2 NEWS 7 SEPTEMBER 2012

Between 17 and 21 September 2012, attorneys participating in the National Wills Week will draft basicwills free of charge. Only a new basic will will be drafted - no amendments to existing wills. Anappointment must be made with a participating attorney or firm. Why must you have a will?

By making a will you ensure that your assets are disposed of in accordance with your wishes after yourdeath. This privilege is called “freedom of testation”.

Why should an attorney draft your will?

Attorneys are professionals qualified in law. An attorney can advise you on any problem which mayarise with regard to your will.An attorney has the necessary knowledge and expertise to ensure that your will is valid and complieswith your wishes.Often a will is not valid because the person who drafts it does not have the necessary legal knowledgeto ensure that the requirements of the law are met.

What happens to your estate if you die without a valid will?

If you die without leaving a valid will, your assets will be distributed according to the provisions of theIntestate Succession Act.The provisions of this Act are generally fair and ensure that your possessions are transferred to yourspouse and children.

BUT, the following problems may arise if you die without leaving a will:

• Your assets may not be left to the person of your choice. • It can take a long time to have an executor appointed. The executor who is appointed may besomebody you may not have chosen yourself. • There can be extra and unnecessary costs.• There can be unhappiness and conflict among members of your family because there are no clearinstructions on how to distribute your assets.

Even if you do notplan to die, doyou have a will?Limpopo

Spring Day 1 September 2012 saw the residents of theMagimeng Village near Steelpoort benefitting from anotherThorburn social investment initiative.Water supply to residents is problematic and the generalsupply is from a single water point (manually pumpedborehole) into 25 liter containers and transporting a maximumof two containers on a wheelbarrow – uphill and downhill.Local Eastern Limb mining security services provider ThorburnSecurity Solutions designed a “Thorburn Karretjie (pull or pushcart)” which would ease the problem for many residents. Basedon the principle of a trailer, this “Thorburn Karretjie” can carry15 water containers (maybe more) and is pushed or pulled, allowing ample handle space for two people to push or pull. Ifnot used for water transportation it could be used for any formof transport – a “spaza shop on wheels”, funeral supportcarrier, wood carrier or whatever needs to be transported andmanually pushed or pulled. An entrepreneur would collect water cans, fill and deliver for afee!Over the past 6 years Thorburn Security Solutions embeddedthemselves in the Eastern Limb of the Bushveld Complex andhas grown in product, services and community support staturewith a recent expansion in services to Platinum Australia atSmokey Hill. Not long ago bread, blankets and beanie hatswere donated in Maandagshoek near Driekop in the miningareas of Modikwa Platinum Mine, Dilokong Mining, MooihoekChrome Mine and Platinum Australia as part of a ThorburnWinter Ice Breaker Project. The “Thorburn Karretjie” was in the absence of the MagimengVillage Chief Kghosi Petrus Maroga accepted by his wife MeSophy Maroga.

Two Rivers Platinum near Steelpoort, wherethe emerging Association of Mineworkersand Construction Union (AMCU) has beenthe majority labour union for the past 18months, is the best-cost producer on theeastern limb of the Bushveld Complex, withexcellent output, Mike Schmidt, CEO of theblack-controlled African Rainbow Minerals(ARM) says.

Schmidt told the publication MiningWeekly Online in an interview this week thatfigures for the period showed that unit costsrose 18% at ARM’s National Union ofMineworkers- (NUM-)dominant Modikwaplatinum operation - where there was a five-week strike and two fatalities - while unitcosts at the AMCU-dominant Two Riversrose only 6%, with 5% of it the result ofgeneral inflation.

ARM reported that Two Rivers performedwell operationally, increasing tons milled by5% and lifting platinum-group metals(PGMs) production to 320 113 oz , 12 951oz more than in the previous financial year, while Modikwa performed badlyoperationally, decreasing tons milled by 5%and lowering PGMs production to 304 044oz, 15 292 oz less than in the previous year.

Schmidt said that ARM worked well withAMCU.

“Two Rivers continues to be the best-cost producer, with very, very good output, and it’s AMCU-dominant,” he told thepublicationsaid.

On union representation at the rest ofARM’s operations being NUM-dominant,Schmidt added: “We also have a good long-standing relationship with NUM, which hasdeveloped a high level of maturity and we’revery comfortable with them as a union.”

The diversified ARM, which is headed byexecutive chairperson Patrice Motsepe, isinvested in PGMs, nickel, chrome, iron-ore,manganese, coal and gold. Although as arule labour unions required 30% workermembership to gain employer recognition, atsome ARM operations the recognitionthreshold was as low as 15%.

Where friction and infighting took placewas at operations where the recognitionthreshold was 50% plus one.

“We need to question whether that’shealthy and whether that should not berevisited,” Schmidt commented. While heconceded that the rise of AMCU to theposition of majority union at Two Rivers was

“not without pain”, he believed that the closerelationship of management with therelatively small 2 500-strong workforce didmake a difference. While, ideally, employerswould prefer not to have to deal with morethan one union in the same bargaining unit,it was process that they had no option but toaccept.

“Other than Modikwa, which is a labour-intensive operation, most of our operationsare either opencast or mechanised and havevery well experienced and competentpeople, so our labour component is wellmanaged,” Schmidt said at this week’spresentation of results.

Overall, Modikwa contributed less than5% to earnings and ARM would becomfortable with an exposure of double thatwithin the labour-intensive space. At thecurrent rate of production, ARM would beable to mine at Modikwe for another 100years and by doubling that responsibly, itcould still mine there for more than 40 years.

ARM depends on labour for less than40% of its earnings component and otherthan at Modikwa, it employed no rock drilloperators. On the opportunity for greatermechanisation, Schmidt said the degree to

which a mine could be mechanised wasorebody dependent. The mechanised TwoRivers, an underground bord-and-pillaroperation, had an exceptionally high outputper person as the lowest-cost producer onthe eastern limb.

Dr Thobakgale said: “I think the problem, is that there are not so many authors forsoapies and that is why they are repeated. All languages must be equal. We must haveSouth African programmes and ones from outside”. With him are Balokile andItumeleng.

Mr Elvis Mhlongo said: “They aresupposed to put new programmes ontelevision. They must use the Africanlanguages. I want programmes from hereand overseas”.

Mr Calvin Matjeke said: “They have tochange the way SABC is at the moment. Iwant a better mix of South African andoverseas programmes. It is fine if theprogrammes are in English”.

Mr Makhushi Mafologela said: “I am finewith them repeating the programmes theybroadcast. They cater for those peoplewho worked night shift by showing it inthe morning again. They are taking theirviewership into consideration”. Mr David Matemane said: “They must be

creative and not always repeating theirprogrammes. They need to think aboutnew things. It is boring people if theyrepeat programmes. People then rathergo to the DSTV channels. The presentsystem for languages is fine. English is amedium of instruction”.

Me Joey Vorster sê: “Ons is baieongelukkig daaroor dat hulle alles so baieherhaal. ‘n Mens betaal ten duurste jou TVlisensie en dan moet jy môre weer nadieselfde goed kyk. Hier by ons het jy ooknog ‘n satellietskottel nodig om na TV1, 2en 3 te kan kyk en dit kos jou ook nogR600 - net om herhalings te sien. Disbloedgeld!”

Mr Bennett Malatjie said: “SABC repeatsGenerations too much. They must makemore South African programmes. I alsowant more soccer”.

Mr Bongani Ndlovu said: “I want otherstories. I don’t want repeats. To see whathappened yesterday again and again isnot good. They must bring us new storiesin English. It does not matter if thestories are from here or overseas”.

Mr Elmon Mahlangu and Ms Sinkey Mahlangu said: “It must be different from what it isnow. Even on Saturdays they show repeats of programmes. You see Generations atnight, during the day and on Saturdays! Languages are not a problem, it can be as it isnow”. With them is Dima Mahlangu.

Left: Mr Andries Mkhawane and Mr Piet Mkhawane said: “They must stop repeatingover and over. They say it is because of popular demand, but we think it is because ofbad management. They don’t indicate PG (parental guidance) or warn of bad things. The other day we watched Muvhango with our small children and in that episodesomeone was raped. They did not warn us that there will be disturbing scenes”.

A study by Media Monitoring Africa between 1April and 15 May this year showed that theSABC TV channels and selected radio stationsrelied heavily on repeating programmes to filltheir broadcasting schedule.According to the report’s findings SABC 1 used28% of its broadcasting time on repeats, SABC2 21 % and SABC 3 15%. When sport and newsare excluded from what counts as local content59% of what was seen on the three channelswere local programming.According to their broadcasting licenserequirements SABC1 and SABC2 as publicservice stations are required to provide viewerswith at least 55% local content between 4amand 11pm every day. SABC 3 is required toshow 35% local content as it is treated as acommercial station.English was found to be the dominatinglanguage on these channels with about 76%of programmes in English. Afrikaans makes upabout 6% and other languages approximately3% each.We asked readers what they think about thesefindings and the way the SABC presents themwith programmes. We also asked what theywould like to see more of on SABC TV.

Mr Potloza Lekgeu and Ms Georgina Lekgeu said: “We are not satisfied with all therepitition. They don’t have much Sepedi and Afrikaans on SABC. They useprogrammes from overseas like the Bold and the Beautiful over and over. They mustmake more local programmes. We must pay our TV licences as it is the right thing todo. They must increase educational programmes in all languages”.

Mnr Jacob Molzawo sê: “Ek wil meerSwazi op TV hê. My kind hoor nie daaitaal iewers anders as by die huis nie. Ekis nie ge-worry oor die stories nie”.

Mr Danny Ngwendana said: “It is not goodto repeat things every day. They mustcome with new programmes. People don’twant to buy TV licenses because theyrepeat every day on the SABC channels. They must balance all languages to suitall people”.

Mnr. Stefan Pienaar en me. Chelsea Ferreira sê: “Ons kyk glad nie na die SABC kanalenie. Ons kyk eerder DSTV. Hulle moet dalk meer Engels op die SABC kanale sit”. Byhulle is Duané Ferreira.

Mr Goodwill Motene said: “There are oldpeople and people who did not go toschool that cannot understand English orAfrikaans. Then they watch TV and peopleadvertise things but they only advertise itin English or Afrikaans. The old peoplethen see something that they like butcannot understand what is being said. Iwant advertisements in other languages. They must balance it. I don’t want them torepeat stories more than twice on TV”.

Mr Thabo Mmole said: “They must changethe repeating situation. Repeating toomuch is not right. I would like more newsand want stories from overseas andSouth Africa”.

Mr Andrew Mjhoka, Mr Richmond Mosoma, Mr James Moretsele and Mr Jabu Kopotsasaid: “We want more local languages on SABC. We are tired of them repeating thestories.
