Synopsis: Excavator struck and damaged an underground natural gas main while performing electric work.
Findings: Reported by Indiana 811; excavator’s response to initial notice was received on 3/7/2013. The excavator had a
valid locate; however, the gas operator wishes to use 8-1-26-18(g)(2) as relief since the locate markings were incorrect.
Nevertheless, once a new access point was established, the locate took the original route back to the place of damage showing
the operator’s maps and records are putting the public at risk.
Conclusion: There was a failure to provide notice of excavation.
Violation: IC 8-1-26-18(f) Operator failed to locate or provided incorrect locate markings.

This letter responds to the Indiana Utility Regulatory Commission, Division of Pipeline Safety, Notification of Possible Violations for Case No. 4226 (as detailed above) identifying potential violations of Indiana law dated May 22, 2013. NIPSCO has not identified any additional information related to this incident not already provided in its March 6, 2013 response.
NIPSCO contends that the failure to accurately locate the line damaged in this case was a result of circumstances beyond the operator’s control and that NIPSCO and its locate contractor (USIC) took every reasonable step to locate the facility within the statutory timeframe. Circumstances can and do occur in the field that adversely impact the performance of locating equipment that cannot always be fully vetted within the prescribed timeframe. NIPSCO encourages that an evaluation be undertaken of the actions taken by the parties at the time to determine whether or not a damage rises to the level of a statutory violation for any party. NIPSCO contends that in some cases damages occur in spite of prudent and appropriate actions by all participants, and that this is such a case.
