2. The Wiluna Gold Mine located 175 kilometres east of Meekatharra andmanaged by Barrack Mine Management Pty Ltd is exempted from theprovisions of section 38 1 c of the Mines RegulationAct 1946 for a periodending 30 June 1993 on condition that-

a a personshall not be employedto work in or aboutthe mine for morethan 14 consecutivedays;

b where a person is employed to work in or about the mine for 14consecutivedays the personshall not be employedagain to work in orabout the mine until that personhas taken a break of not less than7 consecutivedays; and

c a personshall not be employedto work in or aboutthe mine for morethan 12 hours in any day other than to deal with an emergencycausing, or threateningto cause,a hazard or danger to the health orsafety of any personin or about the mine.

d Activities carried our on this land shall not contravenethe Water Authority of WesternAustralia’s By-laws applicable to undergroundwater pollution control.

e Any increasein stormwaterrunoff createdby the developmentof the land shall becateredfor within the site and outlet flows to the WaterAuthority’s drainagesystemshall not beincreased.The developershall at the subdivisional stageprovide theWater Authority withcalculationsand plans to demonstratethat storm water run off from the subdivision willnot increasedischargeto the Water Authority’s drainagesystem. Any improvementsoradditions to the existing drainagesystem as a result of any developmentshall be to therequirementsof the WaterAuthority and shall be at the developers’expense.

12. Land within thebuilding envelopeis to be managedin sucha manneras to avoid the land beinglaid bare in vegetation resulting in loose, wind erodible conditions. Land outside the buildingenvelopeis to be managedin such a mannerthat therewill be no further clearingof the landsave for vegetation that has to be removed to make way for housing, fences, firebreaks,outbuildings and accesswayconstruction, the Council’s approval shall be deemedas Council’swritten consent to removevegetation.

13. The Subdividing owner shall undertakea tree planting programmeover thoseareasshown onthe Special Rural Zone No. 15 subdivision guide plan at a density of not lessthan 1 000 stemsper hectare.

14. The Council may specify that groups of trees are required to retain the rural characterof thelocality. No personshall remove without the prior written consent of Council any of thosegroups of trees.

15. All buildings and effluent disposal areasshall be constructedwithin the building envelopeasdefined on the approvedPlan of Subdivision for Special Rural Zone No. 15. The Council mayvary the position and size of a building envelopeat its discretion, provided any variation willnot adversely affect the amenity of the land. Notwithstanding the foregoing requirements,wherethesubdivisionalguideplan definesan effluent disposalareawithin abuilding envelope,this areashall not be varied and the effluent disposal systemshall be built within it.

16. All on-siteeffluent disposal systemsshall be constructedso as to achievea minimum verticalseparationof 2m. betweenthe systemand the highest known groundwaterlevel, and 100 m.horizontal separation from the Water Authority of Western Australia drain and areas ofintermittent inundation as shown on the subdivision guide plan.

17. Prior to subdivision the subdividing owner shall erect a sign in a prominentplace to informfuture ownersof the specialconditions imposedon the land under Special Rural Zone No. 15,and that they must consult with Council before commencingany development.

18. The subdividing owner of the land shall makearrangementsto Council’s satisfactionto ensurethat prospectivepurchasersare advisedof the sandexcavationon the adjoining lot.

19. The subdividing owner shall make arrangements to Council’s and the Department ofConservationand Land Management’ssatisfaction,to ensurethat prospectivepurchasersareadvisedof thepossibilityof the existenceof declaredrare flora speciesof DrabereaJeanensisandDiuris Sp. Kwinana in the locality.

20. Council may vary building envelopesin order to preservedeclaredrare flora.

21. Prior to final approval of a plan or diagram of subdivision the subdividershall define to thesatisfaction of the Council, the location and size of the building envelopesfor each of theproposedlots.
