ACCC v Pzer dismissedTHE Federal Court has dismissed

the Australian Compeon and

Consumer Commissionrsquos (ACCC)

an-compeve conduct case

against Pzer (PD Breaking News

yesterday)

The ACCCrsquos allegaons referred

to oers made to pharmacies in

early 2012 for the supply of Lipitor

and Pzerrsquos generic atorvastan

product the organisaon said

The ACCC alleged that Pzer had a

substanal degree of market power

and was proscribed from usingthat power to prevent compeve

conduct in the atorvastan market

referring to secons 46 and 47 of

the Compeon and Consumer Act

(PD 26 Feb)

However Jusce Flick dismissed

the case nding that while the

company had taken advantage of

its market power with the alleged

conduct this market power was no

longer ldquosubstanalrdquo at the me of

the oers the ACCC said

Further the Jusce also found the

organisaon had not established

that Pzer had engaged in this

conduct to deter or prevent

competors from engaging in

compeve conduct the ACCC

said

Pzerrsquos defence had denied that

an atorvastan market existed

and that if it did the company did

not have a ldquosubstanal degreerdquo of

market power in this market (PD 10

Oct 14)

The ACCC had previously said it

would pursue in excess of $10m for

each alleged contravenon

ACCC chairman Rod Sims said

the organisaon would carefully

consider the judgement

A spokesperson for Pzer said the

company had always maintained its

behaviour was appropriate

ldquoDuring the Courtrsquos consideraons

we have connued our work with

clinicians and pharmacists whoprescribe and dispense Pzer

medicines to paents every dayrdquo


Mayne Pzer settleMAYNE Pharma Group Limited

has reached an agreement with

Pzer to end ligaon over

its generic version of Tikosyn

(dofelide capsules 0125mg

025mg and 05mg) used to

prevent irregular heartbeats such

as atrial brillaon and atrial uer

Mayne said Pzer had withdrawn

its acon against Mayne meaning

it could enter the US market with

a generic following US Food and

Drug Administraon approval once

a priority review was completed

and prior to the 2018 expiry of

Pzerrsquos patent

Mayne ceo Sco Richards said the

company expected to receive a 180

day exclusivity period on approval

which the company has slated for

next year

14) Zalcberg wrote that the new

generaon of cancer drugs had led

to signicant advances that could

help paents but that many could

not access them due to costs

ldquoAll Australians must have mely

and equitable access to the very

best cancer drugs

have a very serious problem that

needs to be urgently addressed
