Amazon Technologies, Inc. (“Petitioner” or “Amazon”), a Nevada corporation with an

address of 410 Terry Avenue North, Seattle, Washington 98109, believes that it is and will be

damaged by the continued registration of the REECHO (Stylized) trademark (“Respondent’s

Mark”) in Registration No. 6099927 (the “Registration”). Amazon therefore petitions to cancel

the Registration.

As grounds for cancellation, Petitioner alleges:

1. Respondent Shenzhen Yuyin Acoustics Technology Co., Ltd. is a Chinese limited

company with a business address of 502, G2 Bldg., TCL International E City, Shuguang

Community, Xili St., Nanshan Dist., Shenzhen, China 518000.

2. On November 25, 2019, and pursuant to Section 1(a) of the Lanham Act, 15

U.S.C. §1051(a), Respondent filed an application to register Respondent’s Mark in Class 35

(“Respondent’s Application”) for “Audio-video receivers; Cabinets for loudspeakers; Cell phone

straps; Earphones; Headphones; Loudspeakers; Megaphones; Microphones; Portable vibration

5. Amazon is one of the world’s largest online retailers with stand-alone retail

websites in the United States, Australia, Brazil, Canada, China, France, Germany, India, Italy,

Japan, Mexico, the Netherlands, Spain, Turkey, and the United Kingdom. In addition to

shipping to nearly every corner of the world, Amazon directly distributes digital multimedia

content and consumer electronics, including digital media streaming, wireless content delivering,

home automation and security, personal assistant devices, software, accessories, and services to

its customers.

6. Since 2014, and well before any priority date that Applicant has or may claim,

Amazon has used the marks ECHO and AMAZON ECHO in United States commerce in

connection with, inter alia, personal assistant and “smart” voice-controlled speaker devices that

wirelessly deliver information, stream and play music and other audio content, and feature a host

of other useful and entertaining capabilities, like Alexa Skills. In particular, Amazon’s ECHO

device can also intelligently control other Amazon devices, smart home hubs, lighting, switches,

dimmers, and outlets, locks, cameras, and home security systems, heating and cooling systems,

and more.

7. Amazon is the owner of the below outlined U.S. registrations and applications for

gifted items for Amazon.com customers” during the 2015 holiday season and were among the

best-selling products across Amazon in 2016. In 2017, on Prime Day, a global online shopping

day hosted by Amazon, consumers purchased seven times more ECHO devices than on the

previous year’s Prime Day. Amazon’s ECHO devices continue to enjoy immense popularity

today. The ECHO DOT was the #1 selling Amazon device during the 2017 holiday season, and

the best-selling product from any manufacturer in any category across all of Amazon, with

millions sold. See press releases from Amazon.com attached as Exhibit B. In 2017, tens of

millions of ECHO devices were sold worldwide. See Shareholder Letter from Amazon.com

attached as Exhibit C. In 2018, Amazon sold millions more devices than in 2017, with the most

popular electronics including the ECHO and ECHO DOT. Exhibit D.

10. Products and services sold and rendered under Amazon’s Marks have been the

subject of substantial unsolicited media coverage.

11. On February 7, 2016, Amazon’s ECHO device was featured in a Super Bowl 50

commercial, which was the third most watched broadcast in U.S. televised history with over 111

million TV viewers and undoubtedly significantly more online streaming viewers. In 2017,

Amazon again secured Super Bowl airtime and ran not one but three commercials featuring and

promoting its ECHO device. Super Bowl 51 received over 111 million television viewers,

undoubtedly significantly more online streaming viewers, and over 190 million social media

interactions. Third-party articles on the viewership of Super Bowls 50 and 51 are attached as

Exhibit E.

12. Since that time, Amazon’s ECHO product suite has expanded to include lighting,

jewelry, sunglasses, clocks, plug-in minis, and even to car-based personal digital assistants.

13. As a result of Amazon’s extensive use and promotion of the ECHO Marks, the

vast advertising and publicity the ECHO Marks have received, the substantial trading area in

which the ECHO Marks are used, and the high degree of consumer recognition of the ECHO

Marks, the ECHO Marks are strong and deserving of a broad scope of legal protection, with the

ECHO Marks having become famous, in that that the ECHO Marks are widely recognized by the

general consuming public of the United States as identifying the source of Amazon’s goods and

services. The ECHO Marks became famous before any first use of Applicant’s Mark by

Applicant, and Amazon derives invaluable goodwill from this recognition, association, and

identification by the consuming public and the trade.

14. There is no issue as to priority. Amazon’s use of its ECHO Marks began years

prior to the filing of the Application and before any actual or constructive use date of Applicant’s

Mark.

15. Consumers familiar with the goods and services offered in connection with the

ECHO Marks are likely to assume that services offered under Applicant’s Mark originate from

the same source or that they are affiliated, connected, or associated with Amazon.

16. Amazon is damaged by the continued registration of Respondent’s Mark because

the mark so closely resembles the ECHO Marks as to be likely to cause confusion, mistake, and

deception. Persons familiar with the ECHO Marks, and the goods and services offered under

those marks, would be likely to believe erroneously that Applicant’s goods are the goods of

Amazon or are authorized, endorsed, sponsored, or licensed by Amazon. Thus, continued

registration of Applicant’s Mark on the Principal Register would be inconsistent with Amazon’s

strong prior rights in its ECHO Marks under 15 U.S.C. § 1052(d). Amazon will continue to be

damaged if Respondent is permitted to maintain the Registration.

17. Amazon is also be damaged by continued registration of Applicant’s Mark

because the mark is likely to dilute the distinctiveness of the famous ECHO mark by eroding

consumers’ exclusive identification of the mark with Amazon, and otherwise lessening the

capacity for Amazon to identify and distinguish its goods and services, in violation of Section

43(c)(1) of the Lanham Act, 15 U.S.C. § 1125(c)(1). Amazon’s Marks are inherently distinctive

as applied to Amazon’s Goods and Services.

18. For each of the foregoing reasons, Amazon requests that the Board sustain this

proceeding in Amazon’s favor by cancelling Registration No. 6099927.
