My 84 year old mother, Susan Biggs, owns the property to the east at 13388 Duanesburg Road comprised of Tax ID 74.00-3-18 and 74.00-3-16.3. Over the years we have watched the wetland changes on our property as well as our neighbor’s land, but only recently became aware of the need to contact the DEC and Army Corps requesting the freshwater maps be updated. What brought this to our attention was Eden Renewables application to the Duanesburg Planning Board for a special use permit to construct Oak Hill 1 and Oak Hill 2 solar power plants located at 13590 Duanesburg Road with Tax Id 74.00-2-5. Reasons for concern are, but not limited to: Environmental Assessment Form (EAF) indicates the project is located on a Principal Aquifer. Our residence is supplied by well water; Eden Renewables site plans and minor subdivision plan, drafted by Environmental Design Partnership (EDP), provided to the Duanesburg Planning Board, Schenectady County omits the wetlands on the eastern portion of the Project site; and Environmental Design Research’s (EDR) report submitted to DEC and Army Corps of Engineers omits the eastern portion of the Project site, specifically the northeastern corner which is the lowest point of the Project. I would like to bring to your attention possible changes in the wetlands at 13590 Duanesburg Road, Delanson, NY 12053. At the July and August 2019 Public Hearings we informed the Duanesburg Planning Board of these wetlands and our concerns.

On October 2, 2019 Planning Board Chairman Phil Sexton signed the Minor Subdivision Plan which was submitted to Schenectady County. This document omits the wetlands along the eastern portion of 13590 Duanesburg Road.

I would like the fresh water wetland maps updated to reflect the areas as shown on my enclosed map and images because:

• these wetlands should be taken into consideration as Eden Renewables moves forward with permitting and construction of Oak Hill Solar 1 and 2;

• Eden’s Stormwater Pollution Prevention Plan Section 2 Site Description my be inaccurate and the Site Location Map appears to locate the project one mile west of the project site in Schoharie County;

• Duanesburg Planning Board September 19, 2019 Resolution 3.b. approves 90 acres of solar coverage which is not in alignment with the documents and drawings provided to the tax payers indicating 65 acres on Tax ID 74.00-2-5: and

• any future reviews and submissions for development on this parcel should take the eastern wetlands into consideration.
