Development requiring consent (Part 4)
• Development application (DA) required• Statement of Environmental Effects (SEE)• Consent authority (usually Council) makes
decision
Planning Controls - overview
Complying Development• Project must meet required development
standards (in Infrastructure SEPP and EP&A Act and Regulation)
• Requires certification by an accredited certifier
BER examples: school halls, 2 storey classrooms
Planning Controls - overview
Development not requiring consent• Does not require a DA• Requires a Review of Environmental
Factors (REF)• The proponent (DET delegated officer)
determines the applicationBER examples: libraries, COLAs over new
playgrounds, replacement classrooms, toilet blocks, admin buildings
Planning Controls - overview
Exempt development• No Development Application (DA)• No environmental assessment (eg SEE or REF)• Must comply with BCA and all planning and
environmental legislation
BER examples: refurbishments, awnings over existing spaces (not COLAs over new playgrounds or outdoor learning areas)
Another planning pathway for BER projects
• Nation Building and Jobs Plan (State Infrastructure Delivery) Act 2009(NBJP Act)
To be used as last resort!!
Environmental management of construction
• Required for all works – Environmental Management Plans (EMPs) should reflect project risks and the scale of works
• Your planning approval should give you conditions that will be required for construction of your project
Tips
• The planning approval process is an important step in the critical pathway for project success
• Obtain Section 149 Planning Certificates from Council ASAP
• Use experienced town planners to assist in choosing the right approval pathway and in preparing the assessments and applications required
• Ensure that your construction contractor has prepared a site specific environmental management plan and uses it!
