1. PRIOR TO THE BUILDINGS HEREBY APPROVED BEING BROUGHT INTO USE,

detailed landscaping and planting plans shall be submitted for the approval in writing of

this Planning Authority. The plans shall include reference to the future management and

aftercare of the proposed landscaping and planting, and thereafter the management and

aftercare of the landscaping and planting shall be carried out in accordance with these

approved details.

2. FOR THE AVOIDANCE OF DOUBT, All landscaping works shall be completed in

accordance with the details required through condition 4 of this consent, and

implemented no later than the first planting season following completion of the

development hereby approved.

3. Prior to the occupation of any unit within an identified phase indicated on the approved

`Phased Site Plan' all the parking within that phase shall be provided at no less than the

numbers indicated. FOR THE AVOIDANCE OF DOUBT the requirements of conditions

1, 2 and 6 of this consent will require to take cognisance of the approved `Phased Site

Plan' in agreeing how works should be implemented.

4. Prior to works commencing on site, the developer shall submit a Scheme of Works for

the prior written approval of this Planning Authority designed to mitigate the effects on

sensitive premises of dust, noise and vibration during the construction of the hereby

approved development. This shall be in accordance with BS5228: Part 1 :1997 "Noise

and Vibration Control on Construction and Open Sites" as well as BRE publication

"Control of Dust from Construction and Demolition Activities". Once approved in writing

by this Planning Authority, the construction shall be implemented as per the approved

Scheme of Works.

5. Prior to the building hereby approved being brought in to use, a detailed lighting scheme

shall be submitted for written approval by this Planning Authority. Once approved in

writing, the lighting scheme shall be installed and operated to the satisfaction of this

Authority for the life time of this development, prior to the units opening to the public.

6. BEFORE ANY WORKS BEGIN ON SITE, a comprehensive surface water drainage and

SUDs plan shall be submitted for the approval in writing of the Planning Authority. The

provision must comply with the advice set down in Fife Council's Flood Liaison and

Advice Group Guidance Note on Flooding and Drainage Issues in relation to Planning

and Development. FOR THE AVOIDANCE OF DOUBT, any approved scheme shall

henceforth be completed in accordance with the plan in advance of opening the

commercial units to the public.

7. The access bellmouth from the public road shall be constructed in accordance with the

current Fife Council Transportation Development Guidelines (TDG). A minimum throat

width of 6 metres with 6 metres radius kerb shall be provided and constructed in

accordance with the current TDG.

8. A new 2 metre wide footpath link designed, constructed and illuminated in accordance

with the Fife Council Transportation Development Guidelines shall be provided from

Linburn Place into the site to the satisfaction of the Head of Transportation Services.

9. A new 1.8 metre wide footway and its ancillary vehicular crossing shall be provided on

Inchkeith Drive along the frontage of car park 4 in accordance with the current Fife

Council Transportation Development Guidelines and as shown coloured blue on the

relevant plan (plan to be forwarded once it has been submitted).

10. There shall be provided within the curtilage of the site a turning area for vehicles suitable

for use by the largest size of vehicle expected to visit or be used by occupants of the

premises. The turning area shall be formed outwith the parking areas.

11. The construction and delineation of the parking, manoeuvring, servicing, turning and

access driveway areas shall be to the satisfaction of the Development Manager

(Development Services).

12. Visibility splays 4.5m x 90m shall be provided and maintained clear of all obstructions

exceeding 0.6 metres in height above the adjoining road channel level, at the junction of

the vehicular access and the public road, in accordance with the current Fife Council

Transportation Development Guidelines.

13. Within two months of planning consent being granted, revised plans detailing the

provision of 2 No bus shelters at the two bus stops on the Linburn Road frontage of the

site shall be submitted for approval by the planning authority. The applicant shall consult

with Transportation Services regarding the exact locations and specific requirements for

the bus shelters, associated hardstand areas and other ancillary works, prior to the

submission of the revised plans. The parking spaces on the Eastern boundary of the

site will have to be relocated 1 metre further West in order to accommodate an enclosed

shelter, hardstand and a dwarf wall on the West side of Linburn Road.

14. The 2 No bus shelter shall be provided on site to the satisfaction of the planning

authority, prior to any of the retail units coming into use.

15. The existing 'L-shaped' section of public footpath at the Inchkeith Drive frontage of the

site (as shown coloured green on the relevant plan shall be deleted from the Fife Council

List of Public Roads under the Town and Country Planning (Scotland) Act 1997.

Reason(s):

1. In the interests of visual amenity; to ensure that adequate measures are put in place to

protect the landscaping and planting in the long term.

2. To ensure landscaping works are completed at an appropriate stage in the development

of the site.

3. To ensure the site is phased in an acceptable manner, and to prevent any adverse

impacts on neighbouring amenity and road safety.

4. In the interest of minimising the impact on residential amenity during construction.

5. In the interest of minimising anti-social behaviour and to allow consideration to be given

to details which have yet to be submitted.

shall notify this Planning Authority at the stages listed below in order to obtain their

(b) When the roof trusses have been erected but before roof covering takes place.

3. BEFORE ANY WORKS START ON SITE, details of the proposed grass seed to be

planted on the roof and its future management and aftercare shall be submitted for

approval in writing by this Planning Authority. Thereafter the management and

aftercare of the grass roof shall be carried out in accordance with these approved

details for the lifetime of the dwellinghouse.

4. BEFORE THE DWELLINGHOUSE IS OCCUPIED, full details of all boundary

treatments shall be submitted for approval in writing by this Planning Authority.

Thereafter the development shall be carried out in accordance with these approved

details. FOR THE AVOIDANCE OF DOUBT, the proposed boundary treatments shall

incorporate the following :-

(a) Northern boundary - the existing stone wall with railings, as delineated in GREEN

on the stamped approved site plan, shall be retained for the lifetime of the

dwellinghouse hereby approved.

(b) Eastern and Southern boundary - the existing timber fence, as delineated in

YELLOW on the stamped approved site plan, shall be removed and replaced with a

random rubble stone wall in-keeping with the existing stone wall on the northern

boundary.

(c) Western boundary - 1.8 metre high close boarded fence, along the line marked

BLUE on the stamped approved site plan.

5. All bathroom windows shall be obscurely glazed upon installation and thereafter

maintained as such for the lifetime of the dwellinghouse.

6. Notwithstanding the provisions of the Town and Country Planning (General Permitted

Development) (Scotland) Order, 1992 (or any Order revoking and re-enacting that

Order) no development within Classes 1 to 7 shall be undertaken without the express

prior consent of this Planning Authority.

7. That the driveway adjacent to the dwellinghouse shall have a minimum depth of 10.5

metres and shall be constructed to the satisfaction of the Planning Authority at a

gradient not exceeding 1 in 10 (10%) and shall have appropriate vertical curves to

ensure adequate ground clearance for vehicles, PRIOR TO THE OCCUPATION OF

THE DWELLINGHOUSE.

8. BEFORE THE DWELLINGHOUSE IS OCCUPIED, 2 off-street parking spaces shall

be provided within the curtilage of the site in accordance with the current Fife Council

Transportation Development Guidelines and thereafter maintained and kept available

as such for the lifetime of the dwellinghouse.

9. That all boundary markers adjacent to the private access shall be maintained at a

height not exceeding one metre for the lifetime of the dwellinghouse.

Reason(s):

1. In the interests of visual amenity; to ensure that the proposed development does not

detract from the setting of a Category C Listed Building.

2. To enable this Planning Authority to establish that the development is commencing

from the correct level based on an agreed fixed datum point; and

(a) In order to ensure that site works are progressing in accordance with the stamped

approved plan.

(b) In order to ensure that the floor levels conform to the stamped approved plan

illustrating floor levels.

(c) In order to ensure that the height of the roof conforms to the stamped approved

plan.

public roads., Thereafter any such scheme as approved shall be provided

CONCURRENT WITH THE COMMENCEMENT OF WORKS ON SITE, and

thereafter be maintained throughout the construction phase of the development.

5. BEFORE THE OCCUPATION OF THE FIRST LOG CABIN IS COMMENCED, the

existing road from the junction of the B996 to the site access should be widened to a

minimum of 5.00m from the junction of the B996 unless otherwise agreed in writing

with the Planning Authority. BEFORE ANY WORK STARTS ON SITE, the applicant

shall provide a scheme for the upgrade of the road from the junction of the B996 to

the site access for the Prior written approval of the Planning Authority.

6. BEFORE ANY WORK STARTS ON SITE, a comprehensive landscaping scheme

shall be submitted for the prior written approval of the Planning Authority. Any

scheme as submitted shall include:

(I) A detailed landscape design layout including a detailed Plant species list;

(ii) Plant specification to include plant sizes:

(iii) Planting densities and Planting specification;

(iv) Detailed proposals for the long term maintenance of the landscaping scheme.

Any such scheme as approved shall be fully implemented during the first planting

scheme following the completion of the 4th Log Cabin and fully implemented the first

planting season following completion of the 8th Log Cabin or within 12 Months of the

commencement of the landscaping implementation whichever is the sooner. The

maintenance regime shall be implemented with the commencement of the landscape

planting works.

7. BEFORE ANY WORK STARTS ON SITE, details of the external colour/ stain of the

log cabins along with an ongoing external maintenance regime shall be submitted for

the prior written approval of this Planning Authority. Prior to the occupation of each

log cabin it shall be externally treated as per the approved detail and it shall

immediately activate the commencement of the maintenance regime relevant to it.

8. BEFORE THE OCCUPATION OF THE 5th LOG CABIN, the play area shall be fully

installed and thereafter so maintained in perpetuity. BEFORE ANY WORK STARTS

ON SITE, details of a maintenance regime shall be submitted for the Prior written

approval of the Planning Authority. Thereafter any such scheme as approved shall be

fully implemented.

9. The Log Cabins shall never be occupied as a main or sole residence or permanent

residential accommodation and shall operate only as holiday accommodation.

10. Any period of continuous holiday stay within the Log Cabin development shall be

restricted to a maximum occupancy period of 8 weeks, and must not be re-occupied

by the same individual for a period of 7 days.

11. Notwithstanding the restrictions of condition 10, Log Cabin usage which is for

weekend use only (Friday to Monday) will not be bound by such restriction.

12. Documentary evidence in the form of a detailed register shall be retained by the site

operator and made available to this Planning Authority on request demonstrating

compliance with the occupancy restrictions imposed by conditions 9, 10 & 11 of this

consent for each of the Log Cabins located on site. Within 8 weeks of the date of this

consent, the applicant shall agree in writing the detail to be recorded within the

register and thereafter the register shall be maintained in perpetuity, unless otherwise

amended by the Express Planning Consent of the Planning Authority.

13. This consent hereby approved in no way alters the restrictions imposed by conditions

in relation to planning permissions 01/01753/WFULL (Private Stables) and

03/00395/WFULL (Private Golf Course), and therefore cannot function commercially

as part of the Log Cabin development without the further express consent of the

Planning Authority.

Council as Planning Authority.
