KGADI JOHANNA LAMOLA I n his State of the City Address at the Wits Uni- versity’s Linder Auditorium in Parktown, the Johan- nesburg Executive Mayor Parks Mpho Tau said that in the 2013/2014 financial year which starts on July 1, the City would spend R7,3 billion on infrastructure, of which R450 million would be channelled into the inner city to address issues such as crime and filth, poor urbani- sation, overcrowding and safety.The Mayor pointed out that they’ve embarked on a citywide process, en- gaging with communities and stakeholders for the future vision of the city to develop their Joburg 2040 vision for a city that is sustainable, liveable and resilient. “Residents want to live in a city that is not only effective and efficient in the delivery of services, but also a city that listens to its people, and we are making progress in all as- pects of service delivery. We are also winning the war against crime and ur- ban decay, attracting new investments across the city,” announced the Mayor.Tau said working together with the residents, stakeholders and the media, they man- aged to root out corruption and uncovered cases from various government depart- ments including Planning and Health, JMPD and Mu- nicipal Courts. “The city’s fight against corruption was beginning to pay off. Since the launch of the anony- mous anti-corruption tip-off hotline, the city has seen a dramatic increase in the number of tip-offs received from residents, leading to arrests, conviction and sus- pension of employees. In another major announce- ment, Tau said through their sustainable Human Settlement and Urbanisation Programme, they are imple- menting the rollout of vari- ous housing programmes through upgrading of infor- mal settlements, upgrading of hostels and provision of social and transitional hous- ing. “We will continue with our inclusive use of housing programmes in areas such 30 April 2013. The JMPD officers and community stakehold-

ers held the Ward based integrated service deliv-ery programme (Joburg 10 Plus) at Parkinson Park at Norwood. It aimed to ad-dress issues of basic service delivery while addressing issues of crime preven-tion, by-law enforcement and traffic management within the 130 Wards in the City of Johannesburg.This is a comprehensive

programme involving the deployment of 10 JMPD officers per ward to tackle crime and improve the safety and quality of life of the City’s communities. During the meeting it was reported that work that is under progress includes; the development of Score Card for each rank, Mas-ter Plan with solutions for each Ward and Integrated Multi-skilling Training program for the Officers.Since its official launch last year July by the Ex-

ecutive Mayor of Johannes-burg, the pilot project that started on 28 May 2012 has to date successfully man-aged to deploy 81% of of-ficers and 61% of vehicles, identified and placed clus-ters and teams in the wards, consulted with stakeholders and trained a number of of-ficers in the use of Joburg City Safety Process.Pres-ent at the meeting was the MMC for Public Safety Sello Lemao and metro po-lice officials.

It is clear that credit plays an important role in our so-ciety. It allows consumers who do not have enough cash or money in savings to buy valuable assets, such as homes, furniture and mo-tor vehicles on credit. We are also able to buy clothes or pay for our studies on credit. Whilst credit is ben-eficial in this sense, it also has a down side. Credit can and does uplift the lives of consumers; however, it can make their financial circum-stances worse. In particular, consumers find themselves in a bad financial position where reckless lending and/or borrowing took place.The National Credit Act 43 of 2005 (“NCA”) aims to regulate all aspects of con-sumer credit. In doing so the NCA aims to solve spe-cific problems in the exist-ing consumer credit market including the prevention and alleviation of the over-indebtedness of consumers, the prevention of high costs of credit and importantly the prohibition of reckless lending by credit provid-ers. Reckless lending and/or borrowing is a big prob-lem in South Africa as it is known to result in consum-ers owing more money than they can afford to pay back. For this reason reckless credit forms the focus of this article. What is reckless credit?When a consumer wants credit, they have to go through the following stag-es: 1.Apply for credit;2.Verification of credit wor-thiness;3.Approval or decline of credit extension; and4.Default or settlement of credit obligations.Reckless credit is governed by sections 80 to 84 of the NCA and fits into stage 2 of the abovementioned process to obtain credit. This is be-cause reckless credit occurs when a credit provider con-cludes a credit agreement where no affordability as-sessment is done regard-less of the outcome; or an affordability assessment is done but the consumer can-

not afford the debt and the credit provider nonetheless proceeds to provide the credit; or where most of the information indicates that the consumer does not gen-erally understand the risks, costs and obligations of the proposed credit agreement and therefore finds it chal-lenging.The assessment here re-quires that the credit pro-vider take reasonable steps to assess: the consumers general understanding of risks, costs and obligations of the consumer under the credit agreement; the debt re-payment history of the consumer under credit agreements; the existing financial means, prospects and obligations of the con-sumer; and whether there is a reasonable basis to con-clude that any commercial purpose may prove to be successful, if the consumer has such a purpose for ap-plying for that credit agree-ment.The person who decides whether the credit agree-ment is reckless or not must apply the above criteria as they existed at the time the agreement was made be-tween the parties.The effect of a reckless credit agreementIn any court proceeding where a credit agreement is being considered, the court may declare that the credit agreement is reckless. If this is so, then the court may make an order setting aside all or part of the con-sumer’s rights and obliga-tions under that agreement, as the court determines just and reasonable in the circumstances; or an order suspending the force and effect of that credit agree-ment until a date deter-mined by the court when making the suspension or-der.If the court declares the credit agreement is reckless because of the over-indebt-edness of the consumer at the time of the court pro-ceedings, then the court may order, in addition to the suspension order, the restructuring of the con-sumer’s obligations under any other credit agree-

ments.How to prevent reckless creditIt is important for us, as consumers, when apply-ing for credit and while our application is being considered by the credit provider (for example the bank), to fully and hon-estly answer any requests for information made by the bank as part of the assessment they have to conduct. This will pre-vent any misunderstand-ing by the bank as to our understanding of the risks, costs and obligations of the credit agreement, our credit-worthiness and our existing financial position and prospects.Consider for example: Sipho, a consumer, wants to start a small business selling used cars. To start his business Sipho applies for credit from the bank. If Sipho has not been able to pay his debts for the past six years because he has no money, and he does not tell this to the bank, then if the bank does not take the reasonable steps to find this out about Si-pho, the court can declare the credit agreement to be reckless and may set aside all or part of Sipho’s rights and obligations under that agreement or the court may order the suspension of the force and effect of the agreement. There-fore Sipho will not be able to get the money he needs to start his used-car sale business. However, whether it is Sipho’s fault or the banks fault that he was granted credit reck-lessly depends on whether or not Sipho told the bank the full truth at the time he applied for credit. In this example because he did not tell the truth, Sipho is the cause of his own un-fortunate circumstances. If Sipho had told the bank the truth, then they would have considered this in their assessment before granting him credit – in this way the bank and Si-pho would not be acting recklessly.

Faculty of Law takes only 600 learners – even if the minimum APS is 27, they put you on a waiting list if you have less than 32!-Engineering, Science and Health: minimum points in Maths, physical and life sci-ences.
