Qualifying customers onthe Albuquerque downtown network will be charged at the standard PNM Owned Transformerrate.

INTERRUPTION OF SERVICE: The Company will use reasonable diligence to furnish a regular anduninterrupted supply of energy. However, interruptions or partial interruptions may occur or service maybe curtailed, become irregular, or fail as a result of circumstances beyond the control of the Company,public enemies, accidents, strikes, legal processes, governmental restrictions, fuel shortages. breakdownor damages to generation, transmission, or distribution facilities of the Company, repairs or changes in theCompanys generation, transmission, or distribution facilities, and in any such case the Company will notbe liable for damages. Customers whose reliability requirements exceed those normally provided shouldadvise the Company and contract for additional facilities and increase reliability as may be required. TheCompany will not, under any circumstances, contract to provide 100 percent reliability.ACCESSIBILITY: Equipment used to provide electric service must be physically accessible. The metersocket must be installed on each service location at a point accessible from a public rightof-way withoutany intervening wall, fence, or other obstruction.TERMS OF PAYMENT: All bills are net and payable within twenty (20) days from the date of bill. If Xpayment for any or all electric service rendered is not made within thirty (30) days from the date the bill isrendered, the Company shall apply an additional late payment charge as defined in Rate 16 Special xCharges. xLIMITATION OF RATE: Electric service under this Schedule is not available for standby service, and shallnot be resold or shared with others. Should the customers demand exceed 10,000 kW for three monthsin any 1 2month continuous period, the service will be transferred to another rate schedule for customersof this size.
