasizing the correct enunciation of the words in English.
3. Employ factual data retrieved from highly academic resources, to distinguish
between Federal Jurisdiction and State Jurisdiction, this to properly share the
information in collaborative activities during class.
4. Summarize the enumerated powers of Congress, under Article I of the United

synthetizing skills, while maintaining the correct use of grammar rules.

C. Activities to be completed before the Workshop
1. Visit the Virtual Library to research, study and define the course vocabulary as
stated above. Create a table with the concepts, the definition and the academic
source (or sources) from which the definition was taken. Once completed, send
the table to the facilitator through Blackboard. Print a copy a bring it to class.
2. Create a three-column table chart illustrating your findings on the concepts:
Enumerated Powers / Delegated Powers, Reserved Powers, and Implied Powers.
Use highly academic sources for this exercise. See Appendix A
Once you complete the exercise, upload a copy of your table in the written
discussion forum created by the facilitator, using the Discussion Board tool in
Blackboard. In this forum, the students will answer and elaborate on the following
questions:
a. To whom are these powers delegated; to the federal government or to the
states?
b. What Article and Section of the United States Constitution delegates these
powers?
c. List the Enumerated Powers, and give examples of the reserved and implied
powers.
React to the comments of at least three other students. The language of this
activity will be assessed using Appendix B: Paragraph Construction Rubric. Be
prepared for a collaborative activity in class.
3. Read and Study the case Printz v. the United States, 521 U.S. 898 (1997).
Complete the “Guide to Analyze a Legal Case” provided in Appendix B
This is an individual assignment and must be submitted to the facilitator through
the Blackboard platform. Be prepared to discuss this case in class.
4. The facilitator will create a written discussion forum using the Discussion Board
tool in Blackboard. In this forum, the students will interpret the concept of
Federalism. Place special emphasis on the legal terminology you learn, and
highlight the ideas and concepts you learn from the contributions of your
colleagues.
a. React to the comments of at least three other students.
b. The language of this activity will be assessed using Appendix B: Paragraph

5. Study and compare the Federal Courts Jurisdiction vs. the State Courts
Jurisdiction; be prepared for a group collaborative activity in class.
6. Go to the VoiceThread link created by the facilitator in Blackboard and orally
explain what is your understanding of the Dorman Commerce Clause doctrine.
a. Afterward, listen and provide feedback to the delivery of at least two of your
colleagues’ recordings.
b. Make sure to take notes on fundamental aspects of the information you
searched and that of your colleague’s contributions.
c. Bring the notes to class to elaborate during a group activity.
d. The language of this activity will be evaluated using Appendix E: Oral
Communication Skills Rubric.
7. Continue to prepare your Digital Portfolio following the instructions established in
the Digital Performance Portfolio Assessment Handbook found in Blackboard.
D. Application Activities during the Workshop
1. Students will be divided in groups to discuss and compare their charts. See
Appendix A. The facilitator will lead an oral discussion on the topic of Federalism
and the students will discuss their findings using the chart prepared as part of the
activities before the workshop. The facilitator will encourage group and individual
participation. The language of this activity will be evaluated using Appendix F:
Participation Rubric.
2. The facilitator will lead an open discussion on the case assigned, Printz v. the
United States, 521 U.S. 898 (1997). The facilitator will encourage group
participation and will make sure the students achieved reading comprehension of
the case. The facilitator will also make sure the students understood the
assignment and followed the guide provided in Appendix B, for analyzing a legal
case. Students will then divide themselves between one side or the other using
the assigned case (either Printz or United States), and will briefly debate both
parts of the case analyzed, with close guidance from the facilitator. Both sides
must have the same amount of students, meaning that some students may not
necessarily be in the side he or she supports, however, he or she must side with

the colleagues regardless, and bring comprehensive tactics and statements. The
language of this activity will be evaluated using Appendix H: Role-playing Rubric.
3. Students will be divided in groups and will create a mind map on the topics of
Federal Courts Jurisdiction and State Court Jurisdiction. Use Appendix C as an
example.
a. Which courts have limited jurisdiction?
b. Which courts have general jurisdiction?
The facilitator will start a mind map on the board and the students must all
participate to complete a collective version of their individual mind maps. The
students will go to the board and share their thoughts and findings on this topic.
The language of this activity will be evaluated using Appendix F: Participation
Rubric.
4. The facilitator will discuss the Dormant Commerce Clause doctrine, and will ask
the students about their experience while participating in the VoiceThread forum
created in Blackboard. Maintaining decorum and professionalism, each student
will express which colleague’s point of view he or she most identifies with, and
which he or she did not. The facilitator will promote class participation while
discussing this topic. The language of this activity will be evaluated using
Appendix F: Participation Rubric.
5. The facilitator will introduce the topics to be discussed in the next workshop.

discusión escrita.
5. Discutirá el Debido Proceso de Ley sustantivo y procesal al amparo de la Quinta
y Catorceava Enmienda de la Constitución Federal, en una tabla.

instalación de equipos de laboratorio en la industria

reclutamiento, fue contratado para completar un proyecto de seis
meses en una compañía farmacéutica ubicada en Orlando,
Florida.

D. Application Activities during the Workshop:
1. The facilitator will advise the students to pay special attention to class. On the
last hour of the workshop the students will participate on a “Round Robin”. The

9. The class will be divided in two groups for a debate. Students will put away all
their class materials. The groups will participate in a “Round Robin” on the
topics discussed in Workshop Three (Taller Tres) and Workshop Four. The
facilitator may award a bonus to the winning team.
Round Robin Rules:
a. Each group will have a turn to answer a question.
b. The question will be given to one group member, who must try to answer
the question by him/herself. If the question is answered correctly by this

he/she may consult the rest of the group. If the group answers correctly,

This is the second part of the workshop, which also contains activities that must be
completed before the workshop, along with the ones in the Spanish section. It is
recommended that the first two hours of this workshop be offered in Spanish, while the
