F.20 (4) Energy/2004 dated 25.10.2004 and amended vide letters of even nos. dated 10.3.2005, 16.7.05, 18.8.05, 24.2.06, 301106 and 19107) 1. Objectives: 1.1 Whereas with a view to promote generation of power from nonconventional energy sources, Government of Rajasthan promulgated a Policy on 11.3.1999. This Policy known as "Policy for Promoting Generation of Power through NonConventional Energy Sources" ended on 31st March, 2004. A separate Policy was, however, issued on 4th February, 2000 exclusively for promoting generation of electricity from wind. This Policy known as "Policy for Promotion of Electricity Generation from Wind" too ended on 31st March, 2004. During the currency of Wind Policy 2000 a new Policy was promulgated in April 2003 for period up to 31st March, 2009. 1.2 And whereas, the new Central Electricity Act 2003 has come into effect from 10.6.2003. 1.3 And whereas, clause 4 of Policy 2003 provides for supersession of the same. 1.4 And whereas, among the nonconventional sources of energy, Solar, Wind, MiniSmall hydel and Biomass have good potential for generation of electricity in Rajasthan and after having gathered the experiences from the earlier policies and identifying the impediments in the process of generation of electricity from nonconventional sources, State Government has decided to issue a comprehensive Policy for generation of electricity from various sources of nonconventional energy which offers solution to various problems faced by developers, investors and utilities, this Policy is being promulgated. 2. Title and enforcement: 2.1 This Policy will be known as Policy for Promoting Generation of Electricity through NonConventional Energy Sources 2004. 2.2 The Policy will come into operation with effect from 25.10.2004 and will remain in force until superseded or modified by another Policy. 2.3 The amendments made in the Policy vide letters of Energy Department no. F.20(4)Energy/2004 dated 10.3.2005, 16.7.05, 18.8.05, 24.2.06, 301106 and 19107 shall come into effect from the date they were introduced or as specified below. 3.     1.Objectives:

    (vi)"DLC"meansDistrictLevelCommitteetofixthepriceoflandforpurposesofregistration.(vii)"Discom"meansadistributionlicensee,suchasDiscomJaipur,DiscomJodhpurandDiscomAjmer.(viii)"Financialyear"meansyearstartingon1stAprilofCalenderyearandendingon31stMarchofnextcalendaryear.(ix)"Investor"Apersoninvestingforgenerationofelectricityfromnonconventionalsourcesofenergy.(x)"IndependentPowerProducer"(IPP):Asingleinvestorwhoalsodevelopsthewindfarm.(xi)"IREDA"meansIndianRenewableEnergyDevelopmentAgency.(xii)"Licensee"meansapersonwhohasbeengrantedlicenseunderSection14oftheAct.(xiii)"Manufacturer"meansmanufacturerofNonconventionalEnergybasedpowerplant.(xiv) "MNRE" means Ministry of New and Renewable Energy Sources, a Central Government Ministry promoting the use of NonconventionalEnergySourcesinIndia.(xv)"Person"Personmeansanindividualorafirm/companyregisteredundertheCompaniesAct,1956.(xvi)"PowerProducer"meansinvestors/developersgeneratinggridgradeelectricityfromNonconventionalEnergySources.(xvii)"PoolingStation"meanssubstationdevelopedbythedeveloperforinterfacewiththereceivingstation.(xviii)"Power"meanselectricityproducedusingthenonconventionalsourcesofenergy.(xix)"Policy1999"meansPolicyforPromotingGenerationofPowerthroughNonConventionalEnergySources issuedon11thMarch,1999.(xx)"Policy2000"meansPolicyforPromotingGenerationofPowerfromWindissuedon4thFebruary,2000.(xxi)"Policy2003"meansPolicyforPromotionofElectricityGenerationfromWindissuedon30thApril,2003.(xxii)"PLF"meansPlantLoadFactor(xxiii)"PPA"meansPowerPurchaseAgreement(xxiv) "Receiving Station" means EHV SubStation developed by RVPNL/Discom for evacuation of power generated from NonconventionalEnergySources.(xxv)"RERC"meansRajasthanElectricityRegulatoryCommission.(xxvi)"RREC"meansRajasthanRenewableEnergyCorporation.(xxvii)"RIICO"meansRajasthanIndustrial&InvestmentCorporation.(xxviii)"RVPN"meanstheRajasthanVidyutPrasaranNigam.(xxix) Solar Plant:means a power plant or system utilizing solar thermal energy through solar photovoltaic or concentrated solarthermaldevicesincludingitsintegrationintoconventionalfossilfuelforgenerationofelectricity.(xxx)"State"and"Government"means,respectively,theStateofRajasthanandtheGovernmentofRajasthan.(xxxi)"WBA"meansWheelingandBankingAgreement.

    3.2Thetermsnotdefinedabovewillhavetheirusualmeaning.

    4.Useofpowerforcaptivepurposes/sale:

    4.1ThePowerProducersmayusethepowerforcaptiveconsumptionorforsaletoconsumers/licenseesincludingDiscoms.4.2ThecaponpurchaseofenergyfrompowergeneratedthroughNonConventionalEnergySourcesshallbe inaccordancewiththatspecifiedbytheRajasthanElectricityRegulatoryCommission.

    5.GridInterfacing:

    5.1Exceptincaseofsolarpowernotexceeding220KWthegridinterfacingarrangementsforpowerusingnonconventionalsourcesofenergywillbemadebyDeveloper/RVPN/Discomasunder:5.1.1PoolingStation:Interfacing arrangements such as transformers, panels, kiosks, protection,metering, HT lines from thepointsofgenerationtothepoolingstationincludingthepoolingstation

    shallbedevelopedandmaintainedby thePowerProducerasper thespecificationsand requirementsof theRVPN/Discom,and theentirecostforthiswillbebornebythePowerProducer.5.1.2ReceivingStationRVPN/Discom shall finalise the location of receiving station in consultation with RREC on which the electricity generated will bereceivedatminimum33KVlevel.Forcreationofproperfacilityforreceivingpower,thePowerProducershallpayRs.2lacsperMWtoRVPN/Discomasthecasemaybe.Providedthatnogridconnectivitychargesshallbepaidbysolarandother(exceptwind&biomass)powerplantsuptototalinstalledcapacityof50MWintheState.

    5.1.3TransmissionfromPoolingStationtoReceivingStation:The transmission system from pooling station to receiving station shall be developed by thePower Producer at his own cost. This will, however, be deemed to have been transferred toRVPN / Discom for O&M as soon as interconnection between pooling station and receivingstationisestablished.Providedthat incasethe lengthoftheexclusive/internaltransmissionsystemuptoReceivingStation isatadistance longer than thatspecifiedbyRERC,compensationshallbeprovided toDeveloperaswillbedeterminedbyRERC.5.1.4TransmissionandDistributionNetworkAugmentation:For augmentation of transmission/ distribution systems to evacuate the power from receivingstation,RVPN/Discomshalldevelop/augmentthenecessarytransmission/distributionnetworkwithinmutuallyagreedtimeframe.5.2 RVPN/ DISCOM shall grant the interconnection facility, wherever adequate powerevacuationcapacityisavailable,withinonemonthofintimationorCOD,whicheverislater.

    5.3ThePowerProducershall installmeteringdeviceatthereceivingstationathisowncost.Suchmeteringdevicemustconformtostandardsofmeteringcode.5.4ThePowerProducer shall installnecessarycurrent limitingdevices suchasThyristor in thegeneratingequipment.CapacitorsofsufficientratingshallalsobeprovidedintheWindFarmtoensurethattheaveragepowerfactorismaintainedasperrequirementsofStateLoadDespatchCentre,measuredatmeteringpointoftheWindFarm.5.5ThePowerProducershallcomplywithGridCode includingLoadDespatchandSystemOperationCode,MeteringCode,ProtectionCode,SafetyCodeetc.asapplicablefromtimetotimeintheStateofRajasthan.

    6.WheelingandBanking:

    6.1ExceptincaseofpowersoldtoDiscoms,thePowerProducershallpaywheelingcharges@10%oftheenergybilledintothegridirrespectiveofthedistancefromthegeneratingstationandsuchchargeswillbeinclusiveoftheT&Dlosses.Provided that in respect of third party sale and / or captiveuse forwhich PPAs are signedafterMarch31, 2007, the transmission,wheelingandotherchargesshallbeasspecifiedbyRERC.6.2ThePowerProducermayhavethefacilityofpowerbankingwiththeDiscom.TheDiscomsattheendof31stDecemberofeverycalendaryear,willpaytothePowerProducerfortheenergybilledintothegridbuthasremainedunutilised(afterselfuseorsaletoconsumers/licenseesotherthanDiscoms)bythePowerProducerduringthesaidcalendaryearatthepooledrateforprocurementofpowerbytheDiscomintheprecedingfinancialyear.

    Provided that, if at the end of the calendar year it is found that the PowerProducershasdrawnmoreelectricitythanthatbilledbyhimintothesystem,heshallbeliabletopaythecostofthesameattheHTtariffprevailingattheendoftheproceedingfinancialyear.Provided further that in respect of third party sale and / or captiveuse forwhichPPAsaresignedafterMarch31,2007,thebankingofpowergeneratedshallbeasspecifiedbyRERC

    6.3ThePowerProducershallexecuteanagreement(WheelingandBankingAgreement)withtheDiscomforsuchbanking.However,thewheelingagreementwithRVPNwillbeexecutedseparatelyifthePowerProducerintendstousethesystemofRVPNforwheelingpower.6.4WBAsmaybeallowedtobeassigned,inparts,ononetimebasisineachcase,tootherpartiesaftercompletionoftheprojectanditsconnectivitytothegrid,withtheconsentofRREC&RPVN/Discom(s)onpaymentofRs.1.00lacperapplicationtoRREC.

    7.PriceofPower:

    7.1ThepriceofpowertobesoldbytheeligiblePowerProducertoconsumers/licenseesotherthanDiscomswillbedeterminedbythemutualunderstanding/agreementbetweenthesellerandthepurchaser.7.2FortheDiscomsthepriceofsuchpowerwillbeaspertheSchedule1A/1Bappended,asthecasemaybe.

    Provided that forwind farms commissioned afterMarch 31, 2007 and for biomass power plants commissioned after September 30,2008,thetariffshallbeinaccordancewiththatspecifiedbyRERC.(RERCtariffisenclosedasAppendix1&2)

    8.PowerPurchaseAgreement:

    8.1ThesaleofelectricitybyPowerProducer toDiscomswill begovernedby thePowerPurchaseAgreementexecutedbetween theconcerningDiscomandthePowerProducerandwitnessedbyRREC.8.2ThePowerPurchaseAgreementforwindpowerwillbefor20yearsandforpowerotherthanwindpowerwillbefor10years.ProvidedthatattheendoftheperiodofPowerPurchaseAgreementthenewPPAcanbeexecutedatmutuallyagreedrates8.3PPAsmaybeallowedtobeassigned,inparts,ononetimebasisineachcase,tootherpartiesaftercompletionoftheprojectanditsconnectivitytothegrid,withtheconsentofRREC&RPVN/Discom(s)onpaymentofRs.1.00lacperapplicationtoRREC

    9.SettlementofAccounts:

    Theaccountofall transactionsbetween thePowerProducerand theDiscoms/RVPN regardingpriceofpowerandwheelingchargesshallbesettledonmonthlybasisexceptincaseofpriceofpowerunderbankingarrangementswhichwillbesettledwithinonemonthoftheclosingofeverycalendaryear.

    10.MeritorderDispatch:

    ThepowerplantscommissionedunderthePolicywouldnotbesubjecttoMeritorderdispatchregulations.

    11.IncentivebytheStateGovernment:

    11.1ExemptionfromElectricityDuty:ConsumptionofelectricitygeneratedbyEligiblePowerProducersforitscaptiveuseorforsaletoanominatedthirdpartywillbeexemptedfromElectricityDuty@50%foraperiodof7yearsfromCOD.

    11.2Grantof incentivesavailableto industries:GenerationofelectricityfromNonconventionalEnergySourcesshallbetreatedaseligible industry under the schemes administered by Industries Department and incentives available to industrial units under suchschemesshallalsobeavailabletothePowerProducers.

    11.3SingleWindowClearance:AStateLevelEmpoweredCommitteeconsistingoffollowingwillprovidesinglewindowclearanceonproposalsreceivedfordevelopingthepowerplantsbasedonNonConventionalEnergySources:

    1.Addl.ChiefSecretary(Infrastructure)Chairman2.PrincipalSecretary,Revenue,Member3.Secretary,EnergyMember4.CMD,RajasthanVidyutPrasaranNigamMember5.CMD,RajasthanRenewableEnergyCorporationLimitedMemberSecretary

    TheCollector/Collectorsinwhosejurisdictionthelandisproposedforallotmentshallbespecialinvitee.11.4Allotmentoflandonconcessionalrates:TheGovernmentlandrequiredforpowerprojectsbasedonnonconventionalsourcesofenergyshallbeallottedtoPowerProduceratconcessionalratesviz,10%ofDLCratesasperprocedureprescribedbelow.

    Providedthat

    (a) The site for wind power project will be chosen by the developer afterascertainingthewindparameters.(b) The land other than the Government landwill be procured by the PowerProducer/developerathisowncost.(c) While land may be allotted to the Developer / Power Producer for theproject,signingofleaseagreementbytheCollectorshallonlybeafterdepositof the Security Money in RREC for at least 10% of the project capacity forwhichthelandwasallotted.

    RRECwillbeNodalAgencyforpowerprojectsbasedonnonconventionalsourcesofenergy.Itwillalsoplaytheroleoffacilitatorfor:(i)ExecutionofPPA/WBAwithRVPN/Discoms(ii)LoansfromIREDA/PFC/REC/FinancialInstitutions/CommercialBanks.

    13.RegistrationforPowerProject:

    13.1ThePowerProducershallregistertheapplicationwithRRECinprescribedproformaappendedwiththePolicyalongwiththerequiredprojectreport,documents,attachmentsandtheinterfacingschemeetc.13.2Alongwithhisapplication,thePowerProducershalldepositanamountofRs.50,000/perMWwithRRECtowardsprocessingfee,whichshallbenonrefundable.ProvidedthatinsuchcaseswheretheapplicantshadalreadysubmittedanapplicationforaprojectunderWindPolicy2003,alongwithprocessingfees,andhadreapplyforthesameprojectunderthenewNCESPolicy2004,theprocessingfeespaidearlierforthesameprojectmaybeadjustedinthetotalprocessingfeesdueundertheNCESPolicy2004.

    ProvidedfurtherthatforprojectsregisteredfromApril1,2007onwardstheprocessingfeechargeableshallbeRs.25,000/perMW.13.3 The Power Producer shall select the site for establishing the power project and shall also submit theapplicationtoRRECforallotmentofGovernmentlandifany.13.4EveryapplicationwouldbegivenaregistrationnumberbyRREC.ThelistofregisteredapplicationsshallbedisplayedonthenoticeboardofRREC.13.5Inexceptionalcircumstances,wherethewindpatternchangesadverselyforanyparticularlocation,RRECmaypermit relocation of a project to an alternative site once during the life of the project, so long as theinvestorremainsthesame.Forsuchchange,noadditionalchargesshallbe leviedotherthanfor the landsoallotted.

    Provided that in case such relocation entails additional investment for evacuating the power on the part of RVPN / Discom, theconnectivitychargesshallbeleviedasperactuals.

    14.ApprovalofPowerProjects:

    14.1RRECshallforwardlandallotmentapplicationfortheidentifiedgovt.landtotheconcernedDistrictCollectorwithinaperiodof7daysfromthereceiptoftheapplication.Providedthat the landapplication incaseofwind farmcanbe forwardedonly if thesame is forsite forwhichwindparametersarecertifiedbyCWET.14.2RRECshallforwardthegridinterfacingplansubmittedbytheapplicanttoRVPN/Discomfortechnicalacceptance.14.3RRECshallissueinprincipalclearancefortheprojectonverificationoffollowing:14.3.1Theplan/layoutoftheprojectisstrictlyinaccordancewithstandardguidelinesofMNRE/CWET.14.3.2ThesuggestedgridinterfacingarrangementassubmittedbytheapplicantisacceptedandapprovedbyRVPN/Discom.14.4Theprojectproposal "inprinciplecleared"byRRECandmeeting theaboverequirementsshallbeputupbefore theStateLevelEmpoweredCommittee.14.5Thedecisionforsinglewindowclearance(approvalofproject)willbetakenbytheSLECwithinonemonth.14.6 The Power Producerwould initiate activities on the identified / allotted land only after approval is granted by the State LevelEmpoweredCommittee.Provided that if any Power Producer initiates activities on the identified or the allotted land without project approval, subject toregularizationoflandbythecompetentauthority,gridconnectivitywouldbeallowedtosuchprojectonlyafterpaymentofanamount@Rs.5.00lacsperMWaspenaltyamountbyPowerProducertoRREC.

    ProvidedfurtherthatifthisprovisionisviolatedsecondtimebythePowerProducer,nogridconnectivitywouldbepermittedtosuchproject."

    15.SecurityDepositanditsforfeiture:

    15.1TheDeveloper/PowerProducershalldepositarefundableamountassecuritydepositwithRREC,towardscompletionof theproject in theprescribed time frame,within30daysof theapproval of theprojectby theSLECinthecaseofsolarpowerprojects,capacityallocationbyRRECinthecaseofwindenergyprojectsandasperClause16.1Ainthecaseofbiomasspowerprojects.15.2TheSecurityDeposit fordifferentcategoriesofprojectsbasedonnonconventionalenergysourcesshall

    beasfollows:ForWindenergyprojects:(a)InJaisalmerdistrict:Rs.10lacsperMW(b)Inotherdistricts:Rs.5.0lacsperMW

    Providedthat:(1)TheamountshallbeRs.5.0lacswitheffectfromApril1,2007.(2)Forprojectsupto25MW,thesecuritydepositshallbeintheformofcash,onwhichnointerestshallbepayable.(3)Forprojectsexceeding25MW,thesecuritydepositmaybeintheformofbankguarantee.(4)Ifthesecurityamountisnotdepositedwithinthetimespecified,theapprovaloftheSLECshallstandwithdrawnandprioritywouldbeaccordedtothenextapplicant.ForresubmissionofthecasetoSLECforprojectapproval,theapplicantwillhavetoreregisterthecase,alongwiththeprocessingfee,withinthenext30days,failingwhichthelandallottedshallalsostandcancelled.

    ForBiomassenergyprojects:Rs.1.0lacperMW.Thesecuritydepositmaybeintheformofcashorbankguarantee.ForSolarPowerProjects:Rs.5.0lacperMW.Thesecuritydepositmaybeintheformofcashorbankguarantee.

    15.3Thetimeframeforcompletionofprojectsshallbeasfollows:

    16.SpecialConcessions/conditionsforBiomassProjects.

    16.1ReservationofAreaforbiomasscollection:IftheStateGovernmentissatisfiedwiththeprogressachievedinthesettingupofaBiomassbasedpowerplantofaggregatecapacityof7.5MWatadulyapprovedsite,nootherbiomasspowerplantshallbeallowedwithinaradialdistanceof40KM.Providedthat:(a)TheStateGovernmentshallhavetherighttoreviewthebiomassavailabilityandreducethereservationareatonotlessthan30Kms radius, if it is satisfied that such reduction in area reservationwould not adversely affect the sustainability of existing plants.However,suchreviewshallbeheldnotbefore2011.(b)ProjectsclearedunderPolicydated11.3.99andcomplyingwithconditionslaiddownvideamendmentdated28.2.03shallcontinuetoenjoy50Km.reservationfacility.(c)SmallcapacitybiomassbasedgasifiersbeingsetupunderanyprogrammeoftheStateGovt./GOI,throughRRECorotherwise,wouldbeallowedtobesetupwithinthereservedareasodefinedasabove.(d)IfEligiblePowerProducerdesirestoinstalllower/highercapacityplantorwantstoenhancethecapacityofthepowerplantabove7.5MW,thereservationareacouldbereduced/extendedbyRRECtomeetproportionatebiomassrequirementfortheplant."16.1A In view of the area reserved for biomass power plants postregistration, the timeframe for completion of different activitieswouldbeasfollows:DepositofSecurityamount(Rs.1lac/MW)within1monthofregistration.Finalizationoflandandpowerevacuationplanwithin4monthsfromdateofregistration. For noncompliance of above conditions, the registration shall stand cancelled and the security deposit, if deposited, shall berefunded.

    Provided that extension in timelimitmaybegrantedon submissionof application toRREC, alongwith convincing reasons, 15dayspriortoexpiryofthetimelimit,alongwithpenaltyamountasfollows:[email protected]/[email protected]/MWNofurtherextensionbeyondthislimit.

    16.2UseofConventionalFuel:

    Toensuregenerationofpowerintheeventofreducedbiomassavailabilityinthedistrict,aPowerProducercouldbepermittedtouseconventionalfuelupto30%,computedonthebasisofdeclaredheatratelinkedtoP.L.F,inthecaseofbiomassbasedpowerplantoftheaggregatecapacityof15MWandaboveataparticularlocationandupto25%,onsimilarbasis,forthosebelowthatcapacity.

    16.3AvailabilityofWaterforPowerGeneration:TheEligiblePowerProducersshallbeallowedtousewaterforpowergeneration,whereverpossible.Themodifications(s)required,ifany, in the existing canal system shall be done by the IrrigationDepartment at the cost of the Power Producer. For use of groundwater,specificapprovalfromconcernedauthoritiesshallhavetobetaken.

    17.Savings:

    17.1PowerprojectsestablishedunderthePolicy1999,Policy2000andPolicy2003willcontinuetobegovernedaspertheterms&conditionsalreadyagreedandapprovedundertheconcernedpolicies.However,renewalofterms&conditions, ifany,willbeguidedbythisPolicyoranyotherPolicyprevalentatthattime.17.2ThepowerprojectsforwhichPPAshavebeensignedbeforethepromulgationofthisPolicywillalsobetreatedundertheterms&conditionsof thePolicyunderwhichapprovalwasaccordedtothesameprovidedthepowerprojectsgetscommissionedbefore31stMarch2005.Providedthatforpowerprojectsbasedonbiomasstheperiodofcommissionwillbeupto30thSeptember,2008.17.3ThewindpowerprojectproposalsforwhichRREChasaccordedapproval,landhasbeenallotted,settingshavebeenapprovedbyRRECbeforepromulgationofthisPolicyandsubstantial investment(50%oftheproposedcapital investment)hasalreadybeenmadebyPowerProducerwillbegovernedbythePolicy2003.(Clarification The limit of 250MWonPPAs to be signedbyDiscomsunder Policy2003 shall be observedby theCommitteewhileconsideringsuchcases)Providedthatacommitteeconstitutedhereunderwilldeterminewhetherthesubstantiveinvestmenthasbeenmade:i)PrincipalSecretary,EnergyChairmanii)Secretary,Finance,ExpenditureMemberiii)ManagingDirector,RRECMemberSecy.
