Zovirax alternative available THE Therapeuc Goods Administraon (TGA) has advised that an alternave ophthalmic treatment to Zovirax ointment (3% aciclovir) is available. T o address the shortage, expected by GSK to last at least unl September (PD 20 Feb), the TGA said it had granted authorisaon for temporary supply to AciVision 30 mg/g aciclovir ointment for the treatment of keras of the eye, caused by herpes simplex virus. ACCC v Pzer dismissed THE Federal Court has dismissed the Australian Compeon and Consumer Commission’s (ACCC) an-compeve conduct case against Pzer (PD Breaking News yesterday). The ACCC ’s allegaons refer red to oers made to pharmacies in early 2012 for the supply of Lipitor and Pzer’s generic atorvasta n product, the organisaon said The ACCC alleged that Pzer had a substanal degree of market power and was proscribed from using that power to prevent compeve conduct in the atorvasta n market, referring to secons 46 and 47 of the Compeon and Consumer Act (PD 26 Feb). However , Jusce Flick dismissed the case, nding that while the company had taken advantage of its market power with the alleged conduct, this market power was no longer “substan al” at the me of the oers, the ACCC said. Further , the Jusce also found the organisaon had not established that Pzer had engaged in this conduct to deter or prevent competors from engaging in compeve conduct, the ACCC said. Pzer’s defence had denied that an atorvastan market existed and that if it did, the company did not have a “subst anal degree” of market power in this market ( PD 10 Oct 14). The ACCC had previously said it would pursue in excess of $10m for each alleged contraven on. ACCC chairman Rod Sims said the organisaon would carefully consider the judgement. A spokesperson for Pzer said the company had always maintained its behaviour was appropriate. “During the Court’s consideraons we have connued our work with clinicians and pharmacists, who prescribe and dispense Pzer medicines to paents every day.” CLICK HERE to read more.
