This follows an intense period of speculation on the Internet, in which many bloggers and forum users expressed concerns over free speech and other issues. In a downloadable video, FTC lawyer Mary Engle stated that the FTC has no intention to take legal action against bloggers. The FTC issued a press release on October 5, stating that a new set of guidelines have been published for endorsements and celebrity testimonials. In a nutshell, the very extensive document stipulated that it is the FTC’s opinion that reviews on blog are akin to advertisements and that advertisers – not bloggers – should be subject to similar guidelines. Said guidelines are to be formalized into policy on December 1, 2009. A story by Associated Press business reporters, which was repeated in many news outlets online, interpreted this as a need for mandatory disclosure of the sources of review copies by bloggers. This story quoted the FTC’s fines for violating specific portions of TItle 15 USC, related to unfair competition, as being as high as $11,000 (when in actual fact, the fine is $15,000). As is frequently the case online, this story was passed around, quoted extensively, and generally caused a lot of discussion, much of which was unfounded. The US Federal Trade Commission is a very large consumer watchdog regulatory body that is perhaps most famous for antitrust actions and other actions that regulate unfair competition. It does not have the power to make laws, only to initiate court actions as mandated under the FTC Act, which is part of Title 15 USC (a statute that is broad enough to include patent and trademark legislation, which are regulated by another office). This is similar to how the Federal Bureau of Investigation (FBI) enforces the law and investigates crimes, but does not create law.
