    Clerk Israel commented:

    The report submitted to the Board of Trustees for payables is not going to change.

    For additional information contact the Finance Department to review payables information prior to the Board of Trustees meeting.

    Supervisor Grewal gave thanks to the Chair of the Historic District Commission for all her hard work.

    Supervisor Grewal inquired about the age of the failing HVAC roof top unit at the Parks & Recreation Building.

    Director Kurt Weiland commented that the unit has been in place since approximately 1983.

    Trustee Yi inquired about the brand name of the replacement HVAC unit.

    Director Kurt Weiland commented that the brand name is Bryant.

    Trustee Yi inquired whether the addition of CO2 sensors was necessary.

    Director Weiland commented when that the area is not occupied the sensor can detect that and stop that using energy to pump fresh ventilation into the area.

    11.5 Approve the purchase of replacement Fire Engine/Pumper. (Agenda Item Removed)

    11.6 Adopt a resolution to amend the 2012 Parks Millage Budget, 2012 Refuse Budget and 800MHz Budget Res # 12-48.

    Moved by Clerk Israel, supported by Trustee Hunt to adopt Resolution #12-48; a resolution to amend the 2012 Parks Millage Budget, 2012 Refuse Budget and 800MHz Budget.

    Trustee Krone inquired about background information on the resolution.

    Supervisor Grewal commented that Resolution #12-48 is amending 2012 budgets by moving funds around within each of these fund balances to meet statutory requirements.

    Trustee Krone inquired about the suspension of the Saline Sustainability Circle.

    Supervisor Grewal commented the Saline Sustainability Circle has not officially dissolved and the Township has not received any notification.

    Supervisor Grewal commented:

    Administrations priority is making the previously purchased park land accessible to residents.

    High demand for soccer fields at the AAYSA park land.

    Platt Road Park improvements.

    Funding Sources for park improvements.

    11.11 Approve agreement between Recycle Ann Arbor and Pittsfield Charter Township for services associated with the Clean-Up Voucher Program, subject to Township Attorney approval.

    Moved by Trustee Hunt, supported by Treasurer Scribner to approve agreement between Recycle Ann Arbor and Pittsfield Charter Township for services associated with the Clean-Up Voucher Program, subject to Township Attorney Approval.

    Supervisor Grewal commented:

    Advertisement of the Recycle Ann Arbor for Clean-Up Day Voucher Program.

    More proactive use of tax payers dollars and more environmentally responsible.

    Trustee Krone inquired about the estimated cost for the voucher program.

    Director Lyon commented that cost per vehicle is estimated around $23.00 per vehicle based on volume and number the Township experienced during the Clean-Up programs.

    Trustee Krone inquired if it cost $3.00 per vehicle today how did the Township arrive at an estimated cost of $23.00 for the Township.

    Supervisor Grewal commented that this is a free service to the residents and the $23.00 will be funded by the Township.

    Director Lyon commented that the cost is based on an average volume and that volume is much greater than what a person can take to Recycle Ann Arbor.

    Supervisor Grewal commented:

    Residents feedback stated they can actually use the service and dont have to be limited to two calendar days to recycle items.

    Numbers increasing in usage can bring down cost to the Township in 2014.

    Trustee Krone inquired about the estimated usage of this voucher program by the residents.

    Director Lyon commented that numbers will be 500-700 cars equivalent to previous years Clean-Up Day programs.

    11.12 Approve selection of EFI Actuaries Consultant to complete Actuarial Study of Other Post-Employment Benefits (OPEB) for Pittsfield Charter Township, year ending December 31, 2012.

    Moved by Clerk Israel, supported by Trustee Krone to approve selection of EFI Actuaries Consultant to complete Actuarial Study of other Post-Employment Benefits (OPEB) for Pittsfield Charter Township, year ending December 31, 2012.

    Trustee Lotfian inquired about the age requirements for medicate benefit eligibility.

    Supervisor Grewal commented that the report is a sample and was provided to the Township to view.

    Patricia Denig commented that EFI Actuaries Consultant submitted a sample report to give the Township a preview of an actuarial study.

    11.13 Authorize the Supervisor and Clerk to sign the amended service contract CR 43353, subject to Township attorney approval, between Pittsfield Charter Township and Washtenaw County for allocation of Urban County CDBG funds for the Mid-Block Crossing on Carpenter Road.

    Moved by Treasurer Scribner, supported by Clerk Israel to authorize the Supervisor and Clerk to sign the amended service contract CR 43353, subject to Township attorney approval, between Pittsfield Charter Township and Washtenaw County for allocation of Urban County CDBG funds for the Mid-Block Crossing on Carpenter Road.

    Supervisor Grewal commented:

    Centennial Commons previous usage as a private park.

    Donation of 50 acres of park land.

    Previous administration spent millions of dollars on purchasing land.

    Park land accessibility to residents within the Township and regionally.

    Park land amenities.

    Clerk Israel commented that this addition will help the Townships standing for grants for the non-motorized parkways.

    Trustee Yi inquired about the future plan for the donated park land, expansion of the parking lot and the taxes accumulated from the developer.

    Supervisor Grewal commented the Township is determining whether or not to move forward with the donation of Centennial Commons park land.

    Trustee Yi inquired about the current taxes being collected for this property.

    Supervisor Grewal commented that tax information can be obtained from the Treasurers department.

    Treasurer Scribner commented that the vote today is to get things started with the donation.

    Supervisor Grewal commented that time frames are subject to the approval of the donation.

    Trustee Yi inquired about the maintenance costs to maintain this park land are.

    Supervisor Grewal commented that maintenance cost will be determined by which amenities the Township decides to include.

    Trustee Krone commented about transfer costs with the developer for the acceptance of the land.

    Supervisor Grewal commented:

    Developer is expecting $0 from the Township.

    Cost included in resolution language is for the board consideration.

    Clerk Israel commented:

    Taxes assessed to the land.

    Wetland is not buildable and used strictly as park land.

    13.1 First Reading: Resolution approving an Ordinance to amend the Pittsfield Charter Township Water and Sewer Ordinance, Ord. # 300, Revisions to Chapter 36 Utilities, Article V. Cross Connections, Section 36-151 through 190.

    Moved by Trustee Krone, supported by Clerk Israel to receive on First Reading: Ordinance #300 an Ordinance to amend the Pittsfield Charter Township Water and Sewer Ordinance, Ord. #300, Revisions to Chapter 36 Utilities, Article V. Cross Connections, Section 36-151 through 190.

    Director Lyon gave background on Cross Connection Ordinance.

    Backflow connection that can lead into the Township clean water and cause contamination.

    Failure of irrigation systems.

    Cross connection protects the clean drinking water system.

    Cross Connection Ordinance being consistent with the DEQ and universal plumbing codes.

    Primary function is industrial

    Inspections are required to have backflow prevention.

    Trustee Yi inquired about the inspection of residential homes in relation to the Cross Connection Ordinance.

    Director Lyon commented that inspections will primarily focus on commercial property the greatest threat.

    Director Lyon stated that residential homes can be inspected for cross connections but will not have a mandatory yearly inspection. They are required to have a back flow prevention system.

    Trustee Yi inquired that about the possibility of the language being changed to state industrial users are the main concern and not include residential.

    Director Lyon commented that the language is generic due to all connections posing a possible threat to the system.

    Trustee Yi commented:

    Future inspection of residential homes.

    Cost to residents for inspections.

    Supervisor Grewal commented that all corrections will go to the Township attorney for recommendation.

    Clerk Israel commented:

    Township has to have the right to inspect cross connections in residential areas.

    Cost is greater to re-sanitize the water than to inspect every Township home.

    Director Lyon commented that Pittsfield Charter Township currently has a Cross Connection policy in affect.

    Trustee Lotfian inquired where there will be a need for an additional employee for inspections if this ordinance is adopted.

    Director Lyon commented that all existing employees will be used for inspections.

    Trustee Yi inquired about the cost for fixing a failed cross connection.

    Director Lyon commented that the homeowner will have to replace the irrigation systems by default if the cross connection fails.

    Winter Tax Bill Update 12/12/12 Winter Bills were issued on December 1st residents have until February 14th to

    make payments without interest or penalty.

    As a friendly reminder, please make a note that Pittsfield Charter Township

    offices will be closed from Monday, December 24, 2012 through Tuesday, January

    1, 2013. We will re-open at 8:00 a.m. on Wednesday, January 2, 2013.

    By popular demand, the complimentary payment services at all Bank of Ann Arbor

    and two TCF Bank locations along with our online payment options will continue.

    Over 500 residents used these options to make their tax payments since July of this

    year.

    Last year after the closure our office was able to enter the payments received

    during the closure in a timely fashion and we anticipate that it will go even

    smoother this year.

    I appreciate my staff, Orna, Kris, and Melissa, who go above and beyond to make a

    positive experience for our residents.

    The following preamble and resolution were offered by Clerk Israel and supported by Trustee Krone.

    WHEREAS the private developers of the Centennial Park and Centennial Farms subdivisions retain legal title to approximately 50 acres of improved private park land, located along the southern portion of Textile Road between State Road and Lohr Road; and

    WHEREAS in addition to the approximate 50 acres, this park land contains over $100,000 in existing park improvements, including childrens playgrounds, basketball court, soccer field, disc golf course, nature and exercise trails, a pavilion, parking areas, and other significant improvements; and

    WHEREAS the original park covenants provide that the developers reserve the right to grant the park lands to the township for use as a public park on or before all respective subdivision lots are completely developed; and

    WHEREAS the developers have offered to donate the land to the township for use as a public park, available to all Pittsfield Charter Township residents for their use and recreation;

    Sec. 36-152. - Definitions. 28

    The following words, terms and phrases, when used in this article, shall have the meanings ascribed to 29 them in this section, except where the context clearly indicates a different meaning: 30

    Department means the township utilities departmentDepartment of Utilities and Municipal Services and 31 the township Bbuilding and zoning Ddepartment, acting singularly and jointly as one department. 32

    Sec. 36-153. - Enforcement. 34

    This article shall be enforced by the department. The township board by resolution shall designate those 35 persons within the department who are authorized to enforce this article and issue and serve 36 appearance ticketsmunicipal civil infraction citations for violations of this article. 37

    Sec. 36-154. - Premises subject to article. 39

    (a) The following premises which are provided water service by a public or private water system, upon 40 which exist or proposed to exist any of the following systems or conditions, are subject to this article: 41

    (1) A secondary water supply; 42

    (2) A water treatment system; 43

    (3) A boiler; 44

    (4) A commercial or industrial process or equipment which uses water; 45

    (5) A sewage liquid waste or solid waste treatment or process system; 46

    (6) A lawn irrigation system; 47

    (7) A location that supplies potable water for mobile units for cleaning or transport; 48

    (8) A temporary water service; 49

    (9) A wet fire protection system; and 50

    (10) Any premises where contamination exists, or conditions exist, or are substantially likely to 51 occur, which are, or reasonably likely to pose, a threat to the public water supply, being injurious to 52 the public health, safety and welfare. 53

    (b) Except as provided in subsection (a)(10) of this section, the following premises are not subject to 54 this article: 55

    (1) Any premises that contains only structures not exceeding two stories in height and utilizes 56 only such plumbing fixtures as drinking fountains, lavatories, water closets and urinals, or 57 appliances such as residential dishwashers or residential clothes washing machines. 58

    (2) A boiler, at a residential structure, serving less than six dwelling units, which utilizes no 59 chemical treatment. All properties served by the public water supply are subject to provisions of 60 this article including, but not limited to, Residential, Commercial and Governmental. 61

    Sec. 36-155. - Potable water contamination; right of entry; inspections. 63

    When the department is notified, or has reasonable cause to believe, that contamination or alleged 64 contamination of potable water may exist at any premises, the department is authorized to enter any 65 premises within the corporate limits of the township for purposes of investigation and shall take 66 necessary or proper action to protect the public health, safety and welfare. The department shall cause 67 inspections to be made of all properties served by the public water supply where cross connections with 68 the public water supply are deemed possible. The frequency of inspections and re- inspections based 69 on potential health hazards involved shall be as established by the township utilities department and as 70 approved by the state dDepartment of public health. Environmental Quality. The department shall have 71 the right to enter at any reasonable time any property served by a connection to the public water supply 72 system of the township for the purpose of inspecting the piping system for cross connections. On 73 request, the owners, lessees or occupants of any property so served shall furnish to the department any 74 pertinent information regarding the piping system on such property. The refusal of access, when 75 requested, shall be deemed evidence of the presence of cross connections. 76

    Sec. 36-156. - Certificate of compliance. 78

    (a) Site plan review. The township clerk shall notify the township utilities department of all matters 79 before the township planning commission and township zoning board of appeals that pertain to 80 premises being subject to this article. The department may review all applications and plans submitted 81 to the planning commission or zoning board of appeals and submit a written report to the respective 82

    (b) Building and plumbing permits; certificate of occupancy. The department shall review all 85 applications for building and/or plumbing permits for construction, repair or alteration to assure that the 86 application is in compliance with this article. The department shall not issue a building or plumbing 87 permit in violation of this article, nor shall a certificate of occupancy be granted until a certificate of 88 compliance, as provided for in subsection (e) of this section, has been issued. 89

    (c) Plans, specification, information. The department may require an applicant for site plan review, 90 variance, building or plumbing permit to provide complete sets of plans and specifications of the piping, 91 devices, equipment, building and uses that may be necessary or proper to determine the applicant's 92 compliance with this article. 93

    (d) Authority to conduct tests. Prior to the issuance of a certificate of compliance, the department is 94 authorized to conduct, or cause to be conducted, or require an owner to have conducted, any tests of 95 any new or existing piping, arrangement, device, equipment, facility or appurtenances the retention of 96 which the department has reason to believe may result in contamination of potable water, or when the 97 department has reason to believe that there is evidence that cross connections do not meet the 98 limitations prescribed in this article, or at a prescribed frequency to ensure proper functioning of 99 protective devices or methods. Tests shall be conducted by persons certified by an organization 100 approved by the department. A full written record of test conditions, of test methods, and of test results 101 obtained by the department, or by others, shall be maintained by the department and made available for 102 review by the owner. 103

    (1) Test facilities and access. It shall be the responsibility of the owner of the operation tested to 104 provide, at his expense, reasonable and necessary openings in the piping system, appurtenances, 105 equipment or facilities, and safe and easy access to the system, to permit technically valid 106 measurements and samples to be taken. All new piping equipment or facilities that provide 107 potential for cross connection may be required by the department to provide adequate openings in 108 the piping system, appurtenances, equipment or facilities, and safe and easy access to the 109 system, to permit technically valid measurements and samples to be taken. If a person refuses to 110 supply test openings, access scaffolding, and other pertinent facilities requested for the purpose of 111 conducting valid hydraulic tests by the department, the department shall notify such person to 112 show cause before the department on a day certain, not less than ten nor more than 20 days from 113 the date of the notice, why piping or appurtenances, equipment or facilities should not be sealed. 114

    (2) Sampling. The department is authorized to sample or cause to be sampled water or other 115 fluid flowing in, or having potential for flowing in, any piping system subject to this article. 116

    (e) Certificate of compliance. Upon completion of the work authorized by an issued building or 117 plumbing permit for work and premises being subject to this article, the department shall issue a 118 certificate of compliance, which certificate shall state that the premises are in compliance with this 119 article. The owner or person responsible for the new, expanded or altered piping systems, devices, 120 equipment or facility shall notify the department when the work is completed and ready for final 121 inspection, which inspection shall be made promptly after such notification. 122

    Sec. 36-157. - Survey. 124

    The township utilities departmentDepartment of Utilities and Municipal Services shall identify all 125 premises and being subject to this article, classify each premises according to degree of hazard to the 126 potable water system, initiate inspections based on the health hazard potential, and issue a certificates 127 of compliance in accordance with section 36-156. 128

    The township utilities department shall cause to be made periodic inspections of all premises and 131 facilities subject to this article. The frequency of inspections and re-inspections shall be based on the 132 potential health hazards as established by resolution of the township board. 133

    Sec. 36-159. - Prohibitions and technical requirements. 135

    (a) Cross connections prohibited. Cross connections between potable water systems and other 136 systems or equipment are prohibited. A secondary water supply shall not be connected to the premises' 137 potable water distribution piping without the approval of the department. 138

    (b) Service connections. The township utilities department is prohibited from installing and/or 139 maintaining a water service connection to a person's premises where a cross connection or secondary 140 water supply is maintained contrary to the provisions of this article, unless the public potable water 141 supply is protected against backflow by installing an approved backflow prevention device or method at 142 the service connection. 143

    (c) Risk of contamination. When the department determines that there is a cross connection or a 144 secondary water supply on the premises, or that the owner is operating the piping system in a manner 145 that could adversely affect the public system, or when the department determines that there are 146 frequent changes to the piping and related equipment, or the department determines that there is undue 147 risk because of complexity of the piping systems, the department shall require the owner, at the owner's 148 expense, to: 149

    (1) Install an approved backflow prevention device at each service connection to his premises; 150

    (2) Install an approved backflow prevention device annually or more often when deemed 151 necessary; and 152

    (3) Properly repair and maintain such devices and keep adequate records of each test and 153 subsequent maintenance and repair, including materials or replacement parts. 154

    (d) Location of backflow prevention device. No connection shall be made to the service line between 155 the meter and the backflow prevention device, except for the meter bypass line connection. If a bypass 156 around the backflow prevention device is installed, a similar backflow prevention device shall be 157 installed on the bypass. If the service is unmetered, the backflow prevention device shall be installed 158 near the property line upstream from the first outlet or branch connection. 159

    Sec. 36-160. - Piping systems identification. 161

    (a) Color code. 162

    (1) In every instance where multiple piping systems exist, all exposed piping carrying potable 163 water shall be uniformly painted a distinguishing bright blue color and so maintained that each 164 pipe may be readily traced in its entirety by such color. All lines that carry secondary water shall be 165 painted brown. In instances where these colors conflict with established systems of painting in a 166 particular establishment, the department may allow the use of other colors of equal brightness and 167 distinction, provided that the alternative color code is submitted to and accepted by the 168 department prior to painting of the pipe. Any color code shall be posted on the premises at 169 locations approved by the department. 170

    (2) Color coding requirements will be deemed to have been met if three-inch bands of blue or 171 brown paint are used at intervals of not more than 25 feet and at points where exposed piping 172 passes through walls, floors or roofs. The bands shall be applied to the piping on both sides of the 173

    walls and both above and below the floor or roof. 174

    (b) Signs or tags. Where maintenance of color coding is impossible, the department may permit use 175 of permanently attached durable sign or tag of acceptable design on each piece of pipe in each line not 176 to exceed 25 feet between signs or tags, and at each valve. The following are acceptable designs: 177

    (1) Secondary water may be indicated by use of a durable tag in the shape of a four-inch 178 equilateral triangle bearing the legend "Water Unsafe" in letters not less than 7/16 inch in height. 179

    (2) Potable water may be indicated by use of a durable circular tag of three-inch diameter 180 bearing the legend "Safe Water" in letters not less than one-half inch in height. 181

    (c) Posting of secondary water supplies. All openings from which secondary water may be obtained 182 shall have at all times a sign prominently posted within two feet of the opening bearing the following 183 warning: 184

    Such sign shall be at least eight inches by ten inches in size, prominently lettered in contrasting colors, 188 with no letters less than one inch in height. Signs are to be furnished and maintained by the owner of 189 the secondary supply and must be of materials and design acceptable to the department. 190

    Sec. 36-161. - Protection of water-supplied equipment. 192

    Any water-using equipment, apparatus or device shall have its water supply protected against 193 contamination by methods acceptable to the department. 194

    Sec. 36-162. - Water piping submerged. 196

    Water piping used to convey potable water shall not be submerged in non-potable water or other liquid. 197

    Sec. 36-163. - Minimum residual pressure. 199

    Under conditions of flow attained through simultaneous use of fixtures, there shall be a residual 200 pressure of not less than eight pounds per square inch measured on the pressure side of the wide-open 201 faucet or valve supplying the highest fixture in the building, except that flush-o-meter valves shall 202 require a minimum pressure of 15 pounds per square inch on the supply side of the valve when in 203 operation. 204

    Sec. 36-164. - Disinfection of potable water system piping. 206

    The department shall require, when necessary, that the potable water system or any part installed or 207 repaired, be disinfected in accordance with the following methods before it is placed in operation: 208

    (1) The system or part shall be thoroughly flushed and then be filled with a solution containing 209 100 parts per million of available chlorine and allowed to stand two hours before flushing and 210 returning to service. 211

    (2) In the case of potable water filters or similar devices, the dosage shall be determined by the 212 department. 213

    (3) When directed by the department, samples shall be collected and analyzed to determine the 214 effectiveness of the disinfection. 215

    Sec. 36-165. - Backflow prevention devices. 217

    (a) Backflow prevention devices and methods. Each device intended for prevention of backflow shall 218 be approved by the department. The design, maintenance and testing procedures, installation 219 requirements, and other features of the device and evidence of effectiveness may be required by the 220 department prior to acceptance. The department may accept devices approved by the state department 221 of public health or meeting the requirements of the American Society of Sanitary Engineering or of other 222 professional or testing organization. 223

    (b) Accessibility. The backflow prevention device shall be located in a well-drained area of sufficient 224 size, not less than eight feet in height, to permit a person to have convenient access for inspection, 225 testing and repair purposes. Installation of the device below grade or in a meter pit is not acceptable 226 unless specifically authorized in writing by the department. Meters and protection devices shall be 227 installed on the supply line within five feet of the point of entry to the structure within the same room. 228

    (c) Maintenance and re-inspection. All devices installed in a potable water system for protection 229 against backflow shall be maintained in good working condition by the owner or his agent. The 230 department may inspect such installed devices and if found to be defective or inoperative shall require 231 its repair or replacement. No device shall be removed from use or relocated or other device substituted 232 without the approval of the department. 233

    234 (d) Testing of Backflow Prevention Assemblies. All testable backflow prevention assemblies shall be 235 tested initially upon installation to be ensure that the assembly is working properly. Subsequent testing 236 of assemblies shall be on an annual basis as required by the Township and in accordance with 237 Michigan Department of Environmental Quality requirements. Only individuals that are registered 238 approved by the Township and State of Michigan certified shall be qualified to perform such testing. 239 That individual(s) shall certify the results of his/her testing. 240

    (ed) Acceptable backflow prevention devices. Only the following devices are acceptable for protection 241 against backflow: Backflow prevention devices shall be in accepted in accordance with the Michigan 242 Plumbing Code and Department of Environmental Quality Cross Connection Rules Manual. Where 243 there is a conflict, the more stringent requirement shall apply. 244

    (1) An approved air gap at the customer service for protection of the public water system. 245

    (2) An air gap on the premises piping system only when specifically authorized by the 246 department. 247

    (3) A reduced pressure principle backflow preventer for all backflow protection conditions, 248 except at a service to a waste treatment plant. 249

    (4) A double check valve assembly for an automatic fire sprinkler system using an antifreeze 250 solution approved by the department and for the following uses specified in the state plumbing 251 code: 252

    a. A low-pressure boiler not subject to chemical treatment. 253

    b. A closed recirculating system used for heating and cooling not subject to chemical 254 treatment. 255

    c. A water softener of the automatically regenerated type. 256

    (5) A barometric loop for a water connection not subject to back pressure. 257

    (6) A vacuum breaker for water connections not subject to back pressure, such as standard 258 plumbing fixtures, laboratory sinks, lawn irrigation system, and those submerged inlets specifically 259 authorized by the department. 260

    (fe) Installation requirements. Backflow prevention assemblies, devices and methods shall be installed 261 in accordance with the requirements of the Michigan Plumbing Code and Department of environmental 262 Quality Cross Connection Control Rules Manual. 263

    (1) Installation requirements for vacuum breakers, atmospheric type. Any atmospheric type 264 vacuum breaker shall be installed on the discharge side of the last control valve and, on open 265 vessels, shall be at least six inches above the flood level rim of the device, or a distance equal to 266 the critical level plus such safety factor as may be specified for any given vacuum breaker by the 267 department. For closed vessels, e.g., pressure sterilizers, etc., the top of the device shall be 268 treated as the flood level rim, but in addition, a check valve shall be installed on the discharge side 269 of the vacuum breaker. 270

    (2) Installation requirements for vacuum breaker, pressure type. Pressure type vacuum breakers 271 may be installed so that they are continuously subject to static line pressure, i.e., a valve may be 272 installed downstream from the vacuum breaker. Pressure vacuum breakers shall be installed a 273 minimum of 12 inches above the equipment or piping served, whichever is higher. 274

    (3) Installation of check valves. All required check valves, including those which are spring 275 loaded, shall be installed so that the force of gravity will assist in closing and holding the disc or 276 clapper on the seat. No check valves shall be installed in the vertical position on downfeed supply 277 piping. Vertical lift check valves shall be installed only in the vertical position on up-feed supply 278 piping. Horizontal lift check valves should only be installed in the horizontal position. If horizontal 279 swing check valves are installed in vertical piping, the direction of normal flow shall be up, and 280 there shall be internal evidence of a hinge pin to establish the type of check valve. 281

    (fg) Safe air gaps. Safe air gaps shall be maintained between the water supply inlet and the maximum 282 overflow level of any fixture, tank or container. Safe air gaps shall be determined as follows: 283

    (1) Circular openings. Circular water supply inlet openings shall have an air gap equivalent to 284 twice the diameter of the orifice, but not less than one inch and need not be more than 12 inches. 285

    (2) Other openings. For water supply openings other than circular, the air gap shall be 2 times 286 the square root of the area of the opening; or in equation form: 287

    G = 2D for circular openings 288

    G = 2 for other openings 289

    (3) Exceptions. On opening greater than four-inch diameter or of equivalent area if the opening 290 is other than circular, the department shall be consulted for minimum air gaps. 291

    (g) Overflow protection for air gaps and vacuum breakers. Air gaps and vacuum breakers shall be 292 installed above the spill line of the fixture or device; or positive spill openings to the outside of the flush 293 tank device. 294

    (h) Installation of reduced pressure principle backflow preventers. A reduced pressure principle 295 backflow preventer shall be installed above grade or at an elevation not subject to flooding, inside a 296 heater structure to prevent freezing, in a horizontal position, and otherwise in accord with the 297 manufacturer's instructions. 298

    (i) Lawn irrigation systems. Lawn sprinkler systems shall be equipped with a vacuum breaker on the 299

    (1) Manifold systems. If a lawn sprinkler system is installed so different areas sprinkled are each 301 controlled by a valve on the discharge side of the main control valve on the main distribution 302 branch to the entire lawn sprinkling system, the system shall be protected by one of the following 303 methods: 304

    a. Area controls. An acceptable vacuum breaker may be installed on the discharge side 305 of each area control valve. 306

    b. Multiport zone control valves. Where the supply of water to the various zones is 307 controlled by an acceptable automatic multiport zone control valve, at least one port of which 308 is always open, an acceptable vacuum breaker may be installed downstream from the main 309 control valve and upstream from the multiport valve. 310

    c. Backflow preventer. A reduced pressure principle backflow preventer may be installed 311 on the main distribution branch to the sprinkler system in close proximity to the main control 312 valve. 313

    d. Pressure type vacuum breaker. An acceptable pressure type vacuum breaker may be 314 installed between the main control valve and the zone control valves. 315

    e. Other systems of protection. If it is proposed to protect the water supply to a zoned 316 sprinkling system by a method other than one of those set forth in subsection (i)(1)a.d. of 317 this section, complete mechanical and topographical plans of the proposed installation shall 318 be submitted to the department, before the work is done, for examination to determine the 319 acceptability of the installation from the standpoint of protection of the water supply and from 320 the standpoint of potential nuisances. 321

    (j) Fire connection requirements. 322

    (1) If siamese, standpipe or other types of fittings are provided for connection of fire hoses to the 323 fire protection system and the fire protection system is normally supplied through the service and 324 the main water distribution pipe of the premises, a check valve and a control valve of the outside 325 screw and yoke pattern shall be installed in each branch to the fire protection system at its 326 connection with the main water distribution pipe. 327

    (2) If, however, any fire protection system with fittings as described in subsection (j)(1), is 328 located within 1,000 feet of any river, canal or other body of water, a reduced pressure principle 329 backflow prevention device shall be installed in each branch of the fire protection system at its 330 connection with the main water distribution pipe. 331

    (3) A fire protection system with fittings as described in subsection (j)(1), which is within 1,000 332 feet of a river, canal or other body of water and which has a separate water service connection for 333 fire protection purposes only, shall have that service connection protected by a reduced pressure 334 principle backflow prevention device. 335

    (4) Every water service line supplying only fire protection devices shall be equipped with, at a 336 minimum a double check valve assembly.; except that a detector check valve, if used, may be 337 considered one of the check valves of the required assembly. 338

    (k) Fire sprinkler systems. 339

    (1) Unheated areas. Where necessary to provide an automatic fire sprinkler system using 340 antifreeze solutions to serve an unheated area, only antifreeze solutions approved by the 341 department may be used. 342

    (2) Such systems shall have not more than 20 heads and shall have at all times prominently 343 posted within two feet of the fill location a warning sign at least eight inches by ten inches in size 344

    having letters one inch in height bearing the following statement: 345

    (3) Signs are to be furnished and maintained by the owner and must be of materials and design 348 acceptable to the department. 349

    (4) In the supply line to each antifreeze system, there shall be a U loop provided in the supply 350 piping. The down leg (supply side) of the U loop shall drop at least 1.25 times the amount of rise of 351 the up leg of the U. The minimum length of the down leg shall be four feet. Refer to National Fire 352 Protection Association Standards, N.F.P.A. #13, as may be revised, for further details. 353

    (5) Where a system using an antifreeze solution approved by the department is connected to 354 the potable water system, a double check valve reduced pressure principal backflow preventer 355 assembly incorporating outside screw and yoke valves shall be provided in the branch serving the 356 antifreeze system and above the highest point in the line containing antifreeze solution. 357

    (6) Where a system using an antifreeze solution approved by the department is connected to a 358 separate fire protection system, a single check valve and outside screw yoke valve in the supply 359 branch to the antifreeze system shall suffice when the primary fire system is protected with a 360 reduced pressure principal backflow preventer. 361

    (7) When requested in writing by an owner, the department may permit use of antifreeze 362 solutions not approved by the department, provided a reduced pressure principle backflow 363 preventer is installed at the connection to the potable water system. 364

    Sec. 36-166. - Plumbing code. 366

    The potable water supply provisions of the township plumbing code Michigan Plumbing Code are 367 incorporated in this article. In case of conflicts between the township plumbing code and this article, the 368 provisions of this article shall supersede the provisions of the plumbing code. more stringent of the two 369 shall apply. 370

    Sec. 36-167. - Violations. 372

    (a) Unlawful acts. It shall be unlawful for any person to cross connect into the public potable water 373 supply system in violation of any provision of this article. 374

    (b) Compliance with permits and certifications. Building and plumbing permits and certificates of 375 compliance issued on the basis of approved plans and applications authorize only the use, 376 arrangement, construction, devices, facilities and equipment set forth in such approved plans and 377 applications; and any other use, arrangement, devices, facilities and equipment at variance with that 378 authorized shall be deemed a violation of this article and punishable as provided by subsection (e) 379 and/or (f) of this section. 380

    (c) Notice of violation. Except as provided for in subsection (c)(1), the department shall serve a notice 381 of violation on the owner of the premises or person responsible for the violation of a detailed statement 382 or a plan approved under this article. Such notice shall direct the discontinuance of the illegal action or 383 condition and the abatement of the violation. 384

    (1) Exception, notice of violation, immediate danger. Where the department has reasonable 385 cause to suspect that a condition exists that poses an immediate threat of contamination to the 386 potable water supply system, the department need not provide notice of violation as provided by 387 this subsection but may take such action as provided by law to protect the health, safety and 388

    welfare. 389

    (2) Termination of water service. After notice of violation, the violator shall have seven business 390 days from date of mailing, excluding Saturday, Sunday and legal holidays, to contact the 391 department issuing the notice of violation. If the violator fails, refuses, neglects or for any reason 392 does not contact the department, the department shall, by registered mail, send a notice of 393 termination of service directed to the last known address of the violator or post notice on or near 394 the premises at which the violations have occurred. If the violation continues seven business days 395 after mailing of notice of termination, excluding Saturday, Sunday and legal holidays,, the 396 department may terminate water service to that portion of the violator's premises in violation of this 397 article, or terminate water service to the entire premises if necessary to prevent potential 398 contamination from reaching the water utility's water lines. It shall be unlawful for any person to 399 resume water service to such premises unless authorized in writing by the department to do so. 400

    (d) Prosecution of violation. If the notice of violation is not complied with promptly, or an immediate 401 threat of contamination to the potable water supply system exists, the department shall request the legal 402 counsel of the jurisdiction to institute the appropriate proceeding at law or in equity to restrain, correct or 403 abate such violation or to require the removal or termination of the unlawful use of the building or 404 structure in violation of the provisions of this article or of the order or direction made pursuant to this 405 article. 406

    (e) Violation penalties. Any person who shall violate a provision of this article, or code adopted in this 407 article, or shall fail to comply with any of the requirements of this article, or who shall erect, construct, 408 alter or repair a building or structure in violation of an approved plan or directive of the department, or of 409 a permit or certificate issued under the provisions of this article shall be responsible for a municipal civil 410 infractionguilty of a misdemeanor, punishable in accordance with section 2-241 and all equitable relief 411 available by statute1-13. Each day that a violation continues shall be deemed a separate offense. 412

    (f) Abatement of violation. The imposition of the penalties prescribed in this section shall not preclude 413 the township attorney from instituting appropriate action to prevent unlawful construction or to restrain, 414 correct or abate a violation or to prevent illegal occupancy of a building, structure or premises or to stop 415 any illegal act, conduct, business or use of a building or structure on or about any premises. 416

    Sec. 36-168. - Appeal. 418

    Any person aggrieved by a decision of the department shall have the right to appeal to the township 419 construction board of appeals. An application for appeals shall be based on a claim that the true intent 420 of this article or rules legally adopted under this article have been incorrectly interpreted, the provisions 421 of this article do not apply, or an equivalent form of construction, device or arrangement can be used. 422

  • Armed robbers hold up cash advance business in Pittsfield Township

    Two armed men held up a payday loan and check cashing business on Washtenaw Avenue in Pittsfield Township Friday evening, fleeing with cash and employees cellphones, Pittsfield Township police said.

    The men entered the business, near the intersection of Washtenaw and Golfside Drive, and ordered the employees to the floor, said Pittsfield Township Deputy Police Chief Gordy Schick. No one was injured.

    The robbers were last seen fleeing west from the business on foot, Schick said. Ypsilanti police responded with a dog to attempt to track the suspects, two black men wearing all black.

    The robbery occurred shortly after 5 p.m. No further information was immediately available.

    PITTSFIELD TOWNSHIP: Police warn residents to be on lookout for text message scamsSunday, December 9, 2012

    The Pittsfield Township Department of Public Safety is advising area residents to be cautious of text message scams, including a recent trend of messages offering free gift cards.

    The advisory presents a scenario in which a text message is received claiming the recipient won a gift card to a major retailer like Best Buy, Target or Walmart.

    Typically the scam message offer instructions to go to a website and enter a PIN to get the card, according to the Department of Public Safety.

    The website link will direct the recipient to a scam website that will look authentic, such as a scam for a Best Buy gift card linking to a website that uses Best Buy's proper company colors and logo from its' actual website.

    Police advise resident to ignore instructions in the message to text STOP or NO to prevent further messages, as scammers can use this ploy to confirm they found an active phone number. Texts can be forwarded to 7726, which spells spam on most number pads. This alerts the cell phone service to block further texts from the sender's number.

    The advisory message states: "As always, if you think getting a free $1,000 gift card seems too good to be true, it probably is."

    Another type of text message scam is a type of phishing where the recipient is asked to provide sensitive personal or financial information from a sender claiming to be a business like a cell phone company, according to the Department of Public Safety. Police say cell phone providers will not ask customers to verify sensitive personal information in an unsolicited text message.
